  • QUICK INFO:
Possible sentence: LWOP (no DP in Iowa)
Jury breakdown: 7 women, five men. Alts: 2 women, 1 man
Charges: Murder in the 1st degree
    What is the Defense: Innocent
Iowa man Jerry Burns, 66, is on trial as the suspect in the 1979 stabbing murder of Michelle Martinko, an 18-year-old high school student. Jury selection began on Monday and continued into Tuesday.
Here’s what you need to know about the case.
Burns’s trial was moved from Linn County, Iowa to Scott County, Iowa given the high-profile nature of this case. Martinko’s brutal murder remained unsolved for decades. But then, on Oct. 29, 2018, police carried out an operation similar the one that California authorities used to track down the Golden State Killer suspect.
Burns left a straw on table at a Pizza Ranch establishment and authorities seized this discarded DNA evidence covertly. They compared it to a blood sample recovered at the crime scene that had been uploaded to a genealogy database and partially profiled.
Authorities determined that the discarded DNA evidence was a match to the blood found on Martinko’s dress. The judge has allowed the straw to be used as evidence at trial.
Martinko was “repeatedly” stabbed in the face and chest in her family’s car outside of the Westdale Mall on December 19, 1979. Evidence showed that she fought back. Martinko went to the mall that day to buy a winter coat, but never returned home. There was no evidence of a robbery or sexual assault.
Burns was arrested on December 19, 2018-39 years later.
The defendant has pleaded not guilty to first-degree murder. Investigators say Burns “claimed he did not have any recollection of committing this crime,” but could not explain why his DNA showed up at the crime scene.

From how everyone describes her and her pictures, it seems she was beautiful not just on the outside but on the inside too. My heart and prayers go out to her family and friends. Rest in peace precious Michelle Martinko. This monster will be brought to justice and I am so glad there are still police and witnesses still alive to testify.

@@a.b.d.3974 Oh yeah, it was a thrill kill, wonder if he's done more? I hope that more detectives had the foresight to gather evidence that can be tested with technology of today's standards, might clear up some more cases.

Kimberly Hood I agree that this was senseless and devastating. Michelle seemed very special. Let’s see what the defense lawyers have to say.

@@davidgaugamela9801 If he would've admitted to being in that car maybe as a mechanic fixing it that could've explained the blood or his DNA but once he denied all knowledge of her or her car there's only one way it got there. It was a frenzied attack most likely she rebuffed him and he lost it on her, stabbing her face is pure hatred. I don't believe for one second that this was his one and only attack/kill, he's got baggage, he's done more.

The defendants team must know in their heart of hearts the monster sat next to them is as guilty as SIN and yet they can simply put it in the back of their minds and treat him lovingly, yes lovingly. What’s intriguing is would they behave like that if the victim was one of their own. Where do they hide their shame.

Maybe you are referring to the defendant. He's not a younger man, though, so I'm not sure we're talking about the same guy.

MrGrumpyGills thanks for answering. Maybe he is the defendants son as two others suggest. He's sitting a few rows behind him and looks as if he might be. i noticed later, the camera zooming in on others in the audience, further confusing the issue.

Wow, the victim sure did have a lot of boyfriends for an 18 yr old. Curious why this cold case is getting so much attention. It’s no different than the 100s of other cold out there right now. Maybe it’s because she drove a luxurious giant green Buick.

This cold case has absolutely haunted our community for four decades. The Westdale Mall just opened, like two months before this happened. There has never been a time when I've driven by that I don't think of Michelle. She is connected to it by all of us. Also, it was in a public place. She wasn't found in a ditch; it was in a public parking lot, which is more "dramatic" and scary. Also, it was absolutely brutal!!!! There were no known reasons why - just a high school girl going to the mall to buy a coat. Additionally, her family kept it in the news! That's huge. And of course, she is absolutely stunningly beautiful, which shouldn't matter, but in our society, it does. Michelle's family was not rich. That car was her parents'. Nearly ALL cars were huge back then; it has nothing to do with being "luxurious." And it was gold; not green. Now, I'm wondering why you're even watching it, cuz it's clear you're not even paying attention or care about it. Move on and quit berating the dead and those who do care.
