      agreed. They should only be able to use the civil courts in pursuit of debts owed. But the HOA fines might have to be regulated at the state level as some HOAs go hog wild making up the craziest penalties that do not fit the infraction.

    I'm a Florida real eatate broker and can tell you with 1000% certainty that many HOAs are managed by criminals. Many aren't held to any financial accountability because homeowners DO NOTHING. If you're a homeowner and you're not getting or requesting an annual financial statement depicting where every penny goes, rest assured that the HOA treasurer is making out a lot better than your community's common areas. There's no one really managing the treasurer or accountant. The biggest robbery happens within the HOA and it goes 100% unnoticed. They need to fix THAT loophole.

      Very true! There are videos about Turnberry Reserve where the management company`s site manager hired her boyfriend (a convicted felon) as head of security then started fining everyone she didn`t like and locked them out of the pool. After some heated arguments at meetings, the board of directors fired the management company and things have been fine ever since

      @ihatescammers6438 I was attacked by a neighbor who claimed she was the President of the HOA... all because I turned Old Glory upside down. No matter what side you're in, physical assault is a crime. She was actually unseated from the HOA PRIOR TO HER ATTACK ON ME. The HOA did NOTHING. I called the police and they wouldn't arrest her. I moved out into a home in a non HOA neighborhood. Best decision ever.

      Oh man, you are unto something there! My dad’s condo community recently went through an assessment to replace their roof and his portion was 9k for a 1bedroom condo! I went to the HOA committee hearing and recalled the management team say there were no funds in excess to cover the replacement so it’s passed unto the owners. This did not sit well as there were demands for financial statements to justify where the HOA fees were spent on. No surprise, there wasn’t any to furnish and in the end, to make it worse- everyone fees were doubling!

      ​​​​@@rond1475 it's not that they are hidden its how they are interpretated. You have no legal rights to take an HOA to court to have rules interpretated the HOA can interpretate the rules how ever they would like to as long as it matched what is written.
      What about the people who where dragged into a HOA kicking and screaming? In a number of states if a number of people want to start an HOA they can force others to be part of it even if they don't want to be. In my state if 50% plus one want an HOA they can force the other 50% minus one into the HOA and there is nothing they can do to pervent it.

      We live in a HOA here in NC and have never had an unfelt,problem in the 25 years we have lived here! The HOA takes care of the pool, clubhouse, all the property that us nit,owned by homeowners which consists of all the property coming into our area and the small,park right across the street from our home! We have a special,place for homeowners to park their RVs. Boats (we are by a very large lake) or anything else. We have a 2-car garage but iwn 3 cars, one if one of which is always in our driveway unless one of our cars is going to be away for a time. And we have never been asked to park this 3rd car elsewhere. Sounds ti me like the problem HOAs are in Florida, California and a few other states. We would never have bought here if we had uses such as other people,complain about! Our yearly cost has changed a little - it was $360 in 1999 and now it’s $750 - most used for landscaping and pool/clubhouse! No disgusting charges! So you people who hate HOAs are only going by way of ones you might live in or have heard horror stories about - I wouldn’t live in those either!

If you do have that, you do understand you are paying taxes that provide those things then paying your HOA to also provide those things. Which happens to be across the street. Why pay for those things twice? Because one is across the street?
      Deep down, you're basically paying property taxes twice. Once to the county/city you live in then to the HOA. Because the fees your HOA covers are the type of things your property taxes also pay for. Why pay double?

      Wait, what? HOAs in Florida are already individual depending on the neighborhood. I have one where I live but it's very limited. It controls common areas like the entrances and our lake lot and that is it. Not all HOAs are a nightmare. In fact, if set up properly, they are a benefit.

      Deep down, they're paying property taxes twice. Once per year to the local government then monthly to their HOA.
      Here's why I phrase it that way. Property taxes pay for things the city/county has, like public parks, dog parks, public pools. The city/county either has their employees care for these parks or they pay a contractor to do that job. Now, the public areas of a HOA neighborhood also have parks, pools, dog parks and other public areas.
      I get paying a monthly fee if I lived in a condo, because that is going to help pay for upkeep of the building I'm living in. Making sure the elevators are in working order, public areas cleaned. Fix any issues the building itself may have. Single family home, hell no.

The rules just need to be reasonable.

