A big problem because those breeds are intelligent and often used as guide dogs for blind people as well. the dog has to be strong enough to stop their human from moving forward when there is danger. Stupid people just need to get over themselves!
Wrong. She did right by contacting the ADA. I am also a veteran from the U.S. Army, and I have a service dog. He doesn't wear a vest, but I do carry my Dr's perscribed note, shot records, and a copy from the Linn County Animal Control that states he is a registered service dog.

They mean something on the state level, and since a restaurant is subject to state laws, it can be applied within the state the tag is for... It isn't a requirement though... Hence why they are voluntary... You can still use the standard "yes, this is a service dog, and it does x y z task".

People that walk around with these larger service dogs because their scared or whatever fear they have, causes me fear. I'm not doing anything to them, but they are certainly doing something to me. It is illegal when the establishment refuses service based on gender, race, disability, etc. That is federal law. By refusing the woman due to the service dog, the restaurant discriminated against her disability. Therefore, that action is illegal.
It's against Federal ADA and state/provincial law to even ask for such things Nathan! The Americans With Disabilities Act has been around since 1990 and the Ontarians with Disabilities Act has been around since 2005.
It's good to see someone who doesn't "just want an apology" and filed an ADA violation complaint. Most states have a Civil Rights Commission of some sort that will be much more proactive than the DOJ, which takes on average 3 years to get down to nailing violators. The DOJ also tends to wait for multiple complaints on the same business to show a pattern of ignoring the law. State offices will be much quicker and often just as nasty.
I want to say thank you to the Vet that stood her ground. I would like to share an event that happened to me. I am also a disabled vet. with a service dog. I purchased round trip bulkhead window seating 3 months prior. On the 4th and final flight to home USAir gave my seat to another USAir employee and moved me to the location you will see if you search for Disabled Veteran kicked off USAir or Man removed off plane over service dog dispute. The floor was to small of space and the bars under the seat in front of my 80lb dog was absolutely dangerous. USAir had me arrested. The Arizona Judge DISMISSED the charges, I committed no crime. Please I would like to here your comment.

Typical in Florida. Up in Ocala I was eating at Yamoto one say with my daughter. We were the only people in the resturant at the time. A couple came in and the woman had a service dog. His best was clearly marked 'Diabetic Alert Dog". The manager met them halfway across the restaurant and proceeded to give them a hard time. He eventually directed them to a table all the way hack in a corner. When they said they didnt want that table I heard him say he couldnt have his customers being bothered by the dog and if they didn't take the table he told them to take tgey would have to leave. Eventually they left. We were leaving anyway so I followed them outside and spoke wuth them at length about it. The lady said he tried to kick them out but when they refused he tried to stick them in the corner. I went back and confronted the manager. I told him he was risking a hefty fine and even a lawsuit because it is illegal to discriminate against these people and the dog. He tried to say that the table they were insisting on was dirty and he hadnt had time to clear it which is why he wanted them at the other table. So I responded : "Yeah? That's my table and until 2 minutes ago I was eating at that table so quit your lying. I dont know if she's reporting you but I am. Have a great day. Enjoy your fine." People just dont get it.

"The great news is, it doesn't happen very often" It happens ALL the time. Me and my service dog have gotten kicked out of many places that I fined after. It's so upsetting to see things like this, there's not much respect for SD teams and there's such bad rep around teams which is awful.. and if they let in non service dogs all the time then why not accept a service dog that has permission to go ANYWHERE where the handler is???? It must be breed discrimination. I hate people so so so much.

I know that "lost" feeling. I have two service dogs. One is my ears and knows when Im having a vertigo attack coming from my Miniere's and alerts me to that and stands guard, and the other retrieves things for me that I cannot bend to get beyond the metal attached to my spine, and lays on me, or next to me when Im having a vertigo attack. I think the problem people might have, is that my boys are big. I have a Lab/Border Collie mix, and a Great Dane/Pit mix. The Lab retrieves, and the cow hears, lol! He has the biggest ears, lol!! I love my four legged boys!

the people with "papers" are the ones with fake service dogs :( its a common scam and sadly many fall for it. You search on the internet for a site about service dogs and some sites offer a "sertificet " for service dogs for a fee, people who have not reserched AND belive that you need these papers(or people that just want the convenience of having their dog been granted access everwere, pay for them) This hinders people who have "real service dogs" from getting their rights.... and its discussing sadly its a verry growing problem.

