I can't figure out a way that this will be anything other then a bad idea from a content creators stand point. Pewdiepie plays IOS games and gets 3 million views. Pewdiepie play AAA games and he gets 3 million views... It's clear that the video creator is earning those views and not the game.
You bring up a great point. TH-cam honestly had helped a shit ton for people to get info all around the world especially about gaming. Hell tons of the games I've gotten over the years was thanks to finding gameplay online to see what ti was like
AlphaOmegaSin TH-cam has basically become the newest standard in decision making and word of mouth of video games. Nintendo needs a serious revamp of their marketing team and learn where and how certain games are booming the way they are. Should be encouraging the hell out of TH-cam users to promote their product they desperately are trying to sell. I believe that they believe what they are doing marketing wise is effective, which is, meh.

Even after watching a playthrough of more or less the entire story of the second MDK, I chose to buy it anyway because I wanted to be able to feel like a badass being able to defeat the enemies myself, even on the highest level of difficulty. I also decided to give whoever owns the IP now my share of financial support for the purpose of helping encourage them to make another installment.
Just another example of how detached from the reality of modern gaming Nintendo are. I'm far from a fan of theirs, but it still makes me sad to see them consistently getting it so obviously, badly, wrong.

Nintendo flagged one of my videos when I only had six subscribers and the video had like 10 views (a couple were from me). This shows that Nintendo wants every little cent they can get their hands on.
Yeah many people are under the impression that this only affects Let's Players and only affects big channels meanwhile it affects everything and anything from big youtubers to small from Let's Plays to reviews to anything in between

But it's not an actual person from Nintendo more likely than not it was the TH-cam copyright bot. There is a program that just searches a data base for matching music as soon as a video is uploaded and goes "Oh that sounds like this" and flags it. That's why people upload anime opening with the image reversed to try to trick these programs

This isn't all going to be the best idea for Nintendo. Not only can this cause people to lose potential fans or those wanting to be fans, but this can also cause them to lose more money, as if their poor Wii U sales didn't make them lose enough. They seriously need to think of actually doing better things. For a huge Japanese gaming company like Nintendo, I expect them to do so much better than this. They've been flopping for years to come.

The 3DS is doing them just fine as well as their software sales for all their first party games. They just gotta light a fire under the ass of the Wii U and crank out a lot of exclusive titles for it and really start advertising that fucker heavily
Actually Nintendo is no longer taking a loss on the Wii U, though they are making next to nothing on it till it sells, we will see how Mario Kart 8 fares though. Also the 3DS...its unstoppable.

No I'm not saying that. I NEVER ARGUED THAT!!!! However, your video is on youtube thus they make the rules. If they allow Nintendo to take your video down because they don't want it up then that's what's going to happen. This way at least they don't take complete control or just remove your video all together. I agree that it's still crappy it is still better than the other two things that they have done in the past.
I agree with some of your points Alpha, but you have to remember, for every one person who might buy the game, there are more people who just watch the game and Not buy it because they watched the lets play. But I completely see where you are coming from and agree to an extent. Nintendo claims a ton of my videos. But I'm happy to be getting a little piece of the revenue. I use to get nothing....

AlphaOmegaSin From my understanding this doesn't affect all of those people. Its really just let's Play people for the most part. It has to be a certain length. I reviewed The Wonderful 101, Donkey Kong, Sonic Lost World, The Legend of Zelda Wind Waker HD, on TH-cam and Nintendo didn't claim any of those videos. I had plenty of footage from each game. I'm personally excited for this program, Nintendo would claim my Let's plays of DKC tropical Freeze, and other games, at least I can join their program and get a cut. SEGA claimed my whole Bayonetta Lets play with no option for me to get a cut. But like I said, I understand where you're coming from. I'm not saying you're wrong, I even posted your video on my site.
If someone is satisfied with only watching someone else play a game, then it's very unlikely that person would have ever bought it to begin with. So it's a moot point.

Some points to consider are: 1. It is perfectly within Nintendo's rights to do this. 2. This is preferable to the previous greedy company practice of just banning videos outright (i.e. Viacom, Sega) 3. The exact amount of revenue they will take from each video is not specified. Is it going to be 5%, 10%, or 50%? We don't know. 4. Popular TH-camrs like Chuggaaconroy, NintendoCaprisun, and BrainScratchComms will likely not be affected significantly. They are already making enough as it is and they are driven by a passion for the games. 5. This may deter less renown TH-camrs from using Nintendo games in their videos. This may be trouble in the long run for Nintendo, but again we don't know what kind of deal Nintendo and TH-cam will work out with the users themselves. 6. Mob mentality will not help this situation, especially when we don't know all the details yet. You may disagree with it and it is not entirely appropriate in this day and age, but does it put Nintendo in the same league of dickishness as Microsoft and Capcom? I think not. Nintendo has made plenty of mistakes, but it is still a company I grew up with and respect. It may be low on cash and it may be getting desperate, but that is no reason to actively try to topple it. That would grant more power to Sony and Microsoft to do whatever the hell they want with less competition. It would weaken the gaming industry as a whole. I agree more with Reviewtechusa's stance on this matter. First, I never thought anyone would ever not buy a game because they watched a full uncommentated plagthrough. I thought that until my friend watched Bayonetta and DMC playthroughs and now he doesn't want to get those games and he was really interested in them.

It's true, the game itself is Nintendo's intellectual property. But the gameplay is the property of the LPer, so I really don't think Nintendo is in the right here, taking a cut of the money earned by LPers. And whether you do or don't, like AOS said, try looking at the bigger picture. All this is gonna do is piss off a lot of people. People with Nintendo LPs will probably take their LPs down and not do any more walkthroughs of Nintendo games. So there goes Nintendo's chance to take a cut of their money, ALSO there goes free advertising for them. And people could easily become pissed off enough to not buy their products. I don't get how Nintendo can even ask a cut for a game review. As far as I know no professional reviewer give money to the companies of the movie they reviewed and they are paid for doing reviews.

