I am staying in apartment and paying regular monthly maintenance amount to unregistered association but association management people were not doing proper maintenance like cleaning garbage regularly and eventhough they are not performing their duties, I hve complained to the association members many of times but they didn't responded now I am planning to sell my flate but due to this worst maintenance because of this no one is comming farward to buy my flat and causing financial loss and mental agony to me and also they are demanding me to pay monthly apartment maintenance amount if not they were threatening me that they will disconnect all my essential needs like water and power. So for this to whom I need to complaint

Opening a bank account and registering an association for your apartment complex can be beneficial for managing shared expenses, maintenance, and communication. Understanding the reasons behind the current hesitation of your neighbors is crucial to finding a solution. Here are some steps you can take:
      Investigate the hesitation:
Talk to individual neighbors: Have open and honest conversations with a few residents, particularly those who expressed objections, to understand their specific concerns. Are they worried about costs, responsibilities, or misuse of funds?
Gather information: Check past minutes of any informal meetings or notices posted regarding association formation. This might reveal previous attempts and reasons for their failure.
      Address the concerns:
Clarify benefits: Explain the advantages of having an association and bank account, such as shared responsibility for repairs, transparent financial management, and easier collection of maintenance fees.
Address specific concerns: If someone is worried about costs, provide estimates for association fees and potential cost savings through group negotiations. Address any perceived risk of misuse by proposing clear accounting practices and signing authority regulations.
      Take appropriate action:
Seek legal advice: Consult a lawyer specializing in cooperative housing societies for guidance on the registration process and any legal requirements in your city/state.
Propose a formal meeting: Gather all residents through a written notice and propose a formal meeting to discuss association formation and bank account opening. Ensure the notice includes the agenda, date, and time of the meeting.
Prepare documents: If the majority agrees to proceed, have the lawyer draft the necessary documents for association registration, including bylaws and nomination of office bearers.
Open a bank account: Once registered, choose a bank and gather required documents (association registration certificate, PAN card, authorized signatories' KYC details) to open a bank account.
      Additional Tips:
Be patient and understanding: Change can be met with resistance. Address concerns respectfully and encourage open communication.
Start small: If residents are hesitant, propose starting with a simpler structure like a collection system for common expenses before forming a full-fledged association.
Seek external support: Contact your local housing authority or relevant NGOs for guidance and resources on forming an association.
Remember, forming an association and opening a bank account requires collective effort and cooperation. By addressing concerns, providing information, and taking a step-by-step approach, you can encourage your neighbors to participate and create a better-managed apartment complex for everyone.

Thank you for your question! Common areas in an apartment, including corridors, are shared spaces for all residents. You are allowed to walk and use these areas freely. It's important to respect the rights of other residents and follow any specific rules set by the apartment association. If you have further questions, feel free to ask!

Thank you, Rajesh! 20 flats unna apartment ki society ela form cheyalo cheptara?

    • @vmrdaproperties

Forming a society for an apartment with 20 flats involves several steps and requires careful consideration. Here's a breakdown of the process:
      1. Initial Meeting:
Organize a meeting with all flat owners.
Discuss the need for a society and its potential benefits (managing common areas, security, maintenance, etc.).
Elect a temporary committee to lead the society formation process.
      2. Draft Memorandum of Association and Bye-Laws:
The temporary committee, with legal assistance if needed, drafts the society's Memorandum of Association (MoA) and Bye-Laws.
MoA outlines the society's name, objectives, and registered office address.
Bye-Laws define the society's structure, membership, elections, financial management, rules for common areas, dispute resolution mechanisms, etc.
      3. Membership and Share Capital:
Define membership criteria and encourage all flat owners to join.
Determine the share capital and how it will be allocated among members (usually based on flat size or value).
      Collect initial contributions from members.
      4. Registration:
Apply for registration of the society with the Registrar of Societies under the relevant Societies Act (varies by state in India).
Submit required documents including MoA, Bye-Laws, list of members, and proof of address and share capital contributions.
      5. Elections and Management Committee:
Once registered, conduct elections for the society's first management committee.
Committee members typically hold positions like President, Secretary, Treasurer, and members on various sub-committees.
The committee takes over the responsibility of managing the society's affairs as per the Bye-Laws.
Open a bank account in the society's name for managing finances and receiving membership contributions and maintenance fees.
Decide on service providers for common area maintenance, security, etc.
Set up a mechanism for resolving disputes within the society amicably before resorting to legal means.
Maintain transparency in financial management and communicate important decisions to all members regularly.
Refer to the relevant Societies Act in your state for detailed registration procedures and requirements.
Utilize readily available model bylaws provided by government websites or legal resources, adapting them to your specific needs.
Consulting a lawyer specializing in property and society formation can offer valuable guidance throughout the process.
Remember, forming a successful society requires active participation and cooperation from all residents. Encourage open communication, transparency, and collaborative decision-making to build a well-managed and harmonious community within your apartment complex.
I hope this information helps you and your fellow flat owners form a strong and effective society for your apartment.

the eligibility to participate in the association elections will depend on the association's rules and local regulations. If in doubt, consult the association or seek legal advice. Good luck with the elections!

      @vmrdaproperties  6 หลายเดือนก่อน

Generally, apartment associations may have guidelines or policies regarding renting out flats to ensure the well-being and security of the residents.
Whether you need permission from your apartment association to rent your flat to a bachelor tenant depends on the association's rules. Check the bylaws and consult with the association. If no permission is needed, you can decide independently but inform the association to maintain good relations.