    As a European why would anyone want to live in a HOA, I'm the homeowner if anyone else tells me to cut my grass or I can't paint my house can't do Christmas lights beyond a certain date can't have x y and z, they are being told where to go not very politely.

      In western Europe, you have to deal with far worse intrusions on your life and property than an HOA in the USA lol. Now we don;'t have HOA in Canada and I have two houses here. I also have a vacation home in AZ and it is in an HOA gated community. Since I am not at that home very often the HOA does help keep the area incredibly secure and worry free, and also manicured and with luxurious roads and amenities. Fees are not high at $200 a month though half of that is to subsidize the golf course which I am opposed to subsidizing. But it includes garbage pickup, sports centre with pool and hot tub, guard gates and patrols, beautiful roads and natural desert landscaping. Not a bad deal and the HOA has not descended into craziness (yet).

    I'd much rather live in a neighborhood with driveways filled with pickup trucks, better if they are commercial vehicles. Those folks would be way too busy working and making a living than being a Karen and busybody

      If the housing market is essentially all HOAs which in many places it is then yes people are forced to buy. Especially if they have limiting factors that’s making them look in a specific market (schools, proximity to work/civilization etc)

    I lived in 4 HOAs, 3/4 have crossed the line into harassing hard-working neighbors and abused power and fined neighbors. Even fined me for my grass turning brown during a drought even tho county issued water restrictions. I feel sorry anyone living in HOA and CDD communities that's worse paying $100 a month for HOA and $100 for CDD.

    The problem with HOA's is that they are run by this little people, that get in a position of authority and the power goes to their head.If one of them doesn't like you for any reason. They can make your life miserable. Ban all HOA's or limit their power and increase their accountability. It's your property and you should be able to do as you wish within reason.

    Many law firms create HOA oversight companies as an added business. HOA's hire these companies and they in turn have overly aggressive enforcement and monetary sanctions. Follow the money!

    The only way to end HOAs is for people to stop buying them. My friend bought house with a HOA because it was a gated community so she felt safer, meanwhile people were putting their code out on signs for garage sales, there were walk in gates, etc. so not any safer than buying one that wasn’t in a HOA. She had to get permission to repaint her front door the same color it already was because they were going to fine her for not repainting it after the sun had faded it a little. She had 1 tiny oil drop in her driveway and they sent her a letter telling her she HAD to have the WHOLE driveway power washed or it would be a fine. I told her she was dumb to pay for a house where she is told what she can and can’t do and when.

    the lady being interviewed probably lives in a nice neighborhood in every since of the word -
    I used to deliver mail in some upscale and middle class subdivisions - the oldest one had lots of Dr's and old money folks and never caused anybody a problem - they could have golf carts, and many left their decorations up for months - as long as they paid the fees to keep the street lights and signs etc kept up it was ok -- the less affluent one would harass folks for a dead tree on the corner of their lot because they could -- I am glad I live in the woods

    I have bought 3 houses over the past 50 years - I made sure none of them were in an HOA. I will not have someone else telling me what I can and cannot do with my own property, other than the local government codes and regulations. Why would anyone willingly pay a monthly fee to an HOA that will rule your community, often with an iron hand and no recourse against unfair rules and regulations? Nope, not for this man!

    HOA's should only exist where there is shared space to manage... like Pools and playgrounds and golf courses.. they should have not say on how I or you use your property.     needed to be more generous. there should be a fine cap on $1000 per month. there should be no ability of an HOA to put a lien on your house "at all" for "any" reason. and your should be able to put a clothesline anywhere in your back yard no matter if its visible or not.

    I live in an HOA now. If I move I will never move within an HOA community again. I spent time on the board and tried to manage many projects. HOA’s are managed by people who have never owned a business or had a high level in management. There is no way to go against the in power click so I resigned.

    I bought a house once and was told no HOA. Well after I moved in I get a bill for dues. 😳I couldn’t believe how much it was and asked for a breakdown. Well lo and behold it turned into about $100.00 a year. Prior they were gauging the homeowners and no one ever asked to see a breakdown. I also was told I had to pay even though I didn’t know we had a HOA 🙄

    My HOA makes me buff the tips of grass blades after each mowing. I have to admit it does make the grass look shiny. They also make me wash my car a minimum of every other day. When the car is dusty or what have you they write “wash me” in the dust which is extremely embarrassing. One time I went 3 days with no wash and they fined me 1000.00. I didn’t like it but I paid it, so sometimes they do go a little overboard. Just sayin.