Nintendo has been like this since they started making consoles. Remember the monopoly back during the NES and SNES days? Because of Nintendo, other competing companies like NEC and SEGA back then couldn't sell their games in popular stores, because Nintendo forced retailers to only stock Nintendo products.

In America, they had major retailers like Wal-Mart and Toys R Us stock only Nintendo products, and any other company that wanted in couldn't because any retailer that tried to stock non-Nintendo games and consoles had to deal with Nintendo, and they wouldn't have any of it, until finally SEGA demoed the Genesis by a Wal-Mart and finally got them to stock the Genesis, so then other major retailers finally started to stock SEGA's stuff, then eventually other companies followed, and eventually forced Nintendo to end the monopoly. It seems not too many people remember this, or even heard of it before. Gotta do your research pretty deep to find out about this, I guess. Nintendo might have had their reason for doing that, but all it did was hurt the gaming market as a whole, so it's a really good thing they were forced to stop.
I agree, AlphaOmegaSin. TH-cam is an integral part of gaming now. I found some of my all time favorite videogame franchises through TH-cam. I found Sonic, Metroid, Zelda, Final Fantasy, Portal... I don't really see an issue here. People who make money off of Nintendo videos are making money off a product that Nintendo invested millions to create. I'm not saying that Nintendo should have all the money and with an affiliate program they won't be taking all the money but they do deserve a share of it. There are so many users on this site that just release straight up play throughs without any talking or anything they just release the game and they make money off that... which is garbage and Nintendo deserves to take a larger sum out of what that video makes because all that person is doing is showing the game nothing else. I'm sorry but those type of people are making easy money just editing the video into pieces. For people who do playthroughs with them talking and giving their thoughts on the game that's different because they're actually contributing something to the content and they deserve to be paid more for the contend that they produce.
Nintendo's purpose is to get paid FOR THEIR GAMES. Which they do. We buy their game they get paid, they are getting what they always have now they just want more. You're analogy is inaccurate. People who upload straight playthroughs of games without contributing anything to the video should not get paid anywhere near the amount of money that other LPers or reviewers do because they actually make something new with that content. Let's use a correct analogy: Someone buys a DVD of a movie and burns a thousand copies and then sells them. By your logic because that person paid or the DVD they have a right to do whatever they want with it. In reality that's called piracy.

I got a copyright claim from Nintendo for a short walkthrough/commentary warp whistle run of Super Mario Bros. 3. The video was uploaded five months ago, I just got the claim last week, so I doubt it's the Content ID system automatically triggering in this case. This makes me think Nintendo is manually searching for content and flagging it. It almost seems predatory in a way. Creating a "partner network" to me is just like you said--it's a slap in the face, or like pouring salt onto the wound. I doubt it's going to entice people to cover Nintendo products any more than they are now, and Nintendo is going to continue to sink as they have been these last couple of years. Get with the program, Nintendo, otherwise you will be irrelevant soon enough. Oh, and by the way, enjoy the twenty cents you'll probably earn from my video. It's stupid how now people know that Nintendo is doing this they act like all other developers and publishers are angels and act like not enough other developers took down videos because they didn't like them showing off their game, no now it's only Nintendo that's the only one that has a problem with TH-cam. If I see a let's play that's very gameplay heavy I feel like playing the game, games like Mario kart, Smash bros or Mario Smash Footbal. But games with any story like Super Star Saga, or Paper Mario I don't feel like buying or playing the game afterwards because I just saw the whole game.
Last October when Pokemon X/Y came out, I made a video that got 3000 views in a short time (I had 20 subscribers). Then Nintendo put a copyright claim on it and took my ads. Now I don't make Nintendo videos anymore.

I think that it's nintendo's right to collect revenue from the reviewers of their games, especially since the content creators themselves are making a living off of nintendo's works. However, I don't think forcing them to pay is a good idea. Rather than make people opt into this affiliate thing, I think Nintendo should allow people to CHOOSE to take part in it, and to give a portion of the money they make form their videos to Nintendo. This way Nintendo has a new source of revenue (even if it isnt as much as forcing everyone to do it would be), they wouldn't be alienating their fans, and everyone would be happy.

I am a partner though and that is something that is really good for me, the thing here is that I am scared of getting problems with Nintendo because they're not only claiming the vids but to some they are actually putting down some accounts. The problem is, as I keep saying, Nintendo is not earning that money. If I make a review of a Nintendo product and over the course of a year, I make $100 in ad revenue through monetization, that's money that I am earning through making the video. It's not money coming out of Nintendo's pockets, it's coming out of Google's pockets, and only being distributed because I made the review. Without that review, that money basically didn't exist.