They can not ask for papers or make her leave if the dog is under control. She can not file a complaint with the ADA as it's a set of laws not an agency. She has to file a complaint with the department of justice. as this is a civil rights violation.

I did exactly that when I was denied a ride with my service dog on a city bus in Deadwood South Dakota. I was told by the DOJ (civil rights division) to sue the city, they weren't going to do ANYTHING about it. All I wanted was for the DOJ to write a letter to the city of Deadwood warning them about their unlawful actions. They couldn't care less, and it's damn near impossible to sue from across the country (I live in Virginia).
Establishments need to know the law. Those with service dogs are allowed. Now on the subject of "emotional support animals," that's a lot more of a gray area.
Apparently on the ADA website it really isn't a mandatory acquirement for your dog to be registered. But what I don't understand is why just allow almost anyone to claim "emotional support" for "said" person? I can see these services being used haphazardly.
Its sad when people just buy these vests online for their pets and claim they are service animals. It ruins it for people like Shelly who really do have a true service animal. That might be why the restaurant would be skeptical, but it doesn’t make it right for them to do what they did.
I want to to say Thank you for your service to this vet and to his service dog. I am very sure that his dog is intelligent enough to know the short comings of the restaurant owner.
My opinion if it’s a restaurant or a bar you shouldn’t have a service dog or a dog. If it’s a lazy dog when you can bring your dog ok but nobody wants to eat in a restaurant with a dog next to them
Your opinion is your own, of course, you are free to have it. But the law disagrees with you. Service dogs may accompany their handler anywhere the handler is permitted to be. Including restaurants and bars.
I totally understand why folks are so done with the “service dog” epidemic, and It is absolutely horrible that those people who really need one are being harassed, but there are scores of imposters out there who are faking it. A visit to a website and a few bucks later, anybody can “certify” a dog as a service animal. That needs to stop.

There was supposed to be follow-up legislation that would have dictated things like training standards, certification, and so on - the initial bill was written in the manner it was "to get it passed" with minimal resistance. That follow-on legislation never came. Same story with Reagan shutting down asylums and taking away the ability to indefinitely confine people for mental health reasons - follow-on legislation was supposed to provide all kinds of community support for the mentally ill and disabled, so they wouldn't just become homeless. It never happened. This is a fine example of how our lawmakers fail us.
I've even had problems at the VA hospital over my dog. The police or gate guards have given me problems and asked what my diagnosis is or why I need them. Blew me away that they didn't even know the laws..... and they're the veterans hospital that gave me the dang doctor's approval to get the dog.
I don't think it's unreasonable to have to carry papers (say, something like a driver's license) for a service dog. If you're handicapped, you need a placard for the special parking, a limp isn't going to be enough. Otherwise, people take advantage all the time. I've seen matronly women carrying lap dogs in their large purses into stores, and when confronted, they say "Service Dog" when clearly it's not. Seems obvious to me that by requiring certification, it solves the problem for everyone. And it's not like the owner has to carry around a sheaf of papers...Heck, if people can show their proof of insurance from their smart phone, why not a service dog certification?
Poor Finian because its really impossible to do that. You would have to test each dog, and each dog is trained to do different things to serve one handler and their disability. Therefore there can't be a "standard" of training. Its very hard to explain, but essentially if there is a real true registration put it place, not as many people who need a service dog would be able to get one/train one and that isn't what we want. And it also singles a disabled person out and basically puts an even bigger "flag" on them than the service dog already does. It's embarrassing to even have to put patches on your SDs vest for some people. You dont ask someone for papers for their wheelchair or oxygen tank, and under the law a service dog is categorized as medical equipment so there cannot be a registration. It is very easy to spot a true service dog though by how it behaves, and if any dog, true service dog or not, is acting up in public it can be asked to leave
*Poor Finian* Let's see...how do you certify, through unbiased and nondiscriminatory standardized testing, an individual dog trained for a specific person, with a specific disability or set of disabilities when the dog may have been trained by the person it serves? You can't and that's exactly why there is no valid registration, certification, license or ID for a service dog that is legally required or legally recognized.
For anyone concerned: My recommendation is to print out a copy of the ADA and HIPPA laws' relevant sections, especially the parts about the fines. When they ask you for "papers," show them those instead, then tell them if they refuse to serve you, or tamper with your food, you'll be contacting the relevant authorities and filing a complaint. Be direct, be clam, do not be confrontational, but stand firm on your rights. If they're rude or inhospitable, leave, file a complaint, file a personal lawsuit if you like, but make them pay for their transgressions.
It is unsanitary to have animals around food, drinks, and medications and people have pet allergies. So, to hell with everyone else for one woman just because he's a vet?! Absolutely not! She can leave her dog in the car. She does not need it in a store or restaurant.
If you don't like it, eat at home. They have a federally protected civil right to have the service dog with them in the restaurant. You do not have a protected anything to be there free of dogs.

