    Iowa man Jerry Burns, 66, is on trial as the suspect in the 1979 stabbing murder of Michelle Martinko, an 18-year-old high school student. Jury selection began on Monday and continued into Tuesday.
    Here’s what you need to know about the case.
    Burns’s trial was moved from Linn County, Iowa to Scott County, Iowa given the high-profile nature of this case. Martinko’s brutal murder remained unsolved for decades. But then, on Oct. 29, 2018, police carried out an operation similar the one that California authorities used to track down the Golden State Killer suspect.
    Burns left a straw on table at a Pizza Ranch establishment and authorities seized this discarded DNA evidence covertly. They compared it to a blood sample recovered at the crime scene that had been uploaded to a genealogy database and partially profiled.
    Authorities determined that the discarded DNA evidence was a match to the blood found on Martinko’s dress. The judge has allowed the straw to be used as evidence at trial.
    Martinko was “repeatedly” stabbed in the face and chest in her family’s car outside of the Westdale Mall on December 19, 1979. Evidence showed that she fought back. Martinko went to the mall that day to buy a winter coat, but never returned home. There was no evidence of a robbery or sexual assault.
    Burns was arrested on December 19, 2018-39 years later.
    The defendant has pleaded not guilty to first-degree murder. Investigators say Burns “claimed he did not have any recollection of committing this crime,” but could not explain why his DNA showed up at the crime scene.

    He's served this country, I know what happened to my dad after being a marine in Vietnam, this man looks like he's doing a lot better, don't blame him at all for some substance issues, our men and women aren't treated the way you'd think after they come home.

    21:18 - That's the moment that stood out to me the most. "He feels like no matter what happens in this case, he wins because he had the opportunity to be out there with his family all these years." You don't say something like that unless there was a reason why you SHOULDN'T have had the opportunity to be out there with your family all those years. Someone who feels wrongfully charged isn't going to have that mindset. Leon Spies then goes on for 30 minutes not addressing a single thing that was said and instead focused on this man's criminal history to imply these statements are bull.

      Vegans Suck implying that Mr Spies must think the jury is that daft by spending 30+ minutes on that point. His team was more prepared for responding to that testimony than any other thus far.

      Vegans Suck the DNA was analyzed and profiled multiple times prior to the 2008 flood so the validity of that isn’t in question. Plus at that point the raw DNA profile was stored digitally in multiple locations. I think originally they were trying to prove that maybe evidence was handled improperly by investigators, but offer no explanation or scenario where Jerry Burn’s blood would be in a position to contaminate specific evidence like the gear shift.

      Thanks for indicating the specific time of his testimonial when what he says is most relevant. Yes, it's very worrying how laboriously he's being discredited. Let's hope jury isn't duped by the distractions.

    This witness was believable and just 'fried' the defendant. To state he was going to take him to the mall if he kept beating him was the nail in his coffin. The defense attorney tried to make the witness look bad, but it didn't work. The witness appeared to be honest and straight forward with everything.

      @Vegans Suck So, you think it's REASONABLE to believe that a man charged with one of the most heinous of crimes would sign such a document for his most intimate associate, someone that he refers to as his "son", for any reason other than an underhanded way of admitting his guilt? Also, as Burns spoke of the case with him, he apparently NEVER even came close to stating that he didn't do it. I believe the witness. You're a fool, sir.

    When you hear the conversation between this guy and the defendant lawyer, you can tell this guy had accumulated a great deal of experience and knowledge in laws by going to prison for so many times. He understands all the terminologies the lawyer brought up and counter what he thinks the lawyer claimed wrong in a very proficientway.

    personally I find the witness 100 times better of a person & more credible than I find the defense attorney. The attorney is so behind on facts, the witness is quoting law to him 😂😂😂

    I feel sad that the witness has spent so long in prison as he seems like a good man. The sentences in America and Mexico seem very harsh coming from Ireland

    I really don't regard this testimony at all. People can argue whether or not he's reliable. It makes no difference because the DNA evidence IS reliable.

    This witness is really switched on.. excellent witness. Genuinely seems to be testifying because he has a daughter about the same age as Michelle (and realistically/secondarily, probably hopes it helps his own case).

      E Productions there are 4 in the Courtroom, two by Burns, one in the back and one by the back door. Then outside the court there are 2-3 in the back and at the front side there are another 2-3. Can't have a person incarcerated and accused of murder, using the opportunity of being unhandcuffed and out of a cell to escape.

    Mr Defense Attorney: Way too much irrelevant detail, and it seems to me that the age old rule of never ask a question you don’t already know the answer to was broken too many times, and thereby giving this witness the upper hand in framing some of the narrative.
    Mr. Prosecutor: You let this conniving SOB perjure himself by not drawing out his long, long criminal history. He told far from “the whole truth” on direct.
    My conclusion - a big waste of time. More than one juror (likely most) will almost certainly not put any stock in this witness. And that’s the fault of the prosecutor for not drawing out, in his own terms, the dark side of this guy first.
    We didn’t get questions today that ended in. “... and whatnot”. Guessing that someone gave the prosecutor a heads up. That’s a good thing.

      You don't touch anything that does not belong to you while in a prison or jail setting, ever or you would pay the price big time. I know people who have gone to jail and they said your stuff is OFF limits, and inmates respect that.

      Why do uou love the defence attn?? He is annoying. He is trying this witness on stand. Why is alkowed yo spend this much time on this witness pending charges. The defence attorney looks desparate and the jury is probaly lost in a the witness stuug. The wit ess is more believable than the defence attorney.

      You can bet the defense attorney went through EVERY video with a fine tooth comb, looking for any EVIDENCE that this witness looked at his stuff and you can bet he did not find anything, had he, he would have been on it like flies on crap. Not to mention, inmates KNOW if someone touched their stuff, it's all they have, and they are going to protect it with their life. If another inmate sees someone messing with others property, word will get around, and they will pay BIG time. Bottom line, this witness did not touch Burns stuff EVER.

    This witness was one of the most hapless and pathetic characters I have ever seen.
    He can't even tell the truth when the evidence is put in front of him.
    He still continues to lie about his own past and in every answer he lies.
    The lawyer proved him a liar time after time.
    Nothing he said on the stand was truthful imo
    Hope he gets the maximum and throw away the key. He has had too many chances already and will never change.

    First