I am a small LPer and I have already taken down all my Nintendo videos because they all got hit for matched 3rd party content. I was thinking of going back to some Nintendo stuff but this is the last straw.... I have been a huge Nintendo fan since 1987 when I got my NES. I was really happy they came back and kicked ass with the Wii but they have fucked up ever since and even a lot of the choice's they made on the Wii were stupid as fuck, like there terrible online structure. Nintendo has become the old man of consoles. Unable to change with the times. The word I would use for Nintendo is Antiquated, Old and useless. Change with the times Nintendo or you will go extinct. I've posted this somewhere else, but I guess i'll put it here too. I'm more than in favour of this, infact I hope more companies use such a system. Someone who creates LP content is not putting in ALL the work at all, at least half of the entertainment is THE GAME BEING PLAYED, and the companies get NO return for that. It's true that seeing gameplay will convince some to pick a game up, sure, but it also serves to discourage some from picking it up too. Have you honestly never seen someone write "oh, i'll just watch it on youtube instead" when a new game got released, or thought it yourself? How do publishers/developers benefit then? Obviously this is much more of a problem with heavily story driven games than something like Minecraft (where the users imagination is what makes the game fun). There are however, two things about the proposed system that I DON'T agree with. First, why does it have to be set up through a partnership/affiliate program? A system already exists on TH-cam that allows musicians who are performing song covers to automatically split their revenue with the original artist/lable, why can't such a simple solution exist for LP content? And two, it should really only be LP content that is covered by this, someone who is doing a review of a game shouldn't have to pay the developer for the right to do so imo.
I think this is perfectly fair. I've been doing Let's Plays for a few years, and I never put adds on my LPs BECAUSE I'm well aware that I don't own the rights to the game footage. The "my gameplay is unique to me" argument? Complete BS. Most people will tend to play games in a very similar way, even the more unique play styles will have more than one person using them. Even if you're playing a game in a completely unique way, it's still something that the developers designed and included, or at the very least (in the case of a glitch) left in the game. As for the "But it's free advertising!" argument, it can hardly be considered "advertising" when you play through and upload video of the ENTIRE game. Even IF such videos help sales, it still cannot be considered advertising. But the final nail in the coffin for me is this: Let's say I were to download AlphaOmegaSin 's most popular video, add my own commentary track on top of it and put my own opening/ending on it and then upload it to my channel with ads, without his knowledge or permission. Is it fair to Alpha for me to take all of the revenue for that video, even though he wouldn't own my commentary track or the additional editing I did? Of course it isn't. That is obviously NOT OKAY. He would be fully within his rights to have the video pulled. Of course he would also have the option of simply taking all the revenue from it, but then that's where I do agree that it isn't fair since I would have put some work and effort into it. But he would at least be entitled to a cut. The only reason people are freaking out about what Nintendo's doing is because they got away with it for so long before the game devs/publishers caught on. I don't think anyone making money off of LPs on TH-cam deserves every cent they get from advertising on it. The devs/publishers deserve their % too. Now, how MUCH of a portion they should get is up for debate. 50%, which is Nintendo's rumored cut, seems like a bit much to me, it should probably be closer to 10%-30%. tl;dr: Grow the fuck up you entitled pieces of shit.

I've said this before and I'll say it again let's plays, reviews and other such videos are free advertising. So what is their getting paid for it magazines and game journalist get paid for almost the same exact reasons albite different ways. I couldn't even tell you how many people on the TH-cam have made me come back and play games or maybe listen to a song or maybe buy something on their recommendation or just out of nostalgia. People like Angry Joe, Josh scorcher, the autarch, Todd in the shadows and so on and so forth make these companies money and this move just reeks of desperation and the willingness to shoot yourself in the foot.
Like what if it's a review or something where the majority of the video is not Nintendo content, it's almost like Nintendo are screwing those people over.

I think you make valid points, AOS but at the same time I don't find it's entirely unreasonable for a LetsPlay/Commentary channel to pay a small portion back to the company. It's just the same as if Weird Al spoofs a song or any other musician covers a popular song they still have to pay the original label. Now I can see Nintendo abusing this unfortunately; only giving out licenses to LP/Review new games, big name channels taking a heavy majority of funds for themselves and the list can go on. Ultimately we may just have to wait and see how this proposal plays out.

I'm sure the only people who are defending this business practice has never edited a video before or ever done a let's play before. You people do not understand that there is more to it than just "Recording and uploading". Alpha already did a decent job explaining why it's a bad practice but you still defend it without considering how the other side feels. I get it, Nintendo is supposed to make money on the things they created. But they have already got their cut from the $60 that the consumer pays to get the game. And now they are showing it off with the possibility of convincing others to get that same game, ergo, more $60 payments added because he/she showed that one game to his/her subscribers.
The thing about this, in my eyes anyway, is that there are so many people who watch an LP of a game and make a point to never buy said game. "Oh I just saw a youtuber play it, why would I want to play it myself? I already experienced it" is their mentality. So in the end, you have a bunch of dicks on youtube making a shit ton of money just by playing games that were expensive as hell to make. A lot of people nowadays hate to buy blind, unsure of whether or not the game, CD or movie will be to their liking. This is why a lot of people download music and movies, to see if what they see or hear warrants a purchase. When people upload music videos to TH-cam, or even whole albums, people can get a taste of what they can expect. It's the same with Let's Plays. Though I'm sure there are plenty of people who merely watch them for entertainment value (guilty as charged, though I own some of the games that have been done myself and often got the urge to play them again), it can also happen that a game is so fascinating when you see others play it, that you want to try it yourself. And your playthrough may vary vastly from that of the LPer, who usually spends hours practicing and optimizing his/her strategy. If only a handful of people buy a game that has been LP-ed, that's still profit for Nintendo, as these people would probably not buy the game if they didn't have some way of watching the game mechanics in action.
Anyone remember egoraptor at the tester? That fuck disrespected the entire industry when he was in front of a panel of industry veterans and said he was only in the show for the attention. Just like this fuck, I'm sure there are others LPers who couldnt give Zero fucks about the industry and only care about their greedy selves. Publisher takes a small cut and uses that money to develop another game, which can then be used on another LP series.

