My ex and his lawyer tried that on the day of our divorce hearing. My attorney pointed out to the judge that we would be three weeks shy of ten years if it was decreed that day. He made special instructions in open court that our decree should not be booked and paged for another month to make sure I was able to access benefits. He was so disgusted by the end of the long drawn out process my ex and his lawyer created.

Great Video! I Just started getting divorce spousal benefits. I never knew this even exsisted till recently. I got divorced in 1987, I was married for 10 years 8 months and have 2 adult children, one who is disabled. They told me she is eligible for benefits. Right now they are in the process of working on her case.

There are alot of social security workers who dont know their jobs.
You are very right, with what you are saying I get a different story with every person I have spoken with.
That's why I advise people to go about a year before thinking of retiring & get an estimate of what you are going to get under your own & any spouse of 10+ years. You can also set up your paperwork about 3 months ahead of final date to get all your paperwork in order, to take effect on your desired month!!

SSI ends at age 65 yrs old and then they would change you over then to a percentage of his amount if you were married the 10 yrs and his payed more than your retirement security
Thanks. I just helped my ex-husband get spousal benefit. He was denied, I helped him with appeal, and it was approved. He got 'back pay" for r 6 months. The Portsmouth NH DS office was outstanding and very helpful.

After I sent everything in, the agent told me she had to talk to my ex-husband first before it was approved. I was married for 28 years and divorced for for six years when I filed at 63. Everything I’ve read said the ex didn’t even have to know you had applied. The agent said she was having trouble getting a hold of him so I had to call him and give him the number to call her.
I've never heard of that. They shouldn't do that. I would talk to a supervisor

I'm 60 years old. i was married for over 25 years. Seperated 2 1/2 years. Before the divorce, I had no income. No alimony. He agrred to court pay 2k a month. I quit my job in Az for his contract job to IA. 3 uears later he filed for divorce. I had to gett a job to support my self. I'm planning to filed S.S. benifits in 2 years.. when I turn 62. What is the deferents between ages 62 and 65 to collect the benifits.

If you take your or his it's quite a bit less itz around 38% of his full benefit amount I just checked this for myself.

My ex tried that in the divorce decree. In mediation I told the mediator, who was a retired judge , told me the same thing that you stated. It is Federal and divorce decrees cannot change that divorced spousal benefits.

They are not allowed to do the digging for the claimant. You need all the information up front.

What if the judge ruled that your divorce isn’t final for six months but he goes that day and gets married even though the judge explicitly says you can’t. Because for that six months you are still married. But signs it that day and it is 2 months and 3 days until your 10th wedding anniversary
SSA has to go by the marriage certificate and divorce decree...whatever it says.
Two days ago I called social security and waited over an hour. I was asking about divorced spouse benefits. I gave her the info including for ex spouse. She would not give me any idea on what the amount might be (married over 23 years), and told me to call back whenever the ex spouse files for benefits! I told her that I did not think that was accurate, and she simply copped an attitude and repeated herself. 😕
Yes, she was definitely 100% wrong. If there's any money left there, then you are entitled to it if your expouse is, at least 62 years old. Unfortunately, you're gonna have to call again. And specifically, say those words independently entitled divorced spouse.

As long as he's 65yrs old you can apply but you must make an appointment they won't give info like that on the phone you need to see claim worker
I missed out by a week for ten years. I told my lawyer and he ignored me. Social security won’t talk to me.

Get another lawyer. Second opinion or a second pair of eyes analyzing the situation, could make you eligible. I'm not married, but try again. Don't stop at the first No from SsA or your lawyer. Blessing to you.

I have recently filed for S.S. I turned 62 five months ago. I filed because of a chronic illness that prevents my working. (Yes, I have applied for disability as well).
Question; case worker asked me to send my marriage and divorce papers from my first husband. ( married almost 15 years).
Am I correct in understanding that because I remarried ( second husband passed away after almost 6 years of marriage. And because I remarried after his passing, that disqualifies me from receiving spousal benefits from my first husband?
Just wanting to have clarity in order to plan for living expenses (regardless of disability qualification).

If you are not now currently married or you remarried after the age of 60, you might be eligible for benefits on your first husband. That is probably why they asked for the documentation. To determine that eligibility.

I’m 62, my 1st ex is 65, we were married 23 yrs. He draws $2800 mo. I remarried and divorced before 60 , my 2nd husband has been disabled since he was 17 , so he never worked. How much would I draw off 1st husband if I were to start drawing now at age 62, and is that locked in or does it increase as I get older, also would I get survivor benefits when he passes?

I just barely had a representative tell me that my ex has to apply before I can get my ex-spousal benefits. What can I do? I was told just last year that social security requires me to apply for spousal benefits since I am on SSI. and 62 years old.
If they told you wrong like that, then ask to see a supervisor and tell them you want to file for Independently Entitled Divorced Spouse benefits and start them when you first asked last year. Take care, Ed

So the new spouse of an ex-spouse is eligible (at the appropriate age) for a surviving spouse benefit in fewer than 10 years if he/she dies? But the divorced spouse who didn't meet the full 10-year marriage requirement does not? The divorced spouse who had 8 or 9 years invested in the marriage when the other spouse moved on to greener pastures receives no SS benefit from that marriage? That's just sad.

Curious, if common law marriage with a divorce decree … proof of son born of the marriage … do the social security people debate this?
As there is no marriage license for the marriage. The state of the marriage is Iowa where common law is practiced and has not changed. Just divorce decree in same state. April 29, 1991 to March 2002 when the decree was concluded.
If it's for child benefits, then marriage doesn't matter.