This report was very informative. Everyone should watch it because we could all meet a person with a service dog anytime and know how to treat them respectfully. Hopefully that very horrible restaurant has not put her off from venturing out.
Relies on the honor system? That is the problem. If everyone who wants a service dog accommodation were honest this would not even be an issue. It is the cheats that make it difficult for those who have a real service dog. The law should be changed to require appropriate identification. Now before you get all upset, the licensed trainers should be required to provide you with the necessary documentation. It would not make it more difficult for the user but it would eliminate many of the hassles. The other side of the coin should increase penalties for those that deny accommodation when the animal is properly ID'd. Just imagine if the animal had an approved tag and the woman could have produced the ID for her and her dog. On the reverse side of the card should be printed the appropriate law and the penalties for non-compliance. No arguments, no fear on the establishment's side that this person in front of them is just blowing smoke up their backside. SO you hysterical service dog fanatics, what is the problem with being proactive and making it easier for businesses to understand the law and comply? Sadly so many of you would rather curse the darkness then light a single candle.
wilhard45 - How many times do you need to be told that not all service dogs are trained by licensed trainers before it sinks in? There are too many people who need assistance dogs and not enough training programs, so many people have to train their own dogs or have family members/friends do it. Many people who do this have already had a service dog for years and know the training as well as a licensed trainer ever could. The dogs are usually custom trained depending on who is training them and and the person they are being trained for, so there isn't a standardized test like the CGC (Canine Good Citizen, a temperament test) that will work for all service dogs. The training for a dog who warns of oncoming seizues or a drop in blood sugar is nothing like the training of a seeing eye or hearing ear dog, whose training is nothing like a dog trained to assist someone who has had a stroke or is in a wheelchair and on and on. Beyond intensive obedience training, the dogs are trained for a very wide range of disabilities. Some of these are obvious and some aren't, that's just the way it is. That said, if the dog is unruly or disobedient you can ask the team to leave, service dog or not, so I don't see what the big problem is.

I am trying to suggest to you that things like standards and appropriate licensing is required. Want to train your own dog? Fine, then take it to an approved agency to demonstrate that it is in fact properly trained. Your dad can teach you to drive but you still have to take a driving test at your local motor vehicle department. Further, if you have approved documentation of a need and a properly trained animal then there is NO question that you are entitled to everything that the ADA and state regulations provides for.
wilhard45 that's hogwash. Florida Service Dogs, Inc. (a 513c program) provided all their teams with picture ids & vests. Didn't make a difference and when we do file an ADA complaint we don't sue for money, we demand the offenders have to go through training and learn the laws.

