    When I was in the military, I was pulled over, given a field sobriety test, and found to be intoxicated. The problem is that, not only had I not had a drink that day, I don't drink at all. Not even a little bit. Not even a beer a year.

    While in college, I got to be a field sobriety class participant for a police department in Mississippi. We went to a hotel with 15 or so other college kids, had an open bar of top shelf liquors being served to you by cops, and got smashed at 10 AM. All to be walked into a class of officers that made you do field sobriety tests. It was one of the coolest/craziest experiences.

      Lasse Hansen BAC is digital, it can easily be corrupted. Leave one in a car and it can go blank. FL BAC show to have 40% of there BACs read double, some Triple "from" the correct reading.
      Its by design BTW.
      Prohibition has been Repealed FYI. And police wonder why citizens choose pills instead. Police need to use discretion more. Even if Drunk, let them get a taxi or call. Why destroy lives for a beer (Talking to Police).

    I have 3 personal rules I follow:
    1) Drink at home ~ it's cheaper
    2) If i am not home and I have a drink it's because i'm spending the night.
    3) Only go to bars that are in walking distance.
    That's just me, but they've never steered me wrong.

      ...and what were you doing to have a cuntbitch run up on you jump out with her hand on her gun and cuff you like you'd just killed somebody. Police don't just run up on you and risk their own safety for nothing. You were asking for it somehow. I've had my own experiences with cops and none of them ever treated me horribly. I was growing pot one year (1990, and it was 4 plants) and somehow they were told I had a large grow operation. I pulled into my driveway one night, a cop car blocked me from backing out, and 4 guns were pointed at me. I had, and still have, a concealed carry permit and I was armed. I was cool as a refrigerated cucumber, I didn't act like a dick, and they never even put me in handcuffs. 11 cops and a DEA agent were in my house having a look-around. Meanwhile, I was talking to the guy running the show, and by the end of the night my 9mm was handed back to me . I drove myself to the station for a mugshot and fingerprints, and then I was handed an appearance ticket for unlicensed cultivation. They took the 4 plants, but none of my grow lights. They said that they had no room for them, so I could keep them. I talked to them like a reasonable human being, and that's how they treated me. I got a lawyer and none of it even went to court. They wanted nothing to do with my little grow. So, lets recap: 1. Never placed in cuffs. 2. My sidearm was handed back to me. 3. They treated me like a reasonable human being. 4. They never pursued any charges against me. My experience with cops is that they don't want hassles or the paperwork any more than you or I do. Be cool, don't be uppity, give respect, and that's what you get in return.

      That's, not the solution. Weed is illegal and people do it anyways. Cars now days are pretty safe. Make Bar owners more accountable. If you allow customers to leave without knowing they have a sober drive they could be held accountable. Yeah, store owners wouldn't like it but if they allow people to get stupid drunk you should now not let them leave until they are sober and or have a sober driver. Or Officers should not have to deal with repeat offenders. Stiffen up the laws on repeat offenders.

    What do you think of the cop that would arrest people based on his suspicion that they might have used drugs in the past? In many of his cases, he never gave them a drug test, just charged them and cost them thousands in legal fees, bond, maybe they lost their job. Only for months or years later to have the cases dismissed. In the mean time, he got his award for most arrests. Should he go to prison and have his pension confiscated to pay back the people whose lives he ruined?

      ROTFL! I'd love for a cop to arrest me. I can use the money. Hint:
      If you aren't engaged in commerce, no cop in the entire US has
      any legal jurisdiction whatsoever to stop you let alone arrest you.
      The problem is, cops are never taught this fact. They think they
      can arrest anyone as they see fit. But as long as common law remains
      the Supreme Law of the Land in the US, cops can still be sued for
      everything they own in a common-law court!

      Eddy Craig, you'd already know this

      for Federal District Court. Or,
      if you're in California, all courts

      But, if you call your local

      "court of record' is in your state.
      But keep in mind. To open a
      common law court, YOU have
      to first file a claim in a 'court of
      record,' declare it a common
      law court. Do not assume the
      clerk, judge or any court employees
      will do it for you. They won't.

    I got a DUI 17 years ago. First offence, no accident, no body got hurt etc. I went to alcohol and traffic education school for 26 weeks. The videos we watched and stories we heard were OMG. It's been 17 years and I still dont have a sip of beer and drive. Not even a sip. I can get wasted no problem but either take a cab or uber or stay at a hotel. I wish that 26 weeks course was a mandatory part of getting a drivers licence.

      Ayratown A Navy corpsman told me a trick of his; get AAA+, and when you’re done drinking, if you don’t have a sober driver, they can put your car on a roll back truck, and bring you home. When you wake up the next day, your car is in your drive.

    Great video! I had a best friend from college test at .42 after he got to the hospital. He wasn’t driving, but he was found without a pulse and revived in a bathtub. Everyone stay safe!!

