    Go to Andrew Branca’s Law of Defense channel for detailed discussion of the matters raised in this video. There is NM Supreme Court case law that holds a person holding the firearm ultimately responsible for that firearm and any negligent discharge. In NM, it does not matter if someone gives you a gun, says “it’s empty” and you then point it at some, pull the trigger, and it goes “bang”! You (meaning Alec) should have checked the gun and verified it was empty.

      @@jenniferornelas4151 She actually has testified in court already through her film showing him mishandling the gun (even if it was a fake) pointing it cocked at her with his finger on the trigger and pulling it. Then the camera rolls back with her as she falls. Anyone else would be awaiting trial in jail and the most he could hope for is a lesser charge than cold blooded murder with intent. Had she lived at most it would be a civil case like when Dick Chaney shot his own lawyer who refused to press charges. (Fun fact that would have been an interesting case legally as your attorney is normally barred from testifying against you or doing things that harm you legally.)

    Don’t ever assume the gun you’re given is the prop gun. I’ve worked on several films using prop guns only, but I surely checked to make sure it was a prop and not a real weapon. That’s on you sir! You didn’t need to pull the trigger!

    The industry standard is EVERYONE has to check the gun. Baldwin was asked if he wanted to check the gun and he said, "NO". He

      Hannah was and first to blame for not doing her job correctly as an armourer, but Alec is definitely second to blame because Alec had the gun in his hands and didn’t double check it or ask someone to check it and Alec hit the trigger somehow and went off.

    That industry standard says:
    "All local, state and federal laws and regulations are applicable and can override these guidelines if they are more stringent."
    I'm not sure about New Mexico law, but I assume usually the person handling a gun would be ultimately responsible for its safety.

    The first rule my Daddy taught me about handling ANY firearm is ALWAYS assume the firearm is LOCKED AND LOADED until YOU YOURSELF, clear the firearm.
    He would make me repeat this rule before he would hand me a firearm.

    I must have missed the part when someone explained why in the 21st century a REAL gun that can fire real ammunition is being used on a set in the first place.     He’s always been arrogant. Just look at his past with his former wife & daughter. He has never taken accountability for much in his life and he would be so used to YES men that in his world he’s untouchable. Thankfully the law doesn’t apply to those who believe they are above the law simply because of status. Geez he’s just an actor. Nothing really that special. After watching all of his interviews and how he treated handling the gun on set he’s completely guilty of pulling the trigger. Guns just don’t go off on their own- or if they do it’s so extremely rare. He had a lower budget, he wanted things done his way and as a consequence a young lady lost her life. At the end of the day he should have checked his weapon. He also shouldn’t be fooling around on set with ‘ dummy’ weapons and he was responsible for hiring Hannah. He did pull that trigger, whether he wants to admit that now or not. And the state will be able to prove that imo. He deserves to be held accountable.

    He was using the gun as a pointer as well. The industry standard for gun training says that when someone hands you a gun, you check it, and you never point a gun at someone unless you intend to pull the trigger.

    Its sig not taurus that were having issues with discharging when dropped. There's a big difference between a gun just going off in your hand and a gun going off when dropped. Baldwin 100% pulled that trigger and caused it to fire.

    He's been in many other movies involving guns. He KNOWS the rules and protocols for handling guns. NEVER point a weapon at another person whether they claim it is cold or not. It will be interesting to see what the defense witness has to say about Alec not pulling the trigger.

    I don't understand why Court TV experts are so bad when it comes to how guns operate.
    These guns were not manufactured for this movie. They are off-the-shelf Italian-made replicas of Colt Single-Action Army revolvers. They are distinctly different in their design in many different ways from a Taurus that was referenced, and conflating the two shows only ignorance about the subject.

    Hannah Reed was convicted in March of involuntary manslaughter, after a jury found that her negligence caused the death of Halyna Hutchins. Judge Marry Sommer said Reed had not shown any remorse. Judge also said to Reed “ You alone turned a safe weapon into a lethal weapon. And is spending 18 months in prison she should get more prison time. The victim was transported to UNM, Albuquerque. By car it would have been 45 miles but helicopter faster.

