I'm not sure when the show was recorded, but Spyre's legal team has also now released a statement basically saying the NIL agreement with Nico was within the existing NCAA NIL rules at the time. The legal teams on retainer by UT and Spyre seem like they are pawing the ground just waiting for the right people to say "Go!"
I disagree with the statement they are talentless but accept they are failing as an institution overall right now. This is their version of trying to get ahead of the NIL world by coming down on schools (because they still can) and having given up on the athletes (because they keep losing in court). But the structure has completely changed and the NCAA isn’t the one to regulate anymore.
I work at UTK and went there for undergrad and grad. This just shows why athletes, ADs, presidents, and chancellors need to be in the room where decisions are being made. Right now it’s the Wild West and whether it’s a transfer portal change, NIL rules/salaries, or just forming an independent league outside of NCAA to decide conferences/playoffs/bowls, we need some changes. What's to keep a conference from enforcing rules separately depending on the team. Especially if the team is the darling of that conference such as an Alabama or a uga. Lots of money involved for the whole conference winning championships. Do we really want college football to devolve to "we investigated ourselves and found no wrongdoing"
SEC probably should add like 8 or 10 teams and just drop the NCAA all together. Pay the players out of the profits a fair wage don't be greedy. If you're making tons of money don't expect people to work for free. No a scholarship is not equal to the money they make from the players

"uh.... we are leaving the NCAA" - it would take about 10 seconds for the Big10 to make a similar announcement right afterwards...... and by the end of the day, the rest of the conferences would exit the NCAA cannot override the various state legislatures..... no one in the Tennessee legislature attended the NCAA - but they did attend Tennessee, Vandy, Memphis, Bama, Auburn, Georgia, et al...... same goes for the folks elected to the Georgia legislature, the Florida Legislature, the Alabama legislature, the Michigan legislature, etc - the state legislators have no loyalty to the NCAA nor should they - too many kids have been cheated out of being able to earn a living while in school due to rules established by the NCAA that violated the rights of the student athletes...... when is the NCAA gonna compensate the student athletes from the 90s, the 80s and the 70s for their lost earnings due to NCAA rules that violated the US Constitution? perhaps, the Tennessee legislature needs to pass a law that provides an open window in the statute of limitations to allow former student athletes to sue the NCAA for depriving them of income...... and how long would it be before the Georgia legislature does the same...... it won't be long before the NCAA is literally sued into bankruptcy and into financial oblivion there is an old saying amongst those of us who practice law (I did so for 15+ years).... if you owe the bank a little, you are at the banks mercy.... but if you owe the bank a lot, the bank is at your mercy the NCAA is actually at the mercy of the state legislatures - and it is time for them to end their unconscionable "enforcement" actions based on ever changing rules that don't actually comply with the Constitution or the Supreme Court's recent decisions if one considers the constitutional freedom to contract, the NCAA cannot sustain the restrictions that they seem to want to impose that limit the ability of student athletes to negotiate for compensation in whatever form it might take, whether it is in the form of endorsements, scholarships, private jets, new house for mom, or bowls of M&Ms with no orange ones in the bowl - for those who truly dislike Tennessee - or no red ones in the bowl if they really hate Bama...... so long as the compensation is disclosed, open, and legal (ie no hookers and cocaine), the NCAA should not be able to say no I would invite folks to go read the actual arguments that the NCAA submitted to the Supreme Court in the Alston case..... point after point after point that they made were outright rejected by SCOTUS. "The NCAA's remaining attacks on the district court's decision lack merit." For example, "the NCAA contends the district court should have deferred to its conception of amateurism instead of 'impermissibly redefin[ing]' its 'product.' But a party cannot declare a restraint 'immune from §1 scrutiny' by relabeling it a product feature." Alston, citing American Needle, Inc. v National Football League, 560 U.S. 183, 199 n7. "Moreover, the district court found the NCAA had not even maintained a consistent definition of amateurism." The Supreme Court advised the NCAA in its Alston decision that "[t]o the extent the NCAA believes meaningful ambiguity exists about the scope of its authority, it may seek clarification from the district court." Have they sought such clarification from the district courts? NOPE! They continue to make it up as they go along, following the exact same trains of thought that the Supreme Court rejected in Alston. if they are so concerned about compensation of players, then simply impose a compensation cap, to be decided by the conferences, similar to the NFL's salary cap - THAT is the only solution that I have heard of that would comport with prior SCOTUS decisions and actually address the NCAA's concerns while not running afoul of the Sherman Anti-trust Act.... there might be other solutions, but this current approach does not comply with the Alston decision AT ALL There are a lot of old, retired lawyers who are alumni of the various schools (Bama, Tennessee, UCLA, UGA, Vandy, Duke, etc) who have nothing better to do on Saturdays than watch their teams play. But, if the NCAA wants to pick a fight, then GOD HELP THEM! There are two things you never EVAR do. You do not start a land war in Asia and you do not start a word war with lawyers, especially when they have nothing better to do...... This is one retired lawyer who practiced for 15+ years in Minnesota who would be happy as a pig in mud to reinstate his law license and make a practice out of litigating the NCAA into oblivion and right out of existence. At the very least, I think I might call my legislators and suggest that they open up the statute of limitations and pass a law that gives former student athletes the ability to get compensation for the NCAA's prior illegal anti-trust conduct that deprived student athletes the ability to earn a living and gain an education without having to incur the expenses of student loans. How many student athletes had to take out student loans before the Alston decision? And, how many are still having to pay those loans back? And, how many wouldn't have had to incur that debt if the NCAA had not engaged in illegal conduct? If the answer is anything other than "zero" then I daresay that the proposed legislation might damn well be overdue - followed closely by the litigation seeking compensation for the NCAA's illegal conduct. The NCAA needs to understand that they no longer sit upon an unassailable throne. UT Alum, the NCAA is living in the early 1900’s. The courts have already ruled that college athletes have a right to make money. It’s capitalism. Nico is California State resident and his NIL contract complied with California State law. NCAA will continue to lose in the courts until they are completely powerless. State laws and an individual’s right to make money will always override the NCAA.

