    If somebody kills an officer on/off duty they get death row Intentionally or not, but if a officer kills an innocent man walking down street the officer is seen as a hero or he could justified for his actions, how does that work

      @@clanker8686 An execution is a very different thing from an accident killing.. heck, even a premeditated murder is on a completely different level than an execution.. An execution is taking someone’s life after deciding with the power of Law and the State that this person no longer has the right to live. A person who’s is sentenced to an execution had no recourse, no say and no ability to defend herself, while even in a carefully premeditated murder there’s chance of something going wrong the victim getting saved or saving herself. I used to be all for the death penalty, especially because in my country we don’t have it and there are some heinous crimes where criminals are not properly punished, but after giving the topic a lot of thought I believe the death penalty is only ever warranted when there’s proof of intention and premeditation that is absolutely incontrovertible and when the victim is killed in a cowardly and/or torturous manner that denies them any chance of self defense.

    A few years back a police officer in my town sped through a flashing red light at more than 90 mph and smashed into another car, killing a young couple. He got one year in prison and three years probation.
    Why are police officers not punished or held accountable the same as everyone else?

    The victim's wife has been through a lot, but her being allowed to use the death of another person to get personal closure and feel closer to her husband isn't fair on anybody. This entire situation is disgusting and complex and could never be resolved by the simple act of taking another life.

I just disagree that killing the criminal provided any healthy justice or closure for anyone involved personally or for the moral/ legal situation overall.

      Cece Ruben Cece Ruben That's awful, I'm very sorry for your family. We just have different interpretations of "healthy closure." Personally I don't think that it is right to find positive emotions in the killing of another person; for me this feels selfish, illogical, and short sighted. Criminals cannot go on offending on full life sentences; this combined with the fact that juries do make mistakes and my belief in rehabilitation wherever possible means I don't see any need to execute anyone. No crime can be undone, justice must be about eliminating the risk of reoffending and helping those affected in their recovery, rather than creating more loss. I can appreciate that these situations are incredibly emotionally complicated for all involved though.

    He definitely didn't deserve the death penalty. The fact that the wife watched him die is very disturbing. Killing this man will not bring her husband back. She just wanted revenge, not justice.

      I feel the same as you. What is really heart breaking is how blood thirsty people are. This young man should have been charged with voluntary manslaughter and served no more than 15 years in prison. They can often very convincingly fake remorse. The fact is 99% of us go through this life without taking anyone else's life.

      You mock her for looking at details in the video, however if he did not intentionally kill the man his sentence should have been much less harsh. You say that if it were her child she would change her tone, and while that is likely true, it is the duty of the justice system not to cater to the upset feelings of some random wife, but to serve justice. This man made a terrible accident but an accident it was, which in no way deserves the death penalty, not by any sane moral code. If it was intentional, then a strict sentence is required, but i dont think what he did warrants a death sentence. An eye for an eye is not justice, especially for someone so remorseful.

But here in Texas when you kill someone intentionally or by accident while you are committing another crime you are charged with capital murder which only brings life without parole or the death penalty. Since it was a cop and he was asking for the death penalty it's not surprising at all that he was sentenced to death. It's a dumb law in my opinion.

    I cried watching this...my heart breaks for this young man. Interesting cops can kill people deliberately..with no reason, and get off Scott free...Daniel was wrong for evading cops..but his messed up life pretty much left him hopeless..and death seemed better.. nobody thought to have him evaluated mentally? I'm sure if he were a white boy..all types of mental evaluations wouldve been done

It’s not like the officer tried to kill Daniel Lopez and it’s not like Daniel Lopez tried to kill the officer. It just gets complicated because most of the time police officers aren’t accidentally getting killed so no law really stands just for that circumstance. This is just an example of a very rare thing.

      Felony murder. Murder one(and is various synonyms) are dived between premeditated/malice(meaning with intent) and felony(meaning done during the commission of another felony ex:rape or robbery). Both carry sentnaces of either life with out or death. In this case it’s felony case we have felony resisting arrest, reckless endangerment, grand theft, assault(the first officer he attack), and porbally several others. Any one of those let alone all them together means he could have just missed the man but given him a heart attack which killed him and still have been executed because the death is the result of his decision to commit said felony.

      No one knows how one is going to react in a situation like this, with such a huge loss. You lose some of your judgement, you can’t think properly and the feeling of suffering and injustice becomes almost unbearable. Watching the video and knowing the facts from the outside gives a different perspective, a lot different than living all those feelings. You can think that the wife is wrong, that she’s not in a clear state or mind, but honestly you can’t blame her. In a situation like that, here from my chair I would say that I’d be capable of forgiving this, but being right there, a whole different story. This is a tragedy from wherever you look at it, and for me, the wife is another victim.

