Many, if not all, states tax you if you buy a vehicle EVEN IF you sell a previous vehicle in a separate transaction. You can't honestly say that this is "realized" when you hold any sale funds in preparation to purchase a replacement. Taxes have become an excuse to skim money whenever, wherever and any direction money flows.

Everyone should keep a firm grip on the reason for this "case." The government is now spending 25% of GDP, but taxing at 18%, Historically, the nation grew to a superpower with government spending under 18%. They'll take it all if we let them.
Specifically over what years do you find that historically the average federal spending as a percent of GDP is 18%? Because from the turn of the 20th century to today it has fluctuated pretty significantly depending on what the time frame is you're looking. There are certainly times in the past that we've also spent significantly more than 18% of GDP, not just recently. Which is why over the last century the average has been about 18%. For example for the 2 decades from 1974 to about 1995 it was quite a bit higher than that avg. as well.
During that time it rose significantly, and by the beginning of the Reagan administration it was averaging between 20-23+٪, then entered a long decline throughout the Clinton administration, returning to about 18% again by the end of the Clinton admin. Then rising again to about 20% throughout the Bush administration, and finally spiking to about 25% with the onset of the Great Recession.

Because the data I'm looking at from 1929 to 2010 federal spending as a percentage of GDP averaged 18.3%. And the only time period where it was significantly less than that was 1929 to the onset of World War II in 1941, when it spiked to over 40%, then it fell significantly below 18% from 1945 to about 1952. There was also a dip below that average in the early to late 60s but it's been at or above 18% ever since. Mostly above ranging up to 25%.
During the time our nation was not a superpower is when it was historically below 18%. Much lower at times. We didn't become a superpower until we ramped that up to over 40% of GDP during World War II, and have pretty consistently spent more than 18.3% of GDP ever since.

This is a very dangerous case. If they can tax you on unrealized gains, there is no incentive to hold the investment longer than a year. There would be constant rollover of investments and hurt financially the investment.
Yes and no. I’ve thought about it for a couple years. We don’t need unrealized gains. What we need are simply property taxes for equities.
The federal government bought up a third of all real estate mortgages forcing assets to go sky high. This then let counties force sky taxes on properties. Is that fair? No. It lets real estate businesses borrow and refinance and get rich but it screws over the average family suffering with high taxes.
Real estate is taxed and it’s not an unrealized capital gain tax. I think we could do a property tax for equities. It’s the only tk tax giant tech companies I think. The qualified small business stock exemption already lets Cali avoid taxes. You can turn a 50 million investment in a company and sell it at 5 billion and have it be tax free. @@koltoncrane3099 Congratulations on an interesting concept. I believe that it would act as a weight on the equities price, which could provide some stability instead of gyrational swings in price. Almost like an up front load fee. The investor would know the cost upfront, instead of an unknown on the back end. While the government would just piss this property tax away like they do all of our money, it is more palatable (Maybe just Semantically) than Unrealized Gains being taxed.

