- Jay Z wants this case DONE. Shawn Jay Z Carter has filed a motion to dismiss the civil case against him. Jay Z and Diddy are alleged to have raped a 13 year old girl at a VMA's after party back in 2000. Jay Z's lawyers argue that Tony Buzbee, the plaintiff's lawyer, failed to properly investigate the facts of the case prior to filing the lawsuit. San Diego Criminal Defense Attorney Jamahl C. Kersey addresses the arguments in the motion.
This judicial system is very lenient on penalizing false accusers. There's no serious legal accountability for making false charges against another person.

This story, as far as we know, has no corroborating evidence thus far, and a number of major inconsistencies. What’s BS about the argument?
Yes sure, this accuser's claims are terribly inaccurate. There's no real police, attorney, detective or investigator that wouldn't be curious as to the credibility of these claims.

Jay Z brought it to the public first with accusing Buzzbee of trying to blackmail him when it was a standard demand letter. He wanted smoke and got it!

Great breakdown. The factual allegations in the civil suit are sketchy. Right now, It's looking favorable for Jay-Z and less promising for the accuser, who should have secured better representation to draft a stronger complaint. If this gets dismissed and she decides to refile, she should consider a different attorney.

They could have also gone to the mediation as a fact-finding, at least to know who the accuser was and the evidence being used to base the assumption upon his culpability.
They could have operated in good faith and refrained from disparaging a colleague and a professional who is merely legally representing an accuser.
Them going behind Mr Buzbee to investigate him on unrelated professional matters, is what also added to them seeming suspicious because it was heavy-handed, in bad faith and unethical.

2 of 4) When it comes to reputational risk, they engineered that all by themselves. However, there are some mitigating circumstances:
a) In 2000, the navigation for a City nobody is familiar to is near impossible for BOTH that 20 y/o friend and for the dad.
Seeing as it's unfamiliar for everyone, a direct stop to the venue would be improbable. Then we have the question for where exactly she was dropped off, the security protocol would have made the car drop her off far from the door or entry ways, especially if a crowd was there. The proximity and cameras would be useful to source, if any establishment still had them.
b) The now late 20 y/o had no business transporting and leaving a child at an event, no matter their eagerness to get there.
c) Assuming there was extensive travel; the cars would have needed refueling.
The 2000 or latter 90's models did not have a long travel range and as machinery, require at least 1 stop along the distance; before departure and then arrival. The methods of payment should be determined and the other gas station ought to be made known.
c) The limo driver, their employer, or the security services companies need to be subpoenaed to question the protocol in having a "groupie" into the premises.
d) The Mr Madden interaction may have happened because the tour happened AFTER the event, and with planes, it's not impossible to have been at the venue.
What they could have done is to definitively state that the interaction with a 13 y/o did not occur at all. The next is to validate the date in which the tattoo was forged, so that it's not a matter of the use of pictures to make this point.
On point information it happens all the time it's not about disliking someone. Because of whatever you feel about a person or persons as we see in nowadays. People are seen guilty before clearing their innocents. Not all people convicted isn't always guilty it's so many people. Is so deeply into their feelings they bypass all the facts. About what the law supposed to be about you are a attorney and it's public people. That will doubt what you say and saying because they doesn't like somebody.

The allegations came at the back of the Diddy saga and hence it would be easy to take it up as "true". The other is that there seems to have been a flimsy Defense representation whilst at it. The things that were brought up on NCB by the questionable reporter, were not, themselves, brought on by the Defense. It becomes a problem when Mr Spiro then relies on that interview to make his points or for anyone else to use that as the litmus for Discovery. Even what they rely on can be debunked.
The problem is that both Mr Carter and his Defense made this a matter of public interest with their public statements and so cannot now rely on people being unbiased, even when they are wrong. They actively made this a matter of a trial by media and public opinion.

The woman who pretended to receive a call from Buzbee's team while she was on live, only for the Buzbee team to deny it all a couple of days later. Buzbee is probably desperate to find anything against Jay, yet even he doesn't care in the slightest about Jaguar's words.
Two years ago, that woman was live on Instagram throwing her son's ashes at her ex-husband and smearing them on her face. I still remember the video of her asking Jay to reconnect, claiming that "music" needed them to collaborate again. I'm sorry for her, it's clear she has a lot of issues, but you can't take anything she says seriously. Only TikTok could have made her a prophet.

I’m saying that people accused of crimes (I’m aware this is a civil case) are innocent until proven guilty. That’s not my opinion, that is the law. I’m not asking you to consider his denial as the truth, I’m saying people shouldn’t assume he did it just because someone put allegations in a complaint. Is it possible that it happened, sure, anything is possible. But she also has millions of reasons to make up a story. Given all these inconsistencies, it just doesn’t seem plausible thus far. But as I said, if evidence emerges that suggests otherwise, my stance would change. What’s unreasonable about that?
