I'm really sorry about your situation. In this case the doctor can be held responsible for negligence because when he realized he knacked the bladder he should have called the urologist to come assist with repairing. In the matter of the HPCSA taking so long to conclude the case it is probably because they are auditing a number of his cases and not just only your case, so that they can ascertain whether it was a one-time occurrence of negligence or if it is a normal occurrence for this doctor to be negligent.
The bladder is right infront of the uterus. A bladder injury is a possible complication from/during surgical procedures on the uterus. This is usually explained when consenting a patient for surgery. Unfortunate that this occurred. I hope she’s able to get a successful repair and get back to a better state.
I'm really sorry about your situation. Doctors need to be held accountable. One Doctor had me NPO for 3 days pending surgery, then he got upset when my family confronted him.
unfortunately things like these happen more than we would like to, but irregardless of our best intentions and the expirience of the doctor, complications will still happen. and another thing to think about is that, people are not machines or made in factory, each patient have a slightly different anatomy, so complications can arise. It is just that the patient have to be made aware of all the possible complications that may arise during the procedure so that if ever the complications do happen, they know who to go back to.
No one could’ve said it better, the thing is as doctors we learn anatomy in books where veins are blue arteries are red nerves are yellow. On autopsy there’s no blood flow, on a live human being there’s blood flow and it’s kind of a challenge to differentiate those
Total Hysterectomy is no small operation, I've seen people lose lives not because of the operation itself but bleeding being the main problem. Can anyone imagine the stress it brings to the Doctor incharge !?! I am not defending any act of medical negligence, but thee best Doctor to one is thee worst Doctor to someone else. It happens here it happens even with Harvard trainees etc and it's not gonna stop.

It's not a matter of health professionals defending one another, there is legal room for reasonable error due to the nature of human bodies which differ considerably and thus present risks with every procedure. The structural damage referred to in this video is in fact a common risk associated with hysterectomy. It is likely that the surgeon will be exonerated if he took all reasonable measures to ensure the risk was minimised.
@@masiphililedlamini7869 a case for incompetence will be properly investigated by HPCSA in this case. However as she used the Dr's services for several years prior without complaint and given the fact that the Dr provided services to others incl. celebrities also without complaint, this seems to be an isolated incident. Not incompetence. We all understand that Drs are not God, every procedure carries risk and there is no Dr in existence with the capability to avoid all risks. The Dr also competently suggested a less risky method which she declined. But time will tell after the investigation is completed.

Well the dr did mention to her that he/she damaged her bladder and repaired it. Unfortunately It was not successful and now she feels it was negligence and improper for a gynae to repair such. It’s tough being a healthcare professional in SA these days hey.?We’re actually following in the footsteps of USA and people don’t realise how this will affect them as pts one day
My sister is a Doctor and every time i hear such stories my heart sinks for her and every one in this field. Surgeries are high risk in their nature and mistakes can happen that don't necessarily equate to negligence. But i guess on the other side of it, it makes sense to want to blame someone.
I’m sorry you feel that way. In my opinion and in my experience, negligence is as a result of ignorance. Doctor’s have a tendency to brush off patients when they raise valid concerns. And the laziness to seek second opinion from more experienced doctors is the cause of these issues that could be avoided. Someone’s life cannot be taken for granted. All cases should treated with reasonable care and hence every case will assessed based on proper procedures and guidelines and if it is found that the doctor did not follow this procedures then they will be found guilty. If however, the doctor did everything accordingly then they have no case to answer to.
I started a case in Dec 2016 with them. It still hasn't concluded. Dr botched further surgeries since mine, children even. He continues to practice until he decided to retire more than 5 yrs later. Civil case settled out of court 6years later. But HPCSA who are mandated and paid to protect patients don't care 7 years on.
Imagine! He only stopped when he decided to retire! Lord have mercy! Something must be done and things changed! because our lives are changed by these doctors drastically and we live with the burden of loss and the scars from their negligence.
I had TAH in 2019 for ovarian cancer I knew it was a big surgery i knew there will b complications and doctor told me pros and cons yes i feel your pain but sometimes this things do happen im sorry i hope u heal well soon and pray for fast healing. Good luck lets hope it will resolve soon
Health care workers in private practice are individually held accountable. They have to take out practice insurance for cases where people can sue them directly in cases like these. We already pay too much for drs in government hospitals because when a health care worker in government does something like this, the hospital is accountable and we tax payers pay.
That’s not true. Gynaecologists, surgeons and urologists work in the bladder. There’s a whole subspeciality called urogynaecology. Complications don’t equal negligence. Wish people knew this
True story....and a bladder/ureteric Injury should have been discussed when doing the consent. Not sure if the gyne referred her to a urologist post op for a consult, especially when she complained about ongoing pain at 3 months. No one is going to want to be a doctor if patients sue for every complication.

