      My question is if that prosecutor had evidence and that's why there is a mistrial, then because that was the same prosecutor that prosecuted Hannah, then that means that she hid the evidence from Hannah's defense attorney and if so, could Hannah's conviction be overturned because that prosecutor hid evidence from them also? 🤔

      @@yourhuckleberry3733 Yes , Hannah's defence attorney is filing a motion to dismiss or mistrial under the same terms today. They had brought this information before trial and also other evidence was with held including other reports.

      Alex Spiros whole case in the Baldwin trial was telling the judge and jury that the main person responsible for bringing live ammo into rust is SETH and SARAH, not Hanna. Seth and Sarah testified that they brought in the Live ammo polished muddied patined bullets into the rust set and did not tell Hanna where this ammo came from.
      Mr Tesks ammo starline from the 1883 he is the one that Mr Tesky kept so hanna had no access to those 1883 bullets to bring into the rust set. The only person who had access to those 1883 starline live bullets is Seth Kenny.
      When Sarah brought in the 1883 polished muddied bullets to the rust set , the reason they did not tell Hanna it is because Seth and Sarah thought that Thal Read had a batch of these at his own home . But Seth was not aware that those 1883 that thall had was kept with mr Tesky, where hanna had no access to them.

      Seth kenny testified in hannas trial that the 1883 bullets were muddied, patined and not safe to use as he could not hear the bullets rattle, but he still picked and chosed 1883 bullets and polished them to give to sarah and hanna to use. He also testified in his quiet office it was difficult for him to hear which 1883 bullet was live or not live. He gave them to sarah to give to hanna on the 12 october.
      Sarah knew that these muddied patined bullets came from PDQ and that this ammo box went missing for several hours from the set of rust, this is when Sarah took this ammo and put them in Hannas personal ammo box that she brought from home for herself.
      Only Sarah would know where Hannas kept her personal ammo box and had access to it in that moment. Hanna would not be stupid to mix live ammo in the blanks box. Sarah testified that when the muddied patined polished bullets from PDQ returned to the cart after going missing for several hours from the rust set, it was Sarahs idea to mix these muddied patined polished bullets from PDQ into the blanks bullet box that Hanna was loading the gun from.
      When Halina got shot, Sarah knew straight away that it was her patined live muddied bullets that were live and Sarah called Seths phone to speak to him and her call with Seth, Sarah threw all the muddied patined live ammo away and did not tell police that she threw them away until a month later , when these muddied patined bullets were destroyed. These muddied patined bullets would have been the same bullets in Halina which came from PDQ.
      Prosecutor Kari Morrissey testified that Thal and the witness Mr Tesky stated that these live muddied patined bullets never left Arizona, meaning that Thal read never gave Hanna the muddied patined damaged bullets to Hanna to use. And Mr Tesky was holding them, so hanna had no access to 1883 bullets.
      And the reason why the ammo bullets that Mr Tesky brought in looked completely different to Prosecutor Kari Morrisey in the photograph, is because the bullets that Mr Tesky brought in were not polished by Seth in PDQ.
      The bullet that was found in Halina’s body, is the POLISHED Starline Muddied Patined Live bullet from PDQ, that SETH AND SARAH POLISHED. That is a massive difference and most important difference as to why Hanna is innocent, and SETH and Sarah should be in jail for attempted murder
      Hanna should be freed.

    Seth Kenny needs to be interrogated and Sarah Zachary does, too. He told her to throw those live rounds away. She's lying under oath.

      Sarah don't have to do a thing, she was given immunity, but I agree she and Kenny was up to no good. Also, during the HG trial I got the feeling the two of them had been a lot closer than just co workers

      @@maciektrybuszewski9964 Sarah testified that she threw away rounds after a phone call with Kenney. A call she said was not longer than one minute. She called Seth immediately after the shot was fired.
      And now you have these new rounds that are no longer being hidden to finally investigate. Baldwin will never be prosecuted again, but its not too late for Seth Kenney to face charges.

