    I think you are correct : if you are a straight forward case you can do all the application process yourself. I would recommend an attorney for : if you have the financial means (time is money - the hours you will be working on this - what is your time worth vs paying an attorney); if you have a complicated case (missing records, multiple marriages, criminal issues, etc). You are correct even the attorney can make mistakes. I am using / have used an attorney and I saved myself some unforeseen problems: Experienced staff who are very familiar with the government’s website; another backup for who to contact about an update to your case status; expert answers if you run into a problem (I have seen both great information and awful information from non professionals = but professionals have a legal obligation to be competent). After completing the Document Qualify part of the NVC part of the process, I heard of lots headaches and heart aches from mistakes during uploading, website glitches, resubmission nightmares, etc... I did not experience any of that = after I-130 approved, in 5 hours got a notice from NVC that our case is now moved from USCIS to NVC and we can start uploading documents, paying fees, completing our applications. Then 1 week after doing all what the NVC required, we were DQ (document qualified). Now just waiting for our embassy in Cambodia to open and start accepting interviews. June maybe? But I think I saved both time (and earnings $) by using a attorney and some piece of mind that I am doing things correctly. Being separated from loved ones is stressful enough.

      love this breakdown assessment, sorry I missed it from earlier! Dep't of state says all embassies across the board can start to do phased reopening July 15th, some have already opened, but it will depend largely on the local situation with covid. My guess is that the higher the covid cases surrounding the embassy location you're processing thru, the less likely an embassy will be willing to reopen and can continue to drag their heels

    could anyone please advise m, my Husband is a Green Card holder and has filed the I 130 petition and it has been more than a year now and the waiting is too long, can I as the US Citizen (His Wife) still file another I 130 for the same person (His Son)? it's my understanding the process is faster when the US Citizen does the filing then the Green Card Holder,,

About the i130A and i didn't add weeding picture i receive a receipt number it been one year now...what should i do? Do you think they will ask me for the i130a? Ou any picture or i have to send it to them?

      hi there! so sorry for the late reply! have you received an RFE at all? If not, I would message USCIS through your account and ask if you can upload additional supporting docs there on your online account. Make sure the pictures include captions

    about to file CR1 doing it online step is 1 filling i130? will i130A automatically show up AFTER i finish submitting. Will there be prompt or some dropdown where it will allows me to file i130A? wish they had screenshot of the whole interface. I m reluctant to start i130 online, fearing what i miss something isnt prompted and i have to manually go get it, upload it, the whoe interface screenshots would've made life easier.

      hi there! Im not actually sure if the I-130A shows up after the I-130 is filled out, but from others on the channel that have done so online (I did hard paper copy submission), they were able to access it. You will have time to save your progress so u can pace yourself and not feel pressured to do all at once

    I submitted my I-130 a week ago online. My receipt # starts with IOE. On this website my.uscis.gov/account/applicant (in case status section), it is written that "...., we received your Form I-130, Petition for Alien Relative, Receipt Number IOE...., and mailed you a receipt notice or acceptance notice. It is being processed at our Nebraska Service Center location.". But the address for the receipt notice is from California. Do you know why? Which one is the service center for my case? Thank you in advance.

    On your I-130 question 59.a how did you answer that question? It asks for the last address that we lived together. My wife and I have never lived together I usually go visit her for two weeks at a time in the DR.

      for the address, I just put N/A (b/c I also haven't lived w/ my spouse) but I also submitted affidavits of support from both friends & family to help paint the picture and fill in the gaps to explain how we still make our relationship work despite not having lived together before (which can usually be explained with your travel like you mentioned). the affidavits dont need to be notarized, but have your friends & family write them and be sure to include full name, dob, city of birth and passport #. and declare under penalty of perjury that all is true

    Hi again does the translated document that I submit to the USCIS like the certificate of marriage has to be notarized and translated in the US, my husband did it in his country does it still work ?
    And I was wondering how many photos I can submit to not overwhelm the officer since we do have a lot 🤗! Thank you .

      it helps to have it notarized & translated, yes, but not a requirement. you will have to have your translator give a statement w/ their personal information as well as sign & date it verifying that they have translated to the best of their abilities. I submitted a wide range of photos with captions throughout the course of our relationship, maybe about 30 and then 10 of the wedding.

