- A week after Channel 2 Consumer Investigator Justin Gray first reported on a squatter taking over the home of an active-duty Army officer, Channel 2 Action News is getting results. Army Lt. Colonel Dahlia Daure is back in possession of her Dekalb County home, and the squatter is behind bars.

There should be no freaking thing as *”Squatter’s Rights!”*. A tenant is a tenant. A Squatter is a CRIMINAL!

Yeah I saw one video where this lady rented her house for an air b n b & the wooly mammoth that rented it refused to leave bc she had been there X amount of days so the lady came back from vacation & had to deal w/not only the lady not leaving but also she was super rude & said “don’t come in MY room” it was insane & the home owner was so sweet & better than me bc I woulda dragged her out
As long as you live in an English society, you will be subject to the English common law which enforces adverse possession, understand the society you live in and adjust accordingly or leave.
The cops protect the squatters instead of kicking them out and arrest them.

I've heard of exactly ONE state targeting squatters, and that is Florida, by charging a fee to change locks & remove the property of a squatter. It's fairly new. This was filmed 10 months ago in Nevada. I agree that bc of the Captain's service to the country, she was given privileges of which even the other person in the story couldn't avail themselves.🤷♀️

Obviously either the law makers are asleep at the wheel, or the police are too weak to do the "right thing". I hope they get their crap together because home owners are not going to put up with this eviction process thing and cost thousands. I personally wouldn't rely on the police. They have shown time and time again they are weak in this situation, and the definitely don't have it together in most situations. When people take things into their own hands then they want to blame the homeowner. Sorry, if the jury is too weak or stupid, to see what is right, then the system is broken.
@@TL-wy1nk These are generally civil matters so the police don't have any authority if it's not a criminal matter. Lawmakers are the ones who need to change the laws. Also, the banks/mortgage lenders need to do more as well. I have seen so many videos or squatters moving in after people have been foreclosed on. So the bank forecloses on and evicts the person who had the loan and for whatever reason could no longer pay, but they are fine with squatters invading the home and not paying a cent. There's a lot of blame to go around for a broken system and the squatters are exposing the loopholes. Glad this guy got caught, kicked out and arrested.

It's not that they have power. It's that it's simply not an easy thing to prove. So a cop shows up and there are two people with paperwork and both are saying the house belongs to them. Now realistically, anyone should be able to prove in less than a day that the house belongs to them. If I can
1. produce a mortgage statement with my name on it, that at least shows I either have a mortgage or home equity loan on the house. How would I get that if I didn't own the house?
2. show the deed, which will have the bank's name and my name on it, then again, this would prove ownership.
However, it's still not that simple. I can fake those two documents. Now, it's up to the cops to call the mortgage company and the mortgage company with the owner there. It's up to them to then go to the town and confirm the deed isn't fake. They don't have teams that they can dedicate to squatting cases.
I think the best you can do is make sure there's always someone in the house. Because even in this case, you know damn well this thief probably caused a lot of damage on the way out.

Closing this loophole in a hamfisted way would be a great way to rob the rights of legitimate tenants. These are already weak enough in America, they don't need weakening yet further.
The best way to fix this problem i money isn't an object is a specific streamlined property rights court or tenant's court that could get hearing times way quicker. The big issue with why it takes so long right now is how slampacked civil courts are right now, meaning any hearing at all can take months to hold. More judges and dedicated courts would help that process enormously.

@FC if the house was empty long enough where someone can move all their furniture and set up residence there, then yes the house was abandoned, the story never mentioned if she was living at the address, just that she owned it, a lot of people buy up property just to hold it and build up equity and don't use it, the adverse possession law was created to prevent this sort of crap. It's a shame alot of Americans don't understand English common laws. We certainly wouldn't be having the homeless and housing crisis.
This is sickening. I had the same thing happen to my dads home when he went into a nursing facility. I had to take them to court. They destroyed much of the property after they were served papers. Where are the laws to protect homeowners? Squatters should not have any rights!

Lucky for us, I guess, I'm blind and always home. But they don't need to know I'm blind, they just need to know I'm home and think I've got a gun.
This is one instance in which the media was more effective and efficient than law and public policy. So happy to see this outcome for this Army Officer.

Every time I hear about a squatter story, it amazes me how protected they are by the law when they are clearly in the wrong.
It's because the police can't verify who the real owner is, Or rather they can but have never been incentivized to do the paper work. There are clearly times when you have a rightful lease from the owner, but they just want to evict you anyway. The law originally was designed for there to be a due process in that event. Possibly just to make it harder for small time renters to earn money.