      @@maciektrybuszewski9964 it pretty much was when Hannah was there, it was pretty obvious. She was given the opportunity to take a very nice plea deal if she gave up where it came from, it came from her dad, which is Thell Reed, who then gave it to Seth Kenny. Therefore, she didn’t take the deal even as sweet as it was because it would’ve put her dad behind bars, probably for a while, and he would’ve lost his career and his reputation. Hopefully he’s lost that regardless!

    When someone goes out of their way to help the Police and seems to be present at many key moments of the Police investigation, something is rotten. An independent investigation free of the purview of the Sheriff's department needs to look into this. As local Police seem to be buddies of some of the people involved. They need to determine if the live rounds at the set were a mistake or there for something nefarious.

      Which the judge just kind of meh'd past in the Reed case. Like a prosecutor violating attorney client privilege and giving privileged communications to a "witness" in 2 cases is just not something to care about.

      When police are investigating a movie set ammo incident and they don't know squat about movie set ammo They need someone that does know about movie set ammo to help them. What's rotten about that? Seth Kenney is licensed by THE ATFE to deal in firearms and sell movie set ammunition. He's local and the Albuquerque cops know him. The FBI determined that the live rounds didn't come from him. And even if they did, he's not criminally liable. People on set are responsible for checking incoming ammo. They're the ones handling it on set. Not Seth Kenney. Obviously, if it didn't come from Seth Kenney and it didn't come from Thell Reed, it came from someone else. Could have been that medical lady that got traumatized and wants to sue Alec Baldwin and Rust Productions for millions. She put in a pretty good show in court. And wants to see changes. Hannah wants to get the other half of her contract fee. She doesn't want to see changes.

      Wait for it... Sarah was given immunity to testify and railroad Hannah Gutierrez. Seth was never looked further after the search on the prop house five weeks later.

    What we do know is, Alec didn't load the gun, Alec was twice told that the gun was 'cold;' and, the photographer told him to shoot the gun at her twice. We also know that as an actor, according to the testimony up to the calling for dismissal of the case, the 'dummy' bullet closely resembled the live bullet so even if Alec had checked the gun ahead of time, he probably wouldn't have been able to tell the difference. Who could tell the difference? The armorer, it's why there are armorers on a movie set. As for the live rounds, the armorer put 6 of them in places they didn't belong after 'fishing them out of her fanny pack.' They were mixed in with the dummy rounds & she didn't pay attention to whether she was loading the live ones or the dummies. The live rounds could have only come from 2 places - the pro shop where other gun props were purchased and from the armorer's step-father's home. Therefore, either she brought the live rounds or the owner of the pro shop did.

      All of which I have pointed out to all the 'gun safety nuts' who know nothing about making films or TV shows with guns. The armorer and the other safety officer are supposed to know what the tell is for dummy vs. deadly, and to make sure their ammo supplies don't get mixed, don't get contaminated. But if someone is intentionally sabotaging a distracted armorer, then that is very sinister. And I think it is possible. NM is an open carry state. There are people all over carrying ammo. But yet again, it's like LE and the media haven't asked--just how was the set secured from other sources of ammo getting onto it?

      Well stated. Some really basic, ghastly fails led to this tragedy - but except for being the hapless guy left holding the gun, Baldwin wasn’t part of them. People have really worked hard to hold the “big name” responsible, including the prosecutor, but that just doesn’t match the functional reality of how movie and TV sets work. On set, the actors are the center of attention, but they are not gods. They are just part of a large and complex team, with each person doing their specific tasks, and everyone staying in their lane.
      The carelessness on set was monumental, but it really was on the armorer, first and last, to get a grip on the carefree, “open range” mentality and behaviors - and make darn sure they didn’t bleed over onto the set, or any of the production space! Playing mix and match on guns, bullets, and the rest… was a sure recipe for disaster. There’s lessons aplenty for the industry as a whole here, and certainly for armorers everywhere.