I don't see why everyone is trying to take a massive shit all over Nintendo. Plenty of people take straight game footage and upload it with virtually no editing, commentary, anything. You wouldn't hear anyone complain if someone uploaded movies, monetized them, and didn't get penalized or expected to give some of the share of the money to the original creator of the film. Don't tell me it's different with video games. I'm not talking about LPers or reviewers, I'm talking straight game footage. LPers and reviewers should also have to give a percentage of their profits to Nintendo because they're making money off a product NINTENDO created. Nintendo is not selling people products to make money. They're selling games for people's enjoyment. If you made a product for recreational purposes and tons of people were making lots of money off of it you'd be pissed off and want your share too. Don't say Nintendo is cheap, or wrong, or that you're gonna boycott Nintendo for something any of you idiots would do yourself. Be thankful Nintendo let's people upload footage of their games and make money off of their products. I think the logic for Nintendo is that they are going to do more stuff on TH-cam as far as promoting their games, what with Mario Kart TV being made for Mario Kart 8 that allows for uploads to TH-cam which possibly means we'll see a Smash Bros TV services not far from now. So in their minds, I think they're trying to get all Nintendo related material under one banner, thus why they're doing this. May not necessarily be the right way to handle this but neither do I think its a bad idea overall. Might take some work to get it to a point where people feel happy with it. But if Nintendo can provide support to the gamers who are willing to play which who knows what that might be, then it could benefit them more then hurt them.

That being said : I think this decision from Nintendo is a better move than the previous one, who was plain dumb, honestly. Regardless, this one is actually tricky as you could expect from this company, if you read between the lines... As a Let's Player myself, I'm all the way for sharing the revenues with the intellectual owner of the game. Because, that's true, on one hand, it's their product at the core. On one other hand, it's your original content. You need to remember and doesn't forget those principles. People need to open their lazy eyes, and begin to understand that, yes, it's also true that some Let's Players are only commenting a game (and are sometimes doing a fair job at being entertaining just by that), but there is a lot of us who put great time and efforts in our videos, regarding the editing, the fun parts, the audio mix, the dynamic, and so many more things. The whole "movie upload" argument is thus horse shit. Get it together. Apples and oranges, Movies and Let's Plays. Simple. Plus, do I really need to stamp out another statement saying that it's big games that make Let's Players interesting ? When it's true that it's some well known franchises that can attract an audience, it's your commentary, your personnality, your efforts that makes the viewer following you or not in the end. If he doesn't like what you make with the game, trust me, he will go elsewhere. The game is the support, it's an experience in intself, but the experience is different with somebody else. So, yes, if Nintendo wants a piece of the cake, that's perfectly alright and legit - even if, frankly, that would be fair to only go after big shoes and not small fries who are already struggling... But we need to be careful on this statement. Because, what amount do they want ? Will they only share equally ? I feel like an 80% for Mr.Japanese, 15% for Google, and 5% for our sorry ass. I think I may misunderstand this. From what I understand, some channels get third party content tagged, so they don't get any revenue in the first place. So in that case, wouldn't this be a good thing? I can understand though that this is quite the problem if the channel is like pure nintendo and is actually making any kind of money on such a thing, but I thought nintendo already had a third party stamp on those videos, so they're the only one that would make any money in first place.
Problem is that there is an automated matching system in place on youtube that can flag the videos for content, you would then have to dispute it and bring it to their attention to then have it allowed by Nintendo themselves then they would take their cut....it's like a fuckin circus 0__o

I'm going to defend Nintendo here, they deserve a cut. Yes Lets Players record the game but Nintendo is the one that made the game and supplied it to their fans. Saying Lets Players should get all the money for making money all their product is very hypocritical. I would say 50/50 would be fair enough here.

Honestly I understand Nintendo doing this. Before I get replies telling me free advertisement of their games, that is true...but here's the problem. While people are more inclined to buy a game through let's plays, more also lose interest in buying the game. I would have bought Ryse, but after watching gameplay I lost interest in the game. I bought Dead Rising 3 after watching Let's plays of it, I was skeptical because I loved the 1st game but hated the 2nd. Examples of how free advertising worked positively, and negatively. Before I get replies telling me how there are people that live off of TH-cam videos....how about the thousands of Nintendo employees part of a company that continues to lose money? Nintendo has the right because it is their product, people play a game and add a voice over to make money? You can say it's an asshole move, but they have the right to do this, quit denying this. When people put ads on their Let's Play videos, they're making money off a copyright that doesn't belong to them. Lords knows how many times TH-cam offered to install ads on my Suikoden 3 videos because of the views I had on them, but I refused to because I didn't make Suikoden 3. I don't deserve to make money off of it, so nobody else should be making money off their videos if all they're doing is sitting in a room, playing a game, and reacting to it. To get clarity on the issue would require specific legislation or, more likely, a court ruling, and nothing like that exists yet.

AlphaOmegaSin TH-cam has basically become the newest standard in decision making and word of mouth of video games. Nintendo needs a serious revamp of their marketing team and learn where and how certain games are booming the way they are. Should be encouraging the hell out of TH-cam users to promote their product they desperately are trying to sell. I believe that they believe what they are doing marketing wise is effective, which is, meh.

Even after watching a playthrough of more or less the entire story of the second MDK, I chose to buy it anyway because I wanted to be able to feel like a badass being able to defeat the enemies myself, even on the highest level of difficulty. I also decided to give whoever owns the IP now my share of financial support for the purpose of helping encourage them to make another installment.
Just another example of how detached from the reality of modern gaming Nintendo are. I'm far from a fan of theirs, but it still makes me sad to see them consistently getting it so obviously, badly, wrong.

Nintendo flagged one of my videos when I only had six subscribers and the video had like 10 views (a couple were from me). This shows that Nintendo wants every little cent they can get their hands on.
Yeah many people are under the impression that this only affects Let's Players and only affects big channels meanwhile it affects everything and anything from big youtubers to small from Let's Plays to reviews to anything in between

But it's not an actual person from Nintendo more likely than not it was the TH-cam copyright bot. There is a program that just searches a data base for matching music as soon as a video is uploaded and goes "Oh that sounds like this" and flags it.
That's why people upload anime opening with the image reversed to try to trick these programs

Actually Nintendo is no longer taking a loss on the Wii U, though they are making next to nothing on it till it sells, we will see how Mario Kart 8 fares though. Also the 3DS...its unstoppable.