This feels like a power struggle between the NCAA and the super conferences of the SEC and Big 10. I think the NCAA picked Tennessee because they thought the school was the least difficult target with the most notoriety.
Once again, Josh, you proved why you're the best. You looked at the issue on both sides and gave an honest opinion. Many other schools will join the lawsuit once it comes out who else is being investigated. This will finally be the end of NCAA and college football. TN did absolutely nothing wrong and shouldn't be punished for following the laws in place at the time.
Josh I hate Tennessee with a passion but that being said I really hate the NCAA alot more than them . I hate Tennessee just as a fan of Alabama. I have friends that are Tennessee fans But I think the NCAA needs to be disbanded Division 1 football power 5 conferences need to have a self covering body controlled by conference Commissioners and Athletic Directors of each institution and elect a commission chairman. NCAA is in violation of many federal laws and have been for a long time should have been charged already also they are in violation of many state laws and the minimum wage. If you're using someone to make a profit then they're an employee. Also these employees should be getting workman's comp. If the NCAA and college football does not want to pay the players then lower the ticket prices and lower the TV contracts that way profits are not made and more fans can enjoy it. They're not going to because they're greedy and they want all the money and they're even willing to violate federal and state law to do so.
NCAA is trying to show one last push of power and TN was the best target. New expensive QB who’s looking good, already on probation, and a big name in college sports. They leaked this to big reporters and are trying to make it seem as if Tennessee is a terrible organization proving the NCAA is policing NIL. Plowman blew all of this out of the water and won’t put up with it. I think this will drag out and end up in the courts, will probably lead to the end of the NCAA having any teeth. Obviously waiting for more info on this but it looks like everything Tennessee did was within the rules at the time.
We just had a University of Alabama golfer win a PGA event and could not take the money! Unfair? They have to get this reeled in. Conferences will have to agree on the set of rules they enforce. NIL and transferring needs to be the first thing addressed. They need to put the student back in front of the athlete. They need contracts and actually use NIL properly.. These schools allow these players to represent their brand and. Put their talents on display.. but some players are losing sight of the opportunity the Universities present. Without school athletics what are they doing? More than 90% would never go into higher education.
The NCAA has been a failed administrative body for decades. They’ve really lost their credibility since how they handled the Penn St. case. Yes, that case. They care more about anything that deals with $ than the safety of minors in which Penn St basically walked away with a slap on the wrist in which the only case that should institute the DEATH PENALTY. They’ll always care more about money and overlook blatant human rights violations against minors. Plus the the NCAA never wanted to see Tennessee to have any success as an resurgent program, Michigan was targeted and they won the natty. As a Tennessee fan, to me the NCAA (Not Caring About Athletes) wants to come down on Tennessee on NIL investigation but at the same time you have big time schools having NIL deals too. I am for college athletes getting paid but the NCAA needs a Commissioner to be the leading voice to make it fair when it comes down to rules and regulations to make it fair for every school. They want to pick on schools for PR purposes but to me the NCAA will have new leadership in the future. The NCAA can't stand the fact the athletes are getting paid. Not sure what you’re insinuating but it happens to Alabama as well. We got absolutely hammered by the NCAA in the early 2000s and lost postseason play and multiple scholarships for years over it. I think that we were the last ones that were in a major investigation so it’s still fresh in their minds and I think the NCAA is at a do or die stance either they get this nil in control, or the ncaa is no longer needed. I’m not sure about the other teams, but the NCAA punishment against Alabama in the early 2000s sure made a difference ! Post season ban for a few years along with losing a bunch of scholarships. I don’t know what it is about ESPN, Sports illustrated and the NCAA…there seems to be some kind of hate toward that program, and I don’t know why. I never seen a team get hit with so many inopportune penalties this last year, and yet play opponents who did not get one live ball foul the whole game😮. So your answer to the chaos of college football as it is currently constructed is to eliminate the few remaining rules? That should help. Seriously I'm an Ohio State fan and as I see this incredible offseason unfold I am constantly worried that they'll break some rules either knowingly or otherwise. I think the answer isn't allowing each conference to serve it's own self interest, that would be a disaster, the answer is to have stricter, more clear rules and regulations on this transfer portal and NIL nonsense. Rules and regulations enforced by a central body not individual conferences/teams be that the NCAA or some new system.
Schools need to be involved in the NIL deals. Yes, they will use it to recruit, but they will also protect athletes from bad or exploitative NIL deals. To me, the positives outweigh the negatives. Pandoras box has been opened so let the schools handle their own NIL.

