    1. Request all the discovery in your case.
    2. Communicate with your attorney via email.
    3. Request your plea offer in writing.
    4. Inquire whether the state attorney's office has contacted the alleged victim.
    5. Always ask to take depositions, especially in felony cases.
    6. Request a copy of the deposition transcript if there is a victim or witness.
    7. Ask for a copy of any motion to suppress evidence and accompanying case law.
    8. Take an active role in your case by reading through everything and being involved.
    9. If innocent, request that your attorney fight the case.
    10. Be scared but be educated and involved in your case.

      All you say makes good strategy in a case where the court has jurisdiction, and we both the court will assume jurisdiction even when it doesn't have it. Why? Because that's what tyranny does.

    Having dealt with criminal defense attorneys, I have to say this is excellent advice. If you are locked up, authorize a family member or close friend do the emailing and retain the record. He can print it and sent it to you in lock up as long as it would not be dangerous if discovered. Also you wouldn’t want any inmate to see it as there are certainly people there who will lie for the government if they can get something for it.

      I contest that. They worked for me. Sell out? Work for the state? Have u ever experienced that job? Me either but I think most are trying.. but they have a big work load and are typically representing the best people in society

    The average American is illiterate regarding the law and how the legal system works. Your advice is spot on, and I'm sure 1 in 10 will GET IT. And fewer still will need it and do it. Preparedness is not how people--too many people--operate, and will be in a situation of culture shock with so many new things happening; they will freeze up and not remember a thing. Peace

    All fantastic advice. A number of years ago I found myself in a bit of a predicament and a family member referred an attorney who I could "trust", not have to second guess or babysit. I naively paid him in full upfront and trusted him. I remember sitting in the courtroom on my 3rd appearance, and he hands me a stack of papers, whispering to me "This is the discovery read through it and let me know if anything is incorrect". About 15 minutes later I was accepting a plea. The outcome of my case was fair so I didn't feel totally screwed, but I'm certain things were overlooked and as a result, bargaining power was left on the table.

      I too had a fam member recommend an attorney.
      He tried screwing me over multiple times.
      I had to learn everything I could about criminal procedure for my state & everything I could about my charges.
      After refusing to take a deal & after I found & 3 major lies from bodycam that he made on report I got charges dropped.
      It's crazy how everyone in the system worked to convict;
      The prosecutor & cop (of couse) but also the judge, clerk , and even my attorney

      @@jupitercyclops6521 the least amount of work he does, the more profit he nets. The way they look at it is you don’t know anything, you don’t know what your actual exposure is, and they can probably get you a deal, depending on charges, that avoids jail time. A standard deal. Quick 5-7k. If they actual review all that discovery and spot suppression issues….that’s a lot of work and time = less money. I know they sometimes get a bad rap but PDs are often much better. They are in court all the time anyways and their practice practically revolves around suppression and they know all the case law and have seen every imaginable fact pattern. Plus, if they lose whatever you have going on pretrial, they can just go get the standard deal the private atty was gonna get you.

      What if the lawyer says, the client is failing to assist and he had already plead to a case. I would think that would invalidate the plea then. Probation violation.

    My sons father took a case to trial and his PD worked against him the entire time. Refused to depose witnesses, never requested evidence and took him to trial without even knowing the entirety of charges against him. He was of course convicted and held to the max. A lot of PDs just do whats easier and work with the state

      Same here in Oregon. The person claiming I messed with them lied about 90% of everything. I told the PD, he says, “you kicked the car didn’t you?” I was being pressed about harassment and I’m a danger to this person and that I flew from California to Oregon when I lived with them. He didn’t care that the person lied under oath. That should’ve been a dropped case.

      I did my internship in law school for a couple of months. My first trial was a robbery. Feb 13, 2003. It was a bench trial. NOT GUILTY! Had passion then too.

    Lol. Got sentenced to 5 days of community. So I did 3 hrs for each day. Prosecution said that I have to do 40 hours. I told my lawyer that said days, not hours..judge agreed with my interpretation and the charges were dismissed. They won't make the same mistake again I'm sure.

I have bipolar depression, anxiety, panic attacks and PTSD. I’m thinking about taking it to trial. There’s no victims in my case, just me. I’m having ideations now and I’m regretting now staying home and downing my pills. I’m waiting for my refill so i can take them… ALL of them because I’ve been so depressed and back to square one. I know i can’t live like this much longer and the sad thing is is i was doing better since the last 48 hours.