@@kennedystarr8094 Just because you have a lease or mortgage doesn't mean you haven't rented out your house. I would speculate that that the vast majority of rentals have a mortgage on them. So a mortgage only proves you own the house. It doesn't prove that you haven't rented it to someone else. Do you want to have legally rented a house from someone just for them to change their mind later and decide they want to kick you out without using the eviction process by simply claiming you are a squatter? I suspect much of this could be resolved by requiring all rental agreements be notarized and require a raised seal be used in the process. An ink stamp isn't secure enough. Perhaps require all rentals be recorded with the county at the time of execution as well. That would help eliminate the guess work.

squatters rights used to only be for homes that were abandoned for years. You had to prove you lived and received mail at that home, depending on different states laws, usually 7,10 or more years. Which I find acceptable if neither the owner who abandoned the home, nor the city who now owns it, just left it there to rot. But this new thing of just taking over people's homes who are simply away or house is empty because they are selling it, is not squatters rights at all. The news needs to stop calling it that and say what it is,home invasion.

How does a squatter, who in effect is a criminal trespasser, have the same rights to an unlawful detainer action that a holder of a valid lease has? The judicial system is truly broken.
It's not just trespassing. The report also mentions several times that the lease is fake, but the word "fraud" was not even mentioned once. If the lease is fake, will there be criminal charges filed against the squatter for committing fraud?

@@Rsmvbizz There is a legal process that the homeowner has to take in order to “prove” that the squatters don’t have a right to be there. It could take months and during Covid, years, to legally evict them. It a lengthy process that needs to change.
@ab alm It comes down to right and burden of proof. Another of time people will make a fake lease with fake payment. They switch utilities to their name and they claim ownership. The law requires that the property owner prove that the property belongs to them and that it wasn't rented or purchased.
It makes sense in the case of abusive landlords, but in the case of squatters, it's a shield that they abuse.
Only takes a day or so to plant them deep in the backyard with a backhoe.

It’s combinations of injustices like this which are routinely circulated throughout society to keep everyone nice and distracted from other events.
Eviction protection exists to protect tenants from being evicted unfairly, not to protect criminals that broke into your house who have no legal right to be there in the first place. The fact they don’t distinguish trespassers and tenants is ridiculous.
I'm not saying thus situation applies but there are incidents where scammers have tricked people into paying money for a place the scammer claims to own. When the actual owner shows up to the place is when the truth is revealed.

these cases are outright theft of property,trespass, more. but squatter rights are about different rather obscure situations. it's lousy law manipulation that is the cause. like someone buying your home that was sold fraudulently, legal incompetence may not admit to you that the buyer has no rights, since they bought stolen property. and cops helping military- special treatment, whereas they wouldn't a civilian, when they CAN do the right thing; well that makes yet another arm of the law complicit with the perpetrators of these crimes. The problem is bad landlords would abuse the law to evict anyone they want at anytime while pocketing their money. Example, I own a property, rent it out to someone who puts up $5,000 up front. 2 weeks later, I claim they are a squatter.... And scummy landlords will do that.

During covid I saw story after story of families who were living out of cars with their children while adult squatters lived in their homes!

had a squatter in my rental. Spent so much money to get rid of her. It's shameful that squatters are given so many rights while the homeowner has to jump thru all these hoops. There are literally lawyers who will fight for the squatter! It's infuriating. Glad she got her home back.
Why not just go back in the house, and hire someone to remove all their belongings while the squatters are out? Then change the locks so they can't get in. You can be the owner that squats back into your home. You tell the police you own and live there. Police will say it's a civil matter. Let the squatter take you to court. I'm finding that lawyers just hold you back and don't have a personal interest at heart.

I’m a retired Prosecutor and Judge and the cases that I hated the most were landlords/tenant cases. If a squatter somehow got a lawyer through Legal Aid, agencies that would represent a tenant for free, a case could hang around for months before it ended in a trial. Meanwhile the home owner would be without a place to stay and thousands of dollars for their own legal fees. Then, these free lawyers would often file an appeals, taking several more months. The system was totally broken.

I used to think that you had to be really smart and special to be a lawyer, but soon found out that I knew more about Juvenile law and Court procedures than many of the lawyers. So I figured if they could do it, so could I. It was hard to get into a good law school with my C average grade point average (2.69). So I got a real powerful Judge who liked my work and got him to write a letter of recommendation. The Judge said I should write the letter and he would sign it. It was a terrific detailed glowing letter and I got into one of the two State Law Schools and found that I had a good feel for law and got a 3.75 gpa and was number three in the class.

@@theocho8689 the law is actually a pretty balanced one, but sleezy people can and do twist it around. What could be done to a squatter and has successfully been done when there’s a squatter, is for the owner to wait till the squatter goes out say to shop. Then enter his home, remove the squatter’s crap and take possession. Basically squat on the squatter. It can only be done before any court case is filed. If the squatter calls the cops, they won’t remove an owner from his house anymore than they would remove the squatter. They’ll likely say this is a civil matter, take it to Court. The squatter loses as he has no grounds to legally complain. This can’t be done if there was a legitimate lease, though. But a true squatter who has no previous lease right’s can’t complain legally.
This needs to be the way it should be. Quit catering to criminals and take care of the law-abiding citizens. It shouldn't take more than a day to take out the trash
It might take 3 weeks. The police still have to verify the paper trail to see who the rightful lease owner is. IE anyone can claim to be the rightful owner and show up with legal looking papers.
Having a gun is a beautiful thing. Permanent solutions are often the best.