NIL policy may not have been fully baked, but NCAA members knew they couldn’t be involved in arranging deals for prospects. That was a very clear distinction. The colleges need to come together and file a multibillion dollar lawsuit against the NCAA and force an investigation of their practices of how just out of the blue they decide to investigate someone who has just try to come out of one investigation and try to get on with life, but then they throw this their way with another accusation from a rule change in the middle of a rule change from the same people that apparently doesn't like UT for some reason...
Simply bc the NCAA are clearly in the wrong here. Tennessee followed the rules that were in place at the time, then many months later, the NCAA changes the rules, but then decide they want to retroactively go after Tennessee for breaking a rule that wasn't in place yet. *The other point is that the rule in question is unfollow-able to begin with, bc it says you can't use NIL to persuade a recruit to a program. Well is inherently impossible to make any NIL deal and it not persuade a recruit, bc it's literally money for playing at said school. It's ridiculous, and flawed!* The NCAA has no ground to stand on, they've basically walked the plank, are standing at the edge, and getting ready to jump in the ocean!

It is against the rules to use NIL as an inducement to attend your institution. This has been clear and unchanging from the beginning. You may pay him once he arrives. I’m not sure that a “ reasonable person”, which is often the standard used in court, would conclude that flying a family out on the private jet for an unofficial visit (another violation btw) to meet with the collective, being presented with an offer, and then being flown back on the private jet, is not an inducement to attend. It is at least enough to warrant an investigation. Once all the facts are in, then a decision can be made as to whether an infraction occurred. People assume investigation means punishment. It doesn’t.
I think that the heart of the problem is trying to reconcile amateur sports played by student athletes, who are students first, and the huge business that some programs have become, with athletes who are only marginally students.
The NCAA abandoned their duty to regulate post-Alston and spent over a year trying to get the US Congress to intervene and do their jobs for them. Now that it's clear that a legislative solution won't happen they're looking to re-establish their ability to regulate which I don't actually have a problem with. NIL does need to be fixed and is untenable as it is. However, you can't suddenly try to regulate a period you left wide open with rules and guidance you came up with much, much, later when it was clear that the plan to get congress to do it for you wasn't going to work. What the NCAA is trying to do would be like the state locking you up for breaking a law that didn't exist. It would be like making root beer illegal tomorrow and the state trying to use that new anti-root beer law to prosecute everyone who ever sold root beer while it was legal. Just nonsensical.
The NCAA have no one to blame, about the state of CFB and the NIL, but themselves. For at least the last 40 yrs, they have kicked the can down the road, about their colleges & univs making millions of $ off the players' name-image-likeness, yet still claiming the players or "student-athelete" are amateurs. Then, when someone sued them and won, they pouted and threw their hands up. Then, because of the Supreme Court ruling, each State Legislature has drafted their own set of rules & guidelines, which may differ completely from other State's, even within their own conference. Now the NCAA realizes that they are pretty much becoming obsolete and are trying to reign in some power and prove fhey still have teeth. For better or for worse, the game of CFB has changed forever and it's not going back to what we, as fans, grew up watching and loving. That being said, to me I can see, within the next 5-10 years, the SEC, BIG10, Big12 & ACC (if it survives it's inner turmoil), will split away from the current NCAA and create a new collegiate professional league, equipped with their own new set of rules & guidelines. Of course they will need a CEO or commissioner, voted on and appointed by the participating univ. Presidents and AD's, to be the face and maybe that's when Saban comes back for a few years, to help that transition.