    Hi, i've been watching your videos lately. i think they are very helpful. thanks for that. My question to you is that, Im trying to apply for my wife. the only thing that we are not sure when filling the forms is that, when she was 17 years old she left her country and stayed in another country for about 11 years for education and work. Do we need to actually state that in her records or i130? or 130A ? and do we have to actually get any kinda criminal records for when she was there? (she no longer lives there, and it's been 4 years that has got back to her country)

      HI Aria! thanks for being here and for your kind words. Was her move to another country within the last 10 years? (I'm guessing yes, since you mentioned 4 years since) USCIS usually looks back at addrsss and work history, so depending on how old your wife is now, will depend also on how relevant the other country residency is. If it is the 4 years ago that she moved back to her country, they you'd still have to account for the 6 years prior yes that she was in the other country

      if your husband is in the military (esp a military that is either the US or a US-allie) then I would expedite just for service alone. They usually make a quick exception for that

      hi Aliya! the interview timelines are up for grabs right now since it's been totally ruined by covid. I would say from the time each embassy reopens, they will have to deal with at least 4 months of backlog, and then can address scheduling

      HI Justin! did you already file your I-130 and youre asking if you can submit more proof that you just mentioned or you haven't submitted yet? Yes, those will be necessary to send in as documents to support the validity of the marriage.

      No I haven’t send it in as yet I have everything such as pictures plane tickets money transfer receipt and letter from family members supporting our marriage I was asking if it necessary for me to get joint documents like life insurance policy

      @@justinbrown1209 oh I see what you're saying. It only helps to promote your cause, but for joint documents, things like adding your wife to your 401K or retirement account as a beneficiary will do. Anywhere where you can add her name on title or as a beneficiary is great and can be easily done

      hi Frances! thanks for being here! I did include spouse on tax filing, since once youre married, you have to indicate that. For this tax year we did married filing separate, and for social sec I just put the standard 999-88-9999 since he doesn't have one yet

    Hi can you please help me with this question...as a permanent resident I want to file the 1-130 for my husband living in Algeria but iam actually not working cause I am a mama of a new baby :) so I am depending actually on my father, he is willing to take my husband in charge when he comes to the US in the mean time he found a job ..I want to list him as the sponsor for my husband, does USCIS accept it ?       hello! great question. For the initial I-130 processing, you won't have to give as much of that financial info until you get to the 2nd stage - the NVC level where you have to show financial support. So get started on the 1st part, the I-130 right away so you can have your application in! For your question, yes, your dad can be a joint sponsor. You will still have to list as a sponsor, and your dad would be the joint sponsor and has to provide info like tax transcripts, w2 wages, etc. but that is all in the second stage, the NVC and consular processing stage.

      also, my husband read what you wrote & I think he understood your question more. Your wife can process the I-130 and the I-130A for you, but make sure she submits both. You don't need to sign the I-130A yourself if you are in Jamaica and she's here in the US.

      you will be required to do the I130A, yes, or you might get an RFE. you as the US citizen can still help fill it out for foreign spouse

      approval for the I-130? they say it takes up to 4-6 weeks for NVC to receive your case and create case number, but we got ours a lot sooner than that. what stage are you in at the moment so I can give a better answer?

I got my NVC case number within a week of my I-130 approval, but I would definitely try to start calling. they even open until midnight east coast time on weekdays, so you can call after work if you dont yet have your NVC case number. there's still a lot of filing to be done between I-130 approval and interview and a lot of the timeline is up to how quickly you can file those things like the DS 260
