I’m not quite sure on how this law is worded but there are many similar laws on the books for similar situations amongst other categories. In the others there’s a consistency when it addresses the range of actions one is allowed to pursue and remain protected. With that being said, the language of these laws pertaining to profiting off such acts of expression seem to be pretty consistent in that the laws are NOT on the books to protect ppls right to profit on these ideas but rather to simply protect the freedom to create or distribute types of information they are passionate about sharing or feel is important. I had the privilege to meet Ari nearly 10 years ago, this guy that I knew John was close friends with him and I had lunch with them at Miss Lily's down in Manhattan. John owned a pair of the Menthol 10s so I got to get a close look at them and the attention to detail is next level. Ari is a brilliant guy, this could go down as one of the most iconic sneakers of all time for it represents so much more than just a shoe. I doubt anybody will read or really consider this point, but I feel like this was just some slipshod journalism.

This should be considered fair use under the parody statute. It's copying of copyrighted material done for a limited and “transformative” purpose, which is criticism and comedy.

The logo is too similar which is the only problem i believe. Without the logo they would have been fine back then and now i'm pretty sure.
I’m not quite sure on how this law is worded but there are many similar laws on the books for similar situations amongst other categories. In the others there’s a consistency when it addresses the range of actions one is allowed to pursue and remain protected. With that being said, the language of these laws pertaining to profiting off such acts of expression seem to be pretty consistent in that the laws are NOT on the books to protect ppls right to profit on these ideas but rather to simply protect the freedom to create or distribute types of information they are passionate about sharing or feel is important.
On one hand, collectively these hundreds of smaller, unheard of and “specific in nature” laws are everything that creates our fabric of freedom being woven YET UNFORTUNATELY since they don’t always get as technical as they should on the financial aspect (given its not the reason for being created) many ppl like this great gentleman have to simultaneously get a crash course in how insanely expensive this shit is considering the way most of these disputes originate from, which is a “David vs. Goliath” type circumstance where the larger party knows this already and has all the disposable income they need and more to seek and destroy anything that gets in their way. NOW, you’d have to be living under a rock to not sense the change in tide slowly developing and in the future the little guy is going to have the capabilities to compete on every level. Wouldn’t it be great if the reality wasn’t that they’ll just adjust the laws down the road once any type of inequality gap amongst the rich and poor starts to shrink. Regardless of any of it, you gotta respect this man’s passion for choosing to live his life and utilizing his talents & wisdom to make social change in the way he knows how. That’s the POSITIVITY and type of story we need to start holding these larger news corps responsible for choosing to push aside in an effort to show only things relevant to whatever opinions they feel strongly about.
It's a kind of spiky deal when trademarks are involved, you usually have much less of a chance to claim fair use when they pull in trademark law. Branding and logos are under trademark and considering the means he went through to produce the shoes, legally, it would stick enough. On top of that, they probably have some applicable defamation too. Shame though, this is a real neat idea, and corps need more fucking.

I had the privilege to meet Ari nearly 10 years ago, this guy that I knew John was close friends with him and I had lunch with them at Miss Lily's down in Manhattan. John owned a pair of the Menthol 10s so I got to get a close look at them and the attention to detail is next level. Ari is a brilliant guy, this could go down as one of the most iconic sneakers of all time for it represents so much more than just a shoe. Crazy how much money some of the cease and desist skateboard decks go for, these being so rare with so few of them they could be very undervalued as a true piece of culture history

On the other hand, there's really no cohesive narrative to the video. It's very haphazard. It jumps from talking about the domination of two main sneaker brands, to package design, to a full-scale legal battle, to the dangers of tobacco, and then to sneaker design as a whole. There are a lot of good facts and there's a lot of first-party testimony; but the conception, production, writing, and editing don't lend themselves to a single comprehensive takeaway. The video doesn't give the audience any actionable points. Like, okay, it was cool to hear about this guy and the Menthol 10s, but what do we do now? I doubt anybody will read or really consider this point, but I feel like this was just some slipshod journalism.