      Very well said. I’d even expand to remind people that EVERYONE handling a gun on a movie set does so recklessly - because it’s part of what they’re trying to film. Following the foolish logic used to charge Alec, if someone takes a gun while filming and waves it around recklessly, they should be charged with some variation of reckless endangerment, deadly conduct, menacing, etc. AND - if the actor has a prior felony conviction, and they handle a prop gun on a movie set, should they be charged as a felon in possession of a weapon?
      The charges against him were beyond ridiculous

      Some problems with your theories. Armorer didn't pass the live rounds out around the set after fishing them out of the fanny pack. She didn't keep dummy rounds in the fanny pack and she never loaded the gun out of the fanny pack that day. The gun was not loaded to be hot. Fanny pack was for blanks only because they can go through a boxful in a take, most hot scenes are going to have two or three calibres going off, and each caliber has three levels of bang. And they might retake a scene two three or four times. Dummies are load and forget. Load the dummies for the gun and walk away. And you can carry a few in a pants pocket without fear of blowing holes in your jeans 🥸😂😂😂.

      the Sheriff office invited Seth Kenny to guide them through the search warrant at his badly organized props/guns/ammo office. They were all colluding to throw Hannah & Baldwin in jail.

    Corporal alexandria handcock also handled the investigation terribly. I have no idea why she fell for Sarah And Kennys act. She contributed greatly to the mishandling of the ammo, interviews and gathering the correct suspects. Theres videos of her laughing and joking around with Sarah and Kenny, all while taking phonecalls from Seth Kenny and sarah. She took everything seth said as fact and to this day i cant fathom why. If she wouldve investigated everyone equally, she would have found out where that ammo came from

      He was granted immunity from prosecution. Not sure if anything can be done about him. Remember he was on the phone with Sarah Zachary after the shooting and Sarah Zachary decided to throw away ammo before the police arrived. Sarah Zachary can't explain why she destroyed potential evidence yet she also was granted immunity from prosecution.

    The fact that Seth Kenny immediately inserted himself into the investigation and continue throughout the investigation all the way up to and through the trial inserted himself and kept diverting attention to everyone else is why I think even ▪️Seth▪️ Kenny thinks those may have come from him

      @@Thenvisibleman David Hall took a plea deal, he admitted that he only checked 3 of the 6 cylinders and then handed the weapon to Baldwin, he also was obliged to testify. Sarah also signed a impunity agreement in order to testify in the other trial.(I think) and Seth was feeding information to the investigators.

      Let me clarify that actors have never had the responsibility of checking firearms. An armorer, the state’s own witness in Hannah’s trial, testified to that very fact. Paraphrasing here, but that armorer stated that actors only check firearms for their “own peace of mind”, that it was not a requirement and that’s SOP on virtually all movie sets.

    If Hannah Gutierrez has the money to hire a very good lawyer, her civil suit against Seth Kenney could demonstrate clearly how he wittingly or unwittingly provided the live rounds and--on October 12--Sarah Zachary brought them to the Rust movie site in a box. After that, Hannah may have indeed handled them, loaded them, and not checked them properly. But she can expose Seth Kenney for what he is: a liar and a massively successful narcissist.

    For those asking about Brandon Lee. It was different circumstances in death.
    March 31, 1993, while filming The Crow, Lee died from a wound on set, caused by a firearm malfunction; the lead tip of a bullet from a previous scene had stayed in the barrel of a handgun and ruptured a major blood vessel when a blank was shot at Lee
    Although the revolver was loaded with blanks, the gunpowder in the blank cartridge ignited, leading Massee to unknowingly fire a bullet fragment at Lee, who later died in surgery. While Massee did not face any criminal charges, Lee's mother did successfully sue filmmakers for an undisclosed amount

    Joe Swanson should not be making movie bullets, and live bullets. Seth Kenny told the Sheriff, "sh*t sh*t sh*t" when he realized these were indeed Joe Swanson live bullets mixed with dummy bullets.

