    One of the big issues is that most lawyers won't get that deep into the facts of a case. Unless of course they're a wealthy client like yours. So they will take their fees to retain their services, and then trade plea deals with the DA like they're pokémon cards. And innocent people end up having to make a decision to go to court with a lawyer who won't fight for them because they don't have the money, or they take a plea deal for a couple years versus facing 10 to 15.

    This exact thing happened to me. The police report was at best 50% accurate. It painted me in the worst way possibly. So i tried to fight the charge and ended up in even more trouble than if i hadnt tried to fight the original charge. The public defenders suggestion actually cost me more.

    Unfortunately the police reports are important and can ruin your career even though the officer is training for 8 weeks or less. I can’t be in a building with the Police officers because they write false reports based on false reports based off a false report. It never ends. They are murdering a cripple.

    Excellent. thank you. They arrested me for failure to appear while I did appear except I did not hear my name called. I even asked the Judge his name and he answered. Why didnt they check before they arrested me? That is a false arrest is it not?

    My name is Miguel Garcia and Unfortunately I was accused by my daughter and my sister in law of bruising my wife of 45 years and only person in my life. There a lot of money interest for them. Well my daughter called the police they took her to the hospital and the police arrested me and said that my wife wrote a report amusing me of all sorts of things and I simply told the police officer that it's not true my daughter knows how much I love her and then I told the officer and my wife can not speak or write a report she has dementia and he stop for a moment and said well she wrote the report and she gave it to me and you know what happened after that

    Im not an attorney, but it's probably a good idea to do these videos when you're not driving. Any accident happening due to distracted driving plus being recorded by you will be used against you in a court of law.

      The Brady list is a list of law enforcement officials with known credibility issues. If prosecutors intend to use somebody on The Brady list to testify in a case, they have to notify the defense. As a result prosecutors usually will not use a Brady list officer, and will throw out a case, if a Brady officer is the primary witness.

    Question for you, in the State of Florida, does a probable cause affidavit have to be NOTARIZED? If it is what they have used to make their arrest? Affidavits are suppose to be sworn testimates of truth & verified that the person writing & signing it are truly said person. A Probable Cause Affidavit I WOULD think ABSOLUTELY would need to be since it is essentially acting as their "temporary warrant," so to speak. Even if a Superior officer "attests" to it, how does one know he isnt just going along with what Officer Joe SAID happene. Of course he is going to collaborate his buddies story. Where as if it is notarized then they LEGALLY are committing purgery & they would be doing it with malfeasance. Ive found conflicting answers so was hoping maybe you could give me a definitive answer please & thank you sir.

      An arrest affidavit or probable cause affidavit is sworn to by the law enforcement officer under the penalty of perjury.
      Thus, an affidavit need not be notarized.

    If a criminal investigator fails to include a witness statement because it helps the person arrested can there be anything done? In the report he said the person didn't witness anything but at the preliminary hearing he was asked three times were there any witnesses? First time & Second time he says No. The last time he says well I think the wife may have witnessed something.

      Sounds like there is another witness. Use an investigator and find them. Talk to your attorney. The cops are there to convict you not help you. You have been arrested so you are the bad guy. Use their sloppy investigation to your advantage. That’s what’s wonderful about cross examination. Your attorney gets the opportunity to show the court and all in it how incompetent they are. Or hype them up when it’s helps your defense.

    That’s exactly why the reports have to be rigorously vetted and impeached by an independent investigation. Often they contain material errors of fact. This is true of traffic tickets or felony complaints.

    I have a huge question, can a cop report you to court with not enough evidence over an audio identity fraud? Also if the cop already reported you the court house takes over they send you the letter and evelope from the courthouse but what if you received the letter from the police station is that like the cop involved into something or what. Because usually I heard that cops don’t get themselves involved into audios unless it’s enough evidence and a threat or something but for a drama they don’t get themselves involved. I just need someone to confirm….???

