- The plaintiff was making a right turn when the defendant struck him on the side of his vehicle. The defendant and his insurance company refuse to pay, so the plaintiff is suing. The defendant argues he had the right of way, and the plaintiff is at fault.

I know! Blue Book value is for used sales car lots because they sell way over Blue Book beyond the costs of running the lot.

It kills me when people rely solely on Kelly Blue Book to determine the value of a vehicle. Blue book is a guide for banks to determine how much money could be lent for a particular vehicle as equipped. Moreover banks arent going to lend 100% of a vehicles value, they're gonna lend about 80%. The difference the buyer makes up as a down payment. The Blue Book is not the Bible.
A 4wheel drive heavy-duty pickup is not going to bring the same price in New York City as it would in Odessa Texas. Also there are some soft market cars that can be aquired for less than wholesale Blue Book, but sell for close to what Blue book says is market value.
Best way to estimate a vehicles value, is to search the ads and find a vehicle that is the same make, kind and similar condition as yours and see determine from the seller what the lowest offer they would take for the car. The litigants in a court case should bring these findings to court with them as evidence.

5:20 There is absolutely NO WAY that this would be the Plaintiff's fault. Because even if the P was too far forward, he would have to be all the way into the second lane before the Defendant would hit him in order for Defendant to be innocent. Defendant must turn 90 degrees. Legally that's his obligation. Nobody does this but that's the law. That damage on the car shows that the front left corner of the Crown Vic is destroyed, D swooped in too sharp.

Defendant is one of these guys that doesn't really want to slow down when he makes his turns so he starts the turn way too early and wants to clip the apex of the corner... except there was already a car there!

6:10 I have had situations where I am in the middle of making the turn and the car that is stopped moves forward, forcing me to have to swerve farther out. Then I will blast my horn because they will have gone past the stop line on the road. Only then would it be Plaintiff's fault.

This was very similar to an accident I had 5mph max still ended up in acute injury ward for 1 month with numerous broken bones caused by the seat belt. Almost died from a heart attack due to severe injury to my lungs. You don't have to be at speed to cause injury or death when a vulnerable person is in a car. Please drive carefully everyone. .

1600 bucks is a slap in the face. He should've went to Judge Mathis. He wouldve understood the value in a classic. Blue book value shouldn't automatically come in to play if the vehicle can be fixed no matter if its more or not. It needs to be back in the condition before the accident. He can't buy another one for 1600. Those older cars are selling for thousands even in okay condition.

State farm screwed me with my car too. And truck backed into from a parking spot and they found that he wasn't at fault. Figures since that's the only time I didn't call the police. I figured it was obvious
The judge got it exactly right. The defendant was in a rush and tried to hastily turn to beat oncoming traffic and he was being a bit reckless, didn't stay in his lane, and hit the plaintiff. People need to learn to arc their left turns properly and be patient, and not act as if nobody on the road matters but them. Can't tell you how many times I'd be making a right from my residential side street onto the busy, undivided four-lane street and someone turning left onto my side street coming towards me almost hit me because they were in a hurry to beat traffic.

None of our TV judges use Kelly Bluebook values properly, because the values listed are ONLY meant to be SUGGESTIONS, creating a starting point for negotiating a final price, and thus are highly subjective and subject to individual scrutiny based on personal preferences. And YES Judge, the better a vehicle looks aesthetically, and the better it was maintained mechanically, has a HUGE impact on the value of a vehicle to any particular buyer. In other words, a car's value is ALWAYS in the eye of the beholder - NOT in Kelly's Bluebook.
In light of this, I'd say that the plaintiff's car was worth all of what he was asking for it, as long as it was kept up mechanically, as well as it obviously was taken care of aesthetically - especially for a car of its vintage (coming into "Classic" age) which is NEVER reflected in price guides for vehicles of this age, which by the way, was painfully ignored in this case.
This is why CCTV should be on every public road. There would be less liars.

The defendant did forgery on the document, but I do believe that the plaintiff did put her in a bad situation with her husband. Some Caribbean men especially Guyanese and Trinidadian men can be really abusive at times.
Left hand turns are the cause of most accidents. I have a friend from New Jersey that said there are no left turns in New Jersey.
That car looked like it was in perfect condition. There’s no way you could buy one anywhere close to it for $1300! She lowballed him. What he should’ve done was brought actual sale comparisons like an insurance company would accept when valuing a car.