    1st establish status,observe and protect all of the alleged defendants rights. 2nd compell the court to identify, subject matter jurisdiction.

    I accused my conflict attorney of misconduct and she filed for a mental health evaluation and the judge refused to allow a cause hearing to discuss her allegations or substantiate them.
    I was found competent, months later I reminded the judge of the failure to maintain due process in a couple issues and while I was waiting in court because I thought I was there for a motion to dismiss the judge revoked my pro se right and assigned the same conflict attorney and also ordered a mental health evaluation, after the first one was stipulated without me being present .
    I feel like this is retaliation.

      Well respectfully if my client accused me of misconduct I would speak to them and figure out why they would think that. If after that conversation they still believed it, I may want a mental health evaluation. Additionally, if someone represents themselves they are either a fool or suffering from mental issue so that would be a reason to get an evaluation. Then if the person reminded the judge about due process…. Well heck you may be placed in a stray jacket. Sorry. That’s my humor. And 7 people gave a thumbs up. Better hope that’s your jury.

      @@thelawofficesofrogerp.fole7886 that's cute and all but according to rule of procedure a person can not be subjected to mental health eval based on conclusory claims furthermore if that person requests a hearing to object or challenge the validity of the claims used to introduce the eval then it must be had or that is a due process violation, please tell me how I'm wrong using case law, haha.
      in addition, so a judge not holding to procedure should not be held accountable? we should just shut up and deal with it? People this man is a lawyer making all these videos and look how he responded to me, sounds like he supports tyranny against the common man. PAY ATTENTION! His true colors just came out.
      I caught my attorney lying and called them out in court and thats why my attorney filed the eval order, thank you for discrediting me and my situation. I hope everyone sees this and takes note.

So if you outright lied to your client via email which can easily be proven that the things you said to your client were an absolute falsity, and you as a lawyer can't manipulate the client who has researched the policy and procedure as well as standards of conduct for an attorney, then you would want a mental health eval as well.     Get written plea, it's expiration date, always ask for depositions, copy of transcripts if needed, email defender/pretenders, copy of motions and accompanying case log, tell them if you had enough time with lawyer no then no. Take active role in case, be involved. If innocent always request them fight the case and to work it up. I plead guilty in my past and its ruint my life. Not this time especially since I'm innocent. The logging the defenders requests and getting more time to prepare will be vital this time for me. Be educated! Thank you for this. To old and wisend up to just take this crap this time. Praying eventually I can afford a real attorney this time but will do the best with what I can however I can. Help me help you. Good advice. Wish you were in Southern Illinois lol

      I got a DUI attorney and as I started asking questions…my Attorney needs my money first hand before he can talk to me.
      Then he got my money…ain’t care about my questions.
      My attorney told me the paperwork from the officer told him everything…
      I told my Attorney, I am the guy who got arrested, I have my side of the story…Duhhh
      I am screwed.

      I told my entourage that next time anyone got a DUI, plaid guilty to spare the financial burden and the time wasting.
      Unless there is no proof like blow the tube. Once the tube came out over the limit, the attorney job is pretty much “interprete the law for you”.

    Once I was accused of buying cigarettes for a minor. It supposedly happened during my 15 minute break at work, between 2:00-2:15pm, & they were supposedly bought at a store next to my job. It was also an off-brand of cigarettes I had never heard of. I even went to the store later on my own & asked if they carried that particular brand & that particular type (full flavor 100s) & while they did, they were being discontinued or something & they were only selling the remaining stock...& they did not have any of the "full flavor 100s" left. I mentioned that to my public defender & said that sales records would also most likely prove that no one - let alone myself - bought a pack of those on that day during that time frame. But he wouldn't even try to!!!! He flat out refused to!!! & I know they CAN do that, because I've seen prosecutors & cops use sales records to convict someone before. So I don't know why my lawyer wouldn't do it.

      How would a prosecutor prove you bought cigarettes for a minor? There would need to be proof you bought cigarettes 🚬 🚬 🚬. Then there would need to be proof that you gave them to the minor. There needs to be witnesses or video.

    I don't have an Attorney, not yet and likely not ever. For some reason everyone expects me to represent myself, again. So getting this information, request it, like you said, all that stuff I must do alone. I f+;":!ng scared! The only way is Pro Bono. I made calls and asked around, but now I'm alone; I'm the Plaintiff in a lawsuit against the Police and Government; who does that?