      There is a fee/debt/"charge" issued for each crime. If a person is convicted & the JUDGE sentences the person to prison, 82% of the TOTAL of the "charges" goes directly into their retirement fund/ per person they send to prison. Hummmm, let that simmer for a second. How unbiased & impartial do you think that makes alot of them? Do you think the "judges" in our system are giving WeThe People access to a fair trial? Why does the State(who REMEMBER, Constitutionally, anyone accused of a crime has the RIGHT to face their accuser. If their is no victim, how is THE STATE the injured party. Ever seen THE STATE cross examined....ijs) There is a reason PD's & The State come to a plea agreement so readily! If it goes to trial, the CONTROL is now out of their hands. It isn't that woooohoooo, some magical deal was worked out & we the people should be oh so thankful, for the "gift of leniency" they are giving us. It's a scare tactic, saying this is the best you're going to get, you better take it. That way money still lines the State & the judges pockets. If it goes to trial by jury, well, then the run the risk of REALLY loosing. The States Atty & a PD are BOTH EMPLOYED by the STATE. Bit of conflict of interest there if ya think about it. In ANY ARREST & Trial, systemically so many of our Constitional Rights are broken, it is beyond infuriating. Educate yourself, We The People have been railroaded & ran over for so long that MOST have not a clue what our RIGHTS even are anymore. Look up Mulberry vs Madison. Jurisdiction is the ONE thing that can be CHALLENGED @ anytime, theres a REASON, LOOK AT THE CASE ABOVE! It's time we start taking our Rights back & holding them accountable!     So Roger Wana, hear about tunnel vision? K, a long time ago in a single car wreck, where the inebriated captain of the land cruiser left the right of way and rolled the car, five people got out and then traveled south to complete their journey.
    Now, me b'n an after-market observer had loaned one of the wreck-ies a flash light to look for phones. K, all five of the drunk land sailors started walking south.
    So, as I had went back into my abode to get a shot or two of whiskey and then re-appeared at the crash site while looking for the flash light I had loaned I noticed the cops intently observing me.
    This is when I exclaimed, "No,no, I din't do this, no those people are walking that way," while I pointed south.
    And, it took these fine men a few seconds to clear their fughed brains of what I had told them they then realized that the people walking south had been in the rollover. And, then they jumped in their cars and mashed those motors to investigate.
    Now I'm not flaming or bashing anyone about this interaction, but them Boyz were deciding to get me, and I had to set them back on the narrow path.
    Yeah, I've seen this tunnel vision, and I know there is mostly nothing that can be done about it ATM unless you actually can get through to the ones burrowing.
    Now, here is a tepid aftermath: The guy who owns the land that I rent, why he had his drivers license revoked because the Oregon DMV thinks he was the second driver in a single car accident.
    Funny thing, because it isn't happening to me, is tunnel vision, actually is pervasive to every thing human.

    Reading documents on police history, this was NOT ALWAYS the case of writing a report to convict. There were one or two honorable Chief's of Police in 1954 that wrote " accurate and fair reports"

    I trust you got costs awarded for your client against cop and prosecutor, and cop was charged and convicted of perjury, cop was sacked and barred from working in law enforcement; prosecutor was sacked and disbarred for presenting misleading police report knowing it contained lies.

      Unfortunately, you can't get reimbursement for attorneys fees even in civil cases, except in certain limited situations.
      The U.S. legal system favors the wealthy and the police (and the government in general).

    If a baggie of drugs is claimed to have been thrown to the ground by a bearhanded, handcuffed defendent, it is expected that that evidence would be preserved and tested for dna or fingerprints. If not, that raises reasonable doubt if there is no reliable eyewitness testimony.
    In this era of police bodycams, it is expected that this evidence would likely be on video. If not, then there's reasonable doubt. Evidence not preserved or reasonably tested = reasonable doubt.

    I will share this knowledge for others to see and understand your perspective as to why it IS imperative to be accurate, concise, detailed versus when an officer writes half ass and how they can look like a buffoon on the stand, because if I was in your shoes, defending my client, it would be to exploit how the state failed to prove the elements to the offense was not reasonable.

      Sue his ass for falsifying the police report and call the DOJ civil rights division. Have them investigate what happened between you and the police officer.
      Police can be charged for crimes under 18 u.s.c 241 & 242 and other federal statutes…
      I’m no lawyer (at least not yet) but in my experiences with sheriff deputies, SAO, lawyers, and state and federal judges… I’m no one to be fucked with when it comes to constitutional law, specifically Fourth and Fourteenth Amendments.
      Also, educate yourself on Florida Rules of Criminal Procedure. You can easily find it online.
      Lastly, don’t let the government officials bully you as if you don’t or show them that you’re buying into their intimidation tactics, they’ll not only respect you but also fear you.

