    As a bartender in the US, depending on what state you're slinging drinks in, you can be held liable if you keep serving someone who's pass the limit (as in they're showing blatant signs of being wasted) if they get behind the wheel, we are suppose to call them a taxi. However a restaurant is WAY DIFFERENT then a concert venue. There's no way they can keep track of every customer who orders a drink let alone baby sit them the whole night. You have way less control when it comes to keeping an eye on drunk customers in a venue like that then in a bar/restaurant. It's definitely not the venues fault or responsibility. She's s.o.l on that one. Watch her turn it around on her dad next. 🙄
    EDIT:
    Thanks to the nice people who work in venues and sporting arenas for informing myself and others, that they are held to the same rules and regulations as bartenders in bars and restaurants. That being said, depending on where in Canada she was and the laws they have, the establishment could definitely be held liable. Now that being said, they'd have to prove that she didn't sneak her own alcohol in and/or that no other person got drinks for her if the bartenders cut her off. As well as making sure she didn't take any narcotics that would have amplified her intoxication levels. So hopefully Atozy comes back to update us on what happens because I'll be very interested to see what the courts do.

      My state is one of these states and that might be why they ejected her, they may have felt that she was at her limit and she threw a fit when she was refused service (I can't say that is what it was).
      They may not have the same requirement to call a cab there, which makes sense.

      In ontario you have to have a smart serve certificate to serve alcohol and you are held responsible and criminally liable for any harm caused by the alcohol you served.

      The building had a responsibility to know or ought to have known she was driving towards it, yet it did not take responsible action and stayed in place.. The building failed to take the steps to ensure her safety and thus should be held liable for negligence.

    Hi!!! Londoner here! 🙋🏼‍♀️It’s actually a lot worse: she not only got kicked out of the event but rumour has it that they cut her off multiple times before she was forced to leave, they asked her if she was driving and she said no. Also those homes were historical and part of the Underground Railroad. Fuckin brutal eh

      I work side gigs as security. Event security supervising.
      By law, all relevant event staff can be held responsible for the safety of event attendees after they consumed alcohol, until they sober up. Even after leaving the event. Within reason!
      If event staff cut you off from drinking, or eject you from an event for disorderly conduct, because you want to keep drinking after being cut off or make a scene, and it's documented that staff did what they could to best control the situation, the chances of punishment start to shift back onto any patrons in question, for anything that happens after they leave an event.
      This is just plain slobbish behaviour.
      If you can't handle yourself after drinking, you shouldn't drink.
      If you can't handle the accountability and responsibility and shift blame so that you can't blame yourself or your drinking as the problem, then you're an alcoholic, and an addict.
      At the very least, you possess the psychology of one.

      Well, she can sue all she wants. It won't work, she'll end up losing the suit and she'll be on the hook for everyone's legal fees. She's simply digging herself deeper, which is fine by me. Only problem is the legal fees will take precedence over payouts for victims, so maybe that's the play, basically get to a point where she can declare bankruptcy and avoid paying out?

People should be judged on the POTENTIAL of their outcomes rather than the actual outcome. She could’ve killed 20+ people EASILY. Gas stations are super busy at night. She could’ve killed children, babies. This is absurd and disgusting and will only encourage MORE drunk driving because people think, “well shit the punishment is light, oh well I’ll just drive myself” when if it was 10+ years people wouldn’t even take the chance. They’d just automatically get an Uber.

      Less than the criminal charges she received (4)! I bet it's because she didn't even try to pretend she wasn't guilty and probably cried at the judge. The neighbors all seem like incredibly nice people, not the types to write letters urging the judge to spank her with a long sentence. Then again...the longer someone spends in jail, the less time and money they have to pay off your busted windows.

    I lost everything in a fire. The worst is not the building, the lost of family pictures, heirlooms, pets, old books. Those are the kind of things no one can help you with. Things you can't buy. 21 years later and losing everything I had from her (I lost her at 19) still hurts the worst. She should pay.