Yeah it is common especially in patients with other issues like previous pelvic surgery and high body mass index. Counselling and proper referral should've solved this..

They should have had the former president of HPCSA to explain the procedure at least when it comes to cases such as this, am not sure why the doctor felt obliged to do surgery when clearly it wasn’t his/her preferred way of treatment and not referred the patient to someone else with whom the former patient would discuss surgery as it would seem the patient wanted surgery.
Trust me I was a victim at Steve Biko Academic hospital. Now I can't conceive. Left with abdominal pains, and a huge scar instead of a small scar. Going to the council was fruitless because I was taken from pillar to post. It's costly to take them on. The hospital carried out surgery for removal of an expelled fetus where they were looking for a baby which caused huge scaring.
Lost my loved one there, he was operated four times for a bowel perforation, at some point when we came to visit him we’d see his surgery wound literally left open!! Telling us they’re monitoring him, he was fine after the first operation and then everything went downhill from them!!! They kept open and closing him, he kept getting worse ,I wish I could get answers!
I spent more than a month in hospital with an enlarged spleen. The doctors honestly used me as a case study instead of helping me. I was lucky to get out that hospital alive. Am still in pain with an enlarged spleen. Lost all my leave days sleeping in hospital. Now am battling to get my medical report from a private doctor who discovered i had an enlarged spleen. I wonder why he is so afraid.

what she is describing is a known hysterectomy complication. not a botched surgery. maybe they didn't explain to her that it is one of the complications that can happen. The only fault here is dismissing it as healing when she had pains.
Hysterectomies should be a final resort not contraception. You will need hormone replacement therapy for life and be ready for depression and brittle bones
Before she sues she must check the decision of Buthelezi v Ndaba 2013(5) SA 437 (SCA). This can be classified as a normal complication of a hysterectomy.

Very true! They are murderers with no accountability. The system protects them, and we are not informed about where to go, who to talk to when one wants to lay a charge of negligence. My brother passed away after a surgeon operated on him though it was advised that he should not undergo any more surgery, because he had undergone so many in the previous years, he never smoked anything, never drank alcohol, he lived a healthy lifestyle. That arrogant surgeon being a trained medical professional he overlooked the previous doctor's advice, operated on him, he never recovered, he passed on at the age of 29. Every day since he passed on in 2017, I live with the reality of living life without him, he had plans to further his education the following year, thinking he would recover, and I promised him that I too would go back to school, but I lived to graduate without him. It is disheartening really what these doctors do and there are no consequences for their actions.
Sorry to hear of your circumstances, it is truly regrettable that you had this experience but from wat you have detailed in your comment it seems that your brother was chronically ill for some time prior to the procedure. We do not know the circumstances but given the fact that the condition seems to have been at quite an advanced stage if he had several surgeries prior (according to your comment) was there any other treatment that might have helped at the time? If he did not have the procedure what would have been the outcome?
@@DD-hp9vo There were alternatives, the specialist we as the family transferred him to, informed us of the alternative procedures that could have saved his life and was very much upset that a surgeon with many years of experience could not see the trauma that my brother had already recovered from, in his previous ops but instead made the situation worse to a point of no recovery. I remember the day in his office( The specialist) when he told us that our brother wasn't going to recover this time around because of that one doctor who was too a specialist /surgeon who acted on impulse instead of observing and liaise with other medical professionals. As patients we have to face the unfortunate reality of dealing with arrogant, selfish Doctors who do not want to be held accountable for their mistakes and blame them on circumstances. It pains me a great deal till this day, how that situation could have been avoided.

Unfortunately, complications after surgery should be highly expected but doctors can and should be held accountable. Get a lawyer who specializes in medical negligence cases to assess if you have a case or not and take it from there.