      @@thelawofficesofrogerp.fole7886 well the era of no one trusting the word of the cops is upon us, they can testify but thats not evidence and their testimony in many cases can also be excluded if you have the right lawyer who knows the right paper work to file. there is nothing that makes the officer's word the truth, specially once you ask them if officers are allowed to lie to do their job, whent hey say yes and they have to say yes cause they can legally it taints their word out the gate.
      the officer cant be a witness to their own detention, witnesses have to be 4rd parties, the state can and do lie all the time, but like i said the right paper work has to be filed.
      but you are right, cross exam can easily catch them in lies and poke holes in their story, one dude just got off cause 3 officers all worked their stories out together in a closed room, things like that bring down cases all the time and they discovered that and the details through cross exam.
      also local laws apply, my fl got some messed up ones for sure lol

      Bro i had a domestic case that i never could have got convicted of had trial in june of 2022 keep
      On mind it was a missdemeanor domestic well the one witness they were goin tomuse was my son against me well the Sa realized my son knew the truth an nothing happpened so my ex didnt show and we waited 15 minutes past trial afyer waitng 2 years to go to trial i got my case expilunged they dropped the child endagwrment an child abuse charges an nolle prosse my domestic i paid mynatty 1300 for the expungement it got expunged 2 months later the SA refiled the domestic on me and the day of trial offered me simple battwry an my lawyer the joke he was was saying justbtake it i said nope im innocent long story short they had different witnesses beand new pictures pictures from my ex not from the police taken an i was found guilty and then the went after my expungement an got that put on my record!!!
      Long story short bro these SA’s just want convictions If your innocent i want you to be confident Inwas becuaseno knew i didnt do a thing but the truth doesnt matter its all who tells the better story at the end!!

      Correct. But the point of my video is for those that read the police report should not give up. Being arrested and having a record clearly begins prior to what I am discussing. My point of view is to fight a case and prove accuser wrong. Never give up based on what is contained in a report. Comments by Officer or victim in the report are not facts simply allegations.

      I have found what you have shared here to be a very good tool to use and share. It is in understanding when people try to document what happened, it can be open to interpretation and perception by everyone involved. I do agree with your part about when law enforcement do not write detailed reports, it allows the defense to ask more questions to create and cast doubt on the State. You have "Mistake of fact" which can be made known in a report because it is not being concealed. We also have body worn camera video footage that may or may have not captured what an Officer describes in their report. The elements of the offense are required for an arrest and if reasonable, the arrest itself may have not been illegal based upon the totality of circumstances,although to write something that an Officer did not witness would make me cringe because I can see how all the reasonable essentials went out the door.

      I would expect that an arrest that never lead to a conviction can be expunged from the public record (of course it would still remain in the private record for government officials, such as cops and judges, to see).

      Made and sworn upon (to be true under perjury) for the purposes of making a just probable cause…
      Arrest? I’d imagine that statement could be used at trial or no? Lastly could we try to remove…
      Evidence they submitted after the arrest was made due to the false statements made by that officer?
      I think a motion to suppress evidence would be the proper step but I’m struggling to…
      See what needs to be done in disproving they based the arrest on facts but only…

    Are cops supposed to put in police report that I was suicidal? Because there’s nothing in the report! And they literally told me as they were processing me! I didn’t even know at all! Aren’t they supposed to make sure before arresting the person? They literally had me on watch 30 minutes on and off

      Or don't get pulled over for a minor infraction. My report says:
      plain smell of odor of marijuana in vehicle. they refused to admit anything in the vehicle k9 alerted to the van. search was conducted nothing found. driver later admitted to smoking marijuana yesterday. cited for failing to have headlights on."
      Can you guess why I was pulled over?
      Cuffed and stuck in a police car within three minutes of interaction.
      Nothing on me. Nothing found.
      They are out of control.

    I was charged with assault by motor vehicle .
    The cop said he saw on surveillance video the rear right tire of my car run over this fake victims foot .
    I kept asking for the surveillance video , they kept giving me excuses about getting it to me . Eventually the DA said he lost it ? But that he saw the video before he lost it mind u 18 months later of about 20 hearings .
    He admits he didn’t see any assault on same video he lost prior to losing it . But he can’t testify to it because he lost it .
    I had it dismissed for Brady violation losing exculpatory evidence .
    I then wanted to file a law suit against the detective for lying that he saw me running over this fake victim . As the prosecutor impeached him on the record by admitting u can’t see any assault on video . Just a car driving away . From the get go I explained that u can’t assault anyone with a rear right tire ? What am I an acrobat with a car ???
    It’s all fake . The dude filed a false police report .
    Bottom line I was told u can’t sue the cop because the video is now missing and so what if the prosecutor says there was no assault to be seen before he lost ???
    Mind u I lost 19 months of my life because this detective opted to lie instead of protecting me from false reporting .
    What’s your opinion of that ?? As the only reason there was probable cause was because the detective lied that he saw on same surveillance that I ran this faggots foot over same surveillance that the prosecutor later admitted there was nothing of such content to be seen ….
    Please advise

      I wish I knew more about suing city and county over police misconduct. There are mechanisms to do so. You need court transcripts etc but seek out some attorneys that file those lawsuits for their opinions