I am saying that the laws are poorly written, do not clearly spell out who gets a real service dog and for what reasons or how they are licensed. The laws also must be beefed up so that when a real, licensed service dog (or service dog trainee) is denied improperly that there are real penalties. I have proposed in the past that when you get a business license information regarding service dogs based on the type of business you are operating and specifics about what you must allow and what you can deny. Would you rather fix this problem or just whine? Obvious there is a problem and it is obvious law suits and videos are not going to fix it. Why not get together with others in your field, a lawyer or two and hammer out reasonable legislation that would fix the existing problems and then go find a sponsor in the Florida legislature to introduce the bill? 48 people in the complex I live at has now claim they need comfort animal and a couple need service. If a person needs should be no reason to question.but yes always a but. If you leave your service animal and travel 30/52 days without or no one around that are trained to help with why you need. My question is do you need? Also when your comfort animal is spending 3/5 days at another person place without you. Do you really need? To many people paying internet person to send paper claims need not a physician or psychiatrist. This is making it hard for people that have a real need . time the law correct and stop people that lie.
I am a retired veteran with PTSD, 23+ years and three combat tours and I do not want to sit next to an animal, service dog or not. The lady had her loving supportive husband with her, she did not need her “service dog”.
She has a federally protected right to have her service dog with her in the restaurant. No one else has a protected anything to be there free of dogs. If someone doesn't like it, they can ask to be seated elsewhere, or leave. There are many things that service dogs could do for their handler, that another human cannot do. No matter how loving and supportive her husband is, his capabilities are limited.
Our family has own our restaurant for 4years..on occasions we do get folks with service dogs,we never turned them away and usually the dogs are laying under the table not bothering anybody.
Some service dogs help people with medical conditions without knowing the exact reason a person has a service dog it's hard to judge the dog could be for ptsd or diabetes or for epilepsy but the dog is unable to do its job if it's kept away from its owner.

all you have to say is "its a service animal" I've seen many many barely leash trained dog's walking around the mall's and in variouse places claiming its a "service dog". So called "emotional support dogs" don't need any training at all. Most don't get any and it shows. My point was eventually people with very well trained "emotional support" dogs will loose the privilege. Myself included.
The only two reasons service dog could be denied are if the dog is not under control or not housebroken. So if the dogs start shitting everywhere yes they can tell them to leave. That was already discussed in front of the committee, and it was found to be unfair because the people lining up to certify want 20k a dog... Even 100$ can break a disabled person's budget... That would basically require people who are disabled to register with the government about their disability and many people are uncomfortable about their name being part of a 'national diabled person list' which could happen, even though its unlikely. Additionally many disabled people will not have the resources to jump through the hoops to get the registration tag because it would require some form of assessment of their dog which requires money and travel and all Erin P

This is Infuriating to me, I dont care if this post is 2 years old, Lakeland, Fl is a town near where I live, as a fellow service dog handler and person who is disabled, businesses need to educate there employees about ADA rules and federal laws... my health over the last 2-3 years has gradually worsened due to Lupus and other comorbid autoimmune conditions.. we rely on our service dogs daily in order to function on a somewhat "normal" or near normal level.. Now if the service dog is causing a comotion or is being unruly then yes the SD team can be asked to exit the premises...

This restaurant needs to be charged!!! The Ada needs to start charging these restaurants that are, not training their employees and violating the law!!!! It clearly states PTSD and emotional support animals are NOT service animals. It's also a criminal offense to pass a dog on as a service dog when it's not.

i am not a vet but i to have a service dog his name is foster and he is a red terrier he helps my PTSD and depression ignorance and evil are both in the same sick too vets getting treated like this after all they have done too protect us they deserve protection too! people who think mental illness inst serious needs a serious reality check just imagine how bad it is it is really hard living with the medical conditions i have and sadly vets are turned down for almost everything not just service dogs its a damn shame a vet cant get help or go somewhere without being told to leave
Brought my service dog in to a place called Rohndas here in TN. He didn't have his vest but I told the owner when she approached, that he was service. She demanded we either leave or put him in the car. I told her she wasn't allowed to act that way at all and she demanded we just leave. All because her stupid store also was a little diner. I was just there to get a bottled water....

Doesn't make sense. They can ask "what is the dog trained to help you with?" but they cannot ask your disability...uh, does not make sense lol, they get the same info in many cases.
Not really. They can ask what tasks the dog is trained to perform. Could be, Retrieval. Opening doors Balance. Alert. Distraction. Things of that nature. All of which answer the question, without giving away what the disability is.