I hear people here saying it's a surgical complication.... even if that was true, why did he not follow the correct steps? He could have called a urologist on that day to exemine me. This case appears to be an isolated incident as the surgeon seems to have a long standing, successful reputation with celebrity in particular which is why he was specifically selected. Besides the fact she stated he has in fact been her Dr for several years so he must have been doing something right during that time. In that light it is also unreasonable for news media to follow her incentive to publically denigrate the reputation of a medical professional without doing the appropriate prior investigation fully or waiting for legal proceedings on the case to be finalised as the individual then has full right to pursue litigation against her and against news media for defamation. However in this case the issue seems to be emotionally motivated by the news anchors own self admitted experience with possible medical negligence. Bias in news reporting is unprofessional. First obtain all the facts from both sides then run with the story. The complaints and claims procedures are clearly stipulated on HPCSA so it is unclear why she believes there is no information on where to go to submit a complaint. It seems she wanted to divert the HPCSA process entirely for whatever reason. Obtaining legal representation is not a means to divert the HPCSA investigation or to fastrack the process or a means to pressure the Dr for payout. The HPCSA as the regulator will still require whatever time they stipulated to conclude their investigation even if legal representation is used. She has a documentary coming out in this issue, hopefully it will also cover patients responsibilities regarding risks as the Dr did in fact suggest a less invasive method with less risk through hormone therapy but she chose the higher risk option of surgery instead. Hopefully this publicity she is generating for the documentary is also not a means to avoid any payment obligations from her long standing treatment over several years with the same Dr.

We are saying there should be accountability, we can not accept it as an "unfortunate" event and move on. In other professional fields there is accountability for negligence and misconduct ofwhich the consequences are court case and convictions. It's like we are signing our lives away to the hands of people who are "practising" it's bogus! I'm assuming written informed consent was given by the patient for the op. And this entails accepting that complications do occur, even a simple Panado can cause harm after being prescribed. Granted, a Urologist should have been atleast informed intraop.
I really hate that we are here as people. The amount of medical negligence that goes unchecked or where doctors get away with it is insane. Also what's the measure being used to decide if that doctor has more than one case of negligence vs one case, cause that one case matters too and I think alot of patients run out of money to pursue cases and Covid just let doctors run amok, with no accountability or nothing. Shame Mann it’s quite said, I hope they explained all the risks to you…. When I had my c/s I sustained an injury as well which was fixed easily in a public hospital… I knew all the risks. I hope that urologist doesn’t make a mistake which can happen as well
This is an expected complication of abdominal/pelvic surgery. There is also a specialty called UroGynaecology- these are gynaes that can repair bladders amongst many other things.
Just read the consent you signed these things happen and you always go back in for a relap should these problems arise honestly this lady is just looking for money ..
At the same hospital, a doctor told my sister that she did not have a baby in her tummy and they will give her a pill to clean her but she refused a the child nearly aborted is 4 years of age now

Not making your patient of complications is not negligence? Mentioning something while I'm probably high on sedatives is not negligence? What ever made him think it's not necessary to mention such important information is negligence on its own. Even after she went back to him, he says allow it to heal.🚮 if you ask me.
I had a doctor give me medication that made me sick... i tried scheduling an emergency appointment with her they told me shes busy and cant see me... i decided to go to her practice hoping that when she sees how sick i am she will help me... did she not tell me shes busy with other patients and if the meds are making me sick i should stop them (had stopped them a while back and i was still sick) told me that right infront of other patients. Guess what? After i left there i was admitted in hospital and had to take 6 months sick leave to recover after being discharged... did her office not call me a month later threatening me that they will charge me for a missed appointment... i was then told my case is a difficult one and it would take forever to settle... had to just walk away and be grateful that i didnt die... they get away with alot these doctors
@@DD-hp9vo it makes sense what you are saying but I was sick due to the side effects of the medication. Unfortunately by the time a realized that it was medication that was making sick the damage was already done...the Dr other doctor who admitted me confirmed it after running tests
@@thato06 sorry to hear this, that's an unfortunate situation, it may be that the Dr did not do the initial assessment properly to take all possible side effects into consideration however Drs can't always anticipate if a patient might have a bad reaction from medication. Bodies are individual so it is very possible for patients to have unexpected and unforseen side effects from meds that usually do not cause such symptoms. Nevertheless hopefully you have recovered without any long term consequences

