  • A new week, a new episode! In this one I’m showing you how to get in jail as a biohacker. Yep, that’s right. I give you a demo of an exciting glow-in-the-dark beer experiment which you can only do with a permit (I did the experiment at the University of Delft).

      Homosexuality. They realized sending gay people to prison was a little counter-productive.

    The technical report they are referring to is this one:

    I translated a paragraph: "The BVL, by a decision of 5 February 2015, has determined that the use of these new breeding techniques methods, such as the oligonucleotide-directed mutagenesis (OGM) [CRISPR falls in this category], is not subject to genetic engineering law and rapeseeds, which has been modified by a point mutation via this method, are not a genetically modified Organism in the sense of the Genetic Engineering Act (technical report 3 June 2015)."
    According to the law, techniques like chemical/radiation mutagenesis are not considered to produce genetically modified organisms. The idea behind is that if the mutation caused by CRISPR can be obtained by these methods, then the plant produced using it is not considered a GMO and it is not subjected to the Genetic Engineering Act (GenTG).
    I suspect this was a move to allow cultivation of clearfield oilseed rape in Germany and bypassing the ban on GMOs (since such modified rapeseeds are mentioned in the document). However, the same principle could be applied to the CRISPR kits: they produce a point mutation that causes a single aminoacid change to rescue antibiotic resistance in the bacteria strain provided.
    This would mean that the usage of the CRISPR kit doesn't fall under the GenTG.
    However, I imagine that the BiostoffVerordnung, regulating the handling of biological material, would still apply.

    lol, why wouldn't CRISPR count as genetic modification? I'm currently in a genetic ethics course, and we often talk about how few regulations we have here in the US on gene modification. I was never aware that Europe had already begun making laws on the matter.

      Europe didn't have effective laws, they just have blanket bans.