The NCAA lost be back in 1995. Because one player signed his name on a napkin, Alabama got: probation, scholarship limitations, a postseason ban (1995), forfeit of wins in 1993 and, most harmful, scholarship reductions which led to the decline of Football from Stallings to Saban. The NCAA lost me in 2005 when a booster Young, paid Means. The highschool coach testified 3 other schools beyond Alabama offered Cash, coaching positions and tuition for his wife, yet none of those schools were punished. When the NCAA used a "Secret Witness" which happened to be none other than rival TN coach The Great Pumpkin, otherwise known as Phat Phil Fulmer and a spurned media personality along with Tennessee alum and SEC Commissioner Roy Kramer in a conspiracy to bring Alabama down. Phat Phil had been quoted to say long before the investigation that Tennessee wouldn't have to worry about Alabama for much longer. The huge over penalty of 1995 and the backdoor dealings and agendas of the 2005 case... the NCAA back then was a cesspool. It probably hasn't changed.
We knew this was coming once NIL was introduced we knew schools would try to find loop holes everyone was mad at certain schools for not paying recruits but now you see why they waited. NIL WAS NEVER MENT TO PAY RECRUITS TO COME TO YOUR SCHOOL.
So universities are not allowed to be directly involved with NIL and collectives. That much is clear. However, if you take Missouri (the state, not the university itself) as an example, they have legislation on the books regarding NIL. If a Missouri HS kid commits to an in-state university, he can being collecting NIL income upon signing the letter of intent. An advantage to Missouri universities not afforded to out of state universities. An advantage to Missouri HS student-athletes not afforded to out of state student-athletes. The University of Missouri cannot be directly involved in NIL, but the state can? Is the University of Missouri NOT a STATE institution? Where's the NCAA on that? Well, we tried to get federal legislation, but we're stuck with each state doing their own thing. Why? Because the NCAA has no authority (as determined by the Supreme Court of the United States) over NIL. This whole case is a joke. Tennessee is just the beginning. When the SEC and B1G flex on the NCAA (and they will when the NCAA says, "It's Bama, Georgia, Ohio State and Michigan too" because "we're the problem" isn't happening on its own), they will disappear into the hole they crawled out of.

It's funny how tennessee has the biggest and most established NIL collective and they decide to go after them....I'm sure there is no bias or alternative motivation here. They just want people to follow rules that change weekly.
My last straw was the whole Memphis/Derrick Rose thing which happened right before UConn got busted paying its players 50,000 a year. Memphis lost an entire season for something it didn't do nor could have known and prevented. UConn's coach had to sit out 6 in conference games. Bullsh$t!!!

