Yes they were. However at the time it was sold as residential even though it was actually zoned Comercial. They had plans to do an air bnb. Which would have increased the the price. They were made a residential offer. Which was an incorrect offer. The city did not take into account revenue that would be generated.
@@ValerieDee123 Unless they have a proven record of rental income the property generated, saying they were going to make a lot of money with it by renting it out on air bnb will not carry any weight in court.
@@ValerieDee123 The property doesn't even have deeded frontage on Ogle Drive. It has an access easement for a driveway. Commercial land is highly valued, in part, related to its road frontage. With setbacks and everything it would make a pretty lousy commercial property despite it being zoned for such. Its highest and best use, in my opinion, would be as a STR (had it not been taken via eminent domain). Yes from what I have read (comments) on some of the previous videos, they were offered X amount of dollars. That offer was refused by the Races because it did not account for the potential rod it the home was to bring on the future and it did not account for the pricier all purpose land use zoning as opposed to a regular non commercial zoning.
Would this be a path to a resolution? I believe Mrs. Race has mentioned that the Races pay a mortgage payment each month. Maybe the Races paid cash for the home? I don't know. BUT---a LENDER (Bank? Mortgage company?) would not have lent money for purchasing the building/property unless there was a clear deed on it (Assuming that the building/lot were used as the COLATTERAL for the loan.) SO, the lender is in as deep, or deeper, than the Races, who, for example, could declare bankruptcy to get out from under the mortgage in bankruptcy court---assuming they don't have enough equity in the home for the court to EXEMPT according to Tennessee Bankruptcy Exemptions. I'm not suggesting that the family file bankruptcy, but rather that the LENDER is a victim as the Races are, so BOTH together would take legal action against the town/mayor. And generally speaking, a bank has more firepower in the form of lawyers and litigation than your average individual homebuyer. Perhaps a reader here who is familiar with real estate financing could weigh in here.
I’ve done appraising in eminent domain cases. I’m sure they’ve were offered compensation but they probably don’t agree with the valuation. If they don’t agree with the compensation offered, they need to get their own lawyer and appraisal(s) and present their case in court. All this bellyaching on TH-cam will get them nowhere. Courts don’t compensate in eminent domain cases for anything other than actual value of the property. They can keep dragging it out if they want but they need to resolve it so they can get on with their lives. It’s just a vacation cabin. It’s not like it was a generational homestead where their family had a long history. It’s not even their primary residence or business. It’s a little cabin. If this lady spent half the time she spends in making videos on moving the process forward, she would have her compensation by now. It’s like she is enjoying making a big deal out of it and playing the victim.
Local news just did a story on this. Apparently the mortgage was paid off by funds held in escrow by the city. The city approved the route in November 22, 2021. The Races bought the 1047SF home for $306,000 on August 17, 2022 nine months after the route was approved. The city offered them $490,000 for the property in October 2023.