    He should be charged only with reckless driving, nothing more. The police officer chose to be in that place, he chose a risky job, he chose to jump into harm's way, why should this man be held responsible for that police officer's choice or better stated would be the word 'stunt'. The police officer tried a stunt which got him killed. And he was earning money every month in return for pulling of such stunts and now all of a sudden its the fault of this man for causing the police man's stunt to backfire. It defies all sense and reasoning.

    Oh my.. I used to be confused as to why people disagree with death punishment but then I watch this.. Why do they end someone's life so easily?! This is not justice.       Bry Halla Any mistake with death row is irreversible, it’s one murder “balanced” by another murder. Look at it from a far and it’s 2 murders and 1 trial. Capital punishment doesn’t act as a very effective deterrent and some killers come clean, I think you have to think whether or not these people can be corrected. If they can, they go to a correctional facility with parole, if not they go in for life (maybe with parole as u can never know).

    I remember watching this documentary ages ago. What happened to the officer was a tragic tragic incident. Do I believe it was an accident? Yes. Even the judge indicated that he could have fought it from a different angle. Lopez was trying to avoid the spikes and by doing he swerved left and then right - the officer was crouched down at the time and was not his view. Him killing the officer wasn't intentional, but him trying to run away from them was a moment of panic and uncertainty of what to do. He accepted his fate and wanted the death penalty process quicker as he's rightfully knew anything involving an officer- he wouldn't see day light again.

      It’s tragic but it’s important to understand how the law works. Fleeing like he did is a felony and someone died as a result of that felony which triggers the felony murder rule and on top of that he killed a police officer. What happened was not corrupt but I feel like if any guilty person has ever deserved a pardon it’s this man. It’s very rare for someone to take accountability the way he did and the world is a lesser place without someone like that in it. Most criminals would have done anything to reduce their sentence, blame someone else, not even be sorry, and this man was literally sorry to his last breath.

    He took his last moments to apologize to the policeman’s wife and tell her he was OK with dying for what he did. When she nodded and accepted, and he, in her words, relaxed. He knew he didn’t deserve her forgiveness, but he still found a way to apologize to her- and her nod let him know she understood what he said. He needed that, and she freely gave it.
    From beginning to end, this is such a tragedy for so many people. It’s so sad.
    I don’t believe in the death penalty. The state shouldn’t be executing people.

    As someone that is not really a reader a friend of my forced me to read a book he just read. He started to show tears so I wanted to make him happy to read it as well. This book "Riven" from Jerry B Jenkins is the best book I've ever read. It's about about a the death row convict and a pastor that became friends before the execution. The first 50 pages or so was a struggle to get in the story but there comes a point that this book will get you hooked and the story gets better and better and at the last chapters are full of tears. This video reminds me about this book.

      I have a friend in prison who got 25 years for murder bc someone died while he was commiting a felony(stealing a car). The victim was struck by another vehicle and died. The state wanted life wanted life for him but he had a REAL ATTORNEY not a public defender..its crazy the difference it makes as to the sentences and for what crimes when inmates have a public defender they always get the worst. Also, it doesn't seem like Texas deciphers circumstances into penalty phase. A felony is a felony to them . It's kinda messed up idk anywhere else like texas.. I'm sure his victims family grieved as much as a police officers family too.

      K DEN, you're entitled to your own opinion. But there is a reason why the death penalty is only around in 6 countries. If it was a valid punishment which worked and was effective, all countries would use this method.

    He gets the deathpenalty for evading a roadtrap and hitting a officer by doing so. Sorry that i say it but they need too investigate. The distance between the car and the officer. Its clear that he stood way too close. This was an tragic fault but not worth the death penalty

    As a law student, this is very confusing to me. The first thing we learn is that a defendant must have intent to commit murder for a capital murder charge to stick. This should've been charged as a reckless homicide or murder 2. You can't conclusively establish that it was premeditated and it happened in the process of avoiding an obstacle. I'm shocked that a DA would prosecute this under that charge and a court would actually find him guilty. He clearly doesn't meet the elements. Idk what Texas courts are doing but this isn't justice.

Why have some died, and others not for the exact same crime, because of a different judge etc? Although in some cases the death penalty could be just, so much can go wrong. My heart aches for this man and his family. What he did was wrong, but it's not hard to be lead astray in life, it could have easily been any of us. The system is fucked.