the NCAA is actually at the mercy of the state legislatures - and it is time for them to end their unconscionable "enforcement" actions based on ever changing rules that don't actually comply with the Constitution or the Supreme Court's recent decisions
if one considers the constitutional freedom to contract, the NCAA cannot sustain the restrictions that they seem to want to impose that limit the ability of student athletes to negotiate for compensation in whatever form it might take, whether it is in the form of endorsements, scholarships, private jets, new house for mom, or bowls of M&Ms with no orange ones in the bowl - for those who truly dislike Tennessee - or no red ones in the bowl if they really hate Bama...... so long as the compensation is disclosed, open, and legal (ie no hookers and cocaine), the NCAA should not be able to say no
I would invite folks to go read the actual arguments that the NCAA submitted to the Supreme Court in the Alston case..... point after point after point that they made were outright rejected by SCOTUS. "The NCAA's remaining attacks on the district court's decision lack merit." For example, "the NCAA contends the district court should have deferred to its conception of amateurism instead of 'impermissibly redefin[ing]' its 'product.' But a party cannot declare a restraint 'immune from §1 scrutiny' by relabeling it a product feature." Alston, citing American Needle, Inc. v National Football League, 560 U.S. 183, 199 n7. "Moreover, the district court found the NCAA had not even maintained a consistent definition of amateurism."
The Supreme Court advised the NCAA in its Alston decision that "[t]o the extent the NCAA believes meaningful ambiguity exists about the scope of its authority, it may seek clarification from the district court."
Have they sought such clarification from the district courts? NOPE! They continue to make it up as they go along, following the exact same trains of thought that the Supreme Court rejected in Alston.
if they are so concerned about compensation of players, then simply impose a compensation cap, to be decided by the conferences, similar to the NFL's salary cap - THAT is the only solution that I have heard of that would comport with prior SCOTUS decisions and actually address the NCAA's concerns while not running afoul of the Sherman Anti-trust Act.... there might be other solutions, but this current approach does not comply with the Alston decision AT ALL
There are a lot of old, retired lawyers who are alumni of the various schools (Bama, Tennessee, UCLA, UGA, Vandy, Duke, etc) who have nothing better to do on Saturdays than watch their teams play. But, if the NCAA wants to pick a fight, then GOD HELP THEM!

This is one retired lawyer who practiced for 15+ years in Minnesota who would be happy as a pig in mud to reinstate his law license and make a practice out of litigating the NCAA into oblivion and right out of existence. At the very least, I think I might call my legislators and suggest that they open up the statute of limitations and pass a law that gives former student athletes the ability to get compensation for the NCAA's prior illegal anti-trust conduct that deprived student athletes the ability to earn a living and gain an education without having to incur the expenses of student loans.
How many student athletes had to take out student loans before the Alston decision? And, how many are still having to pay those loans back? And, how many wouldn't have had to incur that debt if the NCAA had not engaged in illegal conduct? If the answer is anything other than "zero" then I daresay that the proposed legislation might damn well be overdue - followed closely by the litigation seeking compensation for the NCAA's illegal conduct.
The NCAA needs to understand that they no longer sit upon an unassailable throne. At best, they have a dented, frayed, vinyl folding lawn chair bought for $3 from a Hogs fan at a flea market somewhere in rural Arkansas.

UT Alum, the NCAA is living in the early 1900’s. The courts have already ruled that college athletes have a right to make money. It’s capitalism. Nico is California State resident and his NIL contract complied with California State law. NCAA will continue to lose in the courts until they are completely powerless. State laws and an individual’s right to make money will always override the NCAA.

This feels like a power struggle between the NCAA and the super conferences of the SEC and Big 10. I think the NCAA picked Tennessee because they thought the school was the least difficult target with the most notoriety.
Once again, Josh, you proved why you're the best. You looked at the issue on both sides and gave an honest opinion. Many other schools will join the lawsuit once it comes out who else is being investigated. This will finally be the end of NCAA and college football. TN did absolutely nothing wrong and shouldn't be punished for following the laws in place at the time.
Josh I hate Tennessee with a passion but that being said I really hate the NCAA alot more than them . I hate Tennessee just as a fan of Alabama. I have friends that are Tennessee fans But I think the NCAA needs to be disbanded Division 1 football power 5 conferences need to have a self covering body controlled by conference Commissioners and Athletic Directors of each institution and elect a commission chairman. May not be the answer to all problems but a heck better than now.

NCAA is in violation of many federal laws and have been for a long time should have been charged already also they are in violation of many state laws and the minimum wage. If you're using someone to make a profit then they're an employee. Also these employees should be getting workman's comp. If the NCAA and college football does not want to pay the players then lower the ticket prices and lower the TV contracts that way profits are not made and more fans can enjoy it. They're not going to because they're greedy and they want all the money and they're even willing to violate federal and state law to do so.