This is all that matters. This is the slaveholders rebellion that’s gone global.
It was a mistake to adopt that nomenclature in the first place. Personhood needs to be specifically, more narrowly defined, and valid non-person entities defined separately and incapable of extending human and civil rights to said entities that exist primarily for accounting and tax purposes. Corporate devices have their place, but they should never have status coequal to a person, much less share the same status. The justices here were trying to gain clarity so as NOT to have to visit types of entities and personhood here since the core issue here is about repatriation. An oblique approach to the definition of entity types is a nightmare scenario. Due to the complexity developed over history in a variety of laws and SCOTUS cases, as well as preconstitutional Common Law assumptions, the only two practical vectors to clear and different definitions of personhood and non-person entities are either (1) for either Congress or one or more states to make law differentiating between and clearly defining personhood and non-person entities, which would force the SCOTUS to review the laws and concretize the definitions, potentially changing the interpretation of many other laws and SCOTUS decisions; or (2), the far cleaner means of passing an amendment to the Constitution of the United States of America, therein defining personhood, what entities qualify for it, as well as starting and ending conditions, if applicable. Anything short of that presents conflicts difficult for SCOTUS to resolve, at this point, because… oy. Well, many things, not the least of import being abortion and fetal status, can be at direct odds when considering extension of the same potential decision/policy toward types of corporations and other entities. We've allowed SCOTUS and politicians to acquiesce to financiers to create an impossible quagmire that they can only render MORE convoluted without starting from scratch. We must address all repercussions of clarifying the definition of personhood itself. This SCOTUS, GOP, Democratic Party, and Corporate America would resist. It's up to The People, including some unusually altruistic and humanist rich persons willing to go up against the very structures that allowed them to become and remain wealthy, to engage in direct democracy while it still exists.
So, if your business goes under, or worse gets hit with massive lawsuits, you want to be personally responsible? Or do you only want the assets of your business seized?
If you own stock in a company, do you want to be personally responsible for your share of its debts if it goes under?
Corporations can't vote. However, they can be and are sued on the daily. Imagine if you were trying to file a product liability lawsuit, and your attorneys had to track down every owner of the company and sue them personally. Nobody would ever file a lawsuit.
Corporations are actually democratic institutions. The shareholders elect the Board of Directors, one vote per share. The BoD then hires and fires the CEO. (In Europe, I believe the CEO is elected by the shareholders.) The problem is, stockholders aren't any better at electing their representatives than voters are. A lot of them never even bother to vote their shares. There are even "activist investors" who get control of a majority of voting shares, either by ownership or granting of proxy by shareholders, and vote in their own new BoD. Then they force whatever their agenda is on the Corporation. Sometimes it's to force the Corp to "go green" or such. Other times they want the Corp to focus on short-term profits, increase dividends, and worst case basically loot the Corp.
BTW how is the stockholders of a corporation pooling their money and lobbying politicians any different from the members of a labor union or environmental group doing the same thing?

I never see roughly 18.5% of my paycheck. If I am lucky on April 15 I don't owe more (I have in the past). Except for groceries, everything I buy is between 7-10% sales taxes. So likely about 6% disappears. It is about 0.5% for gas taxes. Than there is so much if you pay for services such as phone services, electricity, or water. I am upper lower class at best, and about 1/3 of my money goes to taxes. You really think the wealthy pay that much less?

The gov wants a way to get tax money before there is income to be taxed. I would like gov services to be paid for after being provided. Also, I would like a credit for value lost due to government caused inflation, this could wipe out taxes being due.

For clarification this case is not about reparations for descendants of slavery. It’s about a REPATRIATION tax. This case is about the definition of income under the 16th amendment and US tax law.
The MRT required corporations to a pay a one-time tax on deferred foreign profits. These are profits that were earned by foreign subsidiaries of American businesses, but not returned home and therefore not yet subjected to U.S. taxation. In short this case is about whether or not America can impose a tax on foreign entities as part of US corporations. Gotta think about offshore tax sheltering and corporate structure. As well as realized income vs unrealized income. In this case it would be the ability to tax deferred revenues.

I’m not an expert so I could be wrong but one time probably means realized at one time but payable over an 8 year period. But I’m not 100% clear on how the tax works. They cajoled many of the hesitant politicians into voting for the tax by pointing out the fixed nominal amount tax per year per worker. Once the government’s foot wedged open the door the government expanded the scope and amount of Income Tax. Today, the government levies the income tax based on your earning power - the more you earn, the more you pay. Under the socialist Roosevelt administration the sly socialist politicians expanded the income tax so as to claw in more money. They justified it under Keynesian economic as a necessary tool to address wealth inequality. Today, we all know the income tax coerces money from the working stiff to give to Wall St Fatcats, Too-Big-Too- Fail corporations, subsidies to dairy producers, farmers, and special interest groups, and the Military Industrial Complex. After 80 years of expanding the income tax to create the current Big Government; funding well-meaning socialist policies ; and levying the most oppressive perennial income tax upon the working class has America become better, stronger, or fairer?
Today’s America has no resemblance to the 1918 America. It seems to me that if congress is not restricted to taxing realized income but can deem an unrealized gain to be income in the hands of a tax payer, then there is no constitutional protection against the blatant expropriation of property without compensation. It is difficult to see how realization can be distinguished from attribution when considering the tax liability of an individual tax payer. If income is not received then it cannot be attributed without lifting the corporate veil and the corporate veil should only be lifted in instances where the corporation is used fraudulently.