If a service dog becomes out of control and the handler does not take immediate corrective action to get the dog back into control, then the business can legally have the handler remove the animal. That is why even if someone can lie through the 2 questions allowed for SDs, it doesn't matter if their dog isn't behaved and keeps in control. While allergies are not a valid reason to deny service/access to someone with a service dog, they must accommodate both parties, which usually means sitting people apart while inside the business. Allergies to dogs are almost always none severe anyway...if someone is so severe that sitting far away from a dog is a problem, then they would have the same problem regardless cause people have dander all over themselves and their belongings like their purse or cellphone.
Also, allergies to not a valid reason for a business to discriminate against service dog teams. No one is forcing the person with the allergies to stay there, go near the dog, or touch the dog.
My son has both a service dog & service rat, they work as a unified team for many of his special needs. The dog is more for physical while the rat is seizure warning. Once he detects an oncoming seizure he'll let out a 3 squeak alert which sends the dog into ready mode. Most people are very accepting & mostly curious. I never miss an opportunity to educate someone, especially misinformed people. Unfortunately, too many are misusing & abusing these laws & using fakes. My son's dog was almost attacked by a fake.
Ur son does not have a service rat. Rats r not service animals. U yourself r actually misinformed. And in some states, labeling a pet as a service animal when it is no, is actually illegal. And u can also get in trouble for taking the rat into non pet friendly locations. And business do have the right to have the rat removed from the location.
Actual service dogs are needed and should be protected by law. But, I think the law should change to require to show proof that it is an actual service animal. Too many people are saying that their pets are service animals, when they are not.

Thanks, Jacob D. People need to have more education on the subject. I know that there are people out there who use fake service animals to access public areas. And that makes it hard for people who actually have disabilities to take their dogs out in public and not get harassed about it.

Wrong. She did right by contacting the ADA. I am also a veteran from the U.S. Army, and I have a service dog. He doesn't wear a vest, but I do carry my Dr's perscribed note, shot records, and a copy from the Linn County Animal Control that states he is a registered service dog.
Main Street Boxer well actually depending on state you are in, there are voluntary registrations... They mean something on the state level, and since a restaurant is subject to state laws, it can be applied within the state the tag is for... It isn't a requirement though... Hence why they are voluntary... You can still use the standard "yes, this is a service dog, and it does x y z task".

I'm on the other side. I was bitten in the face at 5 years old by a German Shepard and had to have several surgeries. To this day (I'm 55) I have an incredible feeling of fear around medium to large dogs. People that walk around with these larger service dogs because their scared or whatever fear they have, causes me fear. I'm not doing anything to them, but they are certainly doing something to me. To be clear, I served 21 years in the military and have gone to years of therapy, but that overwhelming fear of those types of dogs has never left me.

It is illegal when the establishment refuses service based on gender, race, disability, etc. That is federal law. By refusing the woman due to the service dog, the restaurant discriminated against her disability. Therefore, that action is illegal.
The reason that they gave for not letting her in was ridiculous simply because they don't need papers to give access to her or her dog.
Either prove it's a service dog or I'll see you in court.
It's against Federal ADA and state/provincial law to even ask for such things Nathan! The Americans With Disabilities Act has been around since 1990 and the Ontarians with Disabilities Act has been around since 2005.
It's good to see someone who doesn't "just want an apology" and filed an ADA violation complaint. Most states have a Civil Rights Commission of some sort that will be much more proactive than the DOJ, which takes on average 3 years to get down to nailing violators. The DOJ also tends to wait for multiple complaints on the same business to show a pattern of ignoring the law. State offices will be much quicker and often just as nasty.
I want to say thank you to the Vet that stood her ground. I would like to share an event that happened to me. I am also a disabled vet. with a service dog. I purchased round trip bulkhead window seating 3 months prior. On the 4th and final flight to home USAir gave my seat to another USAir employee and moved me to the location you will see if you search for Disabled Veteran kicked off USAir or Man removed off plane over service dog dispute. The floor was to small of space and the bars under the seat in front of my 80lb dog was absolutely dangerous. USAir had me arrested. The Arizona Judge DISMISSED the charges, I committed no crime. Please I would like to here your comment.

Typical in Florida. Up in Ocala I was eating at Yamoto one say with my daughter. We were the only people in the resturant at the time. A couple came in and the woman had a service dog. His best was clearly marked 'Diabetic Alert Dog". The manager met them halfway across the restaurant and proceeded to give them a hard time. He eventually directed them to a table all the way hack in a corner. When they said they didnt want that table I heard him say he couldnt have his customers being bothered by the dog and if they didn't take the table he told them to take tgey would have to leave. Eventually they left. We were leaving anyway so I followed them outside and spoke wuth them at length about it. The lady said he tried to kick them out but when they refused he tried to stick them in the corner.
I went back and confronted the manager. I told him he was risking a hefty fine and even a lawsuit because it is illegal to discriminate against these people and the dog. He tried to say that the table they were insisting on was dirty and he hadnt had time to clear it which is why he wanted them at the other table.
So I responded :
"Yeah? That's my table and until 2 minutes ago I was eating at that table so quit your lying. I dont know if she's reporting you but I am. Have a great day. Enjoy your fine."
People just dont get it.