AlphaOmegaSin From my understanding this doesn't affect all of those people. Its really just let's Play people for the most part. It has to be a certain length. I reviewed The Wonderful 101, Donkey Kong, Sonic Lost World, The Legend of Zelda Wind Waker HD, on TH-cam and Nintendo didn't claim any of those videos. I had plenty of footage from each game.
I'm personally excited for this program, Nintendo would claim my Let's plays of DKC tropical Freeze, and other games, at least I can join their program and get a cut.
SEGA claimed my whole Bayonetta Lets play with no option for me to get a cut.

This people are hardly lost customers or steady customers.
Some points to consider are:
1. It is perfectly within Nintendo's rights to do this.
2. This is preferable to the previous greedy company practice of just banning videos outright (i.e. Viacom, Sega)
3. The exact amount of revenue they will take from each video is not specified. Is it going to be 5%, 10%, or 50%? We don't know.
4. Popular TH-camrs like Chuggaaconroy, NintendoCaprisun, and BrainScratchComms will likely not be affected significantly. They are already making enough as it is and they are driven by a passion for the games.
5. This may deter less renown TH-camrs from using Nintendo games in their videos. This may be trouble in the long run for Nintendo, but again we don't know what kind of deal Nintendo and TH-cam will work out with the users themselves.
6. Mob mentality will not help this situation, especially when we don't know all the details yet. You may disagree with it and it is not entirely appropriate in this day and age, but does it put Nintendo in the same league of dickishness as Microsoft and Capcom? I think not. Nintendo has made plenty of mistakes, but it is still a company I grew up with and respect. It may be low on cash and it may be getting desperate, but that is no reason to actively try to topple it. That would grant more power to Sony and Microsoft to do whatever the hell they want with less competition. It would weaken the gaming industry as a whole. It would break the hearts of a lot of people, including mine. I urge people to please, PLEASE exercise some restraint. Peace.

I thought that until my friend watched Bayonetta and DMC playthroughs and now he doesn't want to get those games and he was really interested in them.

It's true, the game itself is Nintendo's intellectual property. But the gameplay is the property of the LPer, so I really don't think Nintendo is in the right here, taking a cut of the money earned by LPers. And whether you do or don't, like AOS said, try looking at the bigger picture. All this is gonna do is piss off a lot of people. People with Nintendo LPs will probably take their LPs down and not do any more walkthroughs of Nintendo games. So there goes Nintendo's chance to take a cut of their money, ALSO there goes free advertising for them. And people could easily become pissed off enough to not buy their products. A lets play is nothing more than a detailed review, far more detailed than anything you will get in a 5 minute overview. I do not want to see them censored (directly or indirectly) as they constitute what I feel is the best type of review available. If a lets play cuts into sales it is not because it exists or a guy screams at it, it is because the detailed review exposes flaws that the consumer decides are unacceptable. The solution is to make better games.

Nintendo has been like this since they started making consoles. Remember the monopoly back during the NES and SNES days? Because of Nintendo, other competing companies like NEC and SEGA back then couldn't sell their games in popular stores, because Nintendo forced retailers to only stock Nintendo products.

Nintendo didn't want any competition. In America, they had major retailers like Wal-Mart and Toys R Us stock only Nintendo products, and any other company that wanted in couldn't because any retailer that tried to stock non-Nintendo games and consoles had to deal with Nintendo, and they wouldn't have any of it, until finally SEGA demoed the Genesis by a Wal-Mart and finally got them to stock the Genesis, so then other major retailers finally started to stock SEGA's stuff, then eventually other companies followed, and eventually forced Nintendo to end the monopoly.
It seems not too many people remember this, or even heard of it before. Gotta do your research pretty deep to find out about this, I guess. Nintendo might have had their reason for doing that, but all it did was hurt the gaming market as a whole, so it's a really good thing they were forced to stop.
I agree, AlphaOmegaSin. TH-cam is an integral part of gaming now. I found some of my all time favorite videogame franchises through TH-cam. I found Sonic, Metroid, Zelda, Final Fantasy, Portal... Hell, I even found Mario and Luigi through TH-cam. This is yet another uneducated call on Nintendo's part.

I don't really see an issue here. People who make money off of Nintendo videos are making money off a product that Nintendo invested millions to create. I'm not saying that Nintendo should have all the money and with an affiliate program they won't be taking all the money but they do deserve a share of it. There are so many users on this site that just release straight up play throughs without any talking or anything they just release the game and they make money off that... which is garbage and Nintendo deserves to take a larger sum out of what that video makes because all that person is doing is showing the game nothing else.
I'm sorry but those type of people are making easy money just editing the video into pieces. For people who do playthroughs with them talking and giving their thoughts on the game that's different because they're actually contributing something to the content and they deserve to be paid more for the contend that they produce.

You're analogy is inaccurate. People who upload straight playthroughs of games without contributing anything to the video should not get paid anywhere near the amount of money that other LPers or reviewers do because they actually make something new with that content.
Let's use a correct analogy: Someone buys a DVD of a movie and burns a thousand copies and then sells them. By your logic because that person paid or the DVD they have a right to do whatever they want with it. In reality that's called piracy.

I got a copyright claim from Nintendo for a short walkthrough/commentary warp whistle run of Super Mario Bros. 3. The video was uploaded five months ago, I just got the claim last week, so I doubt it's the Content ID system automatically triggering in this case. This makes me think Nintendo is manually searching for content and flagging it. It almost seems predatory in a way.
Creating a "partner network" to me is just like you said--it's a slap in the face, or like pouring salt onto the wound. I doubt it's going to entice people to cover Nintendo products any more than they are now, and Nintendo is going to continue to sink as they have been these last couple of years. Get with the program, Nintendo, otherwise you will be irrelevant soon enough. Oh, and by the way, enjoy the twenty cents you'll probably earn from my video. I'm sure you'll eventually need every penny you can get.

