    Iowa man Jerry Burns, 66, is on trial as the suspect in the 1979 stabbing murder of Michelle Martinko, an 18-year-old high school student. Jury selection began on Monday and continued into Tuesday.
    Here’s what you need to know about the case.
    Burns’s trial was moved from Linn County, Iowa to Scott County, Iowa given the high-profile nature of this case. Martinko’s brutal murder remained unsolved for decades. But then, on Oct. 29, 2018, police carried out an operation similar the one that California authorities used to track down the Golden State Killer suspect.
    Burns left a straw on table at a Pizza Ranch establishment and authorities seized this discarded DNA evidence covertly. They compared it to a blood sample recovered at the crime scene that had been uploaded to a genealogy database and partially profiled.
    Authorities determined that the discarded DNA evidence was a match to the blood found on Martinko’s dress. The judge has allowed the straw to be used as evidence at trial.
    Martinko was “repeatedly” stabbed in the face and chest in her family’s car outside of the Westdale Mall on December 19, 1979. Evidence showed that she fought back. Martinko went to the mall that day to buy a winter coat, but never returned home. There was no evidence of a robbery or sexual assault.
    Burns was arrested on December 19, 2018-39 years later.
    The defendant has pleaded not guilty to first-degree murder. Investigators say Burns “claimed he did not have any recollection of committing this crime,” but could not explain why his DNA showed up at the crime scene.

    This is the most profesional case I h seen so far, attorneys are doing excellent job, both sides and the witnesses also, judge doing a good job in directing the witnesses prior to testifying .👏👏

    its so hard to imagine this happened to her in mall parking lot with all these workers and people leaving the mall and no one saw anything

      I think because it all happened inside the car, probably with the doors shut, nobody saw or heard anything.

    Mr. Curtis Thomas seems like such an awesome guy. I get from his testimony that he was very smitten with Michelle and was greatly affected by her death. He obviously cared about her

    Curtis Thomas, amazing man. He understands his 16 year old mind. It surely has affected him and gave the most real testimony in this case.

    I was born in 1975 and had to google the meaning of “catalog department” because as soon as I heard the witness say it, I was instantly flooded with a sense that I had heard that phrase as a child, but couldn’t place it. With the internet age and online ordering, catalog departments in the already dying breed of department stores in malls are no longer needed.

    It would have been nice to see how she turned out. Just from how people describe her I think she would have been one of those kind of artsy type of girls. She wanted to be an interior designer. She strikes me as someone who probably would have traveled the world and lived a carefree life. She was a real doll. 🥺

    why is it when defense refreshes Mr. Sydell with transcripts he still doesnt remember, but when prosecution refreshes his memory he immediately remembers

      I think at that point he was just over being honest about actual recollection and just wanted to agree with whatever was in the transcript

    Curtis Thomas is the sweetest man I’ve ever seen testified. Based on how everyone is describing Michelle being a sweetheart I can see why they had a connection. She made the time to wait for him and he took a longer break to be with her. Their final time together 🤍.

    I must say it's super weird that her Ex didn't remember he had said that someone had been kinda stalking her and she had been worried about that all week. How could he have forgotten that if it was true?? When she was found dead his mind would have locked into place forever as "The ugly guy that watched her must have killed her!!!"
    So I kinda think he was lying in 81, wanted to make sure police wouldn't blame him.

    Sheryl Anders is the only one who said that Michelle was carrying packages when she left. Wonder why Curtis Thomas didn't say anything about packages? He walked her to the door.

    Why is Mr Thomas's testimony so different to the others? He said they chatted ... and NO mention of the coat she was stressed about and big wad of money... So different to the others' testimonies.

      He was 16. Had moved around a lot. Had no friends. She was pretty, was older, and was super friendly and kind to him. He had a huge crush on her. Plus they questioned him the next morning at the police station and that was a traumatic experience him. One he never forgot. He was the last person to see her alive - accept the killer. Yet he didn't remember being questioned again in 1981 until they showed him the transcript. So that night and the next day stayed with him.

