    In a devastating critique of the judiciary, the Supreme Court and the Collegium system, the likes of which I, at least, have not heard before from any lawyer speaking in public, one of India’s most highly regarded lawyers and a former President of the Supreme Court Bar Association, has said: “We have a large number of judges who are highly questionable. They either lack the expertise or the knowledge and most of all the commitment.” Dushyant Dave adds: “The Supreme Court is afraid of taking the executive head on”. Referring specifically to Prime Minister Narendra Modi, who he says is a strong Prime Minister like Indira Gandhi and doesn’t want the judiciary to question him, Mr. Dave adds “unless we have a judiciary who is willing to question day in and day out” it will be failing the country, the constitution and the concept of justice.

    Thanks to Mr.Dave for his straight forward talk, which really needs serious introspection. What he says is very true. And the standard of the Indian Judiciary is really going from bad to worse. Political interference in Judiciary is not at all advisable. Judges being posted to plump positions after their retirement is not at all a good precedence. This definetely casts serious aspersions on their judgements. This is not good for Indian democracy. What we all Indians really want is truth and righteousness to last forever. Jai Hind !

      Intimidation - threat to life of the self and /or the family members is not a bearable thing to any judge unless the judge is so determined to uphold the law of the land. Every human has a breaking point,of course. At times he might feel helpless and enough is enough. Deplorable.

      Moreover the media and opposition should question the govt ( questioning govt is not questioning India, questioning bjp just because they are ruling India doesn't mean questioning India) if anything goes wrong. And the court should condemn it. Not me mum.

    Salute the fearlessness and daring of Adv Dave in coming out so openly against the sorry state of the highest court of the country. Supreme court gas always failed the citizens of this country in the kind of political situation as we find ourselves in . This happened during emergency and is again happening in such an unabashed manner in the present political scene so much so that one can almost predict what the outcome on petitions would be when these seek relief from the excesses of the executive which are clear violations of the fundamental rights .

      Since this comment off yours was almost an year ago, I hope you must have already learnt all this by now. So moot point. But if you haven't, I would request you to pick up the constitution or atleast a school grade civics book. You will be able to understand the interview better. :)

    Dave sahab is only real lawyer who deserves to be a supreme judge. Whenever I listen him it reconfirm my view that our judiciary should be like that. I don't know what extent one could do these once be a judge but still his views are really required to be listened and followed

But the thing is more dangerous that what Dave sahab is telling that nowadays those types of judges are not selected either by the collagium or if selected but not actually appointed by the government by using some unfair tactics. Perhaps, you don't know that the salaries of the justices from higher judiciary are charged on the consolidated fund of India, beyond the power of the executive (govt as you meant)! Ask those who know or Google it and help restore the confidence of Aam Aadmi in the institutions of the country!

    Even a clip I have seen , admitting Ex. Supreme Court Judge and now a MLC in Rajyasabha Mr. Ranjan Gogai, saying Corruption in Courts is very well there and its way of accepted life now a days. Now what to say further.

      Was surprised by the comments of Justice Chandra hand and his lack of urgency in the hijab ban. Thought he would rise above this deference to the BJP. So much for a Harvard education and all the Indians swear by "Education". Just because someone is a doctor or CEO does not make them honest and god people

    Karan, I have seen a few of your interviews a couple of decades ago on a news channel. Your interviews were very forthright and very bold, bringIng out the facts so clearly which benefited and influenced public opinion. I heard your interview with the bold and forthright hero- advocate Mr. Dave. It was very informative and shows our judiciary in the right light. I always knew the state of affairs in the SC. But this interview brought all the details. Thank you very much. We need tens and tens of Karans and Daves to encourage our judiciary to act with an iron hand, more so with conviction and a strong conscience to fearlessly deliver justice to the POOR.