    The only thing I dislike about HOA’s is the management company. Our management is NON RESPONSIVE to the homeowners unless something is an emergency, however, they keep collecting HOA dues, and come up with special assessments far too frequently. I lost count of how many special assessments we had in the past year. So far, we have had two this year that will last 6 months.

    Our HOA has refused to follow the new laws. They claim that the new laws don’t apply because it is in conflict with CCRs which take precedence. Does anyone have any comments? They are a very aggressive.

    When my husband and I finally was able to buy a home we had a pre-approval letter from our bank. We told the realtor our ceiling and area to look, she pulled up OVER 300 homes. Then we said NO HOA!
    The listing went down to 4. FOUR!
    Don't regret for one second not living in an HOA. ...well it would be nice to have a pool but whatever.

    What people don't seem to know is that you can come together (I think its like 60% of the neighborhood but dont quote me on it, do your research as im sure each state and county have different requirements) and actually put forward a motion to abolish their particular HOA. Its a bit of an effort but it can be done.

    I had a town house when my kids were small. when school was out we noticed there were several people in the community pool as it was a hot day. they said the pool was closed until the next week. when I asked why they were there I was told they were the lifeguards. so I told them to get out of My POOL and promptly called the HOA president. they were removed from the property within fifteen minutes. I sold it soon after an d bout a house. these people are nothing but bullies.

    I remember watching a story about a HOA. A guy did something with his property that made them mad. Can't remember what it was. Think it was painting the house a different color or something. Anyways he got fined. He refused to pay the fine until he got so many he was forced to. They fined him so much he lost his life savings, his wife left with the kids and even harassed his place of work. He eventually snapped from them tormenting him that he waited for them to hold a meeting. He went to the meeting with a shotgun and not alived at least 2 of the HOA board members that were responsible for ruining his life. I can't remember what happened after that. Whether he turned on himself or if he gave himself to the police.
    I have to say I don't feel bad for the board. They tormented him into insanity and losing everything he cared about. He thought that was the only way. There are many other stories like this where HOAs act as bullies and torment men and women so much they just break. HOAs are evil. The fact you buy a home you can't control is not normal. Not everyone is going to have the money to fix or change everything about their home. They shouldn't have to. Basic care and upkeep of the property is something most people do. HOAs aren't needed for the most part. Especially if you've lived in a area for a long time and one just forms and you're stuck there. If someone buys a home, pays taxes and doesn't cause any trouble with the neighbors they should do whatever they want with their property.

      I wish mine had a no dog rule simply because people don’t pick up after them. If I see dog poop in front of my home one more time is swear. I’ve reported people, spoke to them, the Hoa, have a couple signs up, and still.. dog 💩

    I currently live in a house that is part of an HOA and I hate it. They want to control how your home looks. They can change HOA rules just to kick you out.

    I don't get it , you buy a home in an hoa community and before you move in they give you all the rule sand regulations that you must read and sign before buying . It's a choice you make .

    HOA and the fees you pay sadly were things that the city and your taxes USED to pay for. NEVER get a home that has HOA fees NEVER! HOAs should be illegal and cities need to get off their ass and hire more folks or stop taxing us

    Please explain how a business vehicle or first responders vehicle isn’t commercial? I have a work truck that has a small emblem on it and live in an HOA. What is deemed commercial? How can a business or first responders vehicle not be commercial? I would love to stop being harassed and be able to park my work vehicle in my driveway.
    They also threaten to tow vehicles in the street overnight. If I have no room (garage and drive already full) why am I not allowed to park if it’s not impeding traffic on private property (gated community) drives me insane.

I also know too many people who know they are moving to an HOA neighborhood and then pretend they didn’t know, and complain about the rules. Again, don’t like rules? Buy elsewhere, or rent.

      That’s far from the truth for a majority of them. They were set up for those reasons, but they have morphed into something far from what they were intended for. Not saying all, but I would confidently say most. You can watch hours of videos about HOA’s harassing residents and even getting them forced out of their homes for things that truly don’t matter. Losing everything over a DROP of oil in your driveway or because you didn’t ask before you painted your door??? That should be ILLEGAL

    If you do not like guidelines or to follow rules and regulations, don’t move into an HOA expecting them to make exceptions for you.. There are still 55 % of the houses in Florida not with HOA’s , move there .
