Yes you're right but we're talking about the Bakumatsu and Seinan War, it was mostly firearms and very little armor, samurai armor can't stop 19th century bullets even a little so it just weighs you down

Crime was dealt with swiftly and harshly, and any signs of revolt or disloyalty by a han could result in their lord being ordered to commit seppuku, the han being abolished and their land being confiscated and taken over by the bakufu or another clan.

In duels, sure. But in battle, any samurai with armour would wear it, as samurai armour is great at stopping arrows.