      There were 6 live bullets found on set. They were the same brand and shape as Joe Swanson dummy rounds. Nickel primers, Starline brass. It seems dumb for a company that makes fake movie bullets, to also manufacture identical live bullets.

    Yeh, seems like they largely scapegoated Hannah, she made a mistake not checking the rounds correctly, she probably wasn't expecting that live had been brought onto the set and contaminated with dummy rounds and her defence argued she was under a lot of pressure and set off the set when she was supposed to be there ensuring safety. Thell Reed tried to tell the court the rounds came from the supplier - who had put on the blame on Hannah. There's a lot of information the jury weren't told.

    Hannah via her dad. Seth looked them over and possibly missed the live ammo. He had Sarah toss any rounds (dummy and live) from the prop cart. Then he went later into the unsecured prop truck and removed the rest of the live ammo he found there. He insinuated himself into the investigation to keep his own tracks covered.

      Yes. Baldwin’s case should have been dismissed, 100%. Actors in the industry are not responsible for checking weapons themselves - that’s a standard and was testified to by an armorer (state witness) in Hannah’s trial. Dave Halls was 90% as responsible as Hannah, since he should have checked all the rounds (got a plea deal, fine). Hannah’s trial went exactly the way it should have - she was the armorer, failed to check the rounds, and loaded the firearm.

Under his interrogation he claims he points the gun at the ground and fires the gun to make sure they are dummies. He also claims he doesn't remember doing that after lunch.     There is an ATF loophole that allowed Sarah Zachary to handle firearms on the set of Rust because she was employed 1 hour per week by Seth Kenney, who was a licensed armorer, and who sold the production props that were supposed to include guns, dummy rounds and blanks. He hired her for one hour a week only for this reason. Sarah hired her boyfriend’s 19-year-old sister Nicole to help her. Nicole was not authorized to handle firearms on the set. Police interviews with multiple witnesses said that it was Nicole, not Sarah, who had an accidental discharge with a blank and shot herself in the foot. In the Hannah Gutierrez Reed trial, Sarah testified that she herself had the accidental discharge. The prosecutor, Kari Morrissey, had to know she was lying about that. Sarah always acknowledged discarding ammo after the incident and claimed she didn’t know why she did this. Dave Halls, another prosecution witness, also lied on the stand in that trial. Many witnesses contradicted his version of events in police interviews. I don’t think HGR was the source of live ammo on the set. I think Seth Kenney had instructed Sarah to throw away as many dummies as she could so that the production would have to order more from him. But Hannah complained to Sarah that expensive dummy rounds were missing. And I think that Sarah and Nicole tried to mask the fact they had thrown them away by taking what they thought were replacements from PDQ without Seth’s knowledge. But what they took included live rounds, and the box containing these mysteriously appeared in the prop truck on the morning of the shooting. Live rounds ended up in bandoliers for two actors, and one was left on top of the makeshift cart being used by the armorer. It is critical that armorers have a proper cart in which ammo can be locked after it is checked ahead of time. It is not realistic to require them to listen for a dummy to rattle when there are high winds and other noise. People responsible for distinguishing dummies from live rounds should be tested regularly for hearing, vision, and color blindness. This isn’t something actors should be doing. Even police were unable to distinguish some of the dummies on that set from live rounds, and they had to be sent out for testing. George Clooney thinks Baldwin should have made sure the gun was empty. He’s full of helpful advice these days. I don’t think an actor should ever be handed a live gun. An actor should not be trusted to make a live gun safe, especially one that can go off when dropped. I know people want to make this about gun safety and never pointing a weapon. But the primary problem is that live ammunition got on that set. That is an accident waiting to happen, and it can happen without any violation of safety rules. Another senseless tragedy is inevitable if the primary problem is not addressed. The ATF loophole needs to be closed. Seth Kenney used that loophole to bring young women who desperately needed jobs into his orbit, and he did not train or supervise them properly, if at all. He should not have stored live rounds in the same facility with dummies, if that is what happened, and I think it did. If Sarah took those rounds without his knowledge, I don’t know what his criminal exposure is. I don’t know what her criminal exposure is either. The production failed to provide a proper cart that locks. They have civil exposure. I would not have voted to convict HGR. But I also don’t think she should have qualified to be armorer. They should be licensed.
    I was looking forward to hearing testimony from defense experts about the gun. (Forgive me if I don’t trust the gun’s manufacturer to basically testify that he has no liability.) I was looking forward to hearing from experts about whether actors are allowed or encouraged to rely on professionals who tell them the gun has no blanks, which is what “cold gun” means. (What if an actor is sight impaired, or hearing impaired?) But I’m glad the criminal case was dismissed with prejudice. I’m glad the prosecutor was exposed as the liar that she is. The chief investigator lied on the stand for as long as she could, until the judge cornered her, and then she gave up the prosecutor. I hope there are consequences for both of them. Most of all, I hope the investigation into PDQ is reopened and that the evidence that was hidden undergoes powder testing by the FBI. The only way to ensure this doesn’t happen again is through legislative change and big civil penalties. Based on what happened in Baldwin’s trial, there is a chance HGR will get a new trial.
    When people say the 6 live rounds found on the set of Rust were identical, they are forgetting that Sarah Zachary testified that she threw rounds away after the shooting and said she did not know why she did this. I think she realized what she had done and tried to discard the rounds that looked the most different to her.