NCAA is trying to show one last push of power and TN was the best target. New expensive QB who’s looking good, already on probation, and a big name in college sports. They leaked this to big reporters and are trying to make it seem as if Tennessee is a terrible organization proving the NCAA is policing NIL. Plowman blew all of this out of the water and won’t put up with it. I think this will drag out and end up in the courts, will probably lead to the end of the NCAA having any teeth. Obviously waiting for more info on this but it looks like everything Tennessee did was within the rules at the time.

Conferences will have to agree on the set of rules they enforce. NIL and transferring needs to be the first thing addressed. They need to put the student back in front of the athlete. They need contracts and actually use NIL properly.. These schools allow these players to represent their brand and. Put their talents on display.. but some players are losing sight of the opportunity the Universities present. Without school athletics what are they doing? More than 90% would never go into higher education.
The NCAA has been a failed administrative body for decades. They’ve really lost their credibility since how they handled the Penn St. case. Yes, that case. They care more about anything that deals with $ than the safety of minors in which Penn St basically walked away with a slap on the wrist in which the only case that should institute the DEATH PENALTY. As a Tennessee fan, to me the NCAA (Not Caring About Athletes) wants to come down on Tennessee on NIL investigation but at the same time you have big time schools having NIL deals too. I am for college athletes getting paid but the NCAA needs a Commissioner to be the leading voice to make it fair when it comes down to rules and regulations to make it fair for every school. They want to pick on schools for PR purposes but to me the NCAA will have new leadership in the future. The NCAA can't stand the fact the athletes are getting paid. I don’t know what it is about ESPN, Sports illustrated and the NCAA…there seems to be some kind of hate toward that program, and I don’t know why. I never seen a team get hit with so many inopportune penalties this last year, and yet play opponents who did not get one live ball foul the whole game😮. I think the answer isn't allowing each conference to serve it's own self interest, that would be a disaster, the answer is to have stricter, more clear rules and regulations on this transfer portal and NIL nonsense. Schools need to be involved in the NIL deals. Yes, they will use it to recruit, but they will also protect athletes from bad or exploitative NIL deals. To me, the positives outweigh the negatives. Pandoras box has been opened so let the schools handle their own NIL.

The colleges need to come together and file a multibillion dollar lawsuit against the NCAA and force an investigation of their practices of how just out of the blue they decide to investigate someone who has just try to come out of one investigation and try to get on with life, but then they throw this their way with another accusation from a rule change in the middle of a rule change from the same people that apparently doesn't like UT for some reason...

Well is inherently impossible to make any NIL deal and it not persuade a recruit, bc it's literally money for playing at said school. It is against the rules to use NIL as an inducement to attend your institution. This has been clear and unchanging from the beginning. You may pay him once he arrives. I’m no fan of the NCAA but when the facts are out, the case against UT will be undeniable. The problem is arbitrary enforcement makes institutions believe they can ignore the rules. Josh, your argument is flawed and specious.

I’m not sure that a “ reasonable person”, which is often the standard used in court, would conclude that flying a family out on the private jet for an unofficial visit (another violation btw) to meet with the collective, being presented with an offer, and then being flown back on the private jet, is not an inducement to attend. It is at least enough to warrant an investigation. Once all the facts are in, then a decision can be made as to whether an infraction occurred. People assume investigation means punishment. It doesn’t.
I think that the heart of the problem is trying to reconcile amateur sports played by student athletes, who are students first, and the huge business that some programs have become, with athletes who are only marginally students.
How can you break nil rules when there aren't any rules. There should be guidelines but there isn't.

