He wasn't charged with being intoxicated, he was charged with being impaired. Impaired is between 0.05 and 0.08. "Intoxicated" in New York State is between 0.08-0.18

"Impaired" in New York State is between 0.05 and 0.08 so a single 2-4oz martini sounds pretty accurate. Any higher then 0.08 has a different charge there.
Everyone has a family or friend that’s gotten a d.u.i. Even if you aren’t aware of it. Regardless, what he did was reckless. But he’ll be fine. His life isn’t over.
