Accusing someone to their face, in public, that they killed their wife is certainly designed to invite violence. Those would be "fighting words" and likely slander (assuming that after 10 years the Karen didn't have new evidence of his guilt).
I'm aware C- is the next-to-lowest grade, and I agree ATA is remarkably good at being impartial. I just feel that while she deserved a beat down, I'd settle for her getting an F.

@@charlesdemeary did you watch the whole video? ATA literally lists out the reasons why he gave her a C- & to me it seemed like the implication was harsher than what you’re presenting.
With the police grading section he even mentions that he commends the police for managing to stay calm from her “vulgar remarks”.
Bottom line is if he gave her an F for not breaking the law, but instead for being a garbage human in that moment, it would show that ATA is thinking emotionally, instead of from a legal perspective for his grading of her.

I'm a recent subscriber and recently have watched many of your videos. I find them very informative and you do a great job narrating the police encounters and explaining information in a way that's easily understood. You do a great public service making these videos and I personally appreciate the work you do. Maybe it's just me, but sometimes it seems that some of the people that shoot these videos saying they are just "exercising their rights" are intentionally trying to get a rise out of the police. I understand why it's important for people to exercise their rights and challenge the police's knowledge on law and the constitution to teach others who may not know better what rights they have and how to not let government officials violate those rights. Its just to me some of the people featured in your videos are using "exercising their rights" as an excuse to give the police a hard time while they intentionally antagonize them using profanity and insulting speech. They could get much better results staying calm and trying to do things in a way that could be a benefit to all parties. Its like they intentionally want to anger the police into breaking the law or violating their rights.

Accusing someone of killing their wife, and publishing that accusation on the internet would be grounds for a lible case. It wasn't a statement of opinion rather than fact nor a "fair comment and criticism" ... which means she would have to prove it was true. Texas recognises that Allegations or imputations of crimes of moral turpitude are categories of false statements that are so innately harmful that they are considered to be defamatory per se. In the common law tradition, damages for such false statements are presumed and do not have to be proven.

The idea of "fighting words," or words being too offensive to even utter under the guise of "keeping the peace and morality," is completely contradictory to the supreme court upholding that hate speech is free speech, and if saying things specifically to upset people isn't considered free speech, then what the woman said about the sheriff's wife shouldn't be protected by the first amendment, per the court's logic. It's silly, it should all be free speech. The only example of fighting words should be direct instigation, such as egging someone on (e.g telling someone to swing first), not saying something that may be considered offensive. What is offensive to someone is entirely subjective.

IMO, I don't think the sheriff would have hit her regardless of deputies being there or not. Someone putting their hand into a fist can also be a stress-induced habit. It doesn't necessarily have to be an indication that someone is about to become violent. It's like clenching your teeth or using a stress ball. The act of causing pressure as a way to relieve stress is typical behavior. Plus, I have to commend him for his professionalism. How many of us could honestly say we would have taken, "you murdered your wife" well in his situation? That's extremely insensitive and an intentional act to cause emotional distress. He has to live with that accident for the rest of his life. He has to wake up every day without his wife beside him and briefly think was I the cause of that? I cannot imagine the personal torture he has more than likely put himself through every single day.

I don't know what is up with people screaming out their ideas over what they think that their rights are like if they are louder they are right, especially with females it seems, IMO. Honestly, she is lucky that it was a sheriff she said that too, because a civilian may have put their hands on her for such a gross statement after she was rude and hostile raising tensions. and to be honest, even though, outside of self defense, I don't believe in putting hands to a woman, for a situation like this, part of me would feel like "you reap what you sew." I give the sheriff a lot of credit for not going there and listening to his deputies. there is a huge difference between a 1st amendment auditor and someone who constantly baits officials into doing something wrong. and this is all from the video.