It's so upsetting to see things like this, there's not much respect for SD teams and there's such bad rep around teams which is awful.. and if they let in non service dogs all the time then why not accept a service dog that has permission to go ANYWHERE where the handler is???? I know that "lost" feeling. I have two service dogs. One is my ears and knows when Im having a vertigo attack coming from my Miniere's and alerts me to that and stands guard, and the other retrieves things for me that I cannot bend to get beyond the metal attached to my spine, and lays on me, or next to me when Im having a vertigo attack. I think the problem people might have, is that my boys are big. I have a Lab/Border Collie mix, and a Great Dane/Pit mix. The Lab retrieves, and the cow hears, lol! He has the biggest ears, lol!! I love my four legged boys!

service dogs for a fee, people who have not reserched AND belive that
you need these papers(or people that just want the convenience

I did exactly that when I was denied a ride with my service dog on a city bus in Deadwood South Dakota. I was told by the DOJ (civil rights division) to sue the city, they weren't going to do ANYTHING about it. All I wanted was for the DOJ to write a letter to the city of Deadwood warning them about their unlawful actions. They couldn't care less, and it's damn near impossible to sue from across the country (I live in Virginia).
Establishments need to know the law. Those with service dogs are allowed. Now on the subject of "emotional support animals," that's a lot more of a gray area.

Apparently on the ADA website it really isn't a mandatory acquirement for your dog to be registered. But what I don't understand is why just allow almost anyone to claim "emotional support" for "said" person? I can see these services being used haphazardly.

Its sad when people just buy these vests online for their pets and claim they are service animals. It ruins it for people like Shelly who really do have a true service animal. That might be why the restaurant would be skeptical, but it doesn’t make it right for them to do what they did.

My opinion if it’s a restaurant or a bar you shouldn’t have a service dog or a dog. If it’s a lazy dog when you can bring your dog ok but nobody wants to eat in a restaurant with a dog next to them

the lack of register is absurd, it allows the system to be easily abused.
There was supposed to be follow-up legislation that would have dictated things like training standards, certification, and so on - the initial bill was written in the manner it was "to get it passed" with minimal resistance. That follow-on legislation never came. Same story with Reagan shutting down asylums and taking away the ability to indefinitely confine people for mental health reasons - follow-on legislation was supposed to provide all kinds of community support for the mentally ill and disabled, so they wouldn't just become homeless. It never happened.
This is a fine example of how our lawmakers fail us.
I've even had problems at the VA hospital over my dog. The police or gate guards have given me problems and asked what my diagnosis is or why I need them. Blew me away that they didn't even know the laws..... and they're the veterans hospital that gave me the dang doctor's approval to get the dog.

I don't think it's unreasonable to have to carry papers (say, something like a driver's license) for a service dog. If you're handicapped, you need a placard for the special parking, a limp isn't going to be enough. Otherwise, people take advantage all the time. I've seen matronly women carrying lap dogs in their large purses into stores, and when confronted, they say "Service Dog" when clearly it's not. Seems obvious to me that by requiring certification, it solves the problem for everyone. And it's not like the owner has to carry around a sheaf of papers...Heck, if people can show their proof of insurance from their smart phone, why not a service dog certification?