The NCAA abandoned their duty to regulate post-Alston and spent over a year trying to get the US Congress to intervene and do their jobs for them. Now that it's clear that a legislative solution won't happen they're looking to re-establish their ability to regulate which I don't actually have a problem with. NIL does need to be fixed and is untenable as it is. However, you can't suddenly try to regulate a period you left wide open with rules and guidance you came up with much, much, later when it was clear that the plan to get congress to do it for you wasn't going to work. What the NCAA is trying to do would be like the state locking you up for breaking a law that didn't exist. It would be like making root beer illegal tomorrow and the state trying to use that new anti-root beer law to prosecute everyone who ever sold root beer while it was legal. Just nonsensical.
The NCAA have no one to blame, about the state of CFB and the NIL, but themselves. For at least the last 40 yrs, they have kicked the can down the road, about their colleges & univs making millions of $ off the players' name-image-likeness, yet still claiming the players or "student-athelete" are amateurs. Then, when someone sued them and won, they pouted and threw their hands up. Then, because of the Supreme Court ruling, each State Legislature has drafted their own set of rules & guidelines, which may differ completely from other State's, even within their own conference. Now the NCAA realizes that they are pretty much becoming obsolete and are trying to reign in some power and prove fhey still have teeth. For better or for worse, the game of CFB has changed forever and it's not going back to what we, as fans, grew up watching and loving.
That being said, to me I can see, within the next 5-10 years, the SEC, BIG10, Big12 & ACC (if it survives it's inner turmoil), will split away from the current NCAA and create a new collegiate professional league, equipped with their own new set of rules & guidelines. Of course they will need a CEO or commissioner, voted on and appointed by the participating univ. Presidents and AD's, to be the face and maybe that's when Saban comes back for a few years, to help that transition.

The NCAA lost be back in 1995. Because one player signed his name on a napkin, Alabama got: probation, scholarship limitations, a postseason ban (1995), forfeit of wins in 1993 and, most harmful, scholarship reductions which led to the decline of Football from Stallings to Saban.
The NCAA lost me in 2005 when a booster Young, paid Means. The highschool coach testified 3 other schools beyond Alabama offered Cash, coaching positions and tuition for his wife, yet none of those schools were punished. When the NCAA used a "Secret Witness" which happened to be none other than rival TN coach The Great Pumpkin, otherwise known as Phat Phil Fulmer and a spurned media personality along with Tennessee alum and SEC Commissioner Roy Kramer in a conspiracy to bring Alabama down. Phat Phil had been quoted to say long before the investigation that Tennessee wouldn't have to worry about Alabama for much longer.
The huge over penalty of 1995 and the backdoor dealings and agendas of the 2005 case... the NCAA back then was a cesspool. It probably hasn't changed.

We knew this was coming once NIL was introduced we knew schools would try to find loop holes everyone was mad at certain schools for not paying recruits but now you see why they waited. NIL WAS NEVER MENT TO PAY RECRUITS TO COME TO YOUR SCHOOL.
College football has gotten so ridiculous. I knew the NIL would be an absolute disaster for the sport, because the NCAA would botch it.
So universities are not allowed to be directly involved with NIL and collectives. That much is clear.
However, if you take Missouri (the state, not the university itself) as an example, they have legislation on the books regarding NIL. If a Missouri HS kid commits to an in-state university, he can being collecting NIL income upon signing the letter of intent. An advantage to Missouri universities not afforded to out of state universities. An advantage to Missouri HS student-athletes not afforded to out of state student-athletes.
The University of Missouri cannot be directly involved in NIL, but the state can? Is the University of Missouri NOT a STATE institution?
Where's the NCAA on that? Well, we tried to get federal legislation, but we're stuck with each state doing their own thing.
Why? Because the NCAA has no authority (as determined by the Supreme Court of the United States) over NIL.
This whole case is a joke. Tennessee is just the beginning. When the SEC and B1G flex on the NCAA (and they will when the NCAA says, "It's Bama, Georgia, Ohio State and Michigan too" because "we're the problem" isn't happening on its own), they will disappear into the hole they crawled out of.
Nbaa wrote its rulebook as ambigous as possable as they could. And their "enforcement" of "the rules" is purely selective.

Don’t disagree about the view of the NCAA. However, my understanding is that the NIL deal with Nico was signed while he was still in bc high school. Not allowed by the rules. That one isn’t nebulous.
California state law (at least when Nico was in High school but I honestly don’t see why it would have changed sincn then) allows NIL contracts to be signed by High school students.

It's funny how tennessee has the biggest and most established NIL collective and they decide to go after them....I'm sure there is no bias or alternative motivation here. They just want people to follow rules that change weekly.

My last straw was the whole Memphis/Derrick Rose thing which happened right before UConn got busted paying its players 50,000 a year.
Memphis lost an entire season for something it didn't do nor could have known and prevented. UConn's coach had to sit out 6 in conference games. Bullsh$t!!!
The NCAA resembles someone who can sense their power is fading so they go ballistic trying to prove to themselves they still have some...its just now they are exposed and more susceptible