    None of the people making these judgements has ever worked in film. The person who brought live rounds to set bears primary responsibility. I do not know who did that and if it was not Hannah she bears no responsibility for a number of reasons first among those is the fact that she was doing three jobs. The next responsible party is Alec Baldwin but not for the reason charged. He was not negligent in handling the weapon. He is responsible for the chaotic conditions on set. He was the executive producer actually on set and he violated film safety protocols by taking the handoff from the first AD. He took a gun from the wrong department. This was a direct result of the corners being cut by a low budget productions. I have never worked on a film set where the actor checks the weapon for himself. You take the weapon from head props or the armorer ready to fire and fire it and hand it off again to props. It is only in your hand while the camera is rolling. This is the safety protocol, only one person handles the firearm and that person is head props, or his second or an armorer. I have never seen a principal check a firearm on set. It defeats the safety protocol. Film costs were ten thousand dollars a minute in 1985. No one holds up production checking other departments work. Alec was negligent in the way he ran his set, not in the way he handled the firearm. None of the people involved in the prosecution know anything about film production or the protocols involved. They have worked for one hundred years and Alec Baldwin was the first producer to run a fatally flawed set. There remains the possibility that in the confusion surrounding the departure of the camera crew someone deliberately sabotaged the production. That is the kind of 'S' you have in low budget and why Hanna's only error was taking the gig. She should have run from the meeting where she signed the deal memo. Production was an accident looking for a place to happen

    All three people talking here are completely ignorant of the use, handling and safety requirements of firearms. Any person trained in the use of a firearm, as Baldwin has been trained numerous times, knows the Four Rules of firearm safety. The same rules used in the Movie industry. Baldwin RECKLESSLY violated ALL of the safety rules he was required to adhere to, and that’s why one is dead and another was injured. That’s the whole case in nutshell. 100% manslaughter.
    Alec’s father was a shooting coach, he’s been around guns from an early age. He’s had formal firearms safety training so many times, he could qualify as an expert on gun safety. He knew what NOT to do! He did everything he was trained not to do. He knows he’s at fault here and is just trying to dodge responsibility. The Prosecution should be able to point out these simple facts and put him in a cell for eighteen months, easily.
    Should have taken the plea deal, Alec!

    No, the union does NOT require an actor to check the weapon. It suggests it, but does not require it. Do not forget, it was David Halls, the security lead (not Gutierrez) who passed the gun to Baldwin stating it was "cold." So that was essentially two "expert" safety vettings just before he rehearsed.

    I would never trust someone telling me a gun is unloaded and not verify that myself, regardless of the position held by the person handing me the weapon, regardless of the circumstances I’m in. I wouldn’t trust ANYONE’s word. I’m curious if he would have put that gun to his own head and fired without checking? Would he have risked his own safety as easily as he risked everyone else’s?

    Industry standard doesn’t matter, though SAG rules support the criminal charge. You cant point it at someone, you have to know it is a real gun, and you are responsible. Also, NM law overrides it anyway. He was reckless, waving it around, cocking the gun and pointing at a person when he shouldn’t have.

    AB said it for you all! He would normally shoot away from his line- why did he point directly at the victim? His pointing should have been away from a human - it wasn’t and AB was the last line of safety, not inconsistent with NM laws.
    Cop thinks she has her taser and shoots the driver with a loaded duty weapon. It was an accident but the cop is spending time in jail.
    Industry standard is NOT to point towards any human or animal. That’s the safety standard.
    Screen actors guild, OSHA, Director’s Guild and every single handbook owned by actors, producers and directors on set. All people are responsible for safety on set is also the rule in all handbooks.

      This woman knows zero about gun safety standards . IMO - no one is saying how that live Ammo got there- does not take safety standards away from any actor. He knows never to point towards a human . Don’t make the case more difficult than it is. It’s simple and clear. If AB hadn’t pointed at a human the bullet would have gone through a wall or a ceiling and the police never would have known.

    I’ve been around guns pretty much my whole life and the first thing we were taught when you hand a gun to someone you open the action and check it and hand the gun showing that it’s unloaded. The person receiving the gun also looks and makes sure it’s unloaded. This was a movie set. In no instance should there have been a live round in a gun on set. Whoever handed the gun to him . Is the last person to hold it to an actor who in his mind . It’s a movie set and there are never live rounds in a gun on set. Who Brough the live rounds on a movie set??

    If the court thinks that the actor is further responsible for the weapon in the act of rehearsal, then an army of SAG actors will be--pardon a pun---up in arms. They may have to change the regulations on set, but actors are not arms specialists.