It's stupid how now people know that Nintendo is doing this they act like all other developers and publishers are angels and act like not enough other developers took down videos because they didn't like them showing off their game, no now it's only Nintendo that's the only one that has a problem with TH-cam.
If I see a let's play that's very gameplay heavy I feel like playing the game, games like Mario kart, Smash bros or Mario Smash Footbal. But games with any story like Super Star Saga, or Paper Mario I don't feel like buying or playing the game afterwards because I just saw the whole game.

Last October when Pokemon X/Y came out, I made a video that got 3000 views in a short time (I had 20 subscribers). Then Nintendo put a copyright claim on it and took my ads.
Now I don't make Nintendo videos anymore.
It might have not even been claimed by Nintendo, people can false claim videos too.

I think this is just a way that Nintendo is making up for the money they lost for the WiiU not selling well.
I think that it's nintendo's right to collect revenue from the reviewers of their games, especially since the content creators themselves are making a living off of nintendo's works.
However, I don't think forcing them to pay is a good idea. Rather than make people opt into this affiliate thing, I think Nintendo should allow people to CHOOSE to take part in it, and to give a portion of the money they make form their videos to Nintendo. This way Nintendo has a new source of revenue (even if it isnt as much as forcing everyone to do it would be), they wouldn't be alienating their fans, and everyone would be happy.

The problem is, as I keep saying, Nintendo is not earning that money. If I make a review of a Nintendo product and over the course of a year, I make $100 in ad revenue through monetization, that's money that I am earning through making the video. I am a small LPer and I have already taken down all my Nintendo videos because they all got hit for matched 3rd party content. I was thinking of going back to some Nintendo stuff but this is the last straw....
I have been a huge Nintendo fan since 1987 when I got my NES. I was really happy they came back and kicked ass with the Wii but they have fucked up ever since and even a lot of the choice's they made on the Wii were stupid as fuck, like there terrible online structure.
Nintendo has become the old man of consoles. Unable to change with the times. The word I would use for Nintendo is Antiquated, Old and useless.
Change with the times Nintendo or you will go extinct.

I'm more than in favour of this, infact I hope more companies use such a system. Someone who creates LP content is not putting in ALL the work at all, at least half of the entertainment is THE GAME BEING PLAYED, and the companies get NO return for that.
It's true that seeing gameplay will convince some to pick a game up, sure, but it also serves to discourage some from picking it up too. Have you honestly never seen someone write "oh, i'll just watch it on youtube instead" when a new game got released, or thought it yourself? How do publishers/developers benefit then? Obviously this is much more of a problem with heavily story driven games than something like Minecraft (where the users imagination is what makes the game fun).
There are however, two things about the proposed system that I DON'T agree with. First, why does it have to be set up through a partnership/affiliate program? A system already exists on TH-cam that allows musicians who are performing song covers to automatically split their revenue with the original artist/lable, why can't such a simple solution exist for LP content? And two, it should really only be LP content that is covered by this, someone who is doing a review of a game shouldn't have to pay the developer for the right to do so imo.
I think this is perfectly fair. I've been doing Let's Plays for a few years, and I never put adds on my LPs BECAUSE I'm well aware that I don't own the rights to the game footage. The "my gameplay is unique to me" argument? Complete BS. Most people will tend to play games in a very similar way, even the more unique play styles will have more than one person using them. Even if you're playing a game in a completely unique way, it's still something that the developers designed and included, or at the very least (in the case of a glitch) left in the game.
As for the "But it's free advertising!" argument, it can hardly be considered "advertising" when you play through and upload video of the ENTIRE game. Even IF such videos help sales, it still cannot be considered advertising.
But the final nail in the coffin for me is this: Let's say I were to download AlphaOmegaSin 's most popular video, add my own commentary track on top of it and put my own opening/ending on it and then upload it to my channel with ads, without his knowledge or permission. Is it fair to Alpha for me to take all of the revenue for that video, even though he wouldn't own my commentary track or the additional editing I did? Of course it isn't. That is obviously NOT OKAY. He would be fully within his rights to have the video pulled. Of course he would also have the option of simply taking all the revenue from it, but then that's where I do agree that it isn't fair since I would have put some work and effort into it. But he would at least be entitled to a cut.
The only reason people are freaking out about what Nintendo's doing is because they got away with it for so long before the game devs/publishers caught on. I don't think anyone making money off of LPs on TH-cam deserves every cent they get from advertising on it. The devs/publishers deserve their % too. Now, how MUCH of a portion they should get is up for debate. 50%, which is Nintendo's rumored cut, seems like a bit much to me, it should probably be closer to 10%-30%.

I've said this before and I'll say it again let's plays, reviews and other such videos are free advertising. So what is their getting paid for it magazines and game journalist get paid for almost the same exact reasons albite different ways. I couldn't even tell you how many people on the TH-cam have made me come back and play games or maybe listen to a song or maybe buy something on their recommendation or just out of nostalgia. People like Angry Joe, Josh scorcher, the autarch, Todd in the shadows and so on and so forth make these companies money and this move just reeks of desperation and the willingness to shoot yourself in the foot.

I think you make valid points, AOS but at the same time I don't find it's entirely unreasonable for a LetsPlay/Commentary channel to pay a small portion back to the company. It's just the same as if Weird Al spoofs a song or any other musician covers a popular song they still have to pay the original label. Now I can see Nintendo abusing this unfortunately; only giving out licenses to LP/Review new games, big name channels taking a heavy majority of funds for themselves and the list can go on. Ultimately we may just have to wait and see how this proposal plays out.