This has nothing to do with that. This has to do with the government taxing the value of things that haven't actually paid you.
If this goes through then there is nothing a person own which cannot be expropriated by the government without compensation, which seems to violate the constitution.
The tax system is bifurcated. IRC 1 and 11 are for "United States persons" and IRC 871 and 881 are for "Foreign persons".....IRC 873(b)(3) specifically says that "a taxpayer....is a national of the United States." If a person holds a USA passport, which can ONLY be issued to nationals of the United States, then one apparently has the clear and unequivocal right to make a choice as to which tax status they choose. Foreign or United States person.

You dont need to tax unrealized gains. Just remove corporate tax loopholes or require a minimum tax % for ALL corporations above a certain amount. Taxing unrealized gains Sounds like word games by desperate people

If you look all the way back to the very problem that initiated this whole mess it becomes pretty simple. Chauvin contacted and detained/searched floyd over the alleged use of a counterfeit 20$ bill. The search was initiated in an attempt to make an arrest on drug charges. That said its not racist and its not fair and its not his job to engage in behavior like that.

All this case is about is the wealthy not wanting to contribute anything monetarily to our country and society.

As far as I'm concerned, you don't get to not pay taxes; and, be allowed to have as much say in our laws and policies as they buy with their wealth; and, then be allowed to not pay workers a living wage; and, complain about crime, homelessness, inflation (that is being created by the greed of companies that the wealthy are benefitting from); and, complain about the taxes you aren't actually paying to help alleviate these problems in our country; and, then go and buy another luxury home, car, private jet, luxury mega yacht, or other play thing, and, then turn around again and complain about the taxes you should be paying but aren't paying actually.

So basically this is a lawsuit by a corporation having earnings in the U.S. but they do not believe they should pay taxes like the rest of the poor folk because they are a corporation that does business world wide. (how do you think they got poor?)
What? No it was a lawsuit by coule who invested and then got taxed on ownership of a company they hadn't actually benefited from. The point is the government is saying "Your property's value increased by this much, so we're going to tax you as if you had sold it".
Here's the thing to think about: When you buy a car and it's value depreciates by half a ssoon as you drive it offthe lot...do you get a tax BREAK because the value of your property immediately dropped?

This was the result of 2017 tax reform.
They reduced corporate tax, to fill in the revenue gap caused by this Republicans wanted to collect onetime tax on income from outside US even if they didn’t transfer profits to US.
That's the point though: They DIDNT make income. They had partial ownership of an entity that in theory grew in value, but they were never actually paid by said entity. It's exactly as if you were taxed for owning stocks because the stocks went up in value...but you never sold the stocks. @@gund89123

This should be a no-brainer. If the Corporation earns income, the Corporation should be taxed by the Government on that income. (Yes, the corpoate tax structure is effed up.)
If any of that income gets transferred to shareholders before it's taxed by the Government, then the shareholders should get taxed on that income.
Taxing somebody on income they *might* earn is no different from arresting someone for a crime they *might* commit.
The fact that there are all these rules and loopholes that let the Government reach into the corporation's income and then tax the shareholders on it is total BS.

The court needs to enshrine these type of taxes inside the constitution without this congress would never hold corporations responsible for they foreign gains. It just to much politics between lobbyist and congress to not tax these corporations. This could be one of the largest decisions the supreme court has ever decided. The changes to this could have a generational change in the U.S. taking our GPD from now to trillions more in tax realization.
