Hi Aslam, thanks for the informative video. I have filed for constructive dismissal with the CCMA due to double standards on my ex-company applying "management discretion" to determine who gets Voluntary Separation Package (VSP) between myself and my other two colleagues who are equally skilled. The two colleagues were granted VSP and mine was declined. I asked the management to articulate on the criteria applied but their reply was only it was "management discretion", which I found to be a very dismissive answer. Is it permissible for me to ask for minutes of the management meeting where it was decided who gets the VSP and who doesn't? If so, do I just send an email to HR to request for the minutes, or is the process more complex than that?
Yes they are allowed provided that consent is given from the person taking the test. A polygraph test can be used as a mitigating factor when proving your case (it is not the deciding factor, there should be other evidence in addition to the polygraph)
Hi sir,can an employee be fired when already having a final written warning for Non compliance with rules & procedures and the have a hearing to attend for the same charge but with no loss from the bank.
