    Don't forget po yung Special Power of Attorney coupled with interest po. Stating po na kahit patay napo ang Owner or yung original borrower may karapatan po kayo kunin ang Copy ng Tittle po. Yan po ang pinaka problema kapag na fully paid ninyo then patay na ang original borrower from pag ibig/bank. Sana hindi pa po ito huli 😊

    Super informative it spike my confidence to the roof😊 One thing maam do u need to inform pag-ibig or bank about ur agreement with the seller? or u can proceed with the pasalo without there acknowledgement?

      For me we didnt inform them po eh. Saka may procedure po silang ginagawa both the bank and pagibig pero . But as I mentioned they dont know you po kasi as far as the loan is concerned so that why pumapasok po yung SPA.

      Usually po some developer only do waivers of rights then may babayaran lang pong transfer fee para sa inyo napo nakapangalan agad ung condo.

    Si buyer gusto na ifull payment yung bayad sa Pagibig.
    Paano po process nun at mga requirements na need ipresent? Need pa din po ba maypaattorney?

      What I can recommend po is to go straight to pagibig on the process need to be done po.

    Mam thank u.. Kumuha kase ako ng pasalo at medyo natatakot ako kase ang dami ko nababasang negative comments s mga pasalo.. Pero dahil sayo nawala po ang takot ko kase syempre madami pong ppwedeng mangyari sa loob ng 30yrs..plus meron din po ako tulad ng mga documents na hawak mo at notarized po.. Plan ko din po hindi paabutin ng 30yrs..6years or 7years in God's will(isa po akong ofw) 🙏matapos ko po agad..

      Hi Broker Janice tanong ko lang kung kailangan ba na sa Deed of absolute sale or sa Deed of Assumption of Mortgage is nandun yung TCT? TRANSFER CERTIFICATE of TITLE number? Before mo pirmahan at bayaran yung seller?

      Ah ineng ang problema ay hindi ngayon, dahil after 30yrs sasakit ang ulo mo kapag na fully paid mo ang loan mo sa pasalo dahil hahanapan ka uli ng pag ibig ng latest spa para matransfer ang titulo sa iyo. kulang ang impormasyon netong si aruray!!!

    Hello po Miss Janice, ask ko lang po internal agreement po ba yan ginawa nyo? May nag alok po kasi samen ng bahay, assume din po pero ituloy namen cia under the sellers name padin po, pero po nasa developer padin po yun property. Anu po yun mga documents na kailangan?

      Thank you for your message. Still the same documents that i mentioned here po except i believed deed of sale kasi nasa developer pa ung name nung property. You still need to execute deed of sale with assumption of mortgage and Special Power of Attorney. Its also better if you go to pagibiga for some due diliegence just ask the owner to give authorization to check their house loan detail.

    Question po, ano po ang complete list of documents needed if mag avail si buyer ng pasalo house via Internal Agreement?
    At yung selling price po ba na ilalagay sa Deed of Sale with Assumption of Mortgage is yung pasalo price ni seller (cashout) or yung mismong TCP ng house? Maraming salamat po and God bless you! 😇😇😇

      Hi thank you for subscribing and to your message. What I stated in the videos is what I have as documents.
      Here's the lists I have
      1. Deed of Sale with Assumption of Mortgage
      2. Special Power of Attorney
      3. Open-ended Deed of Sale (Pasalo Price ) since binayaran mo naman un full price sa pag-ibig
      4. Waiver of Rights also sign by the wife (Marital Conformity)

    Good day ma'am Janice, yung proseso po na ginawa niyo ng pag salo ay internal agreement between you and the 1st owner na nag pasalo. in the future at mabayaran niyo na ang total balance ng bahay under parin sa account ni original owner saka pa lang ninyo aasikasuhin sa registry of deed and BIR and transfer ng title?
    salamat po sa isasagot niyo.

      Yes po. Once the titled is released from Pagibig that thenonly time po na maproprocess ko po ung deed of sale.