Poor Finian because its really impossible to do that. You would have to test each dog, and each dog is trained to do different things to serve one handler and their disability. Therefore there can't be a "standard" of training. Its very hard to explain, but essentially if there is a real true registration put it place, not as many people who need a service dog would be able to get one/train one and that isn't what we want. And it also singles a disabled person out and basically puts an even bigger "flag" on them than the service dog already does. It's embarrassing to even have to put patches on your SDs vest for some people. You dont ask someone for papers for their wheelchair or oxygen tank, and under the law a service dog is categorized as medical equipment so there cannot be a registration.
It is very easy to spot a true service dog though by how it behaves, and if any dog, true service dog or not, is acting up in public it can be asked to leave
*Poor Finian* Let's see...how do you certify, through unbiased and nondiscriminatory standardized testing, an individual dog trained for a specific person, with a specific disability or set of disabilities when the dog may have been trained by the person it serves? You can't and that's exactly why there is no valid registration, certification, license or ID for a service dog that is legally required or legally recognized.
For anyone concerned: My recommendation is to print out a copy of the ADA and HIPPA laws' relevant sections, especially the parts about the fines. When they ask you for "papers," show them those instead, then tell them if they refuse to serve you, or tamper with your food, you'll be contacting the relevant authorities and filing a complaint. Be direct, be clam, do not be confrontational, but stand firm on your rights. If they're rude or inhospitable, leave, file a complaint, file a personal lawsuit if you like, but make them pay for their transgressions.
It is unsanitary to have animals around food, drinks, and medications and people have pet allergies. So, to hell with everyone else for one woman just because he's a vet?! Absolutely not! She can leave her dog in the car. She does not need it in a store or restaurant.

This report was very informative. Everyone should watch it because we could all meet a person with a service dog anytime and know how to treat them respectfully. Hopefully that very horrible restaurant has not put her off from venturing out.
Relies on the honor system? That is the problem. If everyone who wants a service dog accommodation were honest this would not even be an issue. It is the cheats that make it difficult for those who have a real service dog. The law should be changed to require appropriate identification. Now before you get all upset, the licensed trainers should be required to provide you with the necessary documentation. It would not make it more difficult for the user but it would eliminate many of the hassles. The other side of the coin should increase penalties for those that deny accommodation when the animal is properly ID'd. Just imagine if the animal had an approved tag and the woman could have produced the ID for her and her dog. On the reverse side of the card should be printed the appropriate law and the penalties for non-compliance. No arguments, no fear on the establishment's side that this person in front of them is just blowing smoke up their backside. SO you hysterical service dog fanatics, what is the problem with being proactive and making it easier for businesses to understand the law and comply? Sadly so many of you would rather curse the darkness then light a single candle.
wilhard45 - How many times do you need to be told that not all service dogs are trained by licensed trainers before it sinks in? There are too many people who need assistance dogs and not enough training programs, so many people have to train their own dogs or have family members/friends do it. Many people who do this have already had a service dog for years and know the training as well as a licensed trainer ever could.
The dogs are usually custom trained depending on who is training them and and the person they are being trained for, so there isn't a standardized test like the CGC (Canine Good Citizen, a temperament test) that will work for all service dogs. The training for a dog who warns of oncoming seizues or a drop in blood sugar is nothing like the training of a seeing eye or hearing ear dog, whose training is nothing like a dog trained to assist someone who has had a stroke or is in a wheelchair and on and on. Beyond intensive obedience training, the dogs are trained for a very wide range of disabilities. Some of these are obvious and some aren't, that's just the way it is.
That said, if the dog is unruly or disobedient you can ask the team to leave, service dog or not, so I don't see what the big problem is.

I am trying to suggest to you that things like standards and appropriate licensing is required. Want to train your own dog? Fine, then take it to an approved agency to demonstrate that it is in fact properly trained. Your dad can teach you to drive but you still have to take a driving test at your local motor vehicle department. Further, if you have approved documentation of a need and a properly trained animal then there is NO question that you are entitled to everything that the ADA and state regulations provides for.
wilhard45 that's hogwash. Florida Service Dogs, Inc. (a 513c program) provided all their teams with picture ids & vests. Didn't make a difference and when we do file an ADA complaint we don't sue for money, we demand the offenders have to go through training and learn the laws.

