I also was excited to see there was a change to the " living together " part. But sadly it just brought me to tears. My partner and I have been together for almost 5 years. He's been here in the states and I've been there multiple times. We were denied the Critical Purpose visa because we were not living together. I explained we had decided I would move there last May but Covid hit and that was put on hold. Now 18 months later we miss each other terribly and don't see any chance to be together again anytime soon. This is the hardest thing I've ever had ro deal with. My heart breaks every night I have to say goodbye. I hope things change soon.

And this time will be starting the partnership visa application the day I arrive. They honestly don't take in account how this is mentally affecting people. Very disappointed about the living together part. Both of us come from orthodox Christian families, won't allow living together before marriage. My exemption request declined thrice in last month despite they satisfied with our genuine and stable relationship.
Hi Anjaly, It's a disappointing path they have taken, as we believe that a relationship can be just as stable and genuine without the need to have lived together. It's not the requirement that was in place when the border exceptions came in under H5.25.15.f, when people could easily fetch their partners, but was something that we can only imagine came through due to pressure from the government. It's unbelievable that considering the circumstances of the world. That relationships that have been made prior to covid and the only way in which we have had contact is via social media platforms. That none of this will go towards proof of a stable relationship. My girlfriend has a visitor visa and went home for the CNY then have only had contact via wechat. Borders closed every where and now this. People in power have no experience with this hardship or just heartless..so sad
Hi Lorenzo, There are some in government who understand, who have spent a lot of time talking with migrants, looking for solutions, and one MP who even had to bring his partner into NZ through the CPVV program. Yesterday we spoke with one MP who is fighting for migrants, and had emails with the office of an MP from another party, also fighting for migrants. They know the pain and are doing all they can. Hi Pranav, There isn't, it really is a grey area. There is so many factors that it is hard to do a checklist of things that should or shouldn't be provided. That is where we often see confusion online when people try to compare their situations with others but only on a couple of factors, and then think that INZ is being unfair. It often comes down to the situation of the parties, and the evidence provided can play a huge part. We've had clients recently granted visas with less than a month living together, while we see others declined after several months. However, the evidence and situation for our clients showed they were clearly living together, where others can be less definitive. So unfortunately there is no minimum requirements. The immigration officer will take a holistic approach, and make a decision based on all of the evidence provided. Arran

Government policy ought to adhere to the international treaties and conventions we sign on to right?
Hi Alistair, Sections 185 and 186 of the Immigration Act 2009 remove the right to appeal from people who are offshore. One person did try last year but the court decision was just basically that the court cannot intervene. There is a right to judicial review, though that focuses on whether the correct process was taken rather than if the correct decision was made. I'm aware of one person currently taking this process so we're keeping an eye on that, though aren't hopeful that it will make a difference. Unlike places like the USA where the court can modify or object to legislation, the courts in NZ must follow parliamentary supremacy, and allow parliament to make the rules. While we do see the courts sometimes interpreting those rules in a way that deliberately modifies the intent, we don't believe that would happen here. The government was elected on the basis that it kept the borders closed during the worst of the pandemic, so they have the mandate to do so. And without a right to appeal whether a decision is correct or not, it leaves applicants in a bad situation. The one open path is the Ombudsman option, which we are following for a couple of clients. However, that also won't look to fix bad rules, just whether they were correctly applied. Arran

More and more countries are opening up to allow people to travel there for that period, with Serbia being often used, and Switzerland (for those vaccinated), the Maldives and Singapore providing new options. They will need to transit through another country spending 14 days there, and there are still several allowing travel, such as Serbia. So there are options, just not easy ones. Hi Petal, There probably won't be many options open at the moment, with it being reported that the partners of only 15 other critical workers being allowed to enter (and that would still require him to move from an post study visa to an employer assisted visa). We could have a better look if you emailed us more information, but for most people it may be a wait for the border to open. Hi Veenu, There is no "3 month" requirement that we have heard people mention. What they are supposed to be looking at is whether you are genuine and stable. Part of that is based on living together as, in INZ's words, a couple cannot know they are genuine and stable until they have lived together. We've had clients get a CPVV with under one month of living together as, viewed holistically, they were genuine and stable. Hi, There aren't many options at the moment. The only possibility is other critical worker, but that requires a very high threshold to show exceptional talent that is not readily available in NZ. This is a visa that has a number of declines. We haven't recently helped some in IT into NZ on such a visa, but they are extraordinary in being an internationally recognised expert in their field, so it really is a high threshold that few meet. Alternatively if you could find employment on a listed project under H5.30. So if you think that is you then please contact us. Otherwise, it may be best to wait for the border to open. Arran

Hi Rivin, Yes, that article is true, and there are hopes that once vaccinations are in place that the borders can open. However, that comes down to people wanting to get vaccinated. We see the UK now looking at it's third wave, hitting those who didn't bother, and lockdown remaining in place for another month. So it may all come down to how many get vaccinated by the end of the year. And just to clarify, investors aren't welcome in New Zealand, only the ones who have government connections so seem to be getting through on the same "friends with government" exception that entertainers and celebrities come in on. There aren't many options at the moment. The only possibility is other critical worker, but that requires a very high threshold to show exceptional talent that is not readily available in NZ. This is a visa that has a number of declines. We haven't recently helped some in IT into NZ on such a visa, but they are extraordinary in being an internationally recognised expert in their field, so it really is a high threshold that few meet. Alternatively if you could find employment on a listed project under H5.30. So if you think that is you then please contact us. Otherwise, it may be best to wait for the border to open.

No idea yet, the government likely haven't decided yet either. We're assuming early 2022, but that is still a long time away.

Not many can get work visas at the moment, only a small number who can get border exceptions. For most others, it will be a wait until the border opens.

Are you applying as a partner of a citizen/resident or someone else? If partner of citizen/resident then it should have been processed by now, and please contact us at visas@shlaw.co.nz if it hasn't. If the partner of a work visa/student visa holder, then when the border closed in March 2020, all offshore partnership applications were paused and are not being processed yet. So that will likely be why.

If it's true we can expect some good news by end of this year. Few of my friends moved to your country in critical workers visa and I stuck here. Medical workers and investors are welcome to your country and you don't give a shit about partners. That's totally unacceptable

Yes, that article is true, and there are hopes that once vaccinations are in place that the borders can open. However, that comes down to people wanting to get vaccinated. We see the UK now looking at it's third wave, hitting those who didn't bother, and lockdown remaining in place for another month. So it may all come down to how many get vaccinated by the end of the year.
And just to clarify, investors aren't welcome in New Zealand, only the ones who have government connections so seem to be getting through on the same "friends with government" exception that entertainers and celebrities come in on. Most investors can't apply.

Guys don't be disappointed, the reason NZ is making partner visa difficult is because they want immigrants to come here and find NZers as their future partners. Can we blame them.