      ...and a small but huge detail is that on that particular day, Hannah did not get to pass it to him directly herself. David Hall passed it to Baldwin saying, " cold gun". In the completely unusual instance, Hannah was made to stay outside of the small church with her gun cart, and if I recall correctly she actually handed the gun to Sarah ( trained by Seth) who took it inside the church and passed it to David.

Chaos broke out earlier that day, people quit and walked off the set for a number of reasons, safety procedires being one, having to drive extremely far distances to the set was another. Total discord going on all day prior to the accident. The original expirienced armorer quit too, I don't remember why.

She had little to no respect from Seth and Sarah and little control over the seniors on set. The " evidence of chaos" videos featured are not from that day, but they certainly do indicate a certain lack of respect for Hanna's authority. She was Lead armourer from the start, btw. They couldn't start filming until after Hannah was hired. Find and listen to the testimony on the stand in Hannah's trial. Assistant Director, David Hall in particular mentions that. And it was a couple of camera operators (and I think also a prop assistant) who walked off set due to safety concerns.

    I have always thought that Seth Kenny accidentally mixed live rounds with dummy rounds and Hanna failed to recognize them when she loaded the gun. The initial responsibility lies with Seth Kenny and on down the line where safety protocols failed with each subsequent person.

    The whole case(s) were fascinating to watch. Morrissey committed the biggest investigation sin : she twisted / altered / omitted facts to fit her theory, rather than letting the facts lead to the truth. Once she had the conviction on HGR, she couldn't go back and had to hide the Teske rounds to also help convict AB.
    How did AB defense learn of the Teske rounds is my question. Seems like they knew on day 2 and let Poppel perjure herself.

    When I watched all of the Hannah Gutierrez Reed case, I thought it was weird that the Sarah was let off for her testimony, but yet she threw away shell casings and bullets that are evidence. Seth Kenney made it right on scene after Sarah "emergency" text and went right to the safe and talked with Sarah. He almost was acting stupid and helping police in a weird way. They should test those rounds given by Mr. Teske with the FBI and since they were on 1883 and part of them were reloaded and give to the Rust set.

    No one is asking where the live 45 rounds Seth Kenny brought back from 1883 practice wound up going to ..... i had not heard the rounds in the PDQ bathroom were the 1883 rounds. I believe the restroom rounds were tested and the powder was not the same as the live rounds on Rust..

