Hi Oscar. The Department of Labor recently released a new format of form ETA-9089. The layout is in contrast with what we're used to. ETA-750B appears to be not anymore in the list of forms. For the form ETA-9089, the one linked in the uscis page of form i-140 and the one linked in the form page of the department of labor are with the expiry date in 2021 however by researching ETA-9089 I was able to find another version on the website of the department of labor, with an expiry date in 2025 however the categories in it are very different and don't match the categories J,K,L,M mentionned in the uscis webpage. Do you know if we should still use the old one?
It's common practice among self petitioners and lawyers and I recommend doing it because it takes literally 2 min to print the extra copy and sign it. So why not do it?

It's not mandatory but I don't think it hurts since it takes 10 min to fill out and the officer may be more used to see them in similar categories like NIW

If they approved the I-140, probably not, but I cannot predict what will happen. Just read the instructions carefully. If they have not approved the I-140 yet, the most common situation is that they realize and they issue an RFE for it

Can I submit a new petetion, as I have all the data in my laptop, just to take a print of it. do they assign priority date inspite the petetion is rejected. Secondly , should I wait for UCSIS response and resubmit the same petetion with correct payment system.

Hi Rodrigo, i know but USCIS had not issued any other guideline and they still have a link to the expired form . Since it had been expired a long time, I take it that they are still accepting that version

They discontinued it's no longer in the website. Use ETA-9089
