      @@caspos1987 Ye u wish but then there is 1000 other cryptocurrencies that didn't blow up and tech companys that failed xD its a gamble and as always many lose and only few win also there is rly nothing to sleep on about nfts blockchain is probably one of the most ridiculous and dumbest things of the modern world i doubt it will last in a 100 years we have goverment managed crypto that exists without the need of thousands of gpus wasting energy solving never ending code xD.
      Also unlike private crypto sites a goverment crypto would also be safer cause they can literally give u ur shit back if smth(hack etc.) happens. And who knows if we even need cryptos at all cause online banking is already covering most of it.

I mean imagine you tell someone "Yo I paid $50k for this receipt for this AMAZING Art piece! NOT the Art Piece, just the Receipt for it!" If this was IRL they'd be a LAUGHINGSTOCK.

      I have a theory that Seth Green set this whole thing up as a publicity stunt.
      What better way to advertise a movie than to say "the lead actor is currently being held hostage." Title will be in every publication and he'll have spent nothing on advertisement for his dog water movie.

      @@Battlefox64_RL That is such a brillaint theory, there would so much benefit to Seth and the bored ape yatch club company:
      1. This has generated a huge amount of publicity for an otherwise relatively unknown show.
      2. If it goes to court it is only going to cement the legitimacy of the copyright clauses around these NFTs, benefiting the bayc company.
      3. If it was legitimately stolen, why hasn't the bayc company offered Seth a similar NFT as a replacement. They would want this show to go ahead, it only helps them sell their NFTs.

    I'm surprised people miss such an obvious thing, but the US doesn't have any treaties of legal enforcement with neither Australia or the EU, a judgement from an American court would effectively be worthless in Australia and vice versa, he would have to sue him with an Australian court under Australian law

    The problem with regulating NFTs is you need people smarter than these dumbasses who fall for NFT scams to be writing, implementing, and enforcing those regulations. Can you name a government or court official who has a solid enough understanding of NFTs to do that? Further, have we seen a single court case involving NFT copyrights based on "blockchain ownership" set any expectations?

      I'd sign over ownership, if properly detailed in a contract, for a cut of GROSS revenue from the NFTs.
      Gross revenue because you gotta be ahead of their sneaky accounting tricks or they'll get away with not paying you anything.

    My old brother was trying to scam my sister into creating NFTs. His whole goal was to make a profit for himself and give her a small cut. Telling her it was to support the artist and such. I straight up told my sister what he was trying to do cause well I can smell bullshit from a mile away. She basically still believed him but neither of them got around to doing it. My brother also has a history of wasting money when he gets it and basically gambling it all away with crypto. He also convinced some other guy to give him money and he lost all of it. Crypto isn’t a reliable currency however, you can make something from it if you are wise about it. NFTs are just there for people to waste their money on.

    When they say "purchase" in blockchain terms means "registered transfer of property". The scammer also "purchased" the NFT, since the transfer is registered on the chain. NFT = scam

Unregulated doesn't pass common sense rules, regardless of the situation one could easily assess what was gotten illegally and what hasn't. I am not joining in on the anti-NFT people who cackle and laugh at anyone who lost something trying to do NFT stuff, nor am I for NFTs AT ALL.
      It would be like me going, "I have a receipt" and the other person going, "He broke into my business and printed that himself, here's the proof." Basically showing some sort of evidence of the break-in, regardless of regulation it would be considered stolen regardless of that. I'm not arguing for the decentralized points that most NFT bros jack off to, but by law I'm sure it would be similar to stealing bonds, where your NFT is equivalent to some sort of owned asset.

      @@LyonManes if its just bank credentials, you can easily go to a regulated bank and tell them you didnt make the purchase.
      I had this happen twice easily got my money back and my account numbers changed. This could only be done per bank regulations by going in person with a valid photo ID that match my face, name, address.
      Then on top of that they could only send a new card to the address on file.
      This would be insanely hard to fake you would need to fake a US ID with my name but your face on it. Good luck, that requires a complete fake birth certificate and a fake social sercurity. That jail time if you get caught would be hefty.
      Steal an nft and its basically a game of he said she said. Law cant really do anything, or else Seth would have called them right???
      Well if someone steals your bank info and takes money out, you can call your bank, you can call the police, both have actions they can take against bad actors in a regulated market.

    All too true about the ridiculousness of NFTs amongst people struggling to eat. I've been living on dollar store brand bread for three days, lol. I make sure the cat has enough to eat though. These people are spending incredible amounts of money on images while mine and many others' stomachs growl.

    Know whats funny? He never owned the ape in the first place. The NFT is just a token in a data set for a server, using the image as an identifier. However the image isn't the NFT.

      Bored Ape NFTs are one of the few that actually do give you ownership of the copyright along with the NFT, so he DID own the copyright for that ape and now he doesn't, because the NFT was stolen and that is what gave him the copyright.

    He could literally just make a small change to the "character" (doodle of a mokey), and change the name....and still release the show that he's apparently spent time and money on instead of just abandoning his work and saying he can't release it...
    Anyone know if he found someone to insure the monkey doodles he paid hundreds of thousands for that he totally had big plans to make a profit on, which have just been very publicly stolen? I don't know if nft insurance is a thing, but this seems sus.

