    02/16/2021 - Just looked for update. Found article dated 01/11/2021 stating:
    A disbarred attorney, who continued to file hundreds of disability lawsuits on his own behalf, has been permanently blocked from filing new cases in Arizona’s federal court district without permission.
    Judge Diane Humetewa officially labeled Peter Strojnik a “vexatious litigant” in a scathing ruling that compared his lawsuits to legal extortion and stated that he “habitually over-exaggerates his injuries.”

    Lawyers get disbarred for filling frivolous law suits. The defendants should get together and file a class action against these lawyers. If they don't sue and settle they will be targeted again. There are several lawyers who are beginning to base their practices on doing this exact work.

    As an older paraplegic I am happy that legislation like the ADA was passed in my lifetime. However those who abuse its provisions like Peter Strojnik and 'drive by ADA lawyers' really disrupt the meaning of the law. After years of being regarded as a 2nd class citizen ('oh, we'll just carry you up the stairs', 'we can't accomodate people like you') these people are disgusting.
    When I became a para, handicapped parking spaces were non existent. Today, laws like the ADA and social awareness have changed the attitudes of most towards the disabled but these vultures really give the ADA a bad name,

    ADA needs to change.
    And the biggest change should be that any lawsuits or demands go through an arbitrator and, if the arbitrator says "no" the complainant pays for their services.
    If "yes" then the business is ordered to fix the problem, an NOT pay the complainant even one dime.

    • @RCFrizz
      @RCFrizz 3 ปีที่แล้ว +1

      So there will be nothing but risk for anyone who finds a legit problem. Your "fix" will not improve the situation.

    • @Censoredbyfscists
      @Censoredbyfscists 3 ปีที่แล้ว

      @@RCFrizz if the problem is legit then the arbitrator will rule in their favor. His idea has merit. You don't like it because it's fair I guess.

    • @RCFrizz
      @RCFrizz 3 ปีที่แล้ว

      @@Censoredbyfscists You shouldn't guess because you are really bad at it. Your reply demonstrates a lack of thinking and knowledge of the law.
      I'll give you one reason. It is a myth that arbitration is better than the judicial system. Oh, here's another alternative! How about making the amount a plaintiff can recover lower? The telemarketer law limits recovery to $500-$1500 per violation.
      It is enough to justify going to small-claims court, but not enough to be excessive. Allowing individuals who have been harmed to collect damages has been a part of the enforcement schemes of many laws over the past 50-100 years.

  • @daskritterhaus5491

    Personally as a disabled person I think it's great, I'm not sure about the methods but when I fell at Walmart in a disability parking spot that had the concrete 1" off the ground after they patched some kind of frozen concrete and didn't even check it, I went airbound and my back is still hurting, a total stranger came from their car and rushed to my aid. When I asked the manager, he didn't give a damn and I checked the Internet and saw Walmart can damn sure avoid lawsuits with all their attorneys. I even contacted local Attorneys and they didn't care either.. I already have diagnosed MRI spine degenerative disease and was advised from my doctor if I have any car wrecks/accidents I can be permanently
    in a wheelchair. I even wrote to the Feds ADA in DC about it and they weren't interested either they weren't even willing to see I had proof from MRIs and neurologists report showing preexisting conditions. That concrete is still sitting there 1 or 2" off the ground, not level and somebody's gonna come along and hit it again and they're gonna go airbound just like I did and Walmart is just slipping by not giving a damn, by the way this is in Walmart, Galax Virginia. I think it's about time all of us with disabilities go after these son of a bitches who don't give a damn about our health. Get them! Civil lawsuits can be won. Walmart recently lost a Civil suit from a customer injured, losing her leg! Just in last 7 days in news.
