Retweeting shows the view of the person and their endorsement to it as well, the people should at least get fined if not penalised.

Retweeter get punished and the original writer not even booked , how it can be justified.
Since there is no definitive law exist, the incident will be left to court to decide whether it is offence or not; one court's adjudication would be offence while other would interpret as not offence.
So chances are retweeter may be punished and the original writer/tweeter will go scotfree.

@@kavishwarmokal124 Obviously Original tweeter would also be charged, question is about retweeting.

Thanks for raising such a relevant question in current legal- political scenario. Interpretation of tweet is subjective, hence its endorcement. Underlying assumption to punish retweet would be that person has interprete the same meaning which author wants to convey ,hence it should be left to the court to decide on case to case basis. Can not be blanket approach. Some times reader just retweet bcoz they blindly follow some celebrity .

It should not be left to court to decide, there should be definitive law exist which can define black and white clearly, it should not be left as gray to decide to court at their whim & fancy.

In India greater issues of criminal offence are not discussed or prosecuted but retweet becomes a great issue for some paid professional political party and activists..law is also often used as a tools of vendetta politics...

OUR COURTS NOT GIVE CONSTRUCTIVE DECISIONS BUT JUST PASSOVER ANY CASE TO DECIDE BY LOWER COURT OR FILING THE CASE IN ANOTHER FORM OR COURT
DELAY FOR ANOTHER THREE YEARS TO DECADES

How much gray area can be filled?
The constitution of India itself is gray.