    I live in East London and my dad has a shop just around the block from the house that got hit. We were at the Manson concert that night and we felt the explosion there, even through the concert chaos. It was absolutely insane. The power went out all over the city, even at my house which is not near downtown where it happened. This incident set our city into a frenzy because of the drunk driving. It’s a serious issue here and as a person who drives a lot I can say there are a lot of stupid people like her. I’m so glad you covered this topic, thank you for bringing light to this❤

      Actually, at least in BC canada, because the venue sold her alcohol, they can be held legally responsible. The amount they can be held responsible for can vary based on situations.
      Section 29 of the Ontario Liquor License Act prohibits the sale or supply of liquor to any person who or appears to be intoxicated.
      Section 39 of the Act imposes a duty of care on commercial entities (this can include concerts) to any person who suffers injury or damages as a result of harm caused by an intoxicated patron.
      A “duty of care” is owed by the server to ensure that alcohol is not served to an intoxicated guest, or that a guest is not served to the point of intoxication.
      So basically, this company can be held legally responsible and have legal actions taken against them for this.

    My old boss was like this woman. She could drink 16 double raspberry vodkas in 3-4 hours and drive herself home. She thought it was perfectly fine since it was a short distance, only about 25-30 minutes.

      My uncle is a habitual drunk. 10+ DUI's, license basically gone for life, and killed someone back in the late 90's. Was only driving 5 minutes from the bar to the house. He never learns and would never hold himself accountable. Some people are just terrible people. Death will be the only justice that is served. Anyone who drinks and drives should never be able to operate a vehicle ever again. But that wont happen.

      @@dee27206 Yea, the distance itself was short (by the crow flies) but due to the roads and way home, it was a long drive. Even if the bar did everything correctly and limited her she would get drinks from others constantly. I made the mistake of driving her home one time, wish I didn't but at least she didn't drive that time.

    I'm so glad no one died because of what she did. That explosion was insane. I feel bad for the homeowners losing their house and whatever belongings were inside, but at least they still have their lives so they can rebuild. I can't imagine that'll be easy, but it's better than being dead.

      Its not actually a farfetched lawsuit, overserving someone as an establishment or even the bartender you are subject to liability in many states in the us. I was a bartender for years and was definitely warned you can be arrested for overserving someone or serving a minor.

    I saw a comment about the over serving law suit before that part of the video and I was like “okay I guess the bartender could have done more but it’s definitely not *their* fault that *she* did that,” and then I found out she was at a *concert???* Like how tf could the venue of done more in this case where there were thousands of people??? Like it’s different if it’s a bar with a few dozen patrons maybe, but this was a huge event…

      putting her claim in the best possible light, she showed clear signs of being drunk when ordering, including slurred speech and the like and the bartender just didnt notice or care, served and took money. in which case she has a claim believe it or not (note, in my country she wouldnt have a claim against the catering service, the state would sue the catering service and likely revoke their alcohol license).
      in the worst possible light she had friends or other people order for her after she was cut off, got caught, kicked out by the bouncers, drove off causing the crash and ensuing explosion and then tries to sue the venue and otherwise blast them on social media if they dont give in.

      It's almost impossible at a concert venue, one that holds Manson concerts, so thousands of people, to monitor everyone's alcohol consumption. Especially when some people consume way too much but aren't the person buying it, or going to the concessions to purchase it.
      The big venues have insurance, so it's not enforced as heavily unless it's blatant
      Small venues have to be diligent or would face closures and shut downs or bankruptcy from not being able to afford the fines.
      Even Alcohol commercials have to have a portion reminding you to consume responsibly in Canada, not sure about the states

    Can confirm, in most communities that I know of in Canada, when tragedy strikes, the whole community steps in to help. We had several floods in my city and they never had to ask for more volunteers. There was even a town in my same province which was burned completely to the ground and they had to actually ask people to stop donating clothes.

    As a former bartended we were always trained to not overserve. If someone started to get sloppy we would cut them off. Although I don't think that she is owed any compensation from that venue, I could totally see the state/city revoking their license or fining them if it is proven that she was overserved.