      As per the law po
      The validity ceases once:
      the transaction is over;
      either the principal or the Attorney-in-Fact dies that results to the extinguishment of the agreement;
      or one or both parties revoke/s the agreement, with a revocation letter.
      Yun lang po ang medyo talaga nakakatakot. If this things happened.

      @@ToLitS_26 bago palang po ako na kumuha ng pasalo and hoping to pay it soon and not to wait for 30 years. Or better yet do the pasalo sa pagibig mismo with the current owner pwede naman po yon bago kayo magdecide or magbayad sa owner ng kukunin nyo.

    Question po sa pasalo condo.
    Meron po akong nakuha na pasalo na condo 1.2m ang balance sa PAGIBIG, 28 years to pay.
    Siguro po kaya kong i-fully paid ng 7-9 years, including na po ang interest.
    Ano po kaya ang mas maganda na gawin?
    I-fully paid ko hangang ma-transfer sa may-ari ang title para ang babayaran ko na lang ay ang transfer of title sa Pagibig at capital gains tax?
    Kasi kung ipapa-transfer ko yung loan sa pangalan ko, may pinapabayaran pa na transfer of title sa developer na P100k daw sabi ng nakausap ko sa developer side.
    May nakakaalam po ba nito?
    Or kahit hintayin ko na ma-transfer yung title sa original owner, may babayaran pa rin ako sa developer?
    Malaking halaga din po kasi yung 100k.

    Hi po Ma'am, Ask ko lang po, gusto kong bumili ng bahay na pasalo, kaso natatakot kami ma-scam. Paano po namin malalaman kung legit yung Agent since nakita namin na madaming Agent na nagpost sa Fb yung binebentang bahay pero magkakaiba sila ng details and computation? Same bahay lang po binebenta nila pero magkakaiba ng years left to pay and amount for downpayment. And what if gusto namen ichange yung term ng mas maikli, ano po process? Sana makita nyo po yung post ko. Maraming salamat po. 🙂🙏

      Hi thank you for your message. We actually have RESA (Real Estate Service Act) Law of 2009 which passed to professionalized the real estate industry. You need to ask their Broker or their PRC ID as registered salesperson but unfortunately there is a lot of unlicensed broker or salesagent around, i have nothing against them but they are everywhere, actually they are the masipag one and they have plenty of listings, the best thing to do is to check their legally but if they are not legal and you really want the house their selling you need to check the house the legality of the papers or even maybe demand to meet the owner of the house. As much as you want to deal with licensed broker or registered salesperson unfortunately the law of real estate still not as strong to penalized them. And as i mentioned they have lots of listing you can choose from so as a buyer just check the legality of the paper, go to pagibig to check if the house is updated to their loan and meet the owner. For the terms in pagibig. Once you done all the papers i said in this video. It will be then between you and pagibig already and you can ask all teh questions in your mine.     Question lng po, how much is the estimated fees na binayad nyo po for the atty? May pasalo dn po kc na inooffer sakin pero sagot ko yung legal fees. Appreciate if you can answer po.🙂 Thank you!

      Actually po notarial fee lang po cya. Since isa lang po yung inonotarized which is the deed of sale with assumption of mortgage. I believed nasa 500 po un. Kasi ako napo ung nagdraft ng contract kung sila po ang magddraft my additional fee po.

    amg pasalo halimbawa un unit na nakuja ko 2yrs ko na nahulugan 500k lang nakuha ko.paano kwenta nun yun hinulog mo mg 2yrs kwekwentahin mo pd mo pa dagdagan bukod sa 2yrs mo bayad? 144k na nahulig ko sa 500k na nakuha mo unit mgkano pd ipatong or ipasalo? pls answer i need ur help

      The lawyer can do it po naman but with extra charge compare kung meron napo kayo na ready documents.

      Thank you for your message. Usapan nyo napo ng owner. Minsan hati po sa gastos. As a buyer po you need to make sure na maayos ang lahat ng documents before you pay.

      My standard copy naman po na pwedeng gayahin or the lawyer usually have it napo and yes they just change names and infomations of the house.