I couldn't believe when I read if a squatter lives on a property for @ least 5 years & can prove it. They can go apply to take ownership of the property legally. I was like 😮

I recently looked up somebody from college who I used to smoke weed, trip on acid and do other hippy dippy endeavors with. Turns out after college he joined the air force, went to nursing school, received a commission, and about ten years ago he retired as a full colonel.

Cause some states give criminals more rights than law abiding citizens. It's stupid but true...
So basically how all this happened is that these laws were originally designed to help protect renters from predatory landlords. The idea is that a landlord can't just say one day: "I want you out tomorrow" for no reason. It doesn't give the tenant time to make other arrangements. So the law was basically that to kick someone out of a property that they were leasing from you, you had to give them a notice long enough for them to actually prepare to move.
To be clear: THESE LAWS ARE GOOD when used properly. The issue is that these people are making up fake documents and moving in to people's places. If the person who owns the property says that the person doesn't have a valid lease, it suddenly becomes a legal issue where a judge has to figure it out, because its just one person's word vs another.
Unfortunately, if we made it where the owner could just say that a lease is invalid and have the police drag the person away, it would negate all the laws protecting renters. Any landlord could just say the lease was invalid and kick people out if they wanted the space back. Poorer renters can't usually afford to fight stuff like that in court, especially if they are now homeless.
TL;DR: They are abusing a good-intentioned law in a way that wasn't considered when the law was created.

I came home and this man was in my house, he pointed a gun at me (even if he didn't) but he had one and I defended myself and shot him several times. He dies, let some waco DA charge the home owner, you really think any jury is going to find the home owner guilty? Once enough of these squatters are shot, they will start looking for some place else to stay.
One of the best ways I heard to take out squatters is to rent it to a good friend with a real lease and change the locks when the squatters are out and flip the script on them.

We owned a house in Columbus, Oh. A squatter broke a basement window and dropped her 6-year-old through the broken glass and had him open the front door. We had to go through the eviction process, and it took months. We were remodeling the house. She sold all our tools supplies, carpet, doors, anything that wasn't nailed down and we got nothing back. Police said there was nothing they could do. This needs to be changed. These people are costing homeowners, courts and police millions every year because they are too lazy to work and have found a loophole.
Law makers just make swift heavy penalties. They wont- so we have no need for them. But everyone votes for them.

I don't know where you heard it was a landlord friendly state. We owned 3 houses over the years that we rented. We sold them all because we ha no rights in court. We got screwed over and over and over. The houses were trashed so many times and we would lose and average of $3500 plus our time everytime we had a problem.

The fact some states have squatter rights is ridiculous. Someone can legally take over and steal someone's property. But if you steal a watch, you may get shot.
Because people will leave land or buildings, even, vacant for YEARS. I have a few houses where they're rarely there (they pay me to look after them). In some cases, million dollars + places.
The law says that land is meant to be used. Also, adverse possession is sometimes 20 YEARS (Illinois). It's normally at least 5-10 years until you could own a place that way.
You have to be there openly. You have to pay the taxes and such. What this lowlife is doing isn't that.
It's also why you have very strict rules about property lines. Your neighbor could put up a fence and cause trouble if it's a foot on your side. Even by accident.
Every state has adverse possession, the legal term for squatters right, in their books. The theory is if a property is truly abandoned then a person can claim ownership by improving the property/pay taxes on it.
A case like this is the cops not treating it as trespassing right off the bat. Which is both a good and bad. Because someone could forge a quit claim deed on your house and evict you. How would you want that handled? I bet you would want a judge to verify your paper work over the scammer. Or do you want the cops to arrest you in the spot for trespassing. Because cops only enforce not judge laws

I know someone who got people out of their home by changing the locks on the doors after they left, and got everything out before he came back. He tried to claim he lived there and the owner said, "I don't know this person, and I have no lease with him". If her area they don't have the same laws.

The law states someone can take over property if the property owner does not exercise their rights to recover. And the person moving in must have lived there for many, many years before it can be considered theirs. Some states require up to 20-40 years. Abandonment doesn't mean a military deployment, a house empty to renovate, or under contract with a buyer, a vacation, and so on. These people are criminals taking advantage of the Civil cases taking months to evict. So if you own a home and someday want to sell it, are you telling all of us that we can come and claim it after you moved out waiting for a buyer? Give your address so we can be on the lookout for free housing.

The one thing that Florida has done in the last four years is to pass an anti-squatters bill that will give law enforcement immediate powers to evict and jail squatters. Let’s hope more states wake up and introduce this much needed solution to these low life, bottom feeders in their states as well.