      Here's another thing. This happened at a concert, so if she went with a friend, she might have had said friend get her another drink to get her more drunk. Which again, wouldn't be on the venue, and even if she was thrown out for being too drunk, again, it's not their responsibility to make sure she didn't literally blow up a neighborhood.

      There's waaay too many preventative measures for drunk driving for it to even make sense to sue a venue for overserving customers. Ubers, busses, etc... It should be entirely put on customers now for not taking preventative actions. Sure, bartenders should still cut customers off when they get too drunk but it's not their responsibility for how the customer chose to get home. The customer chose to drive there, drink, and the customer CHOSE to drive home. That's her own damn fault, not the venues.

      @@nerdstop5025 I am not saying the venue is at fault here, obviously we don't know what happened and I tend to side with the bartenders in cases like this. But you are right, it is impossible to fully monitor every customer and it would be wildly unfair to punish them for another person's actions, especially after she has left their venue. I am just saying IF they were proven to serve irresponsibly, they could be in big trouble.

    As someone who lives like 15 mins from where this happened it still blows my mind to have watched this happen a few years back and that was bad enough but then to recently hear about this is just insane to me. Like Atozy makes many good points especially when it comes to the fact that this lawsuit is going to do nothing to help her and will only serve to drag her name through even more dirt than it already has been.

    I can completely relate. I'm suing the bar I got drunk at last night because the girl I hit on shot me down so I went outside and and totally hit on another chick in the parking lot. This chick tased me I fell down and broke my elbow. I'm suing the bar because they knew or should have known that I would make an ass out of myself if they served me alcohol.

    A few years ago, on a quiet winter evening, I was eating dinner with my dad who was visiting, when we heard a LOUD boom. We rushed outside to find my neighbors how had literally exploded- gas leak. 3 people were inside, all escaped. One was uninjured but a teen girl and the father were severely injured- TBI, hearing loss, burns, etc.
    It fucking destroyed a few of us who witnessed it. I rushed out and helped the kids- the injured dad was so upset we couldn’t calm him. I didn’t sleep for the next week, so I funneled my energy into crocheting blankets for the family. Family and friends helped me buy needed things for the kids, like pens that work well with injured hands and new toys.
    I honestly don’t think I’ll ever get that out if my brain. Any of it.

    This actually happened in my hometown, in the neighborhood directly adjacent to mine. The noise was incredible and shook our house an insane amount. We were evacuated but allowed to return 2 days after. It was fucking nuts

    As a bartender in Canada...if you over serve someone to visible intoxication and they drive and something happens...myself and the establishment all can be held liable. Huge fines and I can lose my license to serve alcohol. That's by the law tho. Liquor inspectors come in, check cameras and tils. If you remove someone for being drunk you have to call a cab and make sure they get in. After that you are no longer responsible

      Does this also count towards the concert venues? If they throw someone out for being drunk or being a trouble maker, is the concert venue still responsible for calling an taxi? If so would they pay for the ride or what?

      @@maggiee639 I don't had any friends that goes drinking. Also I feel uncomfortable if I went alone. The main reason is that my husband doesn't drink anymore he quit drinking 10 years ago (he's 31) he did a lot of underage drinking when he was young.

    This is in Canada. And May get thrown out.
    I was corralled into a lawsuit (along with 12 others) when a single guy was sued ….who worked in the same BUILDING as I did. I had nothing to do with his business and only knew him as “a dude who worked in my building”.
    They knew he didn’t have deep pockets.
    They wrangled as many “businesses” (who had insurance policies) as possible so they could force mediation.
    It costs me 25,000 and three years for my attorney just to answer all the bulls@*t letters/hearing/discovery.
    At mediation my business insurance was forced to pay $50,000 just to settle.
    I was faced with spending more than 25,000 to prove this is ridiculous and risk getting a judgement against me some how.
    The insurance company would NOT help pay for the trial and ONLY would pay a settlement.
    Me and 12 others had to pay $50,000 to settle and remove ourselves from possibly getting a large judgement against us.
    That attorney knew how to manipulate the system.
    If this is a US case……don’t ever think a lawsuit is too egregious. I am $75,000 proof it is about settling the money grab…..and never about truth or responsibility.

