Valid ba ang Extrajudicial Settlement of Estate kung hindi isinali ang ibang tagapagmana?

  • Kapag hindi isinali ang isang tagapagmana, o ilang sa mga legal heirs, hindi naayon ito sa batas na nagtatakda na lahat ng mga anak ay magmamana sa namatay na magulang. Kaya hindi valid ang extra judicial settlement of estate kung hindi isinali ang mga ibang tagapagmana.#philippinelaw.

May katanungan na naman po ako kong sakali ba na nakapagbail ang isang akusado at pagdating ng judgement day at nahatulan ng guilty beyond reasonable doubt at gagamitin po nya ang remedy iyong bail nyamay pag asa pa kayang maiibabalik?       Kapag tapos na ang kaso sa korte, binabayaran o ibinabalik ang bail money kahit na mapatunayang guilty ang akusado

      Pumunta sa abogado at magpagawa ng extrajudicial settlement of estate. Kailangan ng titulo ng lupa at ang photo ID gaya ng drivers license ng lahat ng mga tagapagmana. Dapat lahat kayo ay pipirma sa harapan ng abogado.

    Good evening attorney. Lagi po ako nanonoud ng video nyo lalot pag may bagong upload po kayo.
    May katanungan po sana ako na kapag ba ang asawang babae nag popost na ng picture na may ibang kasamang jowa hindi yong asawa niya. Yong mga post niya puro sweet at may pagkiss pa. Pwede na poba gamitin ebedinsya yun para makasuhan siya ng adultery. Salamat po aantayin ko po magiging sagot nyo po 😊

      Hindi pa rin ito matibay na ebidernsya sa kasong adultery. Dapat kasi na ang ebidensya ay ang pagkikipagtalik sa lalaking hindi niya asawa.

    Papaano po atty kung ang isang kapatid ay ayaw pumirma for some unknown reasons sa ejs? Me kaso po ba syang kakaharapin o pwede po ba syang kasuhan ng ibang kapatid?

      Kung ayaw pumirma ang isa sa mga kapatid, maaring mag-file ng petition sa korte ng judicial settlement of estate.

      Kung walang anak agt magulang ang iyong tiyohin, ang kanyang property o estate ay mapupunta sa kanyang mga kapatid. Pwedeng tubosin ng mga tagapagmana ang bahay. Kung ayaw makipag-usap ang nagsanla, dumulog sa inyong barangay.

    Atty. good morning po sa inyo. Atty. itatanong kolang po sana kung malaking gastos po ba pag dinala sa korte like kung hindi na po nagkakasundo magkakapatid pagdating po sa hatian ng mana sa lupa? Kasi po nakatira po ako sa ibang bansa now po hanggang ngayon po kasi ayaw po akong kausapin ng mga kapatid ko dahil sa hindi po kasi ako pumayag sa pinapalaki nilang sukat sa mga loti nila, at hindi po kasi nila sinunod kung ano po yung napagkasunduan po namin pagdating po sa pagpa subdivide sa farm na mana po namin sa magulang namin.

      Hindi kaya pinapalaki nila dahil binibigyan ka ng right of way? Anyway, may mabuting pag-usapan na ninyo kaysa magkakaso pa kayo. Kapag idaan ninyo sa kaso, lahat kayo ay talo sa oras, at gastos. @@EmceeC-xd8ni

      Ang ibig mong sabihin, Deed of Sale Kung hindi pa bayad ang binibilingn lupa, hindi dapat gumawa ng Deed of Sale. Pero maaring magpagawa ng Contract to Sale sa isang abogado.

    Hello, good afternoon po, Attorney.
    I have a question po regarding the imposition of legal interest. Lets say, X borrowed 5,000 from Z and they agreed that the rate of interest is 5% per month. Their written stipulation only includes the amount of Principal but not the interest rate. 3 years later, Z is compelling X to pay the amount of 14,000 inclusive of interest. X have become insolvent.
    What should be the remedy of X for this? Pwede ho ba mababaan yung 60% na annual interest po?

      We used to have anti-usury law but this was suspended in 1983. With the suspension of the law, the parties to a loan agreement can now agree on any interest rate. Pero ang sabi mo, walang written stipuation tungkol sa interest rate. Dahil walang writtenna stipulation tungkol sa pagbabayad ng intetest sa utang, ang maari lamang na singilin na interest ay 12 percent kada taon.

      Kung pinalabas niya o pinalabas nila na sila lang ang tagapagmana at ginawa nila under oath, pwede silang kasuhan. Pero para maprotektahan ang karapatan ng hindi isinali na tagapagmana, mag-file siya kaagad ng Affidavit of Adverse Claim sa registr of deeds
