      Doesn't Canada have a 'loser pays' system? That would encourage companies to go to court and should they win force him to pay all expenses. That should at least slow down the frivolous cases

      @@j3lny425 I hadn’t heard about that so I quickly looked it up and the answer is sort of. Generally Judges will only make them pay a part of the legal fees. So even winning can cost you more than you might win. It actually notes a case where the judge made the lawyer pay fees as well because of his client’s behaviour, she was apparently “vexatious” and the judge blamed the lawyer for either advising his client to be or allowing it. And there’s some ethical expectation that lawyers so some pro bono work but it’s mainly up to the lawyer. The site is four years old and mainly focuses on Alberta so I can’t say it’s the same in every province and territory but I have a link to the website.

      Texas has a law called the vexations litigant law where if a person files one too many frivolous lawsuits eventually he is barred from filing any more lawsuits

      @@ganixaba Yes, at first the term "fake news" was used to refer to the deliberate misinformation that was spread on social media which helped get Trump elected. Like stuff that would literally pretend to be CNN or something, but the URL is slightly off and its actually fake. This was misinformation that the sources admitted was bullshit just intended to help get Trump in office. That stuff was legitimately, by definition, fake news. But, as you said, Trump decided to co-opt the term, and just started calling ALL legitimate news and journalism "fake news." Literally everything except pro-Trump propaganda he declared is "fake news." And that stuck. So now we're stuck with the association of "fake news" being a Trumpist term.

      @Justin Troudcul this is excessive, he isnt filing cases to correct any actual issues. Look into some of his filings and you can clearly see a pattern of filing for any and everything even if it has no actual impact to either make money or stifle the business. We shouldn't lock him up because there isn't anything illegal about it but disbarring him and revoking his right to clog the legal system with frivolous cases is absolutely the right call.
      He is basically case packing to clog up the judicial system with cases that don't actually need to be adjudicated which hinders everyone because it is time these courts can't spend working on actually cases which do need the courts attention.

    There was a woman in the SF Bay Area who was suing everyone in the neighborhood over and over. Finally a judge ruled that she can't sue anymore just like in this instance. She has to get permission from the court. One neighbor said he saw her one time outside of her house across the street as he approached his car. Somehow she managed to sneak behind his car and claimed that he hit her with the car while he was backing up on his driveway.

      @Darin Preston We have the slander and libel laws but because of the American Rule on costs they usually dont have to pay their opponent's costs when they lose in court. This makes it very costly to sue and they mostly go unchallenged in court.

    A guy in a wheelchair came into our bar with a tape measure and threatened to sue because the toilet was 1/2" to close to the wall... I was a little speechless but while I was explaining that we got a variance from the building inspector he said he would drop his lawsuit for $5,000
    I got so upset I started yelling every curse word i know at him... he couldn't have got out of there fast enough and we never heard from him again

    We had a similar problem here in CA: there were lawyers going around to various businesses looking for code violations or less than honest business practices, they would then sue the business for said code violations or practices, then ‘settle out of court’ for monetary damage, despite the fact that the lawyer had not suffered any “injury”. Essentially extortion using the predatory lawsuits as the hammer. Thankfully, the CA Assembly put an end to this by requiring a lawyer to have suffered an actual ‘injury’, and by prohibiting lawyers from filing a lawsuit on their own behalf.

      Yup... back around 2005-2007 I had an upstairs business in Redwood City I had to close because I didnt know any better. There was no elevator at the office space I was renting and I was confronted by an attorney. He expected me to pay him to avoid his filing, and because I was a doctor he thought he was going to get a major payout. I shut it down and had the office emptied over the weekend. Then I let the City council & BBB know they just lost a non profit clinic treating the poor because of this guy.

    So, what happens if he does attempt to file a lawsuit without permission from a judge? Does some clerk somewhere need to compare his name with a database, and simply reject it? I hope that's not all there is to it - he'd still be wasting the clerk's time. I hope that such an attempt would earn him jail time.

    The simple solution is to change our civil tort system to that which virtually every industrial nation uses. Loser pays litigation. So every time you lose a case you pay the opposing persons costs. It gets rid of frivolous cases fast but valid cases still are pursued.

      His strategy was to panic business owners into settling, rather than going to court. Because the case was never in court, the laws that would require him to pay expenses of the person he sued would not go into effect.
      Never get in a pissing contest with a skunk. Instead, get a bigger skunk.

    Not knowing ALL the facts regarding this individual, I am concerned this ruling will signal accessibility for the disabled is no longer an issue. Businesses, like the rest of us, that conform to the "handicap" laws have nothing to fear.

    Seems like a pretty clear case of fraud, racketeering and extortion. Why has he not been charged? If it can be shown that he has worked with anybody in these criminal enterprises then it can become a RICO case.

    now every defendant in his frivolous lawsuits should join forces and hire a couple of attorneys to pursue him in court for every false and frivolous suit he has ever filed. Obtain judgments against him and go after every dime he has or will receive as a result of his abuse of process.

    City near my home a few years ago there was a " disabled man " and a lawyer going around scoping out businesses, mostly restaurants, citing their " violations" and then informing the business owner that for a few thousand dollars they would go away. Legal shake down in my opinion and no better than prison inmates suing because they don't get Lime Jello.

    Under Most British based Law Systems (Canada for Instance.) , if the case is lost the Loser is Responsible for Costs.
    This tends to make most litigation simpler as those knowingly in the wrong just settle.
    Serial Litigators don't even bother because any lost case will cost them money.

      WRONG. In most USA jurisdictions, the prevailing party is entitled to counterclaim against the losing party for damages, costs and fees.