    I worked for a convenience store chain for over a decade. It is true, if you serve someone alcholol when they are clearly intoxicated you can be held liable depending on your location

    I live in Ontario Canada. And you have to be 18 or 19 (19 is when you can drink here) to serve alcohol. You need to pay for a license to become certified to be able to serve alcohol. Even so much as handing a guest a drink or just ringing it thru. In the training I went thru, there’s a big emphasis on over serving and it states that if you over serve someone here and they drive drunk you can be legally responsible.

      Heck, my brother lives with me at the moment, and he's a major alcoholic. Sometimes I can tell he's drunk, but that only after spending a couple minutes around him.
      It's hard to tell sometimes because he's always a angry idiot whose inconsiderate of other people and their feelings, and laughs at the stupidest things and mumbles to himself.
      He acts literally the same when he's drunk.
      Plus, he does his best to stay as high as a kite all the time so it doesn't help to identify if he walks weird or speaks a certain way because he's high or drunk.
      This is with a guy I live with every damn day, I commend those who can tell when one random stranger they see for at least a minute has rea he'd their limit

    It's sad but true here in Ontario we have a certificate called smart serve that you need to pass to be able to sell alcohol like be a bartender and basically you are responsible to make sure that you're not overserving anyone and letting anyone become intoxicated in proximity becomes your responsibility if someone gets drunk And drives in my town somebody overserved someone at a bar and they drove into a fish and chip shop and the drunk driver sued the bar that he left and won unfortunately

      While I can see the logic behind the law, I can't help but still see so many flaws in it, especially if it extends to venues (I think it does in some places). I promotes healthy bartending habits to stop serving your patrons when they've obviously had too much, but I feel there's too many ways to get around it for the patrons

    I'm pretty sure no Canadian judge will even bother with this. We do have safe serve laws, but this is not one of those cases. What I do hope comes out of this, is that she's never allowed to have a license again.

    not sure about Canada, but in certain states bartenders, the bar or restaurant, venue serving alcohol can also be held liable to a certain extent. does it paint the best picture in regards to her stupidity and lack of accountability? no.

      I live in Ontario, and there was a case of drunk driving teens near me. They went to a bar with fake IDs, and drank in the parking lot as well as in the bar. They hit a rock cut driving home, and two of the four kids in the car died. The bar ended up losing their liquor license and the bartender actually got charged with criminal negligence causing death.

      Yes in Ontario, Canada you need a license to sell and serve alcohol. The course you have to take does stress that you can be held liable if you overserve. I don't necessarily agree with it, though.

    Okay, here's the thing. I go hard at concerts sometimes. But I ALWAYS go with my sister, who's my DD. we take turns being the DD, depending on who got drunk last time, who's a bigger fan of the group (sometimes I drag her to concerts and she'll drag me). It's safer knowing you're there with someone who would be able to go home, because those people see so many people that they can't keep track of those who seem more intoxicated, especially at bigger venues. It's so easy not to drive drunk. They have no responsibility after she leaves the venue.

    @atozy, while I am not in Canada, I have heard of similar instances (not to this degree) where a venue is liable for an incident that happened at the person's property. The reason, the intoxicated person was drinking at the venue and the incident took place within 5km radius of the venue,

    Similar things can happen here when I was taking my liquor license to become a bartender and they told us about a story where a woman was served too much alcohol, went out and drove,and killed somebody. And the bartender was also charged too. So it's not rare, but it's very fair.

      Yeah sorry but that is far from fair. The bartender is just doing their job, serving paying customers. It's not their responsibility to prevent patrons from making stupid decisions. Frankly once they exit the building they are not the bar's problem, they are an adult after all . The woman in this case had tons of options besides driving herself, and I refuse to take the impairment caused by said drinking as an excuse for bad judgement.

