Legally parked cars owners should be authorized to sue illegally parked car owners for damages done to their cars as a result of FDNY pushing double parked cars into theirs. Double parked car owners insurance should refuse to reimburse for damages. NO ONE should be allowed to sue the FDNY for this type of issue.
Their insurance company will absolutely go after the drivers illegally parked.

@@001looker how it really works is 1) it is illegal to double park 2) it is illegal to block an emergency vehicle and 3) emergency vehicles can legally do what is reasonable to respond to an emergency. It was more than reasonable to push that car out of the way. That driver's insurance will have to pay out for their iwn damage, damage to the firetruck, and damage to any vehicles the car hit when the firetruck pushed it.

As a Volunteer firefighter I’d like to inform everyone:
1: We have every right to push your car out of the way if it’s blocking us from an emergency.
2: we are legally obligated to enter any premises if there was an emergency call regarding fire on said premises.

I’ve witnessed that at a neighbourhood fire when I was a kid. Huge barn fire that was super hot with two illegally parked cars in front. Not only did their windows get busted to feed the hose lines through but their tires also melted into the asphalt. It was pretty darned priceless!
I’ve seen it happen only once. The windows were busted out and the hose water dripped right inside the car. I’m not sorry it happened to the person - taught them an expensive lesson. Don’t block a fire hydrant and leave your car!
I’m a truck driver. Here’s my NY experience in a nutshell. I was turning into a customers street and my trailer wasn’t going to clear an illegally parked car near the corner. A NYPD officer pulls up to me comes over and says “I’m going to give you two choices: I’ll cite you for blocking the street or you can run over the car and be on your way.” Tandems went up and over the trunk and roof and I was outta there.
I’ve been driving truck for 25 years and I’ve heard this made up story from literally 20 plus people claiming this happened to them. lol lol lol

I warned one driver in my condo complex to move their new Escellade away from the fire hydrant. A few weeks later his expensive ride got pushed by our local city fire department for blocking the same hydrant. He got the usual traffic tickets plus his insurance company got cold feet when they found out why his Escellade got damaged.
the owners of illegally parked cars are liable for any damage done to the fire truck. if a fire truck hits an illegally parked car in the pursuit of their duty and damage happens to the fire engine the owner of the car pays the damages.

If the vehicle was legally parked and had to be moved, the city will cover it. But double parking and blocking fire hydrants, nope. That is on the owner of the vehicle.

I have an FDNY friend (I am in NC) and I guarantee he supports this! Fire risks lives, and that is far more important than a Lexus driven by somebody who can't follow basic parking rules!

The car owners are going to be held liable either personally if they don't have insurance or their insurance is going to pay for any damages to the firetrucks. The cars are illegally parked and impeding rescue vehicles. These people don't understand illegally parked cars automatically accept all fault because they shouldn't be parked where they are in the first place. The car owners are now responsible for any damage to the fire trucks. Hopefully their insurance is up to date, or they actually have insurance. NY state you're required auto insurance but there is alot of a certain type of people who refuse to do what is right or follow the laws in NYC. Damage over a certain amount is considered first a misdemeanor, then at a higher value it is considered a felony and you will serve time in jail for the damages caused by their illegally parked vehicles if they don't have insurance, on top of misdemeanor for no insurance and driving as it is a misdemeanor offense to drive without insurance in NY. If their car was parked where it belonged, they wouldn't have the trouble on their hands but there is a certain kind of people that don't do what is right and refuse to be good people and live a lawful, honest life. I am willing to bet money on what kind of people parked those cars there. Here's a hint, dreads, drug dealers, loud rap "music" blaring from their car that has gawdy wheels and stereo system but the dash is lit up like a Christmas tree, tires are bald to the belts, oil has never been changed and low, and brakes scream as they are way beyond worn but, "ise gottes dha 22s andes dha starweoh whit dha rofers"

The cherry on top is the owners get to eat the damages to their car PLUS the firetruck, AND they’ll get fined or ticketed. That 10 min double-park is about to be expensive.

I remember the night that I pushed a car out of my way at a structure fire. The Chief on scene was furious when the city officer refused to cite me, then he called for a statey, who also wouldn't ticket me...

I’m from Scotland and our firefighters wouldn’t put up with arseholes leaving their cars double parked and blocking the engines. My husband is a paramedic and the ambulances here have to deal with tourists blocking the roads as we have winding narrow roads through hills and glens….tourists don’t know how to reverse back into a passing place and end up causing chaos.

@@hello_its_me. That's why we have insurance. If a person causes an accident then their insurance pays. Why would the "victim" have to pay? Its not their fault. However, I think insurance laws can differ in different states.

No insurance company will pay that claim. companies look at negligence very carefully before they're willing to pay. now if a person is IN a vehicle, and causes an accident, that's a different scenario. here, if the person parked correctly and another vehicle plowed into the car, then yes, company would pay. insurance companies have the right to refuse a claim, it's stated in the policy in the fine print.

Fire trucks and emergency vehicles have priority over double parked vehicles and vehicles parked in front and/or blocking hydrants. If your vehicle was double parked and damaged ---tough, that's on you. if your vehicle was double parked and pushed into a legally parked vehicle and caused damage to the legally parked vehicle, you are responsible and need to pay for damage to the legally parked vehicle.

It's the fault of the people in the double parked cars. Not supposed to double park and not supposed to park in front of a fire hydrant. If the building is on fire and/or someone needs to be rescued the FD don't have time to come look for everyone to move their cars. So, don't double park and don't park in front of a fire hydrant because you never know.
Do you see any other options that could have been used? They don't do it because they LIKE it (I don't think they do, anyway). They have to justify the action to their chiefs, you know. Physics say that there has to be a space to push them into, and if the only space is occupied by a legally parked car, that's what happens. Maybe they could explain it to their neighbors, that they will sue them in small claims court for damages, besides their insurance co suing the at-fault drivers' insurance co?

That tower ladder has a solid metal bumper and weighs over 50,000 lbs there’s no need for a plow it basically is one in itself

Firefighters will straight up break windows to get a hose through if a car is blocking a fire.
Why were those cars allowed to create that hazard to begin with?
The city needs a campaign to educate the residents.
First, blanket the problem areas with flyers, advising them of the danger and warning that enforcement will begin on such-and-such a day. It gives them a chance to figure out alternate parking arrangements.

@Dorothy and Toto If the white vehicle WAS parked legally and it was the firemen who pushed the gray one into it, I would think the owner of the white one would have a case against the city. It is their right to push it out of the way in an emergency, but not into someone ELSE'S legally parked vehicle I would think.

If it's a true emergency and cars are blocking apparatus from accessing the scene HQ shouldn't have anything to say. I drive a E-One Ladder (driving12yrs and on my 2nd E-One Ladder) and have had to push a truck once and a car once to get into the scene. The only thing HQ asked me was if it was necessary and I told them yes. Cops backed me up and that was that.

That’s on the illegal parked car, if it wasn’t there it wouldn’t have happened. It’s not the Firefighters fault that guy blocked the street.
The illegally parked cars are at fault. Would be their responsibility to pay for the repairs on the cars that were legally parked.
If it was necessary due to the emergency then it is OK. Even if the car is parked legally, sometimes it is necessary to make sacrifices for the greater good. The FD often has to break things to do their job. In the end, the insurance companies will work it all out. The important thing, is it doesn't sound like anyone was hurt in the fire and in the end that is all that matters.