I think the thing that upset me is that she totally dismissed me when I was telling her that I was sick knowing that that the medication I was taking could cause adverse side effects. Thank you, I did make a full recovery however it does flare from time to time but because I'm aware of the symptoms I know what to do before it gets worse.
Wasn’t she told of this complication? Also did she sign an informed consent? If she did then the Doctor may not be guilty as she was properly informed of this complication and possible ways to manage the complication if it’s manageable. Also how is the urologist feeling as he might wake up with lawsuit from helping. However, did the doctor do baseline checkups after she came with complaints and how did she manage this? If she didn’t then she might be guilty
HYSERECTOMIES ARE NOT CONTRACEPTION. A woman's womb doesn't just carry a baby it does A LOT!! This is only the start of her pain. She should ready herself for osteoporosis. This whole reducing a woman to a mindset will hurt MANY perfectly created bodies.
The bladder sits right on top of the uterus. And injury to the bladder and ureter is a known complication and should have been declared to her. It’s not so much that the operation was botched it’s that the counselling was inadequate both before and after the procedure. The issue is that of: informed consent and post operative care and counselling. It’s unlikely that the doctor will be disbarred this is a complication that could happen to any surgeon . These is definitely a degree of negligence she should also just sue and reach a settlement either with the Doctor’s insurance. It’s unlikely the HPCSA will strike the dr off the roll
I went to a GP 7 days after my c-section and he pulled the disposable stitch and cut it (making it tighter) now the side of the c-section scar that he pulled and cut the scar from is painful., Do y'all think I have a case? I want to sue for medical negligence.

Every surgery has its own complications. I think this could haven't escalated at this stage if everything was dealt properly since the beginning.

Well the dr did mention to her that he/she damaged her bladder and repaired it. Unfortunately It was not successful and now she feels it was negligence and improper for a gynae to repair such. It’s tough being a healthcare professional in SA these days hey.?We’re actually following in the footsteps of USA and people don’t realise how this will affect them as pts one day
I think when someone is in pain they will want someone to blame.
My sister is a Doctor and every time i hear such stories my heart sinks for her and every one in this field. Surgeries are high risk in their nature and mistakes can happen that don't necessarily equate to negligence. But i guess on the other side of it, it makes sense to want to blame someone.
I’m sorry you feel that way. In my opinion and in my experience, negligence is as a result of ignorance. Doctor’s have a tendency to brush off patients when they raise valid concerns. And the laziness to seek second opinion from more experienced doctors is the cause of these issues that could be avoided. Someone’s life cannot be taken for granted. All cases should treated with reasonable care and hence every case will assessed based on proper procedures and guidelines and if it is found that the doctor did not follow this procedures then they will be found guilty. If however, the doctor did everything accordingly then they have no case to answer to.

I started a case in Dec 2016 with them. It still hasn't concluded. Dr botched further surgeries since mine, children even. He continues to practice until he decided to retire more than 5 yrs later. Civil case settled out of court 6years later. But HPCSA who are mandated and paid to protect patients don't care 7 years on.
Imagine! He only stopped when he decided to retire! Lord have mercy! Something must be done and things changed! because our lives are changed by these doctors drastically and we live with the burden of loss and the scars from their negligence.

Maybe the HPCSA can consider an Accident Fund for such cases.
Health care workers in private practice are individually held accountable. They have to take out practice insurance for cases where people can sue them directly in cases like these. We already pay too much for drs in government hospitals because when a health care worker in government does something like this, the hospital is accountable and we tax payers pay.

That’s not true. Gynaecologists, surgeons and urologists work in the bladder. There’s a whole subspeciality called urogynaecology. Complications don’t equal negligence. Wish people knew this
True story....and a bladder/ureteric Injury should have been discussed when doing the consent. Not sure if the gyne referred her to a urologist post op for a consult, especially when she complained about ongoing pain at 3 months.

Yeah it is common especially in patients with other issues like previous pelvic surgery and high body mass index. Counselling and proper referral should've solved this..

