Causing a Dog's Death

  • The plaintiff lost her precious dog to a heart attack after the defendant's unleashed pit bull attacked him, so the plaintiff is suing. The defendant felt horrible about the attack, but the plaintiff's dog was 16 years old and suffering from liver cancer when it happened. The defendant doesn't feel responsible for a very old dog dying.

Irresponsible dog ownership is the entire reason that everyone in this case suffered. The plaintiff, her sweet dog, and the defendant's dog. ALL because the defendant didn't take care of her ownership responsibilities. And at the end she STILL thinks she shouldn't have had to pay for everything. Very sad, and I'm sick of seeing dog owners like this be idiots.

I have a large strong dog, and he has big teeth. Regardless of how much training I have done, I know for a fact that if he wanted to harm something - he could. He has a great temperament and has never tried to bite. However, if he tried it would be hard to stop him. Being a responsible pet owner means that you understand what your pet is capable of and use precautions to ensure safety for both your pet and others around them.

I've had two Malamute timber wolf crosses.
We knew what we had, and they were never off leash.

Exactly, that's how everybody should think. I own a Rottweiler now. Before her I had another Rottweiler and a Tosa Inu. I know what they were capable of and didn't take the risk. Leash and muzzle every single time we went for walks, even before the new laws came in effect here. It's lucky that in the States you only have a Leash Law to follow. In my country the state has classified the dog breeds according to their disposition for aggression. Group no. 1 are considered the most aggressive and has the exact breeds you might imagine: Pitbulls, Rottweilers, Tosa, Mastiffs, Cane Corsos, some of the big Shepherds etc. By law, we who own these breeds are required to register them with the local Canine Associations and also the Police, so there is an evidence of them. Also, it is forbidden to walk them in public without a leash and a muzzle, irrelevant of how friendly they are or we risk huge fines. But most important, this measure saves the lives of other animals. So it is shocking to me when I see these cases where they are required to do the minimum and leash their dogs 😮 That's it, all she had to do and those poor pups would be alive today. Smh .

@humansparkler Irresponsible for those who don't understand the breed they have, but if you need a guard dog, what are we supposed to get? A Duchshund? I live alone with my 74 year old mother, and half of the day I'm at work in an area where we've had breakins. The responsible and logical thing is to get a guard dog that will discourage any attempts. The important thing is to understand the breed you have and prepare accordingly.

Lady with pitbull was so negligent knowing her dog had got out a number of times and the last time enough. She did the right thing putting it to sleep, she knew..she had to. Most pitbull owners are in a delusional world of their own, excuses and sob stories of "my dog would never" ect. So i actually applaud her for taking accountability, showing empathy, driving the lady to the vet, paying that first vet bill and then coming to the conclusion on her own she had a unfit dog. Give credit where its due. But it all could have been prevented. The saddest part is an innocent little dog minding its own buisness, in his golden years, died in such a way. Sad case. Sad for all.

The level of damage they can do makes them more dangerous than an average dog that is not a bully type breed.
Im also tired of people saying its how you raise them, because that is not true as a general statement. Genetics play a huge part in animal behavior.
Most people, ESPECIALLY those who rescue, have no idea how their dog was bred.

That's so sad the dog had a heart attack and died after being attacked, I, myself have a senior English bulldog that has medical issues she's my baby I don't know what I would do without her so I sympathize, some people are irresponsible dog owners they shouldn't own any. Although I sympathize with the fact that she had to euthanize her dog and that she has children she should have kept her dog on a leash to begin with. People need to start taking responsibility.

One day, he escaped the owner's backyard and reeked havoc on the neighborhood.
Someone called animal control and when they came for him, he jumped up and bit the ac officer. After which he retreated back to his own garage and had a standoff with 2 ac officers and a cop. 😅
Eventually, his owners came out to see what alll the ruckus was about.
Animal control wanted to confiscate him, but his owners refused to hand him over and harbored their fluffy fugitive.
They ended up going to court over it and had to pay a bunch of fines, but Snowball lived to see another day!

I had a client with a Standard poodle, one day we were training out in his front yard with the dog on lead when his neighbors pit bull came barreling down the street towards us - I'm saying "let's get your dog inside", the owner said "I've fucking had it with that dog" and turned his St. poodle loose.
That poodle did a dance around that pit bull like nothing I've ever seen - it was so fast and so agile; bite a leg, leap over its back and bite another, dash around and a bite on the butt, fly over the top of it and bite a front leg ... after 10 seconds of this the pit bull beat feet back home with the poodle hot on his ass. Funniest (and luckiest) thing I've ever seen.
Now if that pit bull had of gotten ahold of that poodle ... different story, poodles have twigs for legs, but that dog was so damn fast the pit didn't know what hit him. I know he had some serious punctures.
After the poodle came back from chasing him home, the owner tells me that the pit bull belonged to our town mayor 🤣, said it had been tormenting the neighborhood for 2 years and the mayor knew it and wouldn't do a thing about it. After that day, I was told the pit bull was never seen running loose again!

