The point is to remain silent until you can get a lawyer. If the law is in the wrong you can then settle in court.

That's how it works in real life. You have to announce you're using your right if you don't want to be treated like sewage. Even when you do announce it, you're immediately assumed guilty, and treated thus.

Innocent until proven guilty is about court, not about encounters with law enforcement.
Now, it's not going to get them a warrant to search or something like that.
But it doesn't preclude them from arresting him and holding him for some time. However, they must have probable cause to arrest if there is no arrest warrant.

Cuffs would 100% fit that guy. I've never had an issue putting cuffs on someone's wrists. The only issue is when arrestees are super fat and you need two pairs so they can can connect behind the back. Additionally, plain old zip ties would NEVER be used. Flex cuffs would be used and no one besides pregnant women or disabled people are ever handcuffed in the front.
If you zip tie his fingers together, he can’t break them without breaking his fingers. Never zip tie the wrists, at least in the front 😅
