Senior Editor Telakapalli Ravi discusses with Senior Advocate Pattabhi Vemulapati on The Supreme Court adjourned the hearing of the quash petition filed by Chandrababu Naidu. On Tuesday, October 3, the Supreme Court rescheduled the hearing of the petition filed by former Andhra Pradesh Chief Minister Nara Chandrababu, seeking to quash the FIR in the skill development scam case, to the following Monday, October 9. The Court instructed the State to provide all the documents filed before the High Court and set the date for the matter as 09.10.2023. During the approximately 50-minute hearing, the focus was primarily on discussing the applicability of Section 17A of the Prevention of Corruption Act, 1988, to this case. The bench raised questions regarding whether Section 17A of the PC Act applies when the offense was committed before the 2018 amendment that introduced Section 17A. The bench also inquired whether Section 17A applies when the FIR includes not only offenses under the Prevention of Corruption Act but also offenses under the Indian Penal Code. Naidu's legal team argued that Section 17A is applicable if the inquiry begins after the 2018 amendment, even if the offenses occurred before it. On the other hand, the State contended that the inquiry had commenced before 2018.