I feel bad for both dogs. The defendant was already on notice from her own admission that her dog was not being contained properly in the garage and multiple times over the back fence. The time for her to do the right thing was when she realized that she had no control over her pet getting out, and she should have put it up for adoption. But she was irresponsible and let it continue and now 2 pets are gone. Get the kid a Gerbil if he needs a pet. I've never heard of a Gerbil slipping under the garage door and killing a neighbor's dog.

No denying that 16 is getting up there, but apparently the defendant is unaware of the dog that had its (confirmed) 31st birthday before passing away last year.
While it doesn't happen often, dogs seeing near 20 is not out of the question. I've had two that saw 19 and in good health (for a 19 year old), I've met a number of OLD dogs in my day.
Even if that Dachshund only had a year left (and it didn't have cancer, that was made up by the defendant), what dog owner wouldn't relish in every moment of that year? And who's to say it wouldn't have seen 2 or 3 more years?
To refuse to pay the vet bills because the dog was old ... what a douchebag. She cost two dogs their lives, since it didn't seem to hurt her conscience, it should at least hurt her wallet.

    • @JamieM470
      @JamieM470 5 หลายเดือนก่อน

I agree 100% on everything you said. That poor little dog would have lived at least another year or two--maybe more, and when he died it should have been peacefully in his sleep. Not traumatized, in severe pain, and suffering. Awful.

Ughhhhhh. I hate these cases for pit bulls. I’ve had pit bulls and they never harmed another person or animal. I took great care and responsibility to make sure of that, which is what we are all supposed to do. My most recent dog, a yellow lab named Czar❤rip, was 90 lbs and was not fat at all lol he was a stocky, cocky little brat and I did not trust him with other animals. Knowing my dog, I took extra steps to keep him safe and the world safe from him. Not rocket science people!!!! I really dislike bad pet owners! It’s disgusting and negligent.

This case is just crappy all around. It could have been prevented if the defendant had her dog under control. Having said that, this whole situation is crappy. I don't think the defendant is a horrible person. She truly felt awful about what happened. She took responsibility after by having her aggressive dog euthanized (a decision that is not easy at all). As a veterinarian, the decision to put the dog down was 100% the correct decision. Yes, you can say that the defendant should have just paid the bills without needing it to come to court, but I also don't blame her for wanting that mediator given the dog was older and had some underlying health issues. Especially given the dog had been improving and then declined, how is anyone (but the vet caring for the dog) to know if the dog passed from the injuries or the underlying cancer. Liver cancer could also cause the dog to not eat, feel crummy and pass away.
Those wounds inflicted on that little dog are awful, it caused so much skin and tissue to die and slough off. It takes weeks to months to heal wounds like that and during the entire healing process the wounds are at risk for infection. I am glad Judge Milan called the vet to get a better understanding of what happened and what the dog passed from to make a decision here. That is what needed to happen.
The hurt present in this case is just insane. Both the defendant and plaintiff lost pets. Both witnessed a dog attack which if you have never witnessed one, I hope you never do, it is horrendous. There is definitely trauma after witnessing a dog attack, so both parties are dealing with that. Just a crummy case across the board.

I feel so bad for both plaintiff and defendant because no one won in this case. I know how HARD it is to put a dog down I’ve done that myself with my dad because our dog was old and was suffering. Yes the defendants dog got out many times and sometimes that happens, both my beagles have got lose from their chain they was on and I went and got them asap and no one was hurt thankfully, sometimes dogs get out and bad things happen and sometimes nothing happens. At least the defendant wasn’t a jerk, most people would be like so what and not give too shits and not help unless forced by a judge. I’ve seen too many of these court cases where the persons dog got out and hurt another dog and that person was like whatever. I feel bad for both ladies and their dogs. I don’t like how the judge was giving the defendant crap, it’s not like the defendant was being a jerk and the defendant didn’t even complain like why scold the defendant, like I said I feel bad for both ladies and their dogs 😭

People ahould have to get permits to own large breeds fr, they should have to take a course about safety and training. They should have to get the dog trained and pass a test every so often. Its wild that just because its a "domesticated" animal, regardless of being highly specialized breeds, anyone can own them.

I do not think the judge is considering the dog as property. If that was her thinking the plaintiff would only get the value of a 16 year old dog which is not $5000. This would be the equivalent as the defendant severely damaging a 16 year old car worth about $500 and the defendant being awarded $30,000 to fix it. You never see that in these cases. The maximum amount awarded for auto damages only the current blue book value.