      He was 16 years old, lonesome, had no friends, she was a little older and beautiful, and very kind and friendly to her. He had a crush on her. He was the last to see her alive - accept the killer. Plus he was taken to the police station the next morning to be questioned and he didn't know why. That was traumatic and not an experience one could easily forget.

      Because the group saw her for 5 minutes when they were together, they all testified it was a very brief encounter 2 - 5 minutes. Whereas Mr Thomas too his break and spent 45 minutes with her and obviously had a crush on her. It makes perfect sense that he had a different encounter with her because he saw her separate to the others. If he had the same story as they had but spent 45 minutes with her then that would be odd.

    Am I missing something?? What's the defense? The suspect sneezed into her car when she was getting into it, leaving his blood on the shifter and her coat? Lol. Good luck with that defense counselor.

      I am guessing that the defense will try to destroy the DNA evidence testimony. That's all they can really do. I am not familiar with the trial but I am hoping that the state has a DNA expert who can clearly and concisely explain the evidence. In other words, dumb it way down. Didn't the state for the OJ trial have an expert that went on and on for days? And then Mr Fung screwed up the chain of custody...but that's another story.

    Judge might be one of the best occupations in the world. You just sit there, listeninning to one story after another, most of which are as intriguing as a suspense movie. You don't have to speak or do anything, just accasionally let out a word that everyone has to obey. Another benefit is that you don't have to wear smart all the time, because you can always have on the robe in front of your audience. The only thing that you need to care about and that may reveal your taste of life is your hair style.
    I like this judge, so elegant and goodlooking for her age.

    Sheryl Anders definitely was as said & most probably is a smoker, her breathing was so heavy I couldn’t concentrate on her giving her testimony!

    There’s certain things I remember 40 years ago. Being involved in a police investigation is something I’d probably remember. I don’t believe this first witness. He doesn’t remember what he gave a statement for about her demeanor but he remembers her demeanor when asked differently.

      O Comino that’s not what I meant. He was being evasive and vague when asked about his statement. Saying he couldn’t remember and makes a blanket comment stating he didn’t think she was all that upset. Then he changes that and seems to have a more clear memory of basically the same thing. I wonder why he would be unwilling to be totally forthright. Does he know the defendant? Was he threatened. Seems odd

    The questions the attorney is asking all the witnesses about where they met her in the mall and where they parked are all irrelevant. Which direction were you going when you walked into the mall, what store was at the end of the mall...Who knows, maybe it was all leading up to his last question "was there frost on your car?"

      John Allen I think they’re trying to prove whether or not they have good memory of the time frame. If they’re good at remembering details then their telling of whatever happened seems more believable.

      I wondered about that.....they may not have had cameras like that in 1979. Not as much violence in Malls, etc., in those days.

      My mother and I raised rabbits. I enjoyed caring for them and bringing them treats. We never lost one to disease. I made myself a rabbit fur coat. It's a ten-step process, both time consuming and physically taxing. Unlike rabbits in the wild, they weren't torn to shreds while still alive and screaming; they were killed swiftly and humanely. Have you ever heard a rabbit scream? They provided much needed meat and were delicious! When you see a rabbit fur coat, don't judge! Your only thoughts while watching this trial should be toward that poor child and the grieving family and town she left behind! The rabbits used to make the coat weren't stabbed to death!

      ​@@bonitamartin4954 -Because rabbits that you murdered were not violently 'ripped apart like in the wild' makes it ok.? No. Carnivorous animals in the wild kill for survival. This day and age ,killing any animals especially for fur is not for survival but for convenience and vanity.
      You 'enjoyed caring' for those rabbits knowing that they would soon be killed , just sounds crazy to me. It's the conditioning you had. So I'm not hear to demonize you for growing up being taught to see these animals as commodity.
      The truth is --Rabbits, foxes, mink, chinchillas, and other animals that are exploited for their fur spend their lives in small wire cages, only to be killed by anal electrocution, by neck-breaking, or in gas chambers. ..sounds wonderful.
      And who are you or anybody here to tell me 'where my thoughts should be'. ? Are you the You tube thought police? Just so you understand, I have compassion for all humans including this poor girl who was so viciously murdered and her grieving family. My heart aches for them. There is a saying -“It takes nothing away from a human to be kind to an animal.”
