    The whole visa Bulletin issue is due to the huge number of applicants from certain countries mainly China and India and to some extent Philippines and Mexico. For purposes of diversity, US has to limit the number of green cards for every country to keep a balanced demographics of new immigrants. That what causes the delay and long wait time for applicants of certain countries. But I think it is a fair process. What funny is to find some applicants complaining of the long delay. Well, blame it on your fellow nationals who clogged the system for your country.

      It is not 100% due to the large countries. By law each country can only get 7% of the available numbers each year. If you are saying the delays in those countries are caused by large numbers of applicants, then I agree with you. There are not nearly enough visas available overall.

    My mom filed a petition for me for the I-130 on August 7th 2023- I just checked the status of my I-130 application it said that I had 5 months until a decision. Has yet to be taken. I have filed for my I-485 status which I still have not received an answer on the I-485 application. The thing is that I overstayed my visa can I still stay in the Us while my cases are pending. Bearing in mind that I’m 44 years old and unmarried.

      This is a complicated question. A few short answers: 1 - you are not an immediate relative of your mom under immigration law, so you will not be eligible to Adjust status in the U.S. unless you filed the I-485 while you were in status in the U.S.; 2 - the visa bulletin is different than USCIS processing times (you may already know that). You are likely in the F-1 category; 3 - the I-485 will not be approved until a visa is available. The final action date for F-1 is 2015, so it appears that you have 8 years to wait.