I am saying that the laws are poorly written, do not clearly spell out who gets a real service dog and for what reasons or how they are licensed. The laws also must be beefed up so that when a real, licensed service dog (or service dog trainee) is denied improperly that there are real penalties. I have proposed in the past that when you get a business license information regarding service dogs based on the type of business you are operating and specifics about what you must allow and what you can deny. Would you rather fix this problem or just whine? Obvious there is a problem and it is obvious law suits and videos are not going to fix it. Why not get together with others in your field, a lawyer or two and hammer out reasonable legislation that would fix the existing problems and then go find a sponsor in the Florida legislature to introduce the bill? Attacking me won't solve the problems. You might be surprised at what you could accomplish. OBTW, I am rated 100% disabled by the VA for physical problems from my service in Vietnam. 48 people in the complex I live at has now claim they need comfort animal and a couple need service. If a person needs should be no reason to question.but yes always a but. If you leave your service animal and travel 30/52 days without or no one around that are trained to help with why you need. My question is do you need? Also when your comfort animal is spending 3/5 days at another person place without you. Do you really need? To many people paying internet person to send paper claims need not a physician or psychiatrist. This is making it hard for people that have a real need . time the law correct and stop people that lie.
I am a retired veteran with PTSD, 23+ years and three combat tours and I do not want to sit next to an animal, service dog or not. The lady had her loving supportive husband with her, she did not need her “service dog”.

There are many things that service dogs could do for their handler, that another human cannot do. No matter how loving and supportive her husband is, his capabilities are limited.

Our family has own our restaurant for 4years..on occasions we do get folks with service dogs,we never turned them away and usually the dogs are laying under the table not bothering anybody.

Some service dogs help people with medical conditions without knowing the exact reason a person has a service dog it's hard to judge the dog could be for ptsd or diabetes or for epilepsy but the dog is unable to do its job if it's kept away from its owner.

Why can’t there be a government issued tag for service dogs? It would clear all of this confusion up immediately.
That would basically require people who are disabled to register with the government about their disability and many people are uncomfortable about their name being part of a 'national diabled person list' which could happen, even though its unlikely. Additionally many disabled people will not have the resources to jump through the hoops to get the registration tag because it would require some form of assessment of their dog which requires money and travel and all Erin P

easy way to get around this is just to require owners of service animals have a ID card for the animal, then all anyone needs to do is ask if its a service animal and can i see its ID card, no arguing that fact then, you dont need to know what the animal is trained to do or anything about the owner, just that they need the animal with them.

This is Infuriating to me, I dont care if this post is 2 years old, Lakeland, Fl is a town near where I live, as a fellow service dog handler and person who is disabled, businesses need to educate there employees about ADA rules and federal laws... my health over the last 2-3 years has gradually worsened due to Lupus and other comorbid autoimmune conditions.. we rely on our service dogs daily in order to function on a somewhat "normal" or near normal level.. Now if the service dog is causing a comotion or is being unruly then yes the SD team can be asked to exit the premises...

Brought my service dog in to a place called Rohndas here in TN. He didn't have his vest but I told the owner when she approached, that he was service. She demanded we either leave or put him in the car. I told her she wasn't allowed to act that way at all and she demanded we just leave. All because her stupid store also was a little diner. I was just there to get a bottled water....

Distraction.
Things of that nature. All of which answer the question, without giving away what the disability is.

If a service dog becomes out of control and the handler does not take immediate corrective action to get the dog back into control, then the business can legally have the handler remove the animal. That is why even if someone can lie through the 2 questions allowed for SDs, it doesn't matter if their dog isn't behaved and keeps in control. While allergies are not a valid reason to deny service/access to someone with a service dog, they must accommodate both parties, which usually means sitting people apart while inside the business. Allergies to dogs are almost always none severe anyway...if someone is so severe that sitting far away from a dog is a problem, then they would have the same problem regardless cause people have dander all over themselves and their belongings like their purse or cellphone.

My son has both a service dog & service rat, they work as a unified team for many of his special needs. The dog is more for physical while the rat is seizure warning. Once he detects an oncoming seizure he'll let out a 3 squeak alert which sends the dog into ready mode. Most people are very accepting & mostly curious. I never miss an opportunity to educate someone, especially misinformed people. Unfortunately, too many are misusing & abusing these laws & using fakes. My son's dog was almost attacked by a fake.

Correct, and that is why people are abusing this loophole. If the animal is not required to have a license or even have a tag on them saying it's an actual service animal then it's easy for someone to bring in their pet and say it is. We are seeing people bringing their pets onto planes, restaurants, and other businesses with "emotional support" animals and saying that they are their service animals. It needs to stop.

Thanks, Jacob D. People need to have more education on the subject. I know that there are people out there who use fake service animals to access public areas. And that makes it hard for people who actually have disabilities to take their dogs out in public and not get harassed about it.
