Florida lawmakers pass bill to revoke squatters' rights, protect property owners

  • House Bill 621 authorizes property owners to request action by the sheriff's office to immediately remove squatters from your home. The bill passed overwhelmingly in the Florida senate last week.

      That makes too much sense for New York. A woman in Flushing, Queens just got arrested after she "changed the locks" on her own house to keep squatters out. Well, the squatters returned to her home, busted down the door, called the police, and had the homeowner arrested. New York is so ass-backwards that it is beyond all hope and redemption.

      Squatters rights go back to the settling of our country. Unowned or unclaimed land could be claimed if the squatter lived on it for a certain amount of time and either farmer it or raised livestock on it. Far different concept from these squatter low lives. Agree, the laws need to be changed immediately.

    The intention of squatter's rights was originally to protect a guy moving out to the wilderness 100 years ago and building himself a log cabin and living to be an old man, only to find out that land was "owned" by some big company and he had to leave after living there for 30 years. People have abused this to now say "I broke in and stole this house so now I live here." NO!!!

      Please cite the law, the jurisdiction, any any other pertinent info proving there was ever a law anywhere, passed by a legislature, that permitted you to steal another's land? I thought it was case law, decided on the particulars by a judge in a legal proceeding. I'm sure it is state by state and the wording is probably different. It was never anything more than a remedy for situations where there was no intent to deprive anyone of their property. You don't get to steal someone's house because they aren't home.

      @garyb6219 what's wow about? The idea behind? Who's idea? Show the law FROM ANY STATE that gives property rights to trespassers and burglars. There isn't one. These situations came about as stated, somebody builds a house on the frontier and 30 years later somebody shows up with a land grant or documents proving the land belonged to someone else, to remove the "squatter." Judges said no. There are 50 states, the last admitted was Hawaii right? Do property rights come from the fed? No, they come from your state. I'm taking issue with the term "rights" when as far as I knew, that right was only granted by a state courts decision in a matter before the court, usually a lawsuit. I'm not a lawyer and have only taken business law and what I know from polisci and civics classes.

      historically, vagrancy and well as trespassing was against the law, and serious, BEFORE the USA even existed. you'd be jailed, or put in stocks and punished. usually this was for passers through; Pilgrims were suspicious of anyone on the move. you didn't do that in those days!

      Well, the problem is that they *_claim_* it's theirs (or that they have a valid lease), and when the cops show up, they say "Hey, I have a lease!" and show them a piece of paper they dummied up.
      The cops don't know who is telling the truth and they end up throwing their hands up and saying "It's a civil matter". ¯\_(ツ)_/¯

      Is old common law intended to allow someone to take over abandoned properties and pay taxes on abandoned properties. Cities don't bat an eye because they're getting tax revenue from a property that wasn't generating revenue before.

      What needs to happen is the Supreme Court needs a total reformation of tenant laws and how they apply to Squatters. Currently in most states, a property must be vacant for 10 years to someone claim Squatters Rights. The reformation should have an addendum, that in order to claim a property you must have lived in that property for 10 years as well.

      No ne really ownes their property. Stop paying your taxes and the government will come and take your house. If they sell it for more than you actually owe them, good luck getting a refund for the difference.

      It's up to the owner. If decide to exercise their right to enter their property, and if need be defend their life with lethal force while removing an unlawful person they can do so.
      The thing that is insane to me is people still think the government, namely the police exist to serve us. All governments even democratic ones are intended to control us, and only help us as much as required to legitimize themselves. If you enter YOUR property, and shoot someone in self defense, it isn't a civil suit ESPECIALLY when the other party is departed. It's a potential criminal case, as long as it IS self defense and they didn't have a lease to be there. You CAN throw their property out, you can disconnect the power, water, and physically force the occupiers off of your property.
      The problem is cities don't like this and will threaten a bunch of BS. But your rights trump their claims as long as the squatter isn't a lawful tenant the city or state can't hold you accountable for what happens as a result of someone else's crime (criminal trespass, assault, etc). But it's dangerous legally and physically, it's expensive to win and in America if the government or a related to the now deceased party bring civil action you have to pay for your own defense.
      The solution in my mind is simple. Strong property rights for law abiding citizens including the right to simply shoot trespassers if they have been ordered to leave on camera and refuse to do so. But I'm a tad aggressive when it comes to our rights vs the rights of criminals.

      Unfortunately, this Florida bill isn’t quite what people think. It still gives squatters rights, but if the squatter is there illegally, then the owner can easily pay. That’s right pay a share to remove the squatter. Florida made it easier to remove the squatter if only if the squatter is there illegally. But again, squatters have rights in Florida to be there, and if you violate squatters right in Florida could be prosecuted by the squatter.

      My state requires 21 years of occupancy before they can try and take your property. It can take from 3-30 days to evict.

      For common how owners who have a reason to be away from there home for a whole month, I guess i understand but as corportations buy more land and homes, making them unaffordable for the average american, everyone will soon become a renter. With everyone becoming a renter, the moment you are a few days late on rent you have broken your lease and are now deemed a squatter, even if you simply need more time to come up with the money. Now that you are a squatter you will be thrown out of the place you have rented no matter how long you been there and your stuff will be in the streets. Now its easy to say, oh people should just save money, but 50% of americans have less than 1000 dollars in savings because everyone can really only afford to live paycheck to paycheck after rent groceries and transportation. So to answer how did it get to this, the government never for saw that individual americans would own multiple homes and have some of them go vacant for months on end, but the goverment did see that landlords were throwing tenants out after a late rent payment. The real question to ask your is does the governemnt give squatters (homless people) any real choice when compared to living on the streets and having a 3 day time limit on shelters.