    When you retire from the bar perhaps you should consider being a motivational speaker! This is spot on not only for criminal proceedings but for life in general. I always get as much as I can in written communication for covering my @$$.
    You can't use depositions in CA for the most part on criminal cases though...

    It has been my personal experience that not once has a Court appointed attorney ever listened to me no matter what I had to say. And when I asked, politely, what have you done so far for me/ The answer was, I have done nothing for you and will do nothing for you. That's my experience in upstate NY.

    Public defense is paid for by the same entity as the prosecution is..therefore they are beholden to such..you can request the funds to hire a private attorney. You may need to fight some, but they eventually have to give in to the request

      No where In the law does it say anything about the lawyer appointed to you, is of the courts choosing..
      As they are paid by the same power, it's a conflict of interest.

      Had one who was sleeping with the district attorney, she got all the charges dropped right away..
      Now he's running for judge.

    This is great info, I wish it was listed in a bullet format in the video description. However I'm making notes as I go along. Thank you so much for these types of videos. So many of us who obviously have no experience with "the system" and find ourselves in these situations are sometimes at the mercy of our attorney (no offense) and we just have to "trust them" but have no idea if they're doing what they could or should be doing along the way.

      All my personal property disappeared my purse and all I had in it way can I do about this situation also I was not allowed to know what was put in my property then I sign it then when I was released from jail I was given the property form but the just did it so quick I had no idea it was my property release form that I signed I noticed my purse and all of what it contains was not on there.     Hello sir what to do when you have received two illegal tickets you reported it nothing happened and you need them out the court due to another court issue... in both cases the officers said incriminating things about the stop..but the now attorney don’t want to pull the video for proof of the wrong of the officer. And the illegal way the tickets was given... one officer didn’t write it up to appear before a judge he just wrote up a made to pay ticket... how do I fix this in my new case..?? I go to court in two in half weeks from today!

      you have to make a record, file a complaint with bar, but try to talk to them first. Again, keep a log of discussions. You have to be able to stand up for yourself and talk out in court. Many judges will ignore but it's hard to ignore emails or lack thereof. We are all people and should be treated well and respected.

      That’s odd to me. Not sure why they would do that. Look at state bar website. Plug in the name and you should have the email. In Florida, every attorney must have their phone and e-mail listed. Not sure of your state but it’s likely online.

My lawer said just plead NO contest and the judge will let you go. He was flirting and when I seen he knew her I should've got rid of him. Long story short she sent me to anger mgmt and still the charges stuck because a new parol officer stepped in and said I was late to an appointment. I didn't know I could take it back within 30 days. Next thing you know I was charge a 2nd time with the same crime. I left the young lady for my safety. Long story short I didn't know she had ptsd, bipolar and entitlement issues. Later I got custody of our kid and refused to even let her come around. I never had been lied on so much with NO proof. I even had my gun rights taken and didn't know until I was picked up at a gun show.

    Thank yoy, my daughter was assaulted by her husband. She had a dislocated hip, he assaulted her, choked her til she passed out, had her maced, then had his friend who did not witness anything, call the police and say she assaulted him. Now he won't return her assets so she can hire an attirney. The sheriff's won't help

    What do you think about a plaintiff that initially lied to the police to have a charged placed on a person, currently now the plaintiff has been relentlessly harassing and stalking the innocent defendant while their case is open.. Also say the plaintiff is even harassing and trying to intimidate potential witnesses to not want to testify. Can a plaintiff be charged with intimidation of a witness?

    My son didn’t get representation and had no contact from the lawyer the court appointed him nor did he get his discovery paperwork until a week before trial.

      Why would someone ever expect for the public defender to care about the case more than your own son should've cared about his case?! Your son should of called his public defender to make first contact which would prove he DEFINITELY cares about his case and freedom and even if he doesn't make first contact he can call anytime for free while being incarcerated or if he's out on bail he can call, email, or go to the public defenders office. I don't believe he never had any contact until a week before trial, BS. Everyone has MULTIPLE court dates leading up to the trial which your public defender/attorney must be present to represent you!!!! The judge would know if he didn't have his defender there and would not be able to move forward without the defender there. If your son cared about his freedom and his case, he never would've neglected to contact his defender and would've proved he cared by calling the public defenders office and speaking to him or left a message for him and while in jail you can also get confidential calls and visits with your lawyer or public defender. You can also fire your public defender and get a new one if you have a good reason. He would of had many different options to make it known he cared about his case and the judge would have it on record aka in the court transcripts if your sons public defender wasn't present.
