      Whatever isn’t covered by the city’s insurance does come out of their pension, or in some departments it might be another account but it comes directly from the pension fund where I’m from

      18 - U.S.C. 241 is "Conspiracy Against Rights."
      18 - U.S.C. 242 is "Deprivation of Rights Under Color of Law."
      --Section 241 is used in Law Enforcement Misconduct and Hate Crime Prosecutions. It was historically used in Human Trafficking prosecutions.
      --Section 242 does not criminalize any particular type of abusive conduct. Instead, it incorporates by reference rights defined by the Constitution, federal statutes, and interpretive case law. Cases charged by federal prosecutors most often involve physical or sexual assaults. The Department has also prosecuted public officials for thefts, false arrests, evidence-planting, and failing to protect someone in custody from Constitutional violations committed by others.

      If a cop is violating your rights and you notify them they are violating your rights and they continue, they lose qualified immunity and you can sue them personally along with the department. Once qualified immubity is lost, you can also press charges.

There needs to be a law that requires DAs to bring felony charges or face disbarment and charges of obstruction of justice themselves.     What is it with cop attacking our elders and the handicapped lately? What we need to do is get lobbying effort going. Collect as many actual stories and incidents as we can of this and get it before Congress. My point is; if we make it were police officers are personally and financially liable for every nut job with a camera is looking to fuck with them, no one would want to be in law enforcement because you open up the door for more people trying to bait them. Like this video, guilty or innocent, they guy didn't break any laws until he started resisting. Like the advise my father gave me around 45 years ago. You don't argue with the cops on the streets, you do the arguing in the courtrooms.

      Stop saying defund them and start saying reform them. They should be better trained, more informed, every department should have a liability insurance, every department needs to have an avenue for the good officers to anonymously report bad officers and their conduct so they can be investigated and monitored. Just like any other job the employees can call osha and report unsafe working conditions.

      99% of crimes are prevented because people know cops have the resources to find your ass and lock you up.
      They actually need MORE funding.
      What needs to change is the rules on things like this.. for example if cops blatantly do things like this they need to be held accountable. And there needs to be an option where if the situation is bad enough then they cant use tax payer funds to pay out settlements.

I get it if they have robbed a store or shot someone in the commission of a crime but if you are only getting traffic ticket , come on !
      I have never been in a situation like that but have Been pulled over while carrying and had no issues . Last time I was pulled over I was going to the DMV to get new tags on my beater because some dude hit me and my truck was in the shop .
      Highway patrol pulled me over , had all my paperwork out before he got to the window . Had my pistol on the seat because it was hard to buckle the set belt . He didn’t even see it but I made him aware of it . He was cool as a cucumber and that was it .

    The money comes out of the City Funds which is still from the Tax Payers I believe. There was an incident that involved 2 different Police Depts, and they were both Sued successfully, and they had to Payout half each because of their involvement. This happened awhile ago..

      We do, in certain circumstances. Plummer v. State is one example of that. That particular case wouldn’t apply to this situation, though.
      The real way to “fix” this is to take settlements out of their pension, reevaluate the qualified immunity standards and create a federal “black list” of individuals who are forbidden from working in law enforcement.