    The tests after the stop is made are called 'field sobriety tests' to determine 'probable cause' to bring you in to test you on a machine that is certified at least once a year, and cannot be tampered with. You are tested twice and the machine is purged with ambient air in between, about 5 minutes at most, this even gives you a slight chance of sobering-up enough. This is the result that is used to either incarcerate you or let you go. If you are arrested this is the reading that will be used for your conviction.

    About 10 years ago I went out drinking with my ex and her sister and brother in law. Her brother in law was and still is a detective. He had some officer buddies along with. All of us got completely hammered and he drove the four of us back to his place while the other officers took their vehicles home as well. It was a real eye opening experience that made me realize we're all human and all do potentially horrible things, but some just get away with it while some don't.

    Interesting how different it is to Australia. Over here they just test you for drugs and alcohol with a roadside breath test. Only takes about 30 seconds to qualify or fail. I prefer it as a civilian because it comes down to a scientific test rather than someone's opinions based on training. I don't think either are infallible but I put my faith in science. Peace.

      Mostly, when a person is truly intoxicated, they don't really care what tests they are doing and just wish to be done with it...There are SOOOO many times when someone states, "Can't you just go ahead and arrest me because I already told ya that I'm drunk, you saw me leaving the bar at two in the morning, I can barely stand, I was urinating in public? You asked what I was doing and I told you that I was taking a piss and that I would respond upon finishing. You broke into insane laughter with the understanding that we had been betrayed more so than they. Besides, I would fail regardless of sobriety."

    Funny I did the walk and turn after getting pulled over and my illness was acting up and I couldnt do it at all. I was 100% sober just a illness I have. But even tho I blew nothing since I couldnt do that test they revoked my licence for 2 years. That test needs to be removed. It's unfair to people who have balance issues while walking. Tho I think I should have stayed home that day but I wanted to meet up for friends for the world of warcraft expansion launch party downtown. :/

    I have 3 DUI’s on my record. First one was when I was 19 years old, I blew a .02 but was charged with DUI because I refused to do a urine test. The second DUI was when I was 21 or 22 years old, I blew a .38 and I wasn’t even mad that I had been charged because I was blacked out until the seen the cherries n berries and I had no business driving. My third DUI was when I was about 25 years old, I had drank about 3-4 mixed drinks of bottom shelf liquor and 1 shot in a 3 hour time span, I knew I wasn’t good enough to drive so I hung around the bar shooting pool drinking water for another 3 hours. I no longer felt the affects of alcohol so I decided to leave, got about 300 ft down the road and got pulled over, did all the field sobriety test and I blew a .10. After 2 DUI’s I was actually trying to drink responsibly but the officer didn’t see it that way. Lost my license for 3 years from that one so when I was finally able to get my license back I decided the only way to guarantee to not get a 4th DUI (because that would be a felony) was to quit drinking entirely. It’s been almost 7 years since my last DUI and I’ve only drank a hand full of times since then, I’ve been completely sober now for almost 3 years. I didn’t quit drinking from doing rehab or drug and alcohol classes either, I quit using will power and because I was tired of being a loser with no drivers license and I was tired of spending thousands of dollars on legal fees, fines and partying. I haven’t even had a ticket since my last DUI and I’m doing much better financially.

      Many places still have subjective laws that can still be used against you based on officer opinion. If you can't prove bad faith either, one false delay or word will often be enough for the DMV to take your license for a year even if no criminal charges are proven. Sometimes you are just on the end of their bad day and it is incredible how easy a technical signal violation is used when nothing else. They (in this state) are not required to tell you why they stopped you. They are not required to inform you of the right for their warrant requirement for blood draws (they will coerce you with the civil matters until you bend or make an error), they are allowed to select the chemical test even if you have a medical condition (famous PA case of a diabetic with blot clots in the arm that suggested a different test still lost his license by DMV standards because it isn't his choice of chemical test, its the cops [note the dmv is a lot of retired cops in charge]) even if it is medically dangerous. The cops are not viable, and they have ruled against liability against medical professionals complying as they too can be in trouble if a blood draw is ordered.
      Until you realize the mountain of problems, you fall into that trap of believing cops never seek easy targets. Doesn't help the fact the system is essentially useless to prevent the general public from knowing YOUR record, but good luck finding provable times the justice system wiped itself clear. You do realize, it wasn't until this summer that PA cops couldn't have sex with those they were interrogating or investigating? They literally robed hookers because paying them meant they could arrest them.
      Stop feeding into the nonsense until you get a grip on the insanity of criminal procedure vs civil that doesn't agree, and there is no one to ask. I can't even find the reason to submit a perjury complaint (specific and articulate fact never proven (an item) that altered a case through the removal of my ability to use an affirmative defense. Mind you, it was on footage they could just ask for. Hint - they made the sworn fact and they also could obtain the evidence. You really expect most lawyers to successfully obtain the information from a store that relies on the police when robbed?
      Read up on the problems of the system before you simply become the naive idiot that could have avoided thousands upon thousands simply proving something the DA could have reviewed dash cam footage for - knowing they will likely get you to plea out because of how hard it is to prove you are innocent.
      FYI: meds with inactive metabolites that have long half lives still are fully able to sentence you for the highest level of DUI. The metabolites doesn't prove intoxication is one expensive fact to have to raise in a system that knows it already yet don't care. May you never live in a poor area with cops that grind axes all day.... I still cannot believe it took this long to outlaw cops robbing hookers.

