Nope, I don't use any one layout, it depends on the kinds of testimonials that make the most sense for each business, and has to match the style of the rest of the site as well. And no, never studied law :)
I can't speak from a legal perspective, but I'm guessing you do need it legally, and just ethically, you should always ask for permission first :) I'd just find one on linkedin, then email them, and say "hey, do you mind if I use this photo?"

Yes from a legal perspective you need to ask them. And if they changer there mind later you just have to remove it ASAP.