I'm sure the only people who are defending this business practice has never edited a video before or ever done a let's play before. You people do not understand that there is more to it than just "Recording and uploading". Alpha already did a decent job explaining why it's a bad practice but you still defend it without considering how the other side feels.
I get it, Nintendo is supposed to make money on the things they created. But they have already got their cut from the $60 that the consumer pays to get the game. And now they are showing it off with the possibility of convincing others to get that same game, ergo, more $60 payments added because he/she showed that one game to his/her subscribers.
The thing about this, in my eyes anyway, is that there are so many people who watch an LP of a game and make a point to never buy said game. "Oh I just saw a youtuber play it, why would I want to play it myself? I already experienced it" is their mentality.
So, free exposure or free advertisement or not, there's a huge chunk of the audience who just watch games being played for the commentary and will never buy the product. So in the end, you have a bunch of dicks on youtube making a shit ton of money just by playing games that were expensive as hell to make. Creative input and talent went into those games and it's being exposed to an audience who might not give a shit about the game itself, just the person playing it. Just look at pewdietard. He probably makes more money than many of the devs of the games he plays and screeches over.

Also let's take Minecraft as example. There are loads of videos on it Mahjong supports them. And look at how many people have bought Minecraft for platforms like Ps3,Xbox360,App and PC.
A lot of people nowadays hate to buy blind, unsure of whether or not the game, CD or movie will be to their liking. This is why a lot of people download music and movies, to see if what they see or hear warrants a purchase. When people upload music videos to TH-cam, or even whole albums, people can get a taste of what they can expect.
It's the same with Let's Plays. Though I'm sure there are plenty of people who merely watch them for entertainment value (guilty as charged, though I own some of the games that have been done myself and often got the urge to play them again), it can also happen that a game is so fascinating when you see others play it, that you want to try it yourself. And your playthrough may vary vastly from that of the LPer, who usually spends hours practicing and optimizing his/her strategy.
If only a handful of people buy a game that has been LP-ed, that's still profit for Nintendo, as these people would probably not buy the game if they didn't have some way of watching the game mechanics in action.

Anyone remember egoraptor at the tester? That fuck disrespected the entire industry when he was in front of a panel of industry veterans and said he was only in the show for the attention. Just like this fuck, I'm sure there are others LPers who couldnt give Zero fucks about the industry and only care about their greedy selves. They should be proud they will provide some income for the companies that gives them content to provide for their shitty youtube channels. It's a win win situation IMO. Publisher takes a small cut and uses that money to develop another game, which can then be used on another LP series.

I don't see why everyone is trying to take a massive shit all over Nintendo. Plenty of people take straight game footage and upload it with virtually no editing, commentary, anything. You wouldn't hear anyone complain if someone uploaded movies, monetized them, and didn't get penalized or expected to give some of the share of the money to the original creator of the film. Don't tell me it's different with video games. I'm not talking about LPers or reviewers, I'm talking straight game footage. LPers and reviewers should also have to give a percentage of their profits to Nintendo because they're making money off a product NINTENDO created. Nintendo is not selling people products to make money. They're selling games for people's enjoyment. If you made a product for recreational purposes and tons of people were making lots of money off of it you'd be pissed off and want your share too. Don't say Nintendo is cheap, or wrong, or that you're gonna boycott Nintendo for something any of you idiots would do yourself. Be thankful Nintendo let's people upload footage of their games and make money off of their products. Anyone who makes money off Nintendo products and doesn't expect to give a share to Nintendo should go cry and deal with it because without Nintendo they wouldn't be making that money in the first place.
I think the logic for Nintendo is that they are going to do more stuff on TH-cam as far as promoting their games, what with Mario Kart TV being made for Mario Kart 8 that allows for uploads to TH-cam which possibly means we'll see a Smash Bros TV services not far from now. So in their minds, I think they're trying to get all Nintendo related material under one banner, thus why they're doing this.
May not necessarily be the right way to handle this but neither do I think its a bad idea overall. Might take some work to get it to a point where people feel happy with it. But if Nintendo can provide support to the gamers who are willing to play which who knows what that might be, then it could benefit them more then hurt them.

I think this decision from Nintendo is a better move than the previous one, who was plain dumb, honestly. Regardless, this one is actually tricky as you could expect from this company, if you read between the lines... As a Let's Player myself, I'm all the way for sharing the revenues with the intellectual owner of the game. Because, that's true, on one hand, it's their product at the core. On one other hand, it's your original content. You need to remember and doesn't forget those principles.
People need to open their lazy eyes, and begin to understand that, yes, it's also true that some Let's Players are only commenting a game (and are sometimes doing a fair job at being entertaining just by that), but there is a lot of us who put great time and efforts in our videos, regarding the editing, the fun parts, the audio mix, the dynamic, and so many more things. The whole "movie upload" argument is thus horse shit. Get it together. Apples and oranges, Movies and Let's Plays. Simple. Plus, do I really need to stamp out another statement saying that it's big games that make Let's Players interesting ? When it's true that it's some well known franchises that can attract an audience, it's your commentary, your personnality, your efforts that makes the viewer following you or not in the end. If he doesn't like what you make with the game, trust me, he will go elsewhere. The game is the support, it's an experience in intself, but the experience is different with somebody else.
So, yes, if Nintendo wants a piece of the cake, that's perfectly alright and legit - even if, frankly, that would be fair to only go after big shoes and not small fries who are already struggling... But we need to be careful on this statement. Because, what amount do they want ? Will they only share equally ? I feel like an 80% for Mr.Japanese, 15% for Google, and 5% for our sorry ass.
Finally, I'm really worried about the tiny lines of this contract, the conditions, like :
"We authorize you to commenting our game ! Go for it !"
And if by any chance you are just stating obvious facts like : this isn't a good feature, this is buggy, etc... And then getting flagged for it... Come on people, we know this already happened and it will again in this circumstances. Be real.
In the end, I would be curious to see what happens if in the worst case scenario, ABSOLUTELY NO CONTENT of Nintendo could be find on TH-cam, except for Nintendo's Channel, saying that their games is the best ones. Trust me, THAT would be what hurts the most the company. No good advertising whatsoever. And don't even mention the so-called independents gamesites... they depend, like us, of Google with advertising revenues, mostly.
Finally, to end my long-ass message - and I'm not even sorry for it, suck it - it's important that every video maker here is well aware of those facts and can prepare a defense if necessary. Because in the end, we are all in the same boat, looking for making good content, and who knows what will happen tomorrow ? If it doesn't affect you right now, it surely can if you don't step against big lobbies.