      @@Samuel-I you do realize actual poppy seeds vary greatly in their ability to cause that issue? It also depends on what all metabolites exist that can be tested to rule out the chance it was poppy seeds? Each type of testing makes assumptions. 4am is indicative of heroin. 20 mins about in the blood, or much longer in the urine. Morphine in blood that is detected as a later metabolite can be problematic to determine if someone is taking morphine tablets, or its the result of heroin. Riddle me this. Why should the state say you cannot refuse a chemical test, and not allow the noninvasive test to be used? Why should the request be viewed as a refusal when the form itself lists both under the umbrella of chemical testing. If one isn't as good as the other, that seems inherently problematic.

      @@Samuel-I plus here is another funny thing. you know MADD? they spend more money simply to gather more money than in any other manner. As an organization, they have become pretty dirty. Take in large car manufacturer donors in exchange for avoiding any topic regarding safety risks (takata is also a huge sponsor) other than alcohol. They refuse to talk about cellphone use, other distractions, safety flaws etc. It isn't because of one topic focus, its the agreement they make with platinum donors.

    If you presented your junk science testing of ocular motility to the American Academy Of Ophthalmology, they would laugh you out of the room. If anyone reading this has ever been charged with DUI based upon an ocular dexterity or pupillary exam performed by someone who doesn't have "MD" or "OD" at the end of their name, make sure your attorney hires an ophthalmologist or optometrist as an expert witness.

      The point of this stuff is primarily to establish probable cause for further examination. These tests alone shouldn't be the only determining factor about whether or not somebody is under the influence.
      I get what you're saying about the eye exams, I'd likely fail them even though I haven't had a drop to drink in nearly 16 years. But, I've got some neurological issues that cause my eyes to jerk around abnormally. I got nowhere near 45 degrees on my left eye before it started to jerk around.
      IMHO, they shouldn't be able to bring DUI charges without some sort of blood test confirming that there's something in the defendant's system that would cause it.

    Hey Officer401. Here is a question. So when a school bus has its red lights and stop arm out. Does an emergency responder that is responding to a call have to stop when it approaches the stopped bus?

      Andrew P we are expected to obey all traffic laws even when responding to an emergency or in a chase. We are exempt from speeding but we are technically supposed to stop at red lights and stop signs. We can pass cars but only when safe. But we have to be safe. If I run a red light and kill someone it's on me. Hope this answers your question. I would also say it depends on the call. If one of my guys is getting shot at. I'm probably gonna break a few laws getting there.

      As a School Bus Driver, here is my Policy with my Bus, anytime I hear a Siren sounding, even if my Red Lights, and Stop Arm are Activated, and functioning, I hold all of my Students on my Bus until I figure out where the Siren is coming from in relation to where my Bus is. If I can actually see the Emergency Vehicle that is sounding the Siren, and it's coming either toward my Bus or approaching from behind, I immediately turn off my Reds, and close my Stop Arm, and allow that Emergency Vehicle to pass, along with any others that may be following it as well. I only reactivate my Reds and Stop Arm to either Discharge or load my Students after the Siren from the Vehicle is no longer audible. I always give them full right of way, because we never know who they are going to the aid of, and it may be someone we know.

      They have no interest in public safety or helping anyone these days. Used to be cops would give you ride home or follow you to make sure you got home safe.
      It is all about revenue and lowering the legal BAC creates more targets while those seriously impaired do not drive and thus are not subject to arrest. If you are drunk you can be arrested he moment you step out of the bar:public drunkenness. Catching you driving pays their system.
      Police should be drug tested once a month and audited by IRS yearly. If they have nothing to hide they have nothing to fear.

    The issue with the shaking pupil test is that I was given it while at home and I have serious anxiety issues causing all of my body to shake, especially when not on my meds, and I failed because I had no meds or anything in my system.

    Eyes do not lie, tell that to the large number of people going to jail while being completely sober and having to go to court to prove their innocence even after losing jobs just because a cop thought they knew what that person was on because of the class

      The state or prosecutor require an exact BAC for a DUI charge.
      The officer needs to have suspicion of a DUI, which is odor of alcohol, failure of roadside tests. And then they have to gain hard evidence, thus requiring the blood test for solid evidence

      The follow the pen trick is simply that. It has been proven that it has no bearing on someone being intoxicated or not. You can be tired and have the same effect on your eyes. It's just a scam to railroad you into a DWI. One thing that is certain.....they are not there for justice or safety ....just put you in jail to drain you of your money.