What about a new wife? (2nd wife) if ex wife is entitled to get her ss benefit from her ex husband then what about his new wife?
I was told I made more than half of my ex spouse’s benefits which I don’t believe is true because I was the lowest wage earner in the household & also stayed at home to care for our two children. SSA told me that I can only get a percentage of his benefits (not the full amount he’s getting) when he dies.

My ex is a computer expert, very shrewd and bitter. He has been self employed since our divorce in 2004. Are all earnings reported to social security based on gross earnings or only net earning when self employed? On the SSA site, if he waits til 70 to claim his benefits (which he will) he will receive $1069/month. He regularly made more than $100k per year, while I made about 1/3 of that.
Is it possible to take the majority of your self employed income and write it off on deductions? Thereby reducing reported income to the government dramatically ?

The highest benefit is only a few grand amount so at 50% spousal if you waited till he is 65yrs old your looking at approx $1500 a month to live on with out any other income the amount drops with other income also.
Good content but slow speech. To speed up his voice change the listening speed or press your finger on the screen to speed the speech rate to twice as fast. It will help if you have attention problems or need to get to the meat of the information

If your ex-spouse hasn't filed for benefits yet, then you will have to wait for 2 years. If that person has filed for benefits, then you don't have to wait for 2 years.
I am currently married am fra and was on ssi disability from 2004 till 2016 when I remarried at age 59 and lost eligibility due to his income - I am currently collecting retirement social security of $220 a month-the Social Security office says I am not eligible for divorce spouse benefits from my previous spouse of 11 yrs back in the 80’s because I remarried under age 60- but my understanding is that if I was disabled and collecting disability at 59 I am eligible? I was on ssi not ssdi

SSI is not the same as SSA disability. No such thing as "SSI disability". You may have been 'disabled' and unable to work due to your health but not approved "SSA DISABLED"
I was married for 11 1/2 years. I am 4 years older than my ex-husband. I'm going to retire from my high school secretary position at 62 because I will hit my rule of 85 and qualify for a full pension. I'll still need additional money to live, but my pension is a good chunk of change. I am not opposed to finding a part-time job, but I'm really hoping to travel in those early years of retirement.That's the backstory and here is the question: CAN I COLLECT on my ex-husband's benefit (half of it) starting when I retire, and then switch to my full benefit at 67 (my full benefit age) without penalty on my full benefit? Or am I forever discounted if I start taking half of his when I turn 62? (All of my full benefit is greater than half of his full benefit.). Also....he will not be retired when I hit 62, so does that throw a wrench into anything? Thank you
You have to file for benefits on your own record first and then file another claim for spouse benefits...that is, if he is still alive...

I understand that if I get divorced. My wife whom doesn't qualify for her own benefits can collect under mine. My question is. Can my benefits be garnished on top of that for alimony.
It really depends on the court. That's not really a Social Security thing. Social Security just follows whatever the court tells them to do.

Nothing can be done about a child that is now and adult but father passed away while she was young and mother never filed for child support (back benefits) ??

I was on SSI then I went in for review and the only one, when I was done and I turned in my paperwork the man at the window said I was looking at some quite a bit of money and I didn't know what to say but he went on to say your due survivors, Widow benefits but I won't get that amount of back pay we will have to Penalize you, l was 54 at that time he said l should have applied at 50 ,l was never told this, can I get the Back pay and when should I get on my own record?
Its not that much and you lose the disability benefits also that's subtracted . You don't get that much on surviver benefits and all only go back 2 yrs but you can apply later

You can't double dip, 50% of her OR your own work record which ever amount is higher.
Curious, when I asked about these benefits years ago I was told his Fill Benefit had to be Double++ my Full Benefit....is that true? Seems since he worked mych longer than I did, at jobs that Paid Alot more than any job I ever had, his benefits should be at least Double mine!!!
That's correct. Her benefit has to be twice yours based on her high 35 years of work.

Can a person apply for divorce spousal benefits who files 4 or 3 months before reaching exactly at 62 but lost the information on marriage and divorce dates? What will SSA say or ask? P.S divorce spouse is married to someone already and still working
3 months before is fine. But you will have to provide your marriage and divorce proof. SSA employees can help you with that.

Can I get ssd on my divorce wife if I get a pension

Thank you for this informative video. I filed for SS benefits several years ago and asked what my benefits would be on my ex-husband's record. It was a few hundred dollars more than mine. I understood he had to have paased away before I would be entitled to file on his record. I asked if they would notify me of his passing and they said I would have to check periodically as they would only pay 6 months back. I hated calling but did not want to miss out on money I was entitled to. I asked every time I called if they could notify me - the answer was always no.
Why would anyone think I would choose a lower benefit? Perhaps I enquired before signing up and got a different representative.
Does SS keep records of my phone enquiries to help me prove my case? Any help you can give before I call SS would be appreciated.
Sorry about that. When you call you can say you want to file for survivor benefits, and if there is more money there, they will schedule an appointment. If not, then they will (should) tell you. If you missed out on some months of benefits, tell them that and request a Reconsideration (SSA561). Good luck, Ed
I was married 25 years. My ex told me I would be able to collect on his and he had no problem with that. It wouldn’t effect any his current would get. I told him I already knew that. I waited until I was 65 and could collect half of his and also work as much as I wanted. He passed away last year and before I could even call them SS sent me a letter letting me know they were sorry for my loss and that I would now get all of his SS which was double what I was getting. His current wife couldn’t collect until she was old enough. She was younger than him. And I had not remarried. If I had I couldn’t get any of his. Hope this helps someone! 😊 11:44

Im currently 62 and 3 months and started drawing SS. I was divorced 20yrs ago. Remarried. I was married 20yrs to my first spouse. I dont know if he is retired. So how can i find out?
If you're currently single, it doesn't matter whether your exspouse retired or not. If your exspouse is at least 62 years old, you can file for benefits.