I think I may misunderstand this. From what I understand, some channels get third party content tagged, so they don't get any revenue in the first place. So in that case, wouldn't this be a good thing?
I can understand though that this is quite the problem if the channel is like pure nintendo and is actually making any kind of money on such a thing, but I thought nintendo already had a third party stamp on those videos, so they're the only one that would make any money in first place.
Problem is that there is an automated matching system in place on youtube that can flag the videos for content, you would then have to dispute it and bring it to their attention to then have it allowed by Nintendo themselves then they would take their cut....it's like a fuckin circus 0__o
So rather this is a good or bad thing to anyone and everyone, in the end, there's one big act going up, trying to take the attention (money) away for their own amusement.

I'm going to defend Nintendo here, they deserve a cut. Yes Lets Players record the game but Nintendo is the one that made the game and supplied it to their fans. Saying Lets Players should get all the money for making money all their product is very hypocritical. I would say 50/50 would be fair enough here.
But they bought the game with their own hard earned cash. They can do whatever they want with the game they bought, It's theirs. If they want to just record themselves playing it for other people to watch then why should they be getting charged for that?
XTsunaVongolaX they aren't being charged for uploading nintendo content, they are making money off ads with content that isn't their's, sure they own that copy or disc, but the characters, graphics, music, or anything else is nintendo's and they are STILL letting gamers make money off of it, this is really no different then a youtube partnership
This is a lot more than Let's players. We're talking about people just simple showing an image of their products, having a second or two of their sound effects or their music, their characters likeness, reviews showing their gameplay footage and shit tons of other examples

Before I get replies telling me free advertisement of their games, that is true...but here's the problem. While people are more inclined to buy a game through let's plays, more also lose interest in buying the game.
I would have bought Ryse, but after watching gameplay I lost interest in the game.
I bought Dead Rising 3 after watching Let's plays of it, I was skeptical because I loved the 1st game but hated the 2nd.

Nintendo has the right because it is their product, people play a game and add a voice over to make money? You can say it's an asshole move, but they have the right to do this, quit denying this. Don't give me a bullshit "Let's plays are an art form".

It's gotten to the point where people do it for the sake of the money, not because of the passion (there are those that do it for passion, don't get me wrong).
A good example of this is TheRadBrad. I loveddd his videos 2-3 years ago, back when he played MW2 with xrags, but I kind of realized that he over hypes everything to sound colorful. I also noticed on his Watch Dogs videos he was cutting them short, likely to generate individual views from each video.
What baffles me is how the hell do they not realize that this is a bad idea?
I don't get why people are upset by this. It's Nintendo's copyright. Nobody should be making money off of Nintendo-copyrighted stuff except for Nintendo. When people put ads on their Let's Play videos, they're making money off a copyright that doesn't belong to them. Lords knows how many times TH-cam offered to install ads on my Suikoden 3 videos because of the views I had on them, but I refused to because I didn't make Suikoden 3. I don't deserve to make money off of it, so nobody else should be making money off their videos if all they're doing is sitting in a room, playing a game, and reacting to it.
Would you guys rather Nintendo pull a Sega and flag every video with Nintendo stuff until they're all removed?
Feigndall Actually, that point is not settled yet. They own the code and modding it is interfering with their intellectual property, but the actual gameplay, the character input if you will, they don't own. To get clarity on the issue would require specific legislation or, more likely, a court ruling, and nothing like that exists yet.

The only people who deserve to make money off of a game are the people who poured their energy and resources into a game. What gives you the right to suddenly ask for a handout just because you shelved out $50 for a game? That's like ordering a meal from McDonald's, filming yourself eating it, and demanding to be paid for it because that's how you "monetize your time".
You also obviously don't know anything about video game journalists. Most do their reviews for free, and don't demand any money from fans even when they go to video game conventions. And the video game journalists who publish their own magazines do so out of their own pocket with their own editing, and go out of their way to promote the games and don't really promote themselves. When you buy a video game magazine, you're funding their service.
So, no. Nobody deserves to be outraged about Nintendo trying to stop people from making money off of their products. I'm a lifelong gamer and I've filmed myself playing video games, but I never once demanded money for it.
Hit a nerve did I? Oin light of the last weeks events, I doubt you know how video game "journalism" works too. To put things into perspective, according to Reuters, the National Enquirer has more journalistic fidelity than any video games new sites. It is rife with puff pieces, corruption and cronyism.
As for monetization of content, thatæs how capitalism works. If you can find something people are willing to pay for, you will make money. I think the entire art world is filled to the brim with hustlers who do things a toddler could, but I respect their skills and marketing their ideas. Just because you are self-important enough to feel youtubers shouldn't make money, doesn't mean they don't have a a right to. And how many let's players do well anyways? Not many. And those that do are brought into the fold, being paid to advertise games.
I may not have to worry about this issue too much since I don't use Nintendo-related stuff in my videos anyways (except once, but it was kinda brief).
