If the ICC was able to insist it has jurisdiction - even though Israel isn't a party to the Rome Statute - because Palestine is a party, can't the same argument be used at the ICJ to bring Hamas to the court, since Israel is a party?
In my view the ICJ would consider itself as having jurisdiction over the matter due to the high profile nature of the case, they are cynics. It seems to me that South Africa manufactured a dispute with Israel to have some standing before the court in order to bring an application. If they (ICJ) make findings in favour of SA wouldn't the ICJ be make a ruling against the UN Charter whereby a non state territory can attack a state with impunity who would have no right to self defence, the UN and it's various bodies would not have any credibility which would be troubling for the world. The current issue with the Palestinians highlights the problems international law and the ICJ has on dealing with non state actors