They should have had the former president of HPCSA to explain the procedure at least when it comes to cases such as this, am not sure why the doctor felt obliged to do surgery when clearly it wasn’t his/her preferred way of treatment and not referred the patient to someone else with whom the former patient would discuss surgery as it would seem the patient wanted surgery.
Trust me I was a victim at Steve Biko Academic hospital. Now I can't conceive. Left with abdominal pains, and a huge scar instead of a small scar. Going to the council was fruitless because I was taken from pillar to post. It's costly to take them on. The hospital carried out surgery for removal of an expelled fetus where they were looking for a baby which caused huge scaring.
Lost my loved one there, he was operated four times for a bowel perforation, at some point when we came to visit him we’d see his surgery wound literally left open!! Telling us they’re monitoring him, he was fine after the first operation and then everything went downhill from them!!! They kept open and closing him, he kept getting worse ,I wish I could get answers!

I spent more than a month in hospital with an enlarged spleen. The doctors honestly used me as a case study instead of helping me. I was lucky to get out that hospital alive. what she is describing is a known hysterectomy complication. not a botched surgery. maybe they didn't explain to her that it is one of the complications that can happen. The only fault here is dismissing it as healing when she had pains.
I think Hysterectomies pose negative consequences and or side effects to our health which we aren't informed of or realize.
Hysterectomies should be a final resort not contraception. You will need hormone replacement therapy for life and be ready for depression and brittle bones

Very true! They are murderers with no accountability. The system protects them, and we are not informed about where to go, who to talk to when one wants to lay a charge of negligence. My brother passed away after a surgeon operated on him though it was advised that he should not undergo any more surgery, because he had undergone so many in the previous years, he never smoked anything, never drank alcohol, he lived a healthy lifestyle. That arrogant surgeon being a trained medical professional he overlooked the previous doctor's advice, operated on him, he never recovered, he passed on at the age of 29. Every day since he passed on in 2017, I live with the reality of living life without him, he had plans to further his education the following year, thinking he would recover, and I promised him that I too would go back to school, but I lived to graduate without him. It is disheartening really what these doctors do and there are no consequences for their actions.

Sorry to hear of your circumstances, it is truly regrettable that you had this experience but from wat you have detailed in your comment it seems that your brother was chronically ill for some time prior to the procedure. We do not know the circumstances but given the fact that the condition seems to have been at quite an advanced stage if he had several surgeries prior (according to your comment) was there any other treatment that might have helped at the time? If he did not have the procedure what would have been the outcome?
@@DD-hp9vo There were alternatives, the specialist we as the family transferred him to, informed us of the alternative procedures that could have saved his life and was very much upset that a surgeon with many years of experience could not see the trauma that my brother had already recovered from, in his previous ops but instead made the situation worse to a point of no recovery. I remember the day in his office( The specialist) when he told us that our brother wasn't going to recover this time around because of that one doctor who was too a specialist /surgeon who acted on impulse instead of observing and liaise with other medical professionals.
As patients we have to face the unfortunate reality of dealing with arrogant, selfish Doctors who do not want to be held accountable for their mistakes and blame them on circumstances. It pains me a great deal till this day, how that situation could have been avoided.

Lani still poses a risk for people's health, though. And taking people's money. Also malpractice cases are common in SA. They are expensive so it would be nice if the judicial system could find a way to make the process a little less expensive.

Unfortunately, complications after surgery should be highly expected but doctors can and should be held accountable. Get a lawyer who specializes in medical negligence cases to assess if you have a case or not and take it from there.

I hear people here saying it's a surgical complication.... even if that was true, why did he not follow the correct steps? He could have called a urologist on that day to exemine me. People can make all kinds of excuses for doctors, at the end of the day doctors took an oath and we need to hold them accountable. Dr X till today has not even checked if I'm okay, even though he knows I've been in and out of hospital and I have a family that I take care of. His life moves on with out a care in the world. My life quality has gone from poor to worse. All I want is for him to take accountability