    I was actually on my way home from a concert in Toronto when this happened but was talking to friends in a group chat (we all did theatre together) that lived in this neighbourhood right after it went down. People that were blocks away felt it and one of the people I know was just down the street from it. It was crazy driving by there days after it happened. The community really stepped up.

    There was a past situation where a Woman working for a Realty company in Barrie Ontario sued her employer for allowing her to drive home drunk after the company Christmas party. Her boss told her not to drive after the party and tried to arrange a ride for her, but she chose to drive home through a snowstorm. The case was settled out of court.

    Ontario based bartender here! I work at a large concert venue a couple hours away from where this happened and unfortunately because of our stupid liquor laws she may have a case. We are legally responsible for every single person that we serve until the moment that they become sober, which is absolutely insane!

    This is waaaaaay too common in the Kitchener, Waterloo area. It’s well known that one of the restaurants here served someone alcohol, they drove drunk, and the person came back at the restaurant for serving them and allowing them to drive. The restaurant now has a two per person serving limit.

    I'm from this town and this shook our city so much. It happened in our downtown core. She can blame budwieser gardens but they have great security and staff. She's so irresponsible and needs to take blame. Our communities really came together quickly to help out all families involved

    I'm TABC certified. And in the US you have to be certified and trained to serve drink and food at any type of venue or bar. The case might make it to trial at the very least. The first thing they drill into you is not to over serve. If I over serve and they die or kill someone else I can get a fine and up to a year in jail. I've managed big events. All servers are certified and trained to pull a manager if someone looks too intoxicated so they can monitor them and/or cut them off. You know give them water or food. Call them a cab if needed. It's a coordinated effort. Yes. You are responsible for your own actions. She definitely deserved prison. This may set a precedent and actually change regulations in the UK if they already don't train and certify servers. At the very least acknowledge that both sides share some sort of accountability. If I invite you to my house party and you die, don't you think your family is coming after me for justice and compensation?? You may lose but you'll be pissed enough to try.

    I was charged with a DUI. I hit another car and totaled my own and permanently injured myself. Nobody else was hurt and even their car had only very minor cosmetic damage. It was my fault completely. I’ve never felt more heartbroken at something I’ve done. I couldn’t imagine trying to blame somebody else for you knowingly driving drunk.

    I really hope she gets the justice she deserves. She needs to not only get the money from the bouncers failing to protect her but everyone else that allowed this to happen should be punished too.
    Absolutely appalling that the beer bottle hasn't been tried for attempted murder at this point.

    By this reasoning, the sale or offer of any alcoholic beverage should not be permitted to any person in any public setting or venue? Just because of what might happen in the future after consuming alcohol? That's like me suing a car dealer for selling me a car that I might end up crashing in the future just because I chose to drive it on a public road with other people around, and saying I would have not crashed if I was not sold the vehicle to drive in the first place. If a person buys alcohol at a venue and chooses to down 3 or 4 drinks in a three minute period, there would not be an indicator of intoxication present because it takes time to take effect after consuming. Or the possibility a person has built up a tolerance to alcohol making it difficult to spot impairment.

    I’ve been trained and served alcohol for 5 years about 6 years ago. If I remembered right we were all warned that it was possible to be liable for over serving people.

    Oh god I remember this. This is my Hometown. Unfortunately in Canada places that serve alcohol can be held liable for drunk driving accidents that occur but it doesn't happen that often.

    Either the gap between the properties was really wide or the Gas Line for the building was along the wall facing the Avenue. Most houses these days have the Gas Line entering through the side walls. Was likely not the case for this building due to its age, but utilities do get upgraded overtime, even for residential properties.

    I LIVE in LONDON Ontario!!!! And not far from where this happened. She is so lucky nobody was killed and the entire city thinks she got off way too easy. She was not remorseful at all and is just an awful person for what she did and took no responsibility

    You know, 10 years ago I could see this flying in court. But now with Lift and Uber there is no way for a event space, venue, or bar(although bars are probably better about it) to keep tabs on it. This is ridiculous.

    In VA you can sue the company for stuff like this. Literally took a class to make sure I don't over-serve people.