      Generally the druggies will drag a house down to absolute squalor. The owner having the electricity and water shut off before they even got there. Usually results in the owner bulldozing the home down. I've read stories where the druggies will wait it out thinking they can't do it if they stay inside. Then they hear it coming for them and they run out, like the roaches they are.

    Yet again, another great reason why I left NYC 17 years ago and moved to Florida! Last week squatters murdered a home owner in Manhattan . Two weeks ago in Queens, the home owner was arrested for changing the locks to the home where the squatters were. She was arrested for illegal eviction of the squatters!!

      In Florida squatters have rights and if owner violates them the owner can be prosecuted. Squatters have to meet certain qualifications. Last month Florida enacted a new law but again that law only made it easy to evict illegal squatters but did nothing about legal squatters

    In New Mexico, I had a squatter on one of my properties. He refused to leave. He knew the law better than anyone when it came to squatting. I called the sheriff. They couldn't/wouldn't remove them. Told me I had to go to the courthouse, file paperwork, set a court date in order to have them removed. I did that. When it came time for the court date, the squatter didn't show up in court because he decided to leave but I had to go through all of that before he was "willing" to get out. You wouldn't believe the mess I had to clean up after he left. Trust me. Squatters do know the law better than anyone so they know what they can and cannot get away with. Hopefully NM will change its laws. I've lived in FL now for over 10 years. Squatters should have no rights.

      The governor did not draft this legislation… DeSantis hasn’t actually done anything to help Floridians. I used to live down there and moved to northern Wisconsin. It’s colder up here but quality of life if significantly better. Florida wages are terrible and the rent prices are ridiculous. Florida public education is a giant cluster too thanks to him. Also, he’s the reason homeowners insurance skyrocketed. My folks still live down there. This particular piece of legislation is actually good though. The legislature finally did something right for once.

      There is a good reason but the laws often went to far to protect squatters. As I understand it the idea of thoes laws was to allow people to fix and take care of abandoned properties that may have no owner due to any reason such as a death or something. Essentialy it was a way to recycle abandoned property that nobody is using so it’s not in a state of limbo.

      This is not addressed in the Constitution, so it’s an issue to each state to decide, per the 10th Amendment.

      Yes, good point. People forget the limited role of the federal Constitution. It said how a new federal government was to be created, what it had power to do and jurisdiction over and what it could not do (bill of rights), because people feared an abusive monarchy like what they fled.

      nah Im happy with people doing their own job and keep people off their own property. It's not the governments job to do that.
      These laws were made to protect the occupants, if you want all your rights taken, then throw your rights away first. Then we will see how you feel being just a squatter. So many people try to illegally kick legal tenants off their property.
      Which makes more laws to protect those people that you felt were already protected enough. So if you disagree with "squatters rights" perhaps its because you have been forced to pay rent your whole life and not because they aren't
      you're just jealous it seems lol I get free rent for life, see how you feel about that. I can move any where in the USA and my rent is payed for by the government.
      All states need to stop being lazy, if you see someone breaking it to your neighbors, say something instead of let them become legal residents 7 days later. Nothing but lazy people here in this country, always expect other people to do everything for them.

    In most states, trespassing is illegal but squatting is not? How does that work, exactly? The whole thing is ludicrous. (BTW, lawmakers, a "tenant" is someone who pays rent, not someone who breaks into your property and sets up housekeeping.)

      Depends on the state but posting a no trespassing sign at the front and back of the home and taking a picture is usually sufficient for to get the police to come over and take them out.

      Trespassing is illegally entering a property for a brief period of time with the intention of leaving. Squatting is illegally entering a property with no intention of leaving
      Squatters rights serve to do two things. First prevent landlords and land owners from taking the law into their own hands while making sure they have no justification for abusing actual tenants. Second it prevents the disuse of property, which is important for housing shortages. If someone can buy up a bunch of property or land and not do anything with it, that’s a problem because that’s land that could be used for housing or other purposes
      Squatter’s rights also aren’t so easy to obtain, not only does the squatter need to live there for 5-20 years depending on the state, but they have to have continuous possession of the property, they cannot have hostile possession of the property, the squatter must have open possession of the property, actual possession, and Exclusive ownership
      Basically the squatter needs to be the only person living there, they have to live there and only there for 5-20 years, they cannot have forcefully taken over the property i.e kicked the owner out, threatened them to hand over the property etc, they cannot live there secretly people have to be able to see the squatter and know that they’re living there, the property owner has to have cause for Trespass i.e the squatter is actively living on the property and refusing to leave, finally the squatter has to act as if they own the property meaning the squatter has to pay taxes on the land
      The majority of squatters aren’t going to meet the requirements and as long as the property owner is actually managing their property by putting up clear no trespassing signs, lights, cameras, doing regular property checks and inspections, squatters and squatter’s rights won’t be an issue
      The only annoying thing is when a Squatter who clearly doesn’t meet the requirements forces the owner to go through the whole eviction process that squatters are entitled to

      An acquaintance of mine near Ocala, Fl tried evicting squatters from his home in 2019. They kept getting extensions by merely claiming "We have no place to go.". Then along came covid and everything stopped. Finally in August of 2023 he was able to get them out. They left $38,000 damage to his home.