I gave birth via c-section last week thursday at one of our local hospitals .Theres a shady genaecologist , he is shady af!Makes me question most of the gyneas in that hospital... Your situation is unfortunate however complications do occur. It's not a matter of health professionals defending one another, there is legal room for reasonable error due to the nature of human bodies which differ considerably and thus present risks with every procedure. The patient also carries some reasonable responsibility to enquire about risks beforehand. The structural damage referred to in this video is in fact a common risk associated with hysterectomy. It is likely that the surgeon will be exonerated if he took all reasonable measures to ensure the risk was minimised and has a good track record with these types of procedures. This case appears to be an isolated incident as the surgeon seems to have a long standing, successful reputation with celebrity in particular which is why he was specifically selected. Besides the fact she stated he has in fact been her Dr for several years so he must have been doing something right during that time. In that light it is also unreasonable for news media to follow her incentive to publically denigrate the reputation of a medical professional without doing the appropriate prior investigation fully or waiting for legal proceedings on the case to be finalised as the individual then has full right to pursue litigation against her and against news media for defamation. However in this case the issue seems to be emotionally motivated by the news anchors own self admitted experience with possible medical negligence. Bias in news reporting is unprofessional. First obtain all the facts from both sides then run with the story. The complaints and claims procedures are clearly stipulated on HPCSA so it is unclear why she believes there is no information on where to go to submit a complaint. It seems she wanted to divert the HPCSA process entirely for whatever reason. Obtaining legal representation is not a means to divert the HPCSA investigation or to fastrack the process or a means to pressure the Dr for payout. The HPCSA as the regulator will still require whatever time they stipulated to conclude their investigation even if legal representation is used. She has a documentary coming out in this issue, hopefully it will also cover patients responsibilities regarding risks as the Dr did in fact suggest a less invasive method with less risk through hormone therapy but she chose the higher risk option of surgery instead. Hopefully this publicity she is generating for the documentary is also not a means to avoid any payment obligations from her long standing treatment over several years with the same Dr.

I'm assuming written informed consent was given by the patient for the op. And this entails accepting that complications do occur, even a simple Panado can cause harm after being prescribed. Granted, a Urologist should have been atleast informed intraop.

Also what's the measure being used to decide if that doctor has more than one case of negligence vs one case, cause that one case matters too and I think alot of patients run out of money to pursue cases and Covid just let doctors run amok, with no accountability or nothing. Yes mistakes are gonna happen but there must atleast be a proper apology and fine or suspension of some sort for one time incidents then if a doctor is proven continuously negligent then they must be lose accreditation. This is an expected complication of abdominal/pelvic surgery. There is also a specialty called UroGynaecology- these are gynaes that can repair bladders amongst many other things.

I had a doctor give me medication that made me sick... i tried scheduling an emergency appointment with her they told me shes busy and cant see me... i decided to go to her practice hoping that when she sees how sick i am she will help me... did she not tell me shes busy with other patients and if the meds are making me sick i should stop them (had stopped them a while back and i was still sick) told me that right infront of other patients. Guess what? After i left there i was admitted in hospital and had to take 6 months sick leave to recover after being discharged... did her office not call me a month later threatening me that they will charge me for a missed appointment... i was then told my case is a difficult one and it would take forever to settle... had to just walk away and be grateful that i didnt die... they get away with alot these doctors
If you were still sick after stopping the medication and sick for six months thereafter it does not appear to be related to medication.

@@thato06 sorry to hear this, that's an unfortunate situation, it may be that the Dr did not do the initial assessment properly to take all possible side effects into consideration however Drs can't always anticipate if a patient might have a bad reaction from medication. Bodies are individual so it is very possible for patients to have unexpected and unforseen side effects from meds that usually do not cause such symptoms. Nevertheless hopefully you have recovered without any long term consequences

I think the thing that upset me is that she totally dismissed me when I was telling her that I was sick knowing that that the medication I was taking could cause adverse side effects. Thank you, I did make a full recovery however it does flare from time to time but because I'm aware of the symptoms I know what to do before it gets worse.

The bladder sits right on top of the uterus.
And injury to the bladder and ureter is a known complication and should have been declared to her. It’s not so much that the operation was botched it’s that the counselling was inadequate both before and after the procedure. The issue is that of: informed consent and post operative care and counselling. It’s unlikely that the doctor will be disbarred this is a complication that could happen to any surgeon . These is definitely a degree of negligence she should also just sue and reach a settlement either with the Doctor’s insurance. It’s unlikely the HPCSA will strike the dr off the roll

I went to a GP 7 days after my c-section and he pulled the disposable stitch and cut it (making it tighter) now the side of the c-section scar that he pulled and cut the scar from is painful., Do y'all think I have a case? I want to sue for medical negligence.