    Hello po ma'am.. recently po naka bili kami ng internal agreement pasalo,tanong ko lang po sana kung what if yung house wife po nya walang valid id? Ok lang po ba na pirma nyalang kasama mister nya? Kc nung una po kc nag kasundo kami yung lalaki lang nandon at nag ka pirmahan,d2 ko lang nakita need din pala yung asawa nung tinanong ko ang sabi nya wala daw po syang valid na id, pina pipirma ko nalang sana sya sa papel at may id nya kaso walandaw syang id pano po kaya yun? Tapos hindi pa naka indicate ang asawa nya dun sa SPA bale yung lalaki lang po naka sulat

If ever ako po ay sasalo ng property at ako mag tutuloy sa Pag ibig siempre Hindi pa nasa akin yung title what if mamatay yung first owner ng property at hindi pa fully paid ang property at nasa pangalan nya pa papaano po kaya yun. Gusto kung sumalo ng property iniisip ko ganito scenario po kasi Hindi kaya mag ka problema po ako ? Salamat sa information in advance.

      Actually where on the same boat. I also think the same thing. There are procedure where you and the owner can go to pagibig to process yung paglipat sayo ng bahay. If you feel uncomfortable with pasalo i suggest you do that. In my case kasi im hoping by God's grace to pay the loan soonest not to wait for 30 years.

      Hi po. I think po if you can do it soon since you have communication yet with the owner. We cant say din po kasi huwag naman po sanang maghabol since pag married po conjugal lahat ng property. But maybe you can also ask pagibig kung ok lang po yun. Actually po ang lawyer na ngnotarized po ng mga documents namin yung nagsabi po sa amin regading the marital conformity.

      While we done the documentation process the lawyer we use po also ask us to make an open ended deed of sale para po once paid pwede napong inotarized and present to pagibig.

      Hi Kath thank you for your message. Bank have different ways of doing it. In my experienced. I had a client na bumili ng property na nakaloan sa bank. What happen is she need to pay first the bank to release the title then deed of sale between the borrower ng loan and yung new buyer. Pano kung walang pangbayad si new buyer? She can then ask to re-loan it this time in her name, in my client case she use other bank so what she did after all the necessary documnets to approved her from the loan the bank now then release letter of guarantee to the bank nung binilhin nya, so once the title is release then as i said the old owner and the buyer will execute deed of sale then once the title is name to the buyer then kylangan nyang ibigay yun sa bank (there is broker that the bank use which is me, ako lang ung nakahawak ng title nayon and i gave it to the bank manager) since nagloan cya sa bank na yon to pay the other bank. Mas mahirap ung documentation ng bank kasi their very careful who to lend the money. Hope its help ❤

Janice salamat po sa pagsagot, bali ang mangyayari po sana dun sa property na gusto namin iassume naka bank loan po kasi yun sa ucpb under sa name ng owner bali kami na po magtutuloy ng hulog as is sa name nya. May question po ako pwede po ma kami ma recognize ng bank na kami na ang naghuhulog at kami na ang may responsibility kung anu man ang mga babayadan sa bank at later on mapupunta ang title. Tapos po regarding sa documentation ng atty / papers pagdating sa legality ( deed of sale etc..) si seller po ang may sagot po ba ng lahat nun? Pasensya na po at napadami ang tanung ko.       Same procedure din po kahit kapatid. For documents si lawyer po ang gagawa and they will charge you for notarization. Hindi po agad mattransfer sa name ng kapatid nyo since nasa pagibig pa ang loan.

      @@georgierojas3302 if direct kayo sa developer or pagibig yes. Kahit walang deed of sale since maybe nag default yung dating may ari na magbayad ng obligasyon nya, yung developer or pagibig already took the property from the default payment to be sell to the new owner.

      Pag sa bank po iba ang procedure nila. Pag may letter of guarantee napo kayo or approved bank loan, you will need to have deed of sale between the owner nung niloloan nyong property and you. Kaylangan po kasi yung title nasa pangalan nyo, then once you have the title, yun po ung ibibigay kay bank and then you will continue the loan again.