      Yup, except Seth Kenny told on the stand in Fri when asked about the 1883 rounds "some had a muddy rattle, some didn't rattle at all"
      Now if they were mixed up you see the issue.

    Are you all forgetting Gutierrez was arrested a few days before the shooting for having a firearm in a dive bar in Santa Fe? She should have been fired. How can an armorer have a pending felony firearm charge? There is a link between Kenney and the SF Sheriff's Department. Find someone to explain how this works in Northern NM.

      She wasn't arrested and she wasn't charged. The gun she had was a DENIX set gun that doesn't even look real and she just was testing it to see if it would pass the visual test. Bouncer at the door said "Can't bring that in here" she said "But it's not real. See?" and bouncer said "Doesn't matter. Looks real." But it was dark in there.😀😂😂.

    In addition to everything else, I find it deeply saddening to consider that Alec Baldwin, raised in the Roman Catholic faith alongside his brothers, has to live with the knowledge that he unintentionally caused someone's death. The emotional and moral weight of this incident, compounded by his religious beliefs, is a heavy burden to bear for the rest of his life. Of course, the family of Miss Hutchins has to endure far worse, but this is still profoundly awful for Alec Baldwin.

    Bottom line Hannah Gutierrez did not check bullets! She admitted in police interviews,"I 'USUALLY' check bullets⁉️There's pix of live bullets on RUST set on her lap & actor's holsters forseveral days! But for Hannah Halyna would be alive today!

      Another possibility is she shook the round, and it was accidentally contaminated by Joe Swanson rattled and sounded like a Dummy round.

    Sarah and Seth are the guillty ones, I thought it from day one since Sarah gave this testimony, and in all respect to Mr Bowles, but he did not defend Hannah enough, if Sarah went in front of Spiro she was in Jail now! and Kenny too! Hope justice will come.

    Alec Baldwin should be in jail. The fact that he isn't shows that rich people aren't held to the same standard as the rest of us. Everyone knows the number 1 rule when it comes to guns. Alec failed the first and second rule of using a gun. Everyone keeps saying who brought the live ammo. None of that matters. When you hold a gun you never point it at somebody unless you tend to use it. You don't pull the trigger unless you tend to own it. Baldwin did neither. He is exactly what is wrong with celebrities and fire arms. Btw it's hard to pass the fire arms training when he was busy doing everything but the training. It's okay he will spend years in civil court now.

    What are live rounds doing on a movie set ? These people are actors not gun nuts . In this situation you would never expect a fully functioning weapon to be given to you while filming a movie .

    Take a look at Seth's first interview with the police. He throws Hannah and her family under the bus by saying that Thel isn't her real father and that she was conceived by his wife cheating on him when he was away on location. Why did he need to say that, if not to try to insinuate himself as the person who knows everything? Zero respect for that man!

      Maybe he was trying to see if the police knew or not? Maybe see how they reacted to the info would it change the way they looked at things? Handled things? Seth Kenney is a hell of an investigator in his own right. He a actually helps Hannah while appearing to be out to get her. He told the police that he tried to get her fired and production told him "No can do. She's too good with the guns." Why would he tell the police that if he's trying to hang her high? I got a theory, you might not agree. I think Seth's looking out for both girls, like daughters. And Sarah hears talk on the set that maybe someone wants Hannah nailed to the wall or just out of the way or something. So that's why he makes that call to the producers, to try to see what they know and maybe get her out of the line of fire without letting on. Sarah can play a real doorknob when she wants to. Probably got other talents that we don't know about yet 😂😂😂.

    Your court system and your prosecution in several cases of late are letting your justice system down, just like in this case, like the YSL case, like the Karren Read case, your prosecution is applying a win at all costs no matter what it takes this judge did the only thing she could have done and that was to dismiss the case, she was completely fair and applied justice the correct way.

    Maybe one important question is who is making live rounds with starline brass dummies/blanks casing ammo since it was said in the trial that the company itself does not make and sell it.
