We had a relative living in our 2 family home in NYC, we lived there with them for 25 years. the rent was never raised.. still $250 a month. same unit next door, $1,900. We wanted to sell and gave the relative 1 YEAR to find a new place. They refused to leave. 3 YEARS in court to get them out. NYC judge kept giving them another 3 months to move. Then the Judge blamed us for creating the problem by never raising the rent..So that the tenant budgeted $250 a month, and now WE CREATED the problem.. BTW: the relative/ tenant didn't pay rent for the entire 3 years. That's what liberal Judges have done to America. The entire housing system in about to collapse - since it is Imposible to be a Landlord anywhere in the Northeast US or west coast.

The reason the Plaintiff should have put in a claim, they would have gone after who was truly responsible for the damages. Not the Landlord. The landlord was not involved in the fire, the tenant was, so that makes the tenant responsible to pay for the damages, She went after the wrong person.

She should have put a claim through her auto insurance. Comprehensive insurance coverage would have paid for the damages less her deductible. The claim like this would not increase her auto insurance premiums.

I side with the plaintiff. It's one thing at the beginning if the landlord said you will have to take it up with your car insurance but that's not what they said. He told her he would take care of the damages thinking it wasn't going to be that much. In California, if the owner of the property does not ask the tenants to get additional insurance then it is the responsibility of the property owner.

I haven't watched the video in full but can you sue for car damages if your car was damaged during an emergency? I don't see how the owner is liable.
Why should the plaintiff come out of pocket! The landlord opted not to go through their insurance because of pikes in their insurance!

The land lord was giving her money literally out of the goodness of his heart - not because he has a responsibility. It was gift at any amount. You can't sue and demand gift giving. I'm honestly sad for her that she doesnt seem to get it. She lashed out at someone trying to help her.
Cant sue the fire department because they were just doing their job.

If she had USAA auto insurance she should have absolutely filed a claim. They are the insurance company that advocates best for their clients.
If USAA finds any fault with the landlords they will go after them for repayment.

Again, this Arbitrator blew it, no surprise , when the defendant said that they did not want the insurance involved, that was a red flag, plus he at first claimed that him and his dad did not know about the tennant starting fires, then he said the tenant was evicted because of his negligent, -red flag-, plus why should the plaintiff have to use her insurance , which she pay a $500.00 deductible, and her insurance will go up, this should of been paid by the building owners insurance, period.

The reason the Plaintiff should have put in a claim, they would have gone after who was truly responsible for the damages. Not the Landlord. The landlord was not involved in the fire, the tenant was, so that makes the tenant responsible to pay for the damages, She went after the wrong person.

she should have put in a claim with the apartment insurance company. they would have investigated this claim. Or her insurance company who would have gone after the owners
She should have put a claim through her auto insurance.
Comprehensive insurance coverage would have paid for the damages less her deductible.
The claim like this would not increase her auto insurance premiums.

If someone falls on my property even if it’s not my fault I’m liable . He could have claimed her car. She didn’t do anything wrong and was damaged. It’s not her responsibility to chase the tenant. It’s the landlords responsibility who they rent to. Period. Another bad call on her part. She is losing it. She has not practiced law in 25 years, gets no continued education so she is lost in current issues.
I side with the plaintiff. It's one thing at the beginning if the landlord said you will have to take it up with your car insurance but that's not what they said. He told her he would take care of the damages thinking it wasn't going to be that much. Then she goes to the bodyshop and has the price to fix it but bc it was more than the owner expected suddenly they don't see any damage to the car. 🤨
I'm confused by the verdict. The defendant agreed to pay at 7:55 and admitted it under oath. So why aren't they responsible?

I think that the fact that THEIR tenant has a pattern of being a firebug & irresponsible and has started 2 previous fires that put the landlord on notice that his tenant that he selected and approved put him on notice after the first FIRE

I am glad the defendant won b/c I don't think the plaintiff had that much damage. I thought the $400 the father originally offered was probably fair. Having said all that, I don't know what the Judge is talking about that you don't go threw the landlord and should have went after the neighbor. I have lived in apartments/townhouses my whole adult life and never have had this be the case. At every place Ive lived you are told to go threw the landlord not your neighbors.
The one who started the fire is the one she should go after and renters insurance should cover it .She waited 2 years after to file court case. Anything could of caused those marks .
The judge missed that the tenant was a nuisance. He caused issues and they only had him removed after the city came after them.
I think you are a little mixed up. They got rid of him after this fire and they paid for that guys housing for 3 months because people from the city got after the landlord for making him homeless.
There are property insurance policies that would incur little to no premium increase for a claim like this. God bless

Tenant caused the fire, and insurance for the building would have covered, because that is what insurance is for. Landlord doesn't have to make a claim if he doesn't want to, everyone else affected by it, can, and should.
Landlords are not responsible for any of your stuff including vehicles anything you bring with you as a tenet is not the landlords responsibility. Why we have tenet insurance that covered your belongings. She should have went after the guy that started the fire not the owners

It happened on the property, it was the landlord property that was destroyed and therefore caused her property to be destroyed, therefore the landlord should pay and then he go after the negligent tenant. This lady shouldnt get the run around.
