Especially considering her audience is known to sell out products based on her recommendations. Its may be a risk, but it's actually a good business decision to prepare for an influx of sales so that your supply can meet demand. If Mikayla actually posted the video, and he still had 10k worth of product left, that's on him. For me, the issue is that she guaranteed over and over again that she would do it.

If he has the money... why didn't he pay her for a review? In my opinion, she was prioritizing her work and procrastinating, what happens, he may get upset, but it happens, we cannot demand too much from someone who is doing us a favor, in my opinion.
If he has that money to invest in his work and he is a "perfectionist", it is better to pay, so he could demand the date, the way she would do it, the filter she would use...

He should have kept this one in the drafts. When I was 16 I had my own Etsy & sold bows. At the time tumblr was huge and the whole kawaii aesthetic. I started small but quickly gained popularity by messaging popular tumblr girls. At the end of the day I knew that they didn’t have to post my bows if they didn’t want to. Like yes I spent the money to ship & a bow that could have been sold but it was a risk I was willing to take. There were a lot of girls who ghosted me & it was what it was. You loose money but you just keep trying…
One time a girl credited the wrong company & when I messaged them they actually blocked me. I also used to take pictures of models like trade for trade type or work. I’m trying to build my portfolio and so are they. Models would constantly post the pictures I took of them and not credit me. I would message them & kindly let them know. I have been blocked many times. Again it does suck but if there’s no contract you have to understand what could happen!

Towards the end I was running into other small businesses that would steal designs etc so I knew it was my time to exit it was getting very stressful and competitive

Yes, Mikayla should have been more clear and said I will review it, but I can't promise when (basically explain what she said in the video). But I think the guy was to reckless and entitled. To me it looks like he was desperate to get costumers, so he decided to use Mikayla's not great reputation to try and fish for sympathy. Basically overplaying the "I got scammed by a big influencer". Which sucks cause it does happen to many people, and things like this make it hard to know who to trust and support.

I’m extremely confused what he thought her obligation to him was when they didn’t have a contract nor was he paying her for it. He essentially just harassed her into giving him free promotion. I also remember seeing his first video and wondering how all those random facts he listed about timing are connected to each other at all or signify any sort of planned sabotage towards his company. Sure it may suck when a person doesn’t stay true to their word, but her word came after he bullied her into contacting him in the first place. Mikayla could’ve gone on to never review the product and act like she never received it in the first place. After all, it was a free PR package. She owed him nothing.

I agree with Ethan here. The only thing she did wrong was lie about it. BUT I think he has a good case of detrimental reliance for that $10,000 AKA she might owe him. Here is my legal analysis.
In contract law, even if an agreement had not been made yet, if there was a reasonable expenditure that 'detrimentally relies' on the performance of something not yet agreed- courts may actually grant that. I think that he REASONABLY assumed she would make a video. The question would be was it reasonable to take out the loan and could mikayla reasonably foresee that to happen.
Courts would only grant money to him if they deem his expenditure 'reasonable'. So, I think he has a good case but it could go either way.
Lets also note that contracts need not be written. They can be enforceable verbally too BUT In order for it to be enforceable there needs to be exchange though. Here, it does not seem like there is any exchange of money and he was just expecting it for free. That is called a gift. However, detrimental reliance bypasses exchange requirement if it was REASONABLE! and there was reliance on the promise!! So, I think the case here is strong.
Her defense would likely be that she flaked on him before so it was unreasonable to take the loan out. Secondly, I think she would argue that it was not reasonably foreseeable that he would take the loan out DUE to her promise. The reliance NEEDS to be foreseeable for the promisor.

So if someone VOLUNTARILY says they will do something that is very important to you, and not ONLY DOESN'T get to it, but never addresses to you or anything until you contact THEM, AND the same thing good on for SEVERAL MONTHS, you're not going to be passed?
Just because something isn't your obligation in the first place, when you offer to do something and you don't do it and leave them in the dark completely, it's just completely okay because they didn't have to do it?
So saying you'll donate to a charity and never doing it is fine because you didn't have to do it in the first place, or babysit so someone could go to work and not show up so now they don't have a possible replacement and waiting for you after they were ready for work only to not even hear from you until they call you and just tell them well you didn't need to watch them or offer to in the first place and they can't rely on you for childcare, they just can't.
I hope someone offers to watch your kids after struggling to find someone when you both need to do something very important and they NEVER show up or even give you a heads up they they were gonna cancel. As long as they've talked to you nicely it's all fine and dandy because they were nice enough to SAY they'll be there to watch your kids in the first place when they aren't responsible for them at all or their guardians.
