therefore it is practically better to present the green card application 15/18 months after the wedding in order to immediately obtain the permanent green card, avoiding all the mess of removing the conditions ...

Do you think USCIS has given up on adjudicating removal of conditions and just sorting it out during the citizenship interviews?

No. There was a period of time where USCIS was adjudicating removal of conditions at citizenship interviews when both applications were simultaneously pending, but this no longer appears to be the case which is causing massive delays.

How soon can you file for the removal of conditions after getting a 2 year green card?

What happens if I get married to an US permanent resident while I am on L1A visa myself - can the path for EB1C which is currently in progress for me , be resumed in case divorce happens ?

    Hello Mr Darian!
My wife left me shortly after she got her first(2 years green card) which is expiring in 4 months from now on…. I did file for divorce earlier this year(end of march)…. she never signed it,so now I am waiting for court decision… been told at the court it will be divorce by default…. also few days ago I received the letter from immigration (that u just mentioned about to remind her to submit documents for her permanent 10 years green card or to remove condition (didn’t open, just assume)… I really loved her but I guess she just used me to get her papers😞…. my question is , is there anything that I have to do now on my behalf at this very moment?! or I should just let it go??
    Thank You 🙏

How much it cost to switch i751 to waiver ?

    • @DarianLaw
      @DarianLaw  ปีที่แล้ว

It depends on the exact situation, but the government fee is $0 (to convert the I-751) to $680 (to file a new I-751).

    Hi sir
    Good evening please
I entered the US on 27th January 2023
My wife divorced me on 27the February 2023
I met a US citizen and we have been together for about 5months and we want to get married this month
Can the interval between the divorce date and my new marriage have bad implications on my green card application?
Please help me out with your answer
    Thanks

It depends on the exact circumstances, but I generally advise that the divorce date isn't determinative. I'm more focused on when you met your new spouse. The reason for this is that many people will not finalize their divorce until they are ready to legally remarry. Some people will separate for years before a divorce is finalized and will begin new relationships during that time, only to legally divorce immediately before remarrying. For example, if you met your new spouse in 2021 and were in a 2 year relationship before your divorce finalized, then I wouldn't be that worried about the divorce date. I focus on the strength and duration of your current relationship with your new spouse, because that is what really matters. You need to prove that your current marriage is a real marriage.