      You have to understand that the usual assumption that the show’s purpose is to entertain people can not be used. The purpose of the show is to inflate the value of the NFT Seth “owned.” If he doesn’t own the NFT, then Seth probably imagines that it would only benefit Darkwing84 if he releases the show.

    So couldn't Seth Green just go through with making the show anyways, and if the new owner of the NFTs so much as tries to sue him for it, they can just go to court and charge the new owner for receiving stolen property then and there? I could imagine if DarkWing doesn't even show, the case could just get thrown out and nothing can stop Seth regardless.

      He didn't know it was stolen when he bought it, so he's not obligated to give it back. So if Seth does just go ahead with making his show using the NFT he no longer owns the copyright to he is definitely open to lawsuit. He would need proof that darkwing bought it knowing it was stolen.

He has been informed it was stolen so if he (the wing boy) acts on the copyright in any way, he is knowingly committing fraud at that point. (This is based on previous court rulings which are only a suggestion to the judge at the time of court and not legally binding nor is it based on NFTs and whether they can even transfer copyright with a receipt).

    Seth is correct from a legal standpoint. Ape yacht club can make any rule they want up about IP and copyright but it doesn't override Federal law. If Seth can prove the NFT was purchased legally and stolen illegally, he will retain the copyright.

      US law doesn't mean beans in Australia. Now you're in the murky waters of international law. For example: will China recognize Seth's ownership? If they don't, will they block the show? And if that unclear, is a company going to pick up the show when they can't use it to sell Bored Ape stuffed animals across the entire world? Is the risk of this even worth it where there are other shows to pick up instead? This is a complete disaster for that show.

    My hope for this story is that Seth Green paid the guy to "scam" him, then post it and purchase it on his alternate account for 200k. Now the IP is instantly worth at least what it was purchased for at the rate of 200k thus artificially driving the asset's value up from it's original value of zero and the added benefit of free publicity for the show.

    You should watch the Legal Eagle about copyright of NFTs. He raises a valid point that that the contract may only with the original purchaser, and does not necessarily transfer with sales on the secondary market. Because at the end of the day just because Bored Apes say they something, does not mean it is legally binding.

    The problem with end user agreements of yacht club or whatever they are, is that, that agreement is only made beholden on the original buyer. The other buyers then on are on contract with the predecessor owner. And the thing with smart contracts is that, they are not acknowledged by the law. Just because I tie a shotgun to my bedroom door and make it deadly to enter my room, doesn't make my room legally against the law to enter. Just because a computer program is meant to do something, it isn't recognized by the law

      Well for the lambo there is the time, money, materials, manpower, etc. that was put into making it that is part of its value. With things like Bored Apes its something a bunch of guys made a template and threw it into a randomizer and pressed the button a few thousand times then minted it on the blockchain. The only reason 1 Bored Ape is worth more than another is cause of some arbitrary drop rate for certain characteristics that is completely in control of the ones that made it.

      Yes, it can more or less be applied to everything. However, "brand" is different because they are desirable from a cultural, socio-economical view: a Lambo is expensive because we associate owning one with being rich and successful. In this way, it has real life personal utility (as a bragging right). However, NFT (or at least the current version) exists for speculative value, and it really is not having any real utility value (and even for projects that claim to have, the question is why on the blockchain). In this way, NFTs are closer to Herbalife or Amway: when was the last time you see people actually consuming their products for health benefits? Or are the seller just trying to offload their inventory to someone else by promising speculative value?

    The entire premise of this video is false. Buying an NFT does NOT grant you a copyright to the image. This is something erroneously believed by many people. For example, a group of people bought NFTs that consisted of images of an unused Dune script. They thought that,because they bought the NFTs,that they were going to be able to produce a film based on the script. Then they found out that they couldn't do that,and buying an NFT does NOT grant you copyright or intellectual property rights. The contract written by Bored Ape Yacht Club does NOT grant you LEGAL IP rights. That contract is not recognized as legal copy right or intellectual copy right,BECAUSE the original owner or the artist that made the NFT art would have to have filed a copyright for each and every one of the apes they made. If BAYC does not have a legal copyright for every one of those apes then ANYONE can legally Save as... and do what they want with the image. TLDR.. If the originator of the NFT does not have a legal copyright for the image,then they do not have any legally recognized property rights to be transferred upon purchase of the NFT.

    I spent 400 on 3 NTF’s. Got them when being first minted. 1 never got poplar on OpenSea. The other 2, I sold for about 2 eth each. It was quick easy money. The mistake most make are buying a bunch and holding them thinking they will go up in value. This was an easy ride the hype train, make a quick easy buck.

    Cryptocurrencies have no inherent value, but neither do fiat currencies like the US Dollar - they only have value because people have agreed that they are willing to trade actual resources for the currency and vice versa. NFTs are like if you wrapped a stack of ten 1-dollar bills with a unique (low-quality) picture and idiots started running to buy them for a thousand dollars in hopes that someone else will buy them for more at some point in the future, with no real notion of how they might appreciate in value other than the hope that people assign more value to them for... no reason.

    I think in the legal argument Green is probably right but it is completely unenforceable. I think that fraud ( i.e. the stolen art being sold ) negates any rights. This all applies to real art and theoretically it would apply, I have seen stolen property being confiscated from the buyer with no recourse so I can't see why the same wouldn't apply here. Of course like I said, it's probably impossible for a court to enforce because it's not just a physical thing they can take away.
